Municipal Code of Chicago § 2-84-010 Establishment - Composition and organization.

2-84-010 Establishment - Composition and organization. There is hereby established an executive department of the municipal government of the city which shall be known as the department of police. The said department shall consist of: captains, lieutenants, sergeants, police officers and such other personnel as the police board deems necessary. All of the foregoing is subject to the appropriations for such positions and compensation therefor as is provided in the annual appropriation ordinance. To supplement the police department, the board may appoint such number of civilian crossing guards to regulate traffic in the vicinity of grade schools during such hours of school days as may be required for that purpose. Municipal Code of Chicago § 2-84-020 Police Board - Establishment, membership and organization.

2-84-020 Police Board - Establishment, membership and organization. (a) There is hereby created a Police Board consisting of nine members to be appointed by the Mayor, pursuant to the process set forth in Section 2-80-080, by and with the advice and consent of the City Council. Except in the case of vacancies filled for the remainder of an unexpired term, Board members shall be appointed for a term of five years, or until their respective successors are appointed and qualified. Provided, however, that no person shall be eligible for reappointment to the Board if such person has served on the Board for more than ten years during his or her lifetime. Board members shall be reasonably compensated for their service on the Board as provided for in the annual appropriation ordinance. (b) Vacancies shall be filled for the remainder of an unexpired term in the same manner as original appointments. (c) The mayor is authorized to remove any member of the police board for just cause, after written notice to the board member stating with particularity the grounds for such removal and an opportunity for a hearing before the mayor or the mayor's designee. Just cause for such removal shall include, but is not limited to, incompetence, neglect of duty, gross misconduct or criminal conduct of the type that threatens to impair or undermine public confidence in the board, or other acts of nonfeasance, malfeasance or misfeasance in office. If, during any calendar year, a member of the police board fails to attend three or more scheduled meetings of the board, the president of the board shall provide written notice of such fact to the mayor and a rebuttable presumption of neglect of duty shall exist. (d) The mayor shall designate a president and a vice-president from among the members of the board. The president and vice-president shall be designated to serve in such capacity for a term not to exceed two years, and may be redesignated by the mayor to serve in such capacity for an additional term(s) not to exceed two years. The board shall hold a regular meeting at least once a month. All regular meetings shall be in a public office of the board with reasonable provision for attendance by the public. The superintendent of police or the superintendent's designee and the chief administrator of the independent police review authority or the chief administrator's designee shall be present at all public meetings of the board and shall have the right to take part in the discussions and deliberations but shall have no vote. (e) The board shall appoint a secretary who shall not be a member of the board. The secretary shall keep a record of the proceedings and transactions of the board specifying therein the names of the members of the board at all meetings and giving the yeas and nays upon all votes. The secretary shall post and publish all orders, resolutions and notices which the board shall order to be posted and published, and shall perform such other duties as are herein or may be, by order of the board, imposed on the secretary. The yeas and nays of police board members on all votes shall be posted by the secretary on the police board website within ten business days of any such vote and shall remain posted on such website for at least two years. (f) The powers of the board shall be exercised by order or resolution adopted by a majority of its members and recorded in the minutes with yeas and nays at length. Such action shall be attested by the signatures of the president or vice-president or two members of the board and by the signature of the secretary of the board. (Prior code § 11-2; Amend Coun. Municipal Code of Chicago § 2-84-030 Police Board - Powers and duties.

