Municipal Code of Chicago § 2-74-010 Purpose of provisions.

2-74-010 Purpose of provisions. It is the general purpose of this ordinance, and it is necessary in the public interest, to establish a system of personnel administration that meets the social, economic, and program needs of the people of the City of Chicago, to provide for a professional and progressive merit system for employment, and to insure flexible career service within the City of Chicago. 2-74-020 Department established - Composition - Commissioner's powers and duties. There is hereby established an executive department of the City of Chicago which shall be known as the Department of Human Resources. The Commissioner of Human Resources shall be the chief executive officer of the Department of Human Resources and shall be appointed by the Mayor with the advice and consent of the City Council and shall serve at the pleasure of the Mayor. The Commissioner of Human Resources shall be responsible for the general management and control of the Department of Human Resources in a manner consistent with the ordinances of the City, the laws of the state, and the rules of the department. The Commissioner of Human Resources shall have the power and duty to: (1) encourage and exercise leadership in the development of effective personnel administration within the several departments in the government service, and to make available the facilities of the department of human resources to this end; (2) advise the mayor on utilization of employees; (3) foster and develop programs for the improvement of employee effectiveness including, but not limited to, position classification, salary administration, recruitment, selection, which shall include as part of the selection process a preference for veterans, promotion, performance ratings, probationary periods, training, employee communications, employee benefits, affirmative action, safety, and health; (4) investigate from time to time the operation and effect of this ordinance and of the rules made thereunder and to report the findings and recommendations to the mayor; (5) establish and maintain records of all employees in city service, in which there shall be set forth as to each employee the class title, pay and status, and other relevant data; (6) make an annual report to the mayor regarding the work of the department; (7) certify that persons named on every payroll have been appointed and employed in accordance with the provisions of this ordinance and the rules adopted thereunder. No city disbursing or auditing officer shall make or approve or take any part in making or approving any payment for personnel service to those persons holding a position in the city service unless said payroll voucher or account of such pay bears the certification of the commissioner or his authorized agent; (8) (a) Impose a fee for the preparation, administration and processing of examinations relating to entry level positions in the city service. The maximum examination fee relating to each entry level examination shall be as follows: Professional series (multiple positions).....$10.00 Other.....$5.00 The commissioner may provide by rule for a waiver of the examination fee for an applicant who provides appropriate documents that the applicant is receiving unemployment compensation, supplementary security income or general assistance, or that the applicant's income is below the federally-defined poverty level at the time of the application; provided, however, that, if the applicant is hired for the position for which the applicant took the examination, the applicant shall be required to reimburse the city for the examination fee. (b) Impose a fee for the preparation, administration and processing of promotional examinations. The maximum examination fee relating to each police sergeant or police lieutenant promotional examination shall be $25.00. The maximum examination fee for each promotional examination for the position of fire engineer, lieutenant, battalion chief or other uniformed service within the fire department shall be $75.00. (9) oversee compliance with the city's hiring policies and procedures. (10) subject to the availability of funds duly appropriated therefor, to purchase off-the-shelf tests for the purpose of employee selection and promotion; (11) apply and carry out this ordinance and the rules thereunder and to perform any other lawful acts which may be necessary or desirable to carry out the purposes and provisions of this ordinance. Municipal Code of Chicago § 2-74-030 Categories of positions in city service.

