No. 896 By Council Members Berman, Eisland and Fisher (by the request of the Mayor) A Local Law in relation to the date of submission by the mayor of a preliminary management report and the date prior to which the council shall conduct public hearings and the date by which the council shall submit a report or reports pertaining thereto, the date of submission by the city planning commission of a report on the draft ten-year capital strategy, the date of submission by the mayor of the preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects, the date of submission by the mayor of the preliminary budget, the date of publication by the director of the independent budget office of a report on revenues and expenditures, the date of submission by the community boards of statements in regard to the preliminary budget, the date of submission by the commissioner of finance of an estimate of the assessed valuation of real property and statement of real property taxes due, expected to be received, and uncollected, the date of submission by the mayor of a tax benefit report, the date of submission by the borough boards of statements on budget priorities, the date of submission by the council of estimates of the financial needs of the council, the date of submission by the borough presidents of proposed modifications of the preliminary budget, the date of publication by the director of the independent budget office of a report analyzing the preliminary budget, and the date by which the council shall hold hearings and submit recommendations in regard to the preliminary budget, relating to the fiscal year nineteen hundred ninety-eight Be it enacted by the Council as follows: Section 1. During the calendar year 1997 and in relation to the 1998 fiscal year: 1. Notwithstanding any inconsistent provisions of section 12 of the New York city charter, as amended by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a preliminary management report as therein described not later than February 13, 1997, and the council shall conduct public hearings on such report prior to April 21, 1997 and submit to the mayor and make public not later than April 21, 1997 a report or reports of findings and recommendations. 2. Notwithstanding any inconsistent provisions of section 234 of such charter, as added by vote of the electors on November 7, 1989, the city planning commission shall submit a report on the draft ten-year capital strategy as therein described not later than March 17, 1997. 3. Notwithstanding any inconsistent provisions of section 235 of such charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit and publish a preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects as therein described not later than January 30, 1997. 4. Notwithstanding any inconsistent provisions of section 236 of such charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a preliminary budget as therein described not later than January 30, 1997. 5. Notwithstanding any inconsistent provisions of section 237 of such charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall publish a report on revenues and expenditures as therein described on or before February 14, 1997. 6. Notwithstanding any inconsistent provisions of section 238 of such charter, as added by vote of the electors on November 7, 1989, each community board shall pursuant to such section submit a statement and recommendations in regard to the preliminary budget as therein described not later than February 28, 1997. 7. Notwithstanding any inconsistent provisions of section 239 of such charter, as added by vote of the electors on November 7, 1989, the commissioner of finance shall pursuant to such section submit an estimate of the assessed valuation of real property and a certified statement of all real property taxes due as therein described not later than February 28, 1997. 8. Notwithstanding any inconsistent provisions of section 240 of such charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a tax benefit report as therein described not later than February 28, 1997. 9. Notwithstanding any inconsistent provisions of section 241 of such charter, as added by vote of the electors on November 7, 1989, each borough board shall pursuant to such section submit a statement of budget priorities as therein described not later than March 10, 1997. 10. Notwithstanding any inconsistent provisions of section 243 of such charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section approve and submit estimates of the financial needs of the council as therein described not later than March 20, 1997. 11. Notwithstanding any inconsistent provisions of section 245 of such charter, as added by vote of the electors on November 7, 1989, each borough president shall pursuant to such section submit any proposed modifications of the preliminary budget as therein described not later than March 24, 1997. 12. Notwithstanding any inconsistent provisions of section 246 of such charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall publish a report analyzing the preliminary budget as therein described on or before March 22, 1997. 13. Notwithstanding any inconsistent provisions of section 247 of such charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section hold hearings and submit recommendations as therein described not later than March 31, 1997. § 2. This local law shall take effect immediately and shall be deemed to have been in effect as of January 1, 1997.

L.L. 1997/012 Enactment date: 3/12/1997 Int. No. 832-A By Council Members Freed, Williams, Clarke, Duane, Linares, Pagan, Robles, Harrison, Rivera and Fields A Local Law to amend the administrative code of the city of New York, in relation to tattoo licenses. Be it enacted by the Council as follows: Section I. Declaration of legislative findings and intent. The Council of the City of New York finds that although it is currently illegal in the City of New York to apply tattoos, tattooists are nonetheless currently operating in the City without any standards or regulation. Without effective health regulation of tattooing, diseases can be transmitted to customers and tattooists through supplies and equipment. In recent years, there has been an increase in demand for tattoo services, resulting in an increasing number of New Yorkers being placed at risk for disease. The Council therefore finds it appropriate for the protection of the public health, safety and welfare of the citizens of New York City to enact legislation to regulate tattooing and tattooists. Such regulation will ensure that tattooists practice basic health and safety procedures necessary to competently engage in the practice of tattooing. The licensing of tattooists will permit the Department of Health to enforce safety standards for tattooists and impose penalties, including license suspension and revocation, for violations of such standards. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect ninety days after its enactment. Actions necessary to prepare for the implementation of this local law, including but not limited to the establishment of a pre-licensure examination as provided in section 17-358 of the administrative code of the city of New York as added by section two of this local law, shall be taken prior to its effective date.

Section 28 of local law 112 for the year 1993, as amended by section 2 of local law 89 for the year 1996, is amended to read as follows: § 28. This local law shall take effect one hundred twenty days after it shall have been enacted into law, provided, however, that sections six, ten, thirteen, fifteen, seventeen, twenty, twenty-one and twenty-four shall expire and shall be of no further force and effect on [April 28] December 31, 1997, and, provided, further, that the commissioner of consumer affairs may promulgate any necessary rules and take any other actions necessary for the timely implementation of this local law prior to such effective date. § 2. This local law shall take effect immediately and shall be retroactive to and shall be deemed to have been in full force and effect on April 28, 1997.