2-84-030 Police Board - Powers and duties. The Police Board shall exercise the following powers: 1. To adopt rules and regulations for the governance of the Police Department of the City; 2. To serve as a board to hear disciplinary actions for which a suspension for more than the 30 days expressly reserved to the superintendent is recommended, or for removal or discharge involving officers and employees of the Department of Police in the classified civil service of the City; 3. To serve as a board to consider appeals, pursuant to Section 2-84-035, by applicants for a probationary police officer position who have been removed from the Department of Police's eligibility list due to the results of a background investigation; and 4. To serve as a board to consider appeals, pursuant to the rules promulgated by the Police Board, by individuals seeking removal of status identification from a criminal enterprise information system maintained by the Department of Police or successor program. The board may appoint any member thereof or a hearing officer to hear disciplinary actions. No officer or employee of the police department in the classified civil service of the city whose appointment has become complete may be removed or discharged, or suspended for more than 30 days except for cause upon written charges and after an opportunity to be heard in his own defense by the police board, or any member or hearing officer designated by it. Before any such officer or employee may be interrogated or examined by or before the police board, or any member or hearing officer designated by it, or departmental agent or investigator, the results of which hearing, interrogation or examination may be the basis for filing charges seeking his removal or discharge, he must be advised in writing as to what specific improper or illegal act he is alleged to have committed; he must be advised in writing that his admissions made in the course of the hearing, interrogation or examination may be used as the basis for charges seeking his removal or discharge; and he must be advised in writing that he has the right to counsel of his own choosing present to advise him at any hearing, interrogation or examination; and a complete record of any hearing, interrogation or examination shall be made and a complete transcript thereof made available to such officer or employee without charge and without delay. Upon the filing of charges for which removal or discharge or suspension of more than 30 days is recommended, a hearing before the police board, or any member or hearing officer designated by it shall be held. The police board shall establish rules of procedure not inconsistent with this section respecting notice of charges and the conduct of the hearings before the police board, or any member or hearing officer designated by it. The police board, or any member or hearing officer designated by it, is not bound by formal or technical rules of evidence, but hearsay evidence is inadmissible. The person against whom charges have been filed may appear before the police board, or any member or hearing officer designated by it, with counsel of his own choice and defend himself; shall have the right to be confronted by his accusers; may cross-examine any witness giving evidence against him; and may by counsel present witnesses and evidence in his own behalf. The police board, or any member or hearing officer designated by it, may administer oaths and secure by its subpoena both the attendance and testimony of witnesses and the production of relevant books and papers. All proceedings before the police board, or any member or hearing officer designated by it, shall be recorded. No continuance may be granted after a hearing has begun unless all parties to the hearing agree thereto. The findings and decision of the police board, including an explanation of those findings and decision, when approved by said board, shall be certified to the superintendent and shall forthwith be enforced by said superintendent. Such findings and decision, including an explanation of the reasons for such findings and decision, shall be posted by the secretary on the police board website within ten business days of the date of certification of such findings and decision to the superintendent, and shall remain posted on such website for at least two years. If any member of the police board dissents from the board's findings and decision, such member shall state the reasons for his or her dissent. Such dissents shall be posted by the secretary on the police board website within ten business days of the date of certification of the board's findings and decision to the superintendent, and shall remain posted on such website for at least two years. In the designation of hearing officers, the police board shall select only attorneys licensed to practice in the State of Illinois, with a minimum of five years' experience. Hearing officers shall conduct disciplinary hearings in accordance with the provisions of this chapter and the rules of procedures established by the police board. The hearing officer may take judicial notice, rule on offers of proof, receive relevant evidence during the hearing and certify the record and make findings of fact, conclusions of law and recommendations to the police board following the hearing. A majority of the members of the police board must concur in the entry of any disciplinary recommendation or action. In the event that three members of the board must recuse themselves pursuant to the provisions of Section 2-78-130, a majority of the remaining members of the police board must concur in the entry of the disciplinary recommendation or action. No member of the board may participate in any disciplinary recommendation or action without having read the record upon which said recommendation or action is based. Nothing in this section limits the power of the superintendent to suspend a subordinate for a reasonable period, not exceeding 30 days. The Board's power to adopt rules and regulations for the governance of the Police Department does not include authority to administer or direct the operations of the Police Department or the Superintendent of Police, except as provided in Section 12.1 of "An Act to regulate the civil service of cities" approved March 20, 1895, as amended. The Board in its discretion shall have the authority to make recommendations to the Superintendent of Police and to the Chair of the City Council Committee on Police and Fire, or its successor committee, concerning revisions in policy and operating procedures to increase the efficiency of the Police Department. Such recommendations shall be posted on the Police Board website within two business days of the date on which such recommendation is made to the Superintendent and shall remain posted on such website for a period of at least two years. Municipal Code of Chicago § 2-84-035 Appeals by applicants removed from eligibility list.

