3.128.450 Inclusion of public property in maintenance benefit area.
A publicly owned lot or parcel of land may be included within the boundaries of a proposed maintenance benefit area or within any new territory added pursuant to a change in geographical boundary area, if prior to the adoption of the resolution of intention as provided in Article III of this chapter its owner has consented to the inclusion of said lot or parcel in the proposed maintenance benefit area and has agreed in writing to pay the service fee fixed in the manner provided in Article IV of this chapter.
