Sec. 3. As used in this chapter, "electricity supplier" means a person, other than a municipally owned utility (as defined in IC 8-1-2-1(h)), that: (1) provides utility service to customers in Indiana; and (2) is under the jurisdiction of the commission for the approval of rates and charges.