2-84-035 Appeals by applicants removed from eligibility list. (a) Definitions. For purposes of this section, the following definitions shall apply: "Applicant" means a person who has applied for a probationary police officer position with the Department. "Board" means the Police Board created pursuant to Section 2-84-020. "Department" means the City’s Department of Police. "Eligibility list" means the Department’s list of eligible applicants for a probationary police officer position with the Department. (b) Appeals. Appeals by applicants who have been removed from the eligibility list due to the results of a background investigation shall be governed by the following procedure and applicable rules: (1) The applicant shall be given written notice by the Department of the Department’s decision to remove the applicant from the eligibility list, along with the reason(s) for the disqualification decision. (2) The applicant may, no later than 60 calendar days from the date on the notice, appeal the decision of the Department by filing with the Board a written request specifying why the Department erred in the factual determinations underlying the disqualification decision, or bringing to the Board’s attention additional facts directly related to the reason(s) for the disqualification decision. (3) The Department may file a written response, and the applicant may file a written reply to the Department’s response, as provided in the Board’s rules of procedure. (4) The Board shall render a decision on the appeal, as provided in the Board’s rules of procedure. (c) Burden of proof. The applicant shall have the burden of showing, by a preponderance of the evidence, that the Department’s decision to remove the applicant from the eligibility list was erroneous. (d) Hearing officers and final decisions. The Board may appoint hearing officers to consider applicants’ appeals in accordance with this section and the rules of procedure adopted by the Board. Each hearing officer shall be an attorney admitted to the practice of law in the State of Illinois in good standing. Hearing officers may make findings of fact, conclusions of law, and recommendations to the Board. The Board shall be the final decision-making authority regarding any appeal under this section, and such decision shall constitute a final decision for purpose of judicial review by a court of competent jurisdiction. (e) Documentary review. The Board’s consideration of the appeal provided in this section is limited to review of: (1) the applicant’s request and reply; (2) the Department’s response; (3) any relevant documentary evidence submitted with such request, reply or response; and (4) the hearing officer’s findings, conclusions, and recommendations. There shall not be a hearing (whether in person or by video or audio conference) on the Department’s decision to remove the applicant from the eligibility list. (f) Failure to file timely appeal. If an applicant does not file a timely appeal as provided in subsection (b), such applicant shall be deemed to have waived his or her right under this section to appeal the Department’s decision to remove the applicant from the eligibility list. (g) Rules. The Board is authorized to promulgate rules of procedure not inconsistent with this section regarding the conduct of appeals under this section. (Added Coun. J. 11-26-19, p. 11390, Art. 2-84-040 Superintendent of Police - Appointment. The Superintendent of Police shall be the chief executive officer of the Police Department. The Superintendent shall be appointed by the Mayor pursuant to the process set forth in Section 2-80-080, and with the advice and consent of the City Council, and shall serve at the pleasure of the Mayor. The Superintendent shall be responsible for the general management and control of the Police Department and shall have full and complete authority to administer the Department, except for those matters under the jurisdiction of the Office of Public Safety Administration, in a manner consistent with the ordinances of the City, the laws of the state, and the rules and regulations of the Police Board. Municipal Code of Chicago § 2-84-050 Superintendent of Police - Powers and duties.

2-84-050 Superintendent of Police - Powers and duties. Subject to the rules of the Department and the instruction of the Board, said Superintendent shall have the power and duty: (1) To organize the Department; (2) To make appointments, promotions, transfers of and to take disciplinary action against employees of the Department; (3) To appoint, discharge, suspend or transfer the employees of the Department and to issue instructions to said employees in the line of their duties. Subsections (2) and (3) shall be administered in coordination with the Office of Public Safety Administration, and are subject to the career service provisions of Chapter 2-74 of this Code; (4) To expend the funds of the Department in accordance with the provisions of the budget appropriations and subject to the approval of the Office of Public Safety Administration; (5) To develop an annual departmental budget covering the anticipated revenues and expenditures of the Department conforming as far as practicable to the forms and dates provided for in relation to the general City budget; and (6) To exercise such further powers in the administration of the Department as may be conferred upon the Superintendent by the Mayor, except for those powers exercised exclusively by the Office of Public Safety Administration. Municipal Code of Chicago § 2-84-051 Notification to news media.