No. 938 By Council Member Berman (by the request of the Mayor); also Council Members Fisher, Povman and Ognibene (Preconsidered on April I 6, 1997) (passed under a message of necessity from the Mayor) A Local Law in relation to the date of issuance and publication by the Mayor of a ten-year capital strategy, the date of submission by the Mayor of the proposed executive budget and budget message, the date of submission by the Borough Presidents of recommendations in response to the Mayor's executive budget, the date of publication of a report by the director of the independent budget office analyzing the executive budget, the date by which the Council hearings pertaining to the executive budget shall conclude, the date by which if the expense budget has not been adopted, the expense budget and tax rate adopted as modified for the current fiscal year shall be deemed to have been extended for the new fiscal year until such time as a new expense budget has been adopted, the date by which if a capital budget and a capital program have not been adopted, the unutilized portion of all prior capital appropriations shall be deemed reappropriated, the dates of mayoral disapprovals of Council action and Council overrides thereof, the date of submission by the Mayor of an estimate of the probable amount of receipts, the date by which any person or organization may submit an official alternative estimate of revenues, the date by which if the Council has not fixed the tax rates for the ensuing fiscal year, the commissioner of finance shall be authorized to complete the assessment rolls using estimated rates, and related matters, relating to the fiscal year nineteen hundred ninety-eight. Be it enacted by the Council as follows: Section 1. During the calendar year 1997 and in relation to the 1998 fiscal year: 1. Notwithstanding any inconsistent provisions of section 248 of the New York City Charter, as added by vote of the electors on November 7, 1989, the Mayor shall pursuant to such section issue and publish a ten-year capital strategy as therein described not later than May 8, 1997. 2. Notwithstanding any inconsistent provisions of section 249 of such charter, as added by vote of the electors on November 7, 1989, the Mayor shall pursuant to such section submit a proposed executive budget and budget message as therein described not later than May 8, 1997. 3. Notwithstanding any inconsistent provisions of section 251 of such charter, as added by vote of the electors on November 7, 1989, each borough president shall pursuant to such section submit recommendations in response to the Mayor s executive budget as therein described not later than May 19, 1997. 4. Notwithstanding any inconsistent provisions of section 252 of such charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall pursuant to such section publish a report analyzing the executive budget as therein described not later than May 27, 1997. 5. Notwithstanding any inconsistent provisions of section 253 of such charter, as added by vote of the electors on November 7, 1989, the Council shall pursuant to such section hold hearings on the executive budget as therein described which shall conclude by May 30, 1997. 6. Notwithstanding any inconsistent provisions of subdivision d of section 254 of such charter, as added by vote of the electors on November 7, 1989, and subdivision b of section 1516 of such charter, as amended by vote of the electors on November 7, 1989, if an expense budget has not been adopted by June 10, 1997 pursuant to subdivisions a and b of section 254, the expense budget and tax rate adopted as modified for the current fiscal year shall be deemed to have been extended for the new fiscal year until such time as a new expense budget has been adopted. 7. Notwithstanding any inconsistent provisions of subdivision e of section 254 of such charter, as added by vote of the electors on November 7, 1989, if a capital budget and a capital program have not been adopted by June 10, 1997 pursuant to subdivisions a and b of such section, the unutilized portion of all prior capital appropriations shall be deemed reappropriated. 8. Notwithstanding any inconsistent provisions of subdivision a of section 255 of such charter, as added by vote of the electors on November 7, 1989, the Mayor may pursuant to such subdivision make any disapproval provided for therein no later than four days following the adoption of an expense budget, capital budget and capital program and, notwithstanding any inconsistent provisions of subdivision b of such section, as added by vote of the electors on November 7, 1989, the Council may pursuant to such subdivision override any such disapproval provided for therein no later than eight days following any such disapproval. 9. Notwithstanding any inconsistent provisions of subdivision a of section 1515 of such charter, as amended by vote of the electors on November 7, 1989, the Mayor shall pursuant to such subdivision prepare and submit to the Council an estimate of the probable amount of receipts as therein described not later than June 10, 1997. 10. Notwithstanding any inconsistent provisions of subdivision d of section 1515 of such charter, as added by vote of the electors on November 7, 1989, any person or organization may pursuant to such subdivision submit an official alternative estimate of revenues as described therein at any time prior to June 3, 1997. 11. Notwithstanding any inconsistent provisions of subdivision a of section 1516-a of such charter, as amended by vote of the electors on November 7, 1989, if the Council has not fixed the tax rates for the ensuing fiscal year on or before June 10, 1997, the commissioner of finance shall pursuant to such subdivision be authorized to complete the assessment rolls using estimated rates and to collect the sums therein mentioned according to law. The estimated rates shall equal the tax rates for the current fiscal year. 12. Notwithstanding any inconsistent provisions of subdivision b of section 1516-a of such charter, as amended by vote of the electors on November 7, 1989, if, subsequent to June 10, 1997, the Council shall, pursuant to section 1516 of such charter, fix the tax rates for the ensuing fiscal year at percentages differing from the estimated rates, real estate tax payments shall nevertheless be payable in accordance with subdivision a of section 1516-a of such charter at the estimated rates, where the commissioner of finance has exercised the authority granted by subdivision a of section 1516-a of such charter to complete the assessment rolls using estimated rates and to collect the sums therein mentioned according to law. However, in such event, prior to the first day of January in such fiscal year, the commissioner of finance shall cause the completed assessment rolls to be revised to reflect the tax rates fixed by the Council pursuant to section 1516 of such charter, and an amended bill for the installment or installments for such fiscal year due and payable on or after the first day of January shall be submitted to each taxpayer in which whatever adjustment may be required as a result of the estimated bill previously submitted to the taxpayer shall be reflected. § 2. This local law shall take effect immediately.

