1. A person in violation of this chapter or rule adopted under this chapter may be subject
to a civil penalty not to exceed one thousand dollars for each violation. The civil
penalty may be adjudicated by the courts or by the agriculture commissioner through
an administrative hearing conducted by an independent hearing officer pursuant to