2-84-051 Notification to news media. The superintendent of police shall make available to local newspapers, radio and television stations the names and addresses of persons, other than juveniles, arrested on charges of soliciting for a prostitute or patronizing a prostitute, as those offenses are defined in the Illinois Criminal Code of 1961; or attempt possession of a controlled substance, as defined in the Illinois Controlled Substance Act. 2-84-052 Maintenance and distribution of certain records. The superintendent of police shall distribute information received under the Child Sex Offender and Murderer Community Notification Act to the various police districts. Municipal Code of Chicago § 2-84-053 Authority to enter into task force agreements.

2-84-053 Authority to enter into task force agreements. In addition to any other authority provided in this Code, the Superintendent of Police shall have the authority to enter into agreements to form law enforcement task forces, agreements to deputize certified law enforcement personnel, and other cooperative agreements, with the following law enforcement agencies: United States Drug Enforcement Administration; Federal Bureau of Investigation; Illinois Department of State Police; Illinois Attorney General; United States Department of Justice; United States Department of Justice, Bureau of Alcohol, Tobacco and Firearms; State's Attorney of Cook County; and other law enforcement agencies determined by the Superintendent of Police to be necessary for the fulfillment of law enforcement functions. The Superintendent is also authorized to enter into agreements with public or private entities concerning placement, installation, maintenance or use of video, audio, telecommunications, or other similar equipment. The location of any camera or antenna permanently installed pursuant to any such agreement shall be determined pursuant to joint review and approval with the Executive Director of Emergency Management and Communications. Agreements entered into pursuant to this section shall be subject to approval by the Corporation Counsel as to form and legality. Such agreements may contain provisions to indemnify or hold harmless participating agencies and their personnel in connection with the purposes of the task force or other agreement. The agreements may not authorize the deployment of City personnel or use of City equipment unless the City Council has duly appropriated funds for such personnel and equipment. The Superintendent of Police shall notify the Chair of the City Council Committee on Police and Fire, or its successor committee, with respect to multi-jurisdictional agreements entered into in accordance with this section. Municipal Code of Chicago § 2-84-054 Notification to state's attorney.

2-84-054 Notification to state's attorney. The superintendent of police or his designee shall promptly notify the Cook County State's Attorney of all officer-involved death incidents. For purposes of this section, "officer-involved death" means any death of a person that results directly from an action or directly from an intentional omission, including unreasonable delay involving a person in custody or intentional failure to seek medical attention when the need for treatment is apparent, of a member of the department while the member is on duty, or otherwise acting within the scope of his or her employment, or while the member is off duty, but performing activities that are within the scope of his or her law enforcement duties. "Officer-involved death" includes any death resulting from a motor vehicle crash, if the member of the department was engaged in law enforcement activity involving the individual or the individual's vehicle in the process of apprehension or attempt to apprehend. Municipal Code of Chicago § 2-84-055 Contracts and agreements - Continuation authority.

2-84-055 Contracts and agreements - Continuation authority. In addition to any other authority provided in this Code, the superintendent of police shall have the authority, pursuant to Section 14 of the Emergency Telephone System Act, to enter into and certify the continuation of agreements on behalf of the police department and the city, with other units of local government, special purpose districts and public safety agencies, for the provision of emergency services outside jurisdictional boundaries. Such agreements and certifications shall be subject to approval by the corporation counsel as to form and legality. Copies of such agreements and certifications shall be filed with the Illinois Attorney General and the Illinois Commerce Commission pursuant to Section 15 of the Emergency Telephone System Act. 2-84-056 Agreements related to training. The Superintendent, in coordination with and subject to the approval of the Office of Public Safety Administration, is authorized to: (1) negotiate and execute agreements with other governmental units, nonprofit and volunteer groups, and private parties to provide training and curriculum development for members of the Police Department or for persons required to be trained by the Department, or to provide training and testing for prospective members of the Department; (2) negotiate and execute agreements with other governmental units to provide training and curriculum development to municipal police departments or other law enforcement agencies of governmental units; and (3) enter into and execute all such other instruments and to perform any and all acts, including the expenditure of funds subject to appropriation therefor, as shall be necessary or advisable in connection with the implementation of such agreements, including any renewals thereto, and including provisions providing indemnification. Municipal Code of Chicago § 2-84-060 Superintendent of police - Warrants for expenditures.