L.L. 1997/027 Enactment date: 5/5/1997 Int. No. 939 By Council Members Dear and Fisher (Read and referred to the Committee on Transportation) (Preconsidered April 8, 1997, Ordered, Printed and Laid Over) A Local Law to amend the administrative code of the city of New York, in relation to the food vending business Be it enacted by the Council as follows: Section I. Legislative findings and intent. The council finds that local law 15 for the year 1995 restricted the number of food vendor permits to be issued to those engaged in the food vending business to one full-term or temporary food vendor permit per individual, corporation, partnership or other business entity in order to stop the amassing of large numbers of permits by any one individual, corporation, partnership or other business entity, and the illegal leasing of such permits by some of these multiple permit holders for exorbitant sums of money. The council further finds that an unintended effect of such local law was the difficulty this one permit limitation created for certain small business owners who held multiple temporary permits and who are exclusive distributors or manufacturers of food such as ice cream sold on a seasonal basis on the streets of the City. These exclusive distributors or manufacturers must rely on their ability to maintain a certain number of pushcarts or vehicles that can legally purvey their food products on the City's streets during a limited season, and such pushcarts or vehicles each need a valid temporary food vendor permit from the City's Department of Health. Without more than one temporary permit, these exclusive distributors or manufacturers cannot maintain the requisite number of pushcarts or vehicles they need during their limited vending season to stay in business and to keep their product available to the City's residents, work force and visiting tourists. The council further finds that through the use of unissued temporary food vendor permits and as currently issued temporary food vendor permits are retired, those exclusive distributors or manufacturers who held multiple temporary food vendor permits before local law 15 for the year 1995 divested them of their additional permits should be allowed to again hold their multiple temporary food vendor permits up to a maximum of a total of sixty temporary food vendor permits. Moreover, multiple temporary food vendor permits should only be issued to persons who were in business as exclusive distributors or manufacturers at the time local law 15 for the year 1995 was enacted and such multiple permits should not be transferable. * * * [Consolidated provisions are not included in this Appendix A] * * * § 13. This local law shall take effect immediately, provided, however, that section nine of this local law shall not take effect until one hundred twenty days after the date of enactment of this local law, and, provided, further, that the commissioner of the department of health may promulgate any necessary rules and take any other actions necessary for the timely implementation of section nine of this local law prior to such effective date. Any person who has been issued more than one temporary permit pursuant to subitem (I) of item (B) of clause (ii) of subparagraph (a) of paragraph three of subdivision f of section 17-307 of the administrative code of the city of New York, as added by section five of this local law, who leases a vehicle or pushcart owned by such person with such person's temporary permit attached thereto to a person licensed as a food vendor pursuant to subchapter two of chapter three of title seventeen of such code shall be subject to the provisions of section nine of this local law on or after the effective date of such section.

The Brooklyn wholesale meat market, as described herein, shall be a public wholesale market for the purposes of section 1301 of the New York City charter and section 72-p of the general municipal law, as enacted by chapter five hundred six of the laws of nineteen hundred eighty-nine, and the commissioner of business services shall be authorized to exercise within the Brooklyn wholesale meat market all powers vested in the commissioner under the provisions thereof and this local law. The Brooklyn wholesale meat market shall consist of that area within the borough of Brooklyn beginning at the point where the westerly street line of first avenue intersects the center line of fifty-fourth street; thence southerly approximately eight hundred and eighty-six and four-tenths feet along the westerly street line of first avenue; thence westerly along a line perpendicular to first avenue to the United States pierhead line; thence northerly along the United States pierhead line to a point where the center line of fifty-fourth street as extended intersects the United States pierhead line; thence easterly along the center line of fifty-fourth street as extended to the point of beginning. § 3. Notwithstanding any other provision of this local law to the contrary, the provisions of chapter 1-B of title 22 of the administrative code of the city of New York as added by section 1 of this local law regarding: (1) the authorization of the commissioner of business services to require a wholesaler or market business to contract with an independent auditor contained in section 22-253 of such code; (2) requirements for the registration of a labor organization or labor union and the disqualification from office-holding in such organizations contained in sections 22-264 and 22-260 of such code as added by section 1 of this local law; and (3) requirements for the registration of a market business contained in section 22-253 of such code of the city as added by section 1 of this local law shall apply as of the effective date of this local law within the fulton fish market distribution area or other seafood distribution area as defined in section 22-202 of the administrative code; provided, however, that no enforcement of the provisions of such section 22-253 with respect to the registration of such market business, the registration of labor organizations or labor unions or the disqualification of officers of such organizations or unions, or the registration of wholesaler trade associations or the disqualification of officers of such associations shall take place until following the effective date of rules promulgated pursuant to this local law, except that, with respect to a market business doing business in the fulton fish market distribution area or other seafood distribution area as of the effective date of this local law the principals of which the commissioner has required to submit to fingerprinting and disclosure pursuant to section 22-258 of the administrative code as added by section 1 of this local law, no enforcement of such requirements shall take place unless and until such entity has failed to submit such fingerprints or disclosure within the time period specified by the commissioner or such registration has been denied. * * * [Consolidated provisions are not included in this Appendix A] * * * § 12. Be it enacted by the Council as follows: Section 1. Declaration of legislative findings and intent. The Council hereby finds and declares that the present procedures for the licensing of newsstands are inefficient and do not operate well in conjunction with procedures for the placement of other structures and objects on the City's sidewalks. In addition, the current method of regulating newsstands does not provide sufficient controls to address all of the concerns they present, including public safety and pedestrian traffic. A new approach needs to be formulated so that newsstands can adequately serve the public without, among other things, overcrowding the City's sidewalks and threatening pedestrian safety. An interagency Streetscape Task Force has examined the issue of structures and objects on the City's sidewalks and has developed a comprehensive plan to improve their crowded and often unsightly appearance. One of the key provisions of this plan is for the Department of Transportation to offer a single franchise for the design, construction, installation, and