(a) The board may not adopt a rule, regulation, or policy that violates Chapter 110 , Civil Practice and Remedies Code. (b) A person may assert a violation of Subsection (a) as an affirmative defense in an administrative hearing or as a claim or defense in a judicial proceeding under Chapter 37 , Civil Practice and Remedies Code.