2-84-060 Superintendent of police - Warrants for expenditures. No money shall be drawn from any fund under the control of the department except upon warrants authenticated by the signature of the superintendent. The board, by resolution, may authorize a temporary substitution in the case of the absence or inability to act of the person whose signature is herein required. A copy of any such resolution of substitution shall be filed with the comptroller. (Prior code § 11-7)

Municipal Code of Chicago § 2-84-070 Weapon turn-in programs.

2-84-070 Weapon turn-in programs. The superintendent of police or his designee is authorized to establish and administer a program to encourage members of the public to turn-in guns, replica weapons and other items deemed by the superintendent to be detrimental to public safety (for purposes of this section, "weapons"). Such authorization includes the power to set dates for turn-in events, solicit donations, execute agreements, dispose of turned-in weapons, and take such other actions deemed necessary to successful administration of weapon turn-in events. Municipal Code of Chicago § 2-84-075 Sale of firearms and ammunition authorized by the superintendent.

2-84-075 Sale of firearms and ammunition authorized by the superintendent. Notwithstanding any other provision of this code to the contrary, the superintendent may authorize the sale of firearms or ammunition by a person issued a federal firearms license to a member of the police department, if that member is authorized to carry such firearm or ammunition. 2-84-080 Police board - Custody of buildings and property - Enforcement powers. The board shall have the custody and control of the offices, stations and other public buildings occupied by the police department or any division thereof, equipment, books, records and other property belonging to said department. It shall, through the superintendent of police, preserve the peace and secure good order and cleanliness within the city, and to that end, it shall enforce all laws, ordinances of the city and orders of the city council and of the mayor. Municipal Code of Chicago § 2-84-100 Transfer of rights, powers and duties.

2-84-100 Transfer of rights, powers and duties. The department and the superintendent of police shall assume all rights, powers, duties, obligations and responsibilities of the former commissioner and department of the environment related to noise and vibration control. All rules or regulations issued by the former commissioner of the environment relating to noise and vibration control, in effect as of January 1, 2012, shall remain in effect until jointly amended or repealed by the superintendent of police, and the commissioner of health, pursuant to their respective authorities. Municipal Code of Chicago § 2-84-140 Police dogs - Interference with activities unlawful.

2-84-140 Police dogs - Interference with activities unlawful. It shall be unlawful for any person to wilfully or maliciously torture, torment, beat, kick, strike, mutilate, injure, disable or kill any dog used by the police department of the City of Chicago in the performance of the functions of such department, or to interfere with or meddle with any such dog while being used by said department or any officer or member thereof in the performance of any functions or duties of said department or of such officer or member. Municipal Code of Chicago § 2-84-150 Lost and stolen property - Custody.

2-84-150 Lost and stolen property - Custody. The custodian of lost and stolen property, under the direction of the superintendent of police, shall act as custodian of all property seized or taken by the police. All officers and members of the department into whose possession may come any property seized or taken shall deliver the same at once to the said custodian, unless it is wanted for immediate use as evidence in any case, and in that event, a report and inventory of the same shall be forwarded at once to the said custodian. Nothing contained in this chapter, however, shall be held to require the custodian to take possession of, or to make disposition of, any lost or stolen property the disposition or possession of which is otherwise provided for by this Code. Municipal Code of Chicago § 2-84-160 Sale of seized property.