maintenance of a variety of structures and objects on the City's sidewalks, including newsstands, at no cost to the City (the "coordinated street furniture franchise"). The Department of Transportation would determine, pursuant to siting criteria and a consultative process with elected officials and community boards, and in consultation with the franchisee, the order in which and location where such newsstands would be built by such franchisee. The franchisee would be able to sell advertising space on such newsstands, and the City would receive a share of the gross revenue generated by such advertising or a fixed, guaranteed minimum annual amount, whichever is greater. As for the operation of new newsstand sites built by such franchisee, other than those built to replace an existing newsstand, a competitive system would be used to select the operator thereof. In this competitive system, preferences will be granted to all persons who currently receive legislative preferences for the grant of newsstand licenses pursuant to New York City Administrative Code § 20-230(a): disabled veterans; persons with disabilities as currently defined by the Department of Consumer Affairs; veterans who are not disabled; and persons over the age of sixty-two. Persons who fall into categories receiving preferences pursuant to New York City Administrative Code § 20-230(a) will continue to receive preferences; however, if at the end of the five year period during which current newsstand operators will remain in their newsstands or in newsstands built to replace those newsstands, a competitive system is implemented to select the operators of those newsstands or replacement newsstands, preferences will be granted to current newsstand licensees only until the date on which a competitive system is used to select an operator for a newsstand built by the selected franchisee to replace such licensee's newsstand, or until the date on which such licensee successfully bids for operation of a newsstand, whichever occurs first. The Council finds that current newsstand operators who have built and operated newsstands under the current licensing law should not, at least at this time, be put into this competitive system. However, there should be a moratorium on the issuance of newsstand licenses by the Department of Consumer Affairs and the City should receive revenues for the use of its sidewalks by newsstands. Therefore, pursuant to a determination made by the Department of Transportation regarding a particular newsstand location, persons who are newsstand licensees as of the effective date of this local law will be given the opportunity to become concessionaires at the site of the newsstands they have already built. As for the operation of newsstands built by such franchisee to replace existing newsstands, persons who are newsstand licensees as of the effective date of this local law who are operating existing newsstands pursuant to such licenses or who have been granted concessions to operate such existing newsstands will be given the opportunity to become concessionaires at the site of the newsstand built by such franchisee to replace such licensees' existing newsstands. Thus, for a period of five years after the effective date of this local law, persons who are newsstand licensees as of the effective date of this local law shall be able either to continue to operate their existing newsstands as licensees or concessionaires, or to operate newsstands built by the franchisee to replace their existing newsstands as concessionaires; provided, however, that nothing shall limit the Commissioner of Consumer Affairs' authority to revoke or suspend a newsstand license during such five year period, and nothing shall limit the Commissioner of the Department of Transportation's authority to terminate a newsstand concession during such five year period. The five years shall be calculated as the amount of time spent, in any combination, after the effective date of this local law, as either a licensee or a concessionaire of an existing newsstand site, or as a concessionaire of a newsstand built by the selected franchisee to replace such licensee's existing newsstand. Four years and three months after the effective date of this local law, the Commissioner of the Department of Transportation shall submit a report to the Council on the effectiveness of the newsstand concession program and the Mayor shall then submit a proposal as to the future operation of those newsstands which have continued to be operated by persons who are newsstand licensees as of the effective date of this local law. If the proposal is accepted or if the Council fails to act upon it within sixty days, it will take effect. If the Council rejects such proposal and fails to enact its own alternative, the Commissioner of the Department of Transportation may seek approval from the franchise and concession review committee for the continuation or renewal of concessions covering such newsstands and for the granting of concessions to such licensees who have continued to operate such newsstands as licensees. If such approval is not sought or not obtained, the Department of Consumer Affairs will reissue newsstand licenses to former newsstand licensees who had become concessionaires at such newsstands and will renew newsstand licenses that had continued to be held by such licensees. * * * [Consolidated provisions are not included in this Appendix A] * * * § 7. Four years and three months after the effective date of this local law, the department of transportation shall submit to the city council a report which shall include a comparison of the operation of those newsstands which have been competitively bid to those which have continued to be operated by former licensees who have become concessionaires at such former licensee's newsstand or at replacement stands installed and maintained pursuant to a franchise granted pursuant to chapter fourteen of the city charter. Such report shall compare the two types of newsstand operation with regard to revenue generated, turnover, amount of time in and out of operation, and any other factors which may be useful in determining the extent to which the newsstand operations are serving as adequate conduits for the dissemination of newspapers and periodicals, and shall explain any variables to which any of the information contained therein is subject. No later than thirty days after the submission of such report to the council, the mayor shall submit a proposal for the future operation of those newsstands which have continued to be operated by licensees or former licensees who have become concessionaires at such former licensees' newsstands or at replacement stands installed and maintained pursuant to a franchise granted pursuant to chapter fourteen of the city charter, after the date which is five years from the effective date of this local law. Within sixty days after the first stated meeting of the council following the receipt of such proposal, the council may approve, modify or reject the proposal by means of any appropriate legislative action. In the event the council fails to act with respect to the proposal within such sixty day period, the proposal shall be deemed to have been approved by the council. § 8. No newsstand which has continued to be operated by a licensee or former licensee who has become a concessionaire at such former licensee's newsstand or at a replacement stand installed and maintained pursuant to a franchise granted pursuant to chapter fourteen of the city charter, shall be the subject of an agreement entered into pursuant to a request for proposals, the term of which commences on a date which is more than five years after the effective date of this local law, unless (i) the mayor shall have recommended such action with regard to all newsstands operated by such licensees or former licensees in the proposal required pursuant to section seven of this local law and (ii) the council shall have approved such proposal pursuant to such section. Provided, however that the prohibition contained in this section shall not apply if such licensee or former