2-74-030 Categories of positions in city service. All positions in the city service shall be in one of the following categories: (1) Elected officials; (2) Executive heads of city departments; (3) Members of boards and commissions whose appointment is subject to confirmation by the city council; (4) Senior executive service, consisting of positions which entail duties including city-wide or departmental level determinations of policy, or positions which entail the implementation of such policies, or positions requiring high technical or scientific skills, to be determined by the commissioner of human resources on the basis of quantitative job content evaluation, with the resultant listing published in the human resources rules. It shall include all positions listed in Appendix A, which is attached at the end of this chapter. The commissioner of human resources is authorized to add positions to the list of senior executive service employees and remove positions therefrom if: (a) the commissioner of human resources finds that the total job content as measured by the Hay Guide Chart – Profile Method (1980 Edition) of quantitative job content evaluations is 550 points or more for an added position or less than 550 points for a removed position; (b) the commissioner of human resources reports the finding in writing to the mayor; and (c) the mayor approves the finding in writing; (5) Departmental employment service employees, consisting of the positions in the unskilled and semiskilled labor/trade and allied occupations, which positions are filled without city-wide competitive examinations, but subject to fair and valid job related pre-employment screening. The departmental employment service classes will be determined by the commissioner of human resources with the approval of the mayor on the basis of quantitative job content evaluation and the resultant listing published in the human resources rules. They shall include all positions listed in Appendix B, which is attached at the end of this chapter. The commissioner of human resources is authorized to add positions to the list of department employment service and remove them therefrom if: (a) the commissioner of human resources finds that a position is a labor/trades or allied occupational position having a job content under the Hay Guide Chart – Profile Method (1980 Edition) of quantitative Know How job content evaluation with 100 points or less for an added position or more than 100 points for a removed position; (b) the commissioner of human resources reports the finding in writing to the mayor; and (c) the mayor approves the finding in writing. Department employment service will also include all prevailing rate employees; (6) Employees of the law department; (7) Police officers above the rank of captain and firefighters above the rank of battalion chief; (8) Employees whose work is seasonal and does not exceed 180 days in any calendar year; (9) A private secretary for each elected official; (10) Administrative assistants to the mayor, and such employees of the mayor's office as are appointed by the mayor; (11) Employees of the city council, unless such positions are specifically included in the career service by ordinance; (12) Positions exempted from the career service pursuant to the rule of the department upon recommendation of a department head and after comment and recommendation by the commissioner of human resources and the approval of the mayor. These additional exemptions must be based on the need for flexibility in appointment to positions which (a) are necessary in order to maintain confidentiality, or (b) are administratively necessary in order to effect a program including, but not limited to, such programs as student work experience programs, trainee programs, federal public service employment programs, and any other programs, which, because of the program requirements, cannot be subject to career service requirements; (13) Career service employees, consisting of employees in all other positions and occupational classes other than in (1) through (12) above. Municipal Code of Chicago § 2-74-040 Human resources board.

2-74-040 Human resources board. There is hereby created a human resources board consisting of three members appointed by the mayor by and with the advice and consent of the city council, for a term of five years, or until their respective successors are appointed and qualified, except that of the initially appointed board, one member shall be appointed for two years, one member shall be appointed for three years, and one member for five years. Upon the expiration of the term of any member of the human resources board, the mayor by and with the advice and consent of the city council, shall appoint each successor for a term of five years and each member shall serve until a successor is appointed and qualified. A vacancy shall be filled for the remainder of an unexpired term in the same manner as original appointments. The mayor shall appoint one of the members of the board as chairperson to serve for a term of one year or until a successor is appointed. The board will have the responsibility of providing advice and counsel to the mayor and to the commissioner of human resources on all aspects of public personnel administration including, but not limited to, manpower utilization, manpower training, employee grievances and employee salaries, in addition to other duties as provided by this chapter. Municipal Code of Chicago § 2-74-050 Human resources rules.

