in effect306.113. Operate defined — probable cause required. — 1. For purposes of sections 306.111 to 306.119 * , the term "operate" means to physically control the movement of a vessel in motion under mechanical or sail power in water.
2. No arrest shall be made under sections 306.111 to 306.119 * unless probable cause exists for that arrest.