licensee has (i) declined to enter into a concession agreement in the case of a licensee, or declined a continuation or renewal of a concession agreement covering such newsstand or replacement stand in the case of a former licensee, (ii) declined the renewal or reissuance of such operator's license proffered by the department of consumer affairs in accordance with section nine of this local law, or (iii) such person has been determined to be unfit to operate a newsstand as a concessionaire or licensee. § 9. If the council rejects the mayor's proposal in accordance with section seven of this local law, the department of transportation may seek to obtain approval for the continuation or renewal of concessions covering newsstands operated by former newsstand licensees at such former licensees' newsstands or at replacement stands installed and maintained pursuant to a franchise granted pursuant to chapter fourteen of the city charter, and for the granting of concessions to newsstand licensees who have continued to operate newsstands as licensees. If the department of transportation does not seek such approval or approvals, or such approval or approvals are not obtained, the department of transportation shall inform the department of consumer affairs, and, notwithstanding the provisions. contained in subdivisions d and f of section 20-229 of subchapter seven of chapter two of title twenty of the administrative code of the city of New York as added by section three of this local law, the department of consumer affairs shall reissue newsstand licenses to such former licensees for the locations at which they are operating such newsstands and shall renew newsstand licenses that continue to be held by licensees at an annual fee of five hundred thirty-eight dollars. Such reissued and renewed licenses shall be subject to all of the requirements of subchapter seven of title twenty of the administrative code relating to newsstands as amended by this local law, provided, however, that such licenses shall not be subject to cancellation as provided in subparagraph b of paragraph one of subdivision f of section 20-229 of such code as added by section three of this local law. § 10. Nothing contained herein shall affect the concessions granted by the department of transportation pursuant to section three hundred seventy-four of the city charter to operate newsstands installed and maintained pursuant to a franchise granted pursuant to chapter fourteen of the city charter where such newsstands do not replace existing newsstands. § 11. This local law shall take effect immediately.

In 1990, after a free election in Burma in which Nobel Peace Prize winner Aung San Suu Kyi's National League for Democracy (NLD) won 80% of the Parliamentary seats, the State Law and Order Restoration Council (SLORC) arrested, murdered and exiled such elected members of the NLD and annulled the election. Aung San Suu Kyi was placed under house arrest. Since then, thousands of civilians have been killed, arrested, tortured or forced out of Burma as a result of brutal government repression. The SLORC has conducted extensive military operations against ethnic groups within Burma. Additionally, the SLORC has refused to implement recommendations adopted by the United Nations General Assembly in December, 1993 and the United Nations Human Rights Commission in March, 1994. The United States has already imposed a ban on new U.S. investment in Burma, suspended all economic and military aid to Burma, imposed an arms embargo against the country, ended some low tariffs that had applied to its products and blocked the international Monetary Fund and the World Bank from making loans to Burma. The system of oppression by the SLORC is illegal and contrary to international laws and covenants. It being morally repugnant to the citizens of the City of New York and the New York City Council, the City of New York as an expression of moral outrage at the SLORC' s continuing human rights violations in Burma does hereby set forth a municipal policy restricting its business with banks and companies doing business in Burma. * * * [Consolidated provisions are not included in this Appendix A] * * * § 5. Legislative findings. The council hereby finds that city regulation of gambling "cruises to nowhere" that operate from locations within New York city is necessary to ensure public confidence and trust in such activities and to safeguard the security of the public who participate in them. Gambling activities are particularly susceptible to criminal activity and have historical associations with organized crime control. Like the legislatures in other jurisdictions, such as New Jersey and Nevada, which have acted to protect consumers from fraudulent practices and to prevent gambling from providing new opportunities for organized crime, the council finds that public confidence and trust can only be achieved and sustained by a regulatory system that ensures that such gambling operations will not be controlled or influenced by persons with criminal records and associations or associations with organized crime. The council therefore finds that it is necessary to require that businesses that operate gambling "cruises to nowhere" using vessels embarking from New York city, and their employees and suppliers, be licensed by the city and that the standards for the issuance of such licenses allow for the denial of licenses to entities and individuals unable to demonstrate that they possess good character, honesty and integrity. The council finds further that in order to provide for effective regulation to ensure the lawful operation of gambling on vessels operating from New York city, it is necessary to establish a gambling control commission that shall be responsible for the licensing and regulation of businesses that conduct shipboard gambling. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. The provisions of this local Law shall be severable and if any phrase, clause, sentence, paragraph, subdivision or section of this local Law, or the applicability thereof to any person or circumstance, shall be held invalid by any court of competent jurisdiction, the remainder of this local Law and the application thereof shall not be affected thereby. § 4. The New York city gambling control commission is hereby authorized, immediately upon the effective date of this local law, to develop application and disclosure forms for the purposes of applications for licenses, certificates of approval and registrations pursuant to sections 20-954 and 20-955 of the administrative code of the city of New York, as added by section 2 of this local law, to establish fees for such applications and for background investigations, and to require the submission of such application and disclosure forms and fees within thirty days of having made such forms available by shipboard gambling businesses in operation as of such date, by persons employed as of such date by such businesses and, within sixty days, by vendors that would be subject to the provisions of sections 20-954 or 20-955 of the administrative code of the city of New York as added by section 2 of this local law. The commission shall, before the date on which application and disclosure forms are made available to vendors pursuant to this section, develop and make available a list of categories of vendors and/or amounts of sales of such goods or services that do not require obtaining a license as a key vendor or registration as an auxiliary vendor and may waive the requirement for a license or registration when, in its discretion, such license or registration is unnecessary to achieve the purposes of this local law. In addition, the chair of the commission may grant permission to a shipboard gambling business authorized to operate pursuant to section 5 of this local law to purchase goods or services on an expedited basis from an unlicensed or unregistered vendor when such purchase is necessary for the operation of such business. The commission shall, in addition, establish a procedure for the preliminary review of applications submitted by shipboard gambling business