2-74-050 Human resources rules. The commissioner of human resources shall issue human resources rules, which may also be referred to as personnel rules. Prior to the effective date of such rules, the commissioner of human resources shall give public notice in one or more newspapers of general circulation, and in no case shall such publication be less than ten days before the effective date of the proposed rule or amendment to the rule. Such public notice shall include information concerning where the rules can be reviewed and where comments may be directed. Nothing contained herein shall prohibit the commissioner of human resources from giving other appropriate public notice. The rules shall provide: (1) For the preparation, maintenance and revision of a position classification plan for all positions in the senior executive service, career service and department employment service, based upon similarity of duties performed and responsibility assigned, so that the same qualifications may reasonably be required for and the same schedule of pay may equitably be applied to all positions in the same class; (2) For the annual submission of a pay plan to the mayor; (3) For the recruitment and selection of persons in the career service on the basis of their relative fitness, and job-related selection procedures in the department employment service; (4) For the establishment of eligible lists for appointment and promotion in career service, upon which lists shall be placed the names of successful candidates in order of their relative excellence in the respective examinations. The commissioner may substitute rankings such as excellent, well-qualified and qualified for numerical ratings and establish eligible lists accordingly. Such rules may provide for lists by area or location, by department or other agency, for removal of those not available for or refusing employment, for minimum and maximum duration of such lists, and for such other provisions as may be necessary to provide rapid and satisfactory service to the operating agencies. The rules may authorize removal of eligibles from lists if those eligibles fail to furnish evidence of availability upon forms sent to them by the commissioner; (5) For the certification to an appointing authority of the names (a) of the five highest persons available on the appropriate eligible list to fill each vacancy, or (b) from the highest ranking group if the list is by rankings instead of numerical ratings; (6) For promotions which shall give appropriate considerations to the applicant's qualifications, record of performance and ability; (7) For probationary periods after original career service appointment not to exceed one year; (8) For emergency employment for not more than 90 days with the consent of the commissioner and for provisional employment when there is no appropriate eligible list available. No such provisional appointment shall continue longer than nine months, nor shall successive provisional appointments be allowed; (9) For keeping records of performance of employees in the career service, which performance records shall be considered in determining salary increments or increases for meritorious services; as a factor in promotions; as a factor in reinstatements; and as a factor in discharges and transfers. Appropriate performance records will be maintained for other employees; (10) For layoffs in the career service, by reason of lack of funds or work, or abolition of a position, or material change in duties or organization, and for reemployment of employees so laid off; (11) For implementation and administration of the grievance procedure provided by this chapter; (12) For the establishment of disciplinary measures such as suspension, demotion in rank or grade, or discharge. For all permanent employees in the career service, such measures shall provide for a statement of the charges on which discipline is based, together with an explanation of the evidence supporting the charges and an opportunity for the employee to respond to the charges in writing before action is taken, appeals after such disciplinary action, and a hearing on the charges upon request of the employee in case of discharge, demotion or suspension exceeding 30 days, and review of suspensions not exceeding 30 days, consistent with the requirements of due process of law. The charges and explanation of evidence need not be in any particular form, but must be sufficient to apprise the employee of the matters on which discipline may be based. The employee's response must be reviewed by the department head or designee responsible for making the decision, provided that such designee may not be the person who initiated the charges against the employee. No permanent employee in the career service may be discharged, demoted or suspended for more than 30 days unless the statement of charges and any matters in support are first reviewed by the departments of law and human resources, before the employee is notified of such action; (13) For development and operation of programs to improve work effectiveness, including training, education, safety, health, welfare, counseling, recreation and employee relations; (14) For the establishment of procedures for departmental review of disciplinary actions taken against departmental employment service employees. All such procedures shall be approved by the commissioner of human resources; (15) For such other policies and administrative regulations, not inconsistent with this law, as may be proper and necessary for its enforcement. Municipal Code of Chicago § 2-74-060 Hearing of charges brought against employees.

