9-88-010 Traffic regulations and vehicle laws - Enforcement. (a) It shall be the duty of the superintendent of police to enforce the traffic regulations of this city and all of the state vehicle laws applicable to street traffic in this city, to make arrests for traffic violations, to investigate crashes and to cooperate with the commissioner of transportation, the executive