operating in New York city on or before one hundred and eighty days following the effective date of this local law and for provisional authorization for such businesses to operate following such preliminary review, pending completion of full review. At any time during or following such preliminary review that the commission finds reasonable cause to believe that an applicant lacks good character, honesty and integrity or that there are other reasons that may lead to the denial of a shipboard gambling license pursuant to section 20-956 of the administrative code of the city of New York, as added by section 2 of this local law, the commission may, in its sole discretion, refuse to issue a provisional authorization or revoke such an authorization. A provisional authorization to operate a shipboard gambling business granted by the commission pursuant to this section shall be deemed void upon the issuance or denial of an application for a shipboard gambling license. § 5. This local law shall take effect immediately, provided, however, that: (i) no enforcement of the requirement for a shipboard gambling license shall take place with respect to a shipboard gambling business operating on or before January 8, 1997 that has submitted completed application and disclosure forms and the fees established pursuant to section 4 of this local law to the New York city gambling control commission no later than thirty days following the date on which such forms have been made available by the commission and such application has not been denied; (ii) no enforcement of the requirement for a shipboard gambling license shall take place with respect to a shipboard gambling business operating in New York city on or before one hundred eighty days following the effective date of this local law that has submitted completed application and disclosure forms and the fees established pursuant to section 4 of this local law to the New York city gambling control commission and such application has not been denied, provided that such business has received a provisional authorization to operate from the New York city gambling control commission pursuant to section 4 of this local law and such provisional authorization has not been revoked or an application for a license been denied; (iii) no enforcement of the requirement for a key vendor license or a vendor registration shall take place with respect to a vendor furnishing goods or services to a shipboard gambling business described in (i) of this section where the vendor was furnishing goods or services prior to the effective date of this local law and such vendor has submitted completed application and disclosure forms and the fees established pursuant to section 4 of this local law to the New York city gambling control commission no later than sixty days following the date on which such forms have been made available by the commission pursuant to section 4 of this local law and such application has not been denied; provided that the commission shall make provision for temporary permission for a shipboard gambling business operating pursuant to this section to purchase goods or services from a vendor that has not provided goods or services to such business prior to the effective date of this local law provided that such vendor has submitted completed application and disclosure forms to the commission upon agreement to provide goods or services and such application has not been denied; (iv) no enforcement of the requirements set forth in subdivision 1 of section 20-963 of the administrative code of the city of New York, as added by section 2 of this local law shall take place with respect to a shipboard gambling business described in (i) of this section until ninety days following the date upon which applications and disclosure forms have been made available by the commission; (v) no enforcement of the requirement for a key vendor license or registration shall take place with respect to a vendor furnishing goods or services to a business described in (ii) of this section where such vendor has submitted completed application and disclosure forms to the commission by the time the provisional authorization has been issued to such business pursuant to section 4 of this local law and such application has not been denied; (vi) no enforcement of the requirement for a key employee license, a certificate of approval or an employee registration shall take place in regard to a person employed by a shipboard gambling business described in (i) of this section who has submitted the forms and the fees required by the commission no later than thirty days following the date on which such forms have been made available by the commission and such application has not been denied; (vii) no enforcement of the requirement for a key employee license, a certificate of approval or an employee registration shall take place in regard to a person employed by a shipboard gambling business described in (ii) of this section who has submitted the forms and the fees required by the commission no later than the date on which such business has been issued a provisional authorization by the commission and the application has not been denied; (viii) provided that the commission shall make provision for temporary permission for a shipboard gambling business operating pursuant to this section to employ persons who were not employed by such business prior to the effective date of this local law or at the time provisional authorization was issued to such business, provided that such persons have submitted completed application and disclosure forms and such application has not been denied.

The findings were compiled in a June 1997 report prepared by the department of environmental protection entitled, "The Impact of Food Waste Disposers in Combined Sewer Areas of New York City." In short, the study found that the prohibition on the installation of food waste disposals in combined sewer areas should be lifted. The study assessed the long-term impact of food waste disposals based on a maximum installation rate of one percent each year. The department of environmental protection has assured the council that it will supplement its ongoing monitoring of other factors that affect the City's treatment and disposal of wastewater by monitoring the introduction of food waste disposals to identify any problems that may materialize. In the unlikely event that problems do begin to surface, the department of environmental protection has further assured the council that it will immediately inform the council and recommend corrective action. With these assurances by the department of environmental protection, and in consideration of its own authority to oversee the implementation and effect of the installation of food waste disposals, the council finds, after review and analysis of the report, that at this time the prohibition of food waste disposals in combined sewer areas is no longer warranted. * * * [Consolidated provisions are not included in this Appendix A] * * * § 4. Legislative findings. In 1970, the city council enacted local law 30 which made fundamental reforms in computing rent increases for residential dwellings subject to the New York city rent and rehabilitation law (rent control). Included among these reforms was the establishment of the maximum base rent formula, which is used today to compute the maximum rent that may be charged for a rent controlled apartment for the ensuing two-year period. The maximum base rent formula is based upon several cost components plus an eight and one-half percent return on capital value, where "capital value" is defined as equalized assessed valuation using the special state equalization ratio established pursuant to article 12-A of the New York state real property tax law (RPTL). At the time of local law 30's enactment, the only other official equalization measurement in existence was the article 12 (RPTL) state equalization rate, which, like the article 12-A special state equalization ratio, provided an equalization ratio of assessments to market values for all taxable real property situated in New York city. Although