2-74-060 Hearing of charges brought against employees. The human resources board, a member thereof, or a hearing officer appointed by the board shall conduct a hearing of all appeals by any career service employee of discharge, demotion, or suspension for a period of more than ten days upon request of the employee, and may provide by rule for review of suspensions of ten days or less. The human resources board, any of its members, or a hearing officer appointed by the board may administer oaths and secure by subpoena both the evidence and witnesses for the production of relevant books and papers. All proceedings before the board, a member thereof, or the hearing officer shall be recorded. The findings and decision of a member of the board or hearing officer shall be certified to the human resources board, which may accept or reject the findings and decision or may require further hearing before the board. After the board accepts the findings and decision of its member or hearing officer, or after a hearing by the human resources board, it shall certify the findings and decision to the commissioner of human resources who shall then notify the appropriate appointing authority. Nothing in this section limits the power of the appointing authority or his/her designee to take disciplinary action against a subordinate pursuant to the rules of the department of human resources. If the human resources board finds that the number of hearing officers is insufficient to hear and report on cases before it in a timely manner, it shall retain the services of such additional hearing officers as are necessary to ensure the timely hearing and report of such cases. If the appropriation for payment of hearing officers is insufficient for this purpose, then the expense of such hearing officers shall be borne by the department from which such cases arise, based on the cost involved in hearing and reporting such cases. Appeals by an employee of discharge, demotion or suspension for a period exceeding 30 days shall be governed by the following procedure: (a) The employee shall be given written notice of the disciplinary decision by the department head or designee. The employee may appeal the department head's or designee's decision to the personnel board by making a written request therefor within five calendar days of the effective date of discipline. An appeal shall not affect the effective date of discipline. The written notice must contain the following statement: If you desire a hearing on this disciplinary action, you must file a written request for the hearing with the Personnel Board of the City of Chicago, Room 1100, City Hall, Chicago, Illinois. Your written request must be received by the personnel board within five calendar days of the effective date of discipline. Late requests will not be accepted. (b) If the employee requests a hearing, a date therefor shall be set, not more than 45 days following receipt of the request for hearing by the personnel board. Either party may request a continuance for good cause shown, but the hearing must be completed within 60 calendar days of the initial hearing date, unless further delay is caused by the employee. The personnel board shall render a decision on the appeal not more than 60 calendar days after the close of the hearing. If the time limitations provided for herein are not met, the employee shall be entitled prospectively to the pay and benefits of the position held before the imposition of suspension or discharge, or in the case of a demotion the difference in pay between the former and current position, beginning with the first day after the failure to meet the time limit, pending decision of the personnel board, but the employee shall have no right to be reinstated except by order of the personnel board. The personnel board shall file a written report in all cases where a discharged, demoted or suspended employee becomes entitled to the pay and benefits of his or her former position prospectively by reason of failure to meet a time limit. The report shall be filed with the committee on finance and the city clerk within 21 days of the failure to meet a time limit, and shall contain the causes and circumstances of such failure. Nothing herein shall deprive the personnel board of jurisdiction to decide the merits of the disciplinary action. (c) An employee whose discipline is not upheld shall receive full backpay for any period when he or she was off work, or serving in a lower position, less any lesser disciplinary action imposed by the board. Said employee shall be reinstated to his or her position or such lower position as determined by the board, upon notification of the board's decision, or following such lesser discipline as may be imposed by the board, as appropriate. Municipal Code of Chicago § 2-74-070 Grievance procedures for employees.

2-74-070 Grievance procedures for employees. The commissioner of human resources, within 120 days of the enactment of this ordinance, shall prescribe uniform procedures for pursuing grievances for career service and departmental employment service employees, including provisional employees. "Grievances", as defined herein shall not include disputes over discipline, salary scales or wage rates. (Prior code § 25.1-7; Amend Coun. J. 12-7-05, p. 64870, § 1.6)

Municipal Code of Chicago § 2-74-075 Hiring preference for residents of socio-economically disadvantaged areas.