2-84-160 Sale of seized property. (a) The department shall keep a record of all seized property. For purposes of this section, "seized property" means property seized by the department in connection with an arrest. (b) The department shall make reasonable efforts to notify and advise to the owner of any seized property not being held for investigation, or potential forfeiture, of the procedure to claim such property. (c) The department shall dispose of any seized property that is: (1) not retained for investigatory or evidentiary purposes, or for potential forfeiture, and the owner fails to claim the seized property within 30 days from the date of its seizure; or (2) held for investigatory or evidentiary purposes and the owner fails to claim the seized property within 30 days; (i) from the date of the final disposition of the court or administrative hearing proceeding pertaining to such property; or (ii) after notice from the department that the investigation for which the property was seized has been concluded, if the property is not subject to a court or administrative hearing proceeding, or potential forfeiture. (d) Any seized property not recovered by the owner at the expiration of the holding period provided in subsection (c) shall be disposed of in the following manner: (1) seized property deemed by the superintendent to be of use to the city shall be forfeited to the city for its use; (2) seized property deemed by the superintendent to be unsalable and of no use to the city shall be destroyed; or (3) seized property deemed salable by the superintendent shall be sold through online public auction. (e) The department shall publish on its website the procedures to claim any seized property eligible for return and information directing the owners to the website of the third-party online or live auctioneers that auction the seized property. (f) After the expiration of the holding period provided in subsection (c) the department shall transfer salable seized property to a third-party online or live auctioneer for auction to the highest bidder. Before such sale, the third-party online or live auctioneer shall provide a publicly available description and photograph of the seized property on its auctioning website. Any owner believing his property is subject to auction shall have the opportunity to recover, subject to ownership verification, the property from the third-party auctioneer before the sale of the property. If any property seized or taken possession of by the police force, shall be of a perishable nature or so bulky or of such nature as to make it dangerous or inadvisable to retain possession thereof, for the length of time specified in Section 2-84-160, the custodian, upon certifying such fact to the superintendent of police, and setting forth his reasons why such property should not be retained for the period hereinabove fixed before disposing of same, shall with the approval of the superintendent of police cause such property, if deemed by the custodian to be salable, to be advertised forthwith in a daily newspaper of the city, and shall sell such property at public auction at any time after three days have elapsed from the seizure or taking possession thereof, except if any such property be deemed to be unsalable or dangerous, it shall be disposed of as refuse or in such other reasonable manner as may be deemed by the custodian. 2-84-196 National Standardized Child Passenger Safety Training Course for police officers. The Superintendent of Police shall establish a Child Passenger Safety Program that shall require at least two police officers per district to complete and maintain certification in the 32-hour National Standardized Child Passenger Safety Training Course developed by the National Highway Traffic Safety Administration, which is designed to provide the basic technical skills, experience and knowledge of the proper use and installation of child passenger safety seats. The assigned police officers shall take the necessary continuing education course(s) as recommended by the national certifying body to maintain certification as a Child Passenger Safety Technician. The education and inspections shall occur on a weekly basis by appointment only at the discretion of the District Commander. Information regarding the Child Passenger Safety Program shall be made available on the Chicago Police Department's website and through the City of Chicago's 311 Service Center. (Added Coun. 2-84-200 Special police - Harbor police and bridge tenders. The superintendent of police may appoint as special policemen, persons of suitable character, who are in the employment of the city in the capacity of harbor police or bridge tenders, but such persons so appointed shall receive no additional pay for their services as such special policemen. Such policemen shall possess the same powers as the regular police patrolmen only when within the scope of their constituted duties it becomes necessary for them to act as special policemen. They shall be subject to all the rules and regulations governing the police department. (Prior code § 11-21)

2-84-210 Special police - For humane societies. The superintendent of police shall have power, upon the application in writing of any society for the prevention of cruelty to animals and children, incorporated under and by virtue of the laws of the state, to appoint and swear in not to exceed 25 special policemen, whose names and addresses shall be set forth in such application; provided, the persons so to be appointed shall be recommended by the president of any such society. The superintendent of police shall keep a list of all persons so appointed by him, and he may remove or discharge any of the persons so appointed at any time without assigning any cause therefor, and he may appoint other persons upon similar application and recommendation to take the place of the person of persons removed or discharged. The special policemen so appointed shall be particularly charged with the duty of enforcing the provisions of this Code relating to cruelty to children and cruelty to animals. They shall comply with and be subject to all the rules and regulations prescribed by the superintendent of police for the government, control, and duties of such special policemen. They shall also perform other special and temporary police duties as may, in emergency cases, be required by the superintendent of police or other police officer, or as may be required by the rules and regulations so prescribed. They shall, in the performance of such duties, have all the powers and privileges of patrolmen of the police department of the city. The appointment of such special policemen shall be upon the condition that the city shall not be liable in any way for the compensation of any such special policemen, and on condition that such compensation shall be provided by the society requesting such appointment to be made.