the article 12 state equalization rate and the article 12-1. Special state equalization ratio were numerically similar at that time, the council selected the article 12-A special state equalization ratio for computing capital value. It is the council's understanding that, at the time, the article 12-A special state equalization ratio closely and more accurately reflected the current market values of all taxable real property in New York city so as to provide the best possible measurement for computing "capital value". However, since the enactment of local law 30 the city has altered the way in which it assesses property. Beginning in 1981 with the state legislature's enactment of chapter 1057, all properties in the city of New York were classified into one of four classes, with class one consisting of residential dwellings of three units or less, class two consisting of multiple dwellings of four units or more, class three consisting of utility property and class four consisting of all other property not designated as class one, two or three, predominantly commercial. Under this class structure system, class two residential property is assessed at a substantially higher percentage of the fair market value than class one. Because the article 12-A special state equalization ratio reflects the average assessment ratio for all four classes of property, using it to compute equalized assessed valuation for class one and class two properties only, produces distorted values for each of these classes. More specifically, using the article 12-A special state equalization ratio to compute equalized assessed valuation artificially inflates the capital values for class two properties resulting in a doubling of the statutory eight and one-half percent return on capital value, while at the same time, it artificially decreases the capital values for class one properties, resulting in a return on capital value that is less than half of the statutory rate. In light of the statutory eight and one-half percent return on capital value, the unforeseen result of a return on a distorted measure of capital value, described above, is contrary to the obvious intent of local law 30. In 1989, the New York state division of housing and community renewal, which also acknowledged the gross inequity and unintended consequence that results from the utilization of the article 12-A special state equalization ratio, began using the more appropriate ratio, the article 12 tax class ratio, and continued to do so to the present. Since the creation of the class structure system the state has provided a separate ratio of assessed value to market value for each class of property. The council finds that the article 12 tax class ratio provides a more accurate measure of the value of properties for a particular class than the article 12-A special state equalization ratio because the article 12 tax class ratio measures the value of those properties within that particular class as opposed to the article 12-A special state equalization ratio which measures the value of all real property within the city, including one-, two- and three-family dwellings, utility property and commercial property, for the purpose of establishing the city's constitutional tax and debt limits. By requiring the appropriate tax class ratio established pursuant to article 12 to be used in calculating equalized assessed valuation, this local law fulfills the obvious intent of the council in a way that fairly serves both landlords and tenants. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. Notwithstanding any other provision of this local law, the standard adjustment factor for the 1996/97 maximum base rent cycle shall be computed in accordance with the provisions of section 2 of this local law. § 4. Local Law 115 contained a provision by which the Council could, at its discretion, review those commuter van service applications which were approved by the Taxi and Limousine Commission and could, by local law, either approve or disapprove those determinations. In the two years since the first commuter van service application became subject to Council review the Council has chosen to review each approval of a commuter van service that was presented to it and, in fact, has approved more determinations than it has disapproved. However, the independent analyses conducted by the Council during its review of these applications has disclosed significant weaknesses in the manner in which the Taxi and Limousine Commission and the New York City Department of Transportation, the agencies charged under Local Law 115 with evaluating those applications, meet that obligation. Moreover, it has become readily apparent that the decisions made by those agencies to authorize the operation of a commuter van service in specific geographic areas have been made without the benefit of any comprehensive study having been made of where in the City commuter vans are needed as a complement to existing mass transit services, not as competitors, the number of vans actually necessary to provide this complementary service, the hours during which complementary service is really needed and concerns related to traffic congestion and physical safety as the number of commuter vans proliferates. Recognition of this deficiency led the Department of City Planning to initiate a Commuter Van Service Policy Study this Spring, whose mission includes identifying areas underserved by existing mass transit and the creation of a Technical Advisory Committee comprised largely of representatives from a number of City, State and Federal agencies. A Final Report is scheduled to be completed by March 31, 1998. Finally, for many years, even prior to the enactment of Local Law 115, many members of the Council have decried the lack of effective enforcement against those who operate commuter van services without legal authorization and those with legal authorization to operate but who do so in an illegal manner. For these reasons, it is the strongly held view of the Council that no further applications for authorization to operate or expand the operations of commuter van services should be approved for a period of one year during which period the Final Report of the Department of City Planning should be issued and the Council will have had a reasonable period of time to consider its contents, and/or until the Council has conducted its own study of these issues. During this period the Council will also have a fair and reasonable opportunity to consider regulatory changes which may be appropriate and to undertake any necessary legislative action. * * * [Consolidated provisions are not included in this Appendix A] * * * § 4. Twenty-five years ago, when the comprehensive New York City Noise Control Code was enacted, it was declared as the public policy of the City that "... every person is entitled to ambient noise levels that are not detrimental to life, health and enjoyment of his or her property ..." and that "... the making, creation or maintenance of excessive and unreasonable noises within the city affects and is a menace to public health, comfort, convenience, safety, welfare and the prosperity of the people of the city." The ability of the City's residents, workers and visitors to secure a minimum level of quiet and freedom from noise is critical to the quality of life and the enjoyment of their homes, workplaces, places of recreation and the exterior environment. It is axiomatic that strong enforcement is essential to the effectiveness of any regulatory program and a significant component of such enforcement is the penalty to be imposed for a violation of the law. Strong civil penalty provisions serve as a deterrent to violations of the Noise Control Code and preserve and advance the public policy reflected therein. However, it is the view of the Council that the existing civil penalties no longer serve as an adequate deterrent. This bill strengthens enforcement by establishing two new tiers of civil penalties in which those penalties are substantially increased for a second violation of the same provision of the Noise Control Code by the same person and for third and subsequent violations of the same provision of the Noise Control Code by the same person. The Council also declares that nothing in this legislation is intended to limit the authority of the Environmental Control Board to issue "cease and desist" orders under existing provisions of the Noise Control Code. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. Legislative Findings of Fact and Declaration of Policy. The Council hereby finds that it is essential to the safety and well-being of the residents of the City of New York that members of the New York City Police Department be held to the highest standard of conduct and integrity in the performance of their professional responsibilities. As a society, we confer upon police officers the power to make arrests and, where necessary, use force, in order to protect public order, prevent crime and apprehend criminals. If the trust and confidence of the public is to be maintained, members of the police force must conduct themselves honestly, in a manner commensurate with the high degree of trust placed in them. The Council finds that the vast majority of police officers discharge their duties honestly and with integrity. A relatively small number of police officers, however, have been found to engage in serious criminal activities, particularly in connection with the illegal drug trade. This was the finding of the Commission to Investigate Allegations of Police Corruption and the Anti-Corruption Procedures of the Police Department, better known as the "Mollen Commission." In July 1994, after an extensive investigation lasting almost two years, the Mollen Commission issued its final report. Among its key findings, the Commission concluded that the Police Department's internal anti-corruption systems had been allowed to deteriorate to the point where they "minimized, ignored and at times concealed corruption, rather than root it out." The Commission concluded that the Department must retain primary responsibility for policing itself and maintaining integrity within its ranks. To that end, the Commission recommended a "dual track approach" calling for reform of the Department's internal anti-corruption structure and the creation of an independent police monitor to insure that the structure is working effectively. The Council finds, as did the Mollen Commission, that once the glare of publicity has dimmed, the Police Department's commitment to zealously root out corruption will eventually diminish unless an independent entity continues to closely monitor the Department's anti-corruption efforts as well as independently investigate allegations of illegal activities. The purpose of this legislation is to create such an independent mechanism based upon the model proposed by the Mollen Commission. The Independent Police Investigation and Audit Board created herein will have both the power to audit and examine the Police Department's own anti-corruption efforts and the ability to conduct independent corruption investigations backed by the power to issue subpoenas. It is, however, the Council's intention that the Police Department continue to have the primary responsibility for detecting and preventing internal corruption. The Council is also aware of the vital role played by other offices, such as the City's District Attorneys, in exposing and prosecuting acts of official corruption. The Council recognizes the need for cooperation and coordination among the responsible agencies in order to avoid duplication of efforts and interference with ongoing investigations and other legitimate law enforcement activities. For these reasons, the legislation requires the Board to enter into protocols with the Police Commissioner, the District Attorneys and the Civilian Complaint Review Board in order to create a structure in which such cooperation and coordination will be facilitated. On November 23, 1994, after extensive public debate and consideration, the Council adopted Int. No. 402-A, which created an Independent Police Investigation and Audit Board. The legislation was vetoed by Mayor Giuliani on December 23, 1994. On January 19, 1995, the Council overrode the Mayor's veto, and Int. No. 402-A became Local Law 13 of 1995. Subsequently, Mayor Giuliani instituted a judicial proceeding against the City Council seeking to declare Local Law 13 invalid. On June 28, 1995, Justice Beatrice Shainswit of the New York State Supreme Court, New York County, held Local Law 13 to be invalid on the ground that, absent a referendum, the Council's power to appoint members of the Independent Police Investigation and Audit Board unlawfully interfered with the Mayor's authority to appoint "officers of the City" pursuant to § 6(a) of the Charter. The court found that the Board's authority pursuant to Local Law 13 to "assist the police department to formulate and implement policies to detect and eliminate corruption" was sufficient to confer the status of "officers of the City" upon Board members, for the purposes of Charter § 6(a). On January 9, 1997, the First Department of the Supreme Court Appellate Division affirmed the Supreme Court's ruling that Local Law 13 was invalid. The Appellate Division's sole basis for this ruling was that the law interfered with the Mayor's appointment powers under the Charter. The Appellate Division declined to sever the Council's appointment power from Local Law 13, pointing to the fact that the law was adopted without a severability clause. The Court failed to give effect to § 1153 of the Charter, which expressly provides that "[i]f any provision of this charter ... shall be held invalid or ineffective in whole or in part or inapplicable to any person or situation, it is the purpose and intent of this charter that all other provisions thereof shall nevertheless be separately and fully effective and that the application of any such provision to other persons or situations shall not be affected." The New York State Court of Appeals has refused to grant the Council leave to appeal the decision of the Appellate Division. It is therefore the intention of the Council to amend and re-adopt the disputed legislation, curing those purported legal defects found by the two lower courts. The Council hereby reaffirms its conviction that the creation of an Independent Police Investigation and Audit Board would benefit the police force and enhance the public's trust and confidence in the Police Department. In order to address the issues raised by the courts, the five members of the Board created by this legislation shall be appointed by the Mayor; two of those members shall be designated by the City Council. The chair shall be appointed by the Mayor after consultation with the Speaker of the Council. This appointment structure is based on that of the Civilian Complaint Review Board (Charter § 440(b)(1)) and the Campaign Finance Board (Charter § 1052(a)(1)). Contrary to the finding of the lower court, it was not the Council's intention to vest the Board with policy-making authority by allowing it to "assist" the Police Department to formulate and implement policies to detect and eliminate corruption. The plain language of the bill, and the statement of legislative intent, made clear that the legislation was not intended to interfere with the Police Commissioner's primary role in investigating corruption and disciplining members, nor the executive authority to manage the Police Department. In order to clarify the Council's intention in this regard, the language of the bill has been amended to permit the Board to make non-binding recommendations to the Police Department regarding the formulation and implementation of anti-corruption policies and programs, similar to its authority to make recommendations for the improvement of the Department's anti-corruption systems. Finally, an express severability clause is contained in the law, making clear the Council's intention that should any portion of the law be held invalid, the court should use its power to strike only the invalid portion of the law, leaving the rest intact. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3.