2-74-075 Hiring preference for residents of socio-economically disadvantaged areas. (a) For purposes of this section, the following definitions shall apply: “Commissioner” means the City’s Commissioner of Human Resources. “Covered position” means any open position in a City department in the following categories of City service under Section 2-74-030: (i) departmental employment service employees; (ii) employees whose work is seasonal and does not exceed 180 days in any calendar year; and (iii) career service employees. “Department” means the Department of Human Resources. “Hiring plan” means the hiring plan covering the applicable City department developed pursuant to Shakman, et al. v. City of Chicago, et al., Case Number 69 C 2145 (N.D. Ill.), each as amended from time to time. “Socio-economically disadvantaged area” means any area within the City that meets the criteria for designation as a socio-economically disadvantaged area as set forth in rules promulgated by the Commissioner of Planning and Development pursuant to Section 2-92-390. (b) Unless otherwise prohibited by the hiring plan or any federal, state, or local law, and subject to the availability of eligible applicants, the Department shall provide a referral list for employment in a covered position that includes 25 percent of eligible applicants who are residents of socio-economically disadvantaged areas. (c) The Department shall: (1) include a hiring preference provision consistent with this section in all postings soliciting applicants for covered positions; and (2) maintain records adequate to monitor compliance with this section. (d) The Commissioner is authorized to adopt rules for the proper administration and enforcement of this section. (e) In the event of a conflict between this section and a bona fide collective bargaining agreement, the collective bargaining agreement shall prevail. (Added Coun. J. 3-20-24, p. 10131, § 1)

2-74-080 Discrimination - Unlawful activities. No person shall discriminate against any employee or applicant because of race, color, sex, gender identity, age, religion, disability, national origin, ancestry, sexual orientation, marital status, parental status, military status, source of income, credit history (within the meaning of Section 6-10-053), or criminal history (within the meaning of Section 6-10-054), as those terms are defined in Chapter 6-10 of this Code or in rules duly promulgated thereunder. Municipal Code of Chicago § 2-74-085 Salary and wage histories.

2-74-085 Salary and wage histories. (a) Requirements. (1) No City department shall screen job applicants based on their wage or salary history, including by requiring that an applicant’s prior wages, including benefits or other compensation, satisfy minimum or maximum criteria; or requesting or requiring that an applicant disclose prior wages or salary: (i) as a condition of being interviewed, (ii) as a condition of continuing to be considered for an offer of employment, (iii) as a condition of an offer of employment or an offer of compensation, or (iv) as a condition of employment. (2) No City department shall seek the wage or salary history, including benefits or other compensation, of any job applicant from any current or former employer. (b) Rules. The commissioner of human resources, within thirty (30) days of the enactment of this ordinance, shall prescribe uniform procedures for pursuing complaints filed under this section. (Added Coun. Municipal Code of Chicago § 2-74-090 Unlawful practices relating to employees and employment - Penalty.

2-74-090 Unlawful practices relating to employees and employment - Penalty. A. No person shall directly or indirectly coerce, attempt to coerce or command any employee in the city service to pay, lend or contribute anything of value to a party, committee, organization, agency, or person for political purposes. No employee in the career service may use his or her official authority or influence in the career service for the purpose of affecting or interfering with the result of an election or a political office. Nothing herein contained shall affect the right of the employee to hold membership in, and support, a political party, to vote as he chooses, to express his opinions on all political subjects and candidates, to maintain political neutrality, and to attend political meetings. B. No person shall make any false statement, certificate, mark, rating or report with regard to any test, certification or appointment made under any provisions of this ordinance or in any manner commit or attempt to commit any fraud, prevent the impartial execution of this ordinance and any rules issued thereunder. C. No person shall, directly or indirectly, give, render, pay, offer, solicit, or accept any money, service or other valuable consideration for any appointment, proposed appointment, promotion or proposed promotion, or any advantage in a position in the city service. D. No employee of the department of human resources, examiner, or other person shall defeat, deceive or obstruct any person in his right to examination, eligibility, certification or appointment under this ordinance, or furnish to any person special or secret information for the purpose of affecting the rights of any person with respect to employment in the career service. E. Any person who wilfully violates this section shall be fined not less than $100.00 nor more than $500.00 or be imprisoned for not more than six months, or both. Any person who is convicted of a violation of this section shall, for a period of five years, be ineligible for appointment to or employment in a position in the city service, and if he is an officer or employee of the city shall forfeit his office or position. Municipal Code of Chicago § 2-74-095 Employment applications - Unlawful practices.

2-74-095 Employment applications - Unlawful practices. No person shall knowingly make any false statement or material omission on any application for employment with the city. Any person who violates this section shall be fined an amount up to $500.00 for each offense. (Added Coun. J. 4-16-97, p. 42635)

Municipal Code of Chicago § 2-74-097 Employment applications - Skills-based hiring.

2-74-097 Employment applications - Skills-based hiring. When the Commissioner of Human Resources considers applicants to hire for a position of City employment, the Commissioner may consider relevant work experience if the Commissioner, when appropriate, determines that such work experience is equivalent to a college degree. Municipal Code of Chicago § 2-74-100 Applicability to career service and probationary career service employees.

2-74-100 Applicability to career service and probationary career service employees. Employees who are career service or probationary career service immediately prior to the adoption of this ordinance shall be continued in their respective positions without further examination, unless exempted or separated from their positions as provided by ordinance or rule. Any such person whose position is reclassified hereunder to the departmental employment service shall retain any right that would have otherwise been enjoyed under the career service. Nothing herein shall preclude the reclassification or reallocation as provided by this chapter of any position held by such incumbent. (Prior code § 25.1-10)

Municipal Code of Chicago § 2-74-110 Provisional appointments.

2-74-110 Provisional appointments. An employee holding a provisional appointment in a career service position as defined by Section 2-74-030(13) of this ordinance immediately prior to the adoption of this ordinance shall continue in that position without further examination unless separated as provided by ordinance or rule, or unless the position is not otherwise reclassified, reallocated or exempted from the career service as provided by this ordinance. Any such employee shall also be required to serve a probationary period of one year commencing from the date of the adoption of this ordinance. (Prior code § 25.1-11)

Municipal Code of Chicago § 2-74-120 Reciprocal agreements with other agencies.

2-74-120 Reciprocal agreements with other agencies. The department of human resources is authorized and empowered to enter into reciprocal agreements, upon such terms as may be agreed upon, for the use of equipment, materials, facilities, and services with any public agency or body for purposes deemed of benefit to the career service. The department of human resources may cooperate with other governmental agencies charged with public personnel administration in conducting personnel tests, classification of positions, recruiting personnel and training personnel. Municipal Code of Chicago § 2-74-130 Exemptions to chapter applicability.

2-74-130 Exemptions to chapter applicability. This ordinance shall not apply nor have any effect upon the police board, its manner of selection, composition, or its powers and duties as set forth in Sections 2-84-020 and 2-84-030 of this Code and Section 3-7-3.1, Section 10-1-18.1 and Section 10-1-45 of the Illinois Municipal Code. Nor shall this ordinance have any effect upon the selection, powers or duties of the superintendent of police as set forth in the Municipal Code of the City of Chicago and Section 3-7-3.2 of the Illinois Municipal Code. Municipal Code of Chicago § 2-74-140 Removal of member of human resources board - Conditions.

2-74-140 Removal of member of human resources board - Conditions. The mayor may, in the mayor's discretion, remove any member of the human resources board for incompetence, neglect of duty or malfeasance in office. The mayor shall forthwith notify the city council in writing of any such removal. Any vacancy created by such removal by the mayor shall be filled by the mayor pursuant to the provisions of Section 2-74-040. (Prior code § 25.1-14; Amend Coun. J. 12-7-05, p. 64870, § 1.6)

2-74-150 Department heads - Functions and duties. Department heads shall appoint persons in the departmental employment service, subject to the approval of the commissioner of human resources. The department head shall seek technical advice and consultative services from the department of human resources to develop job related screening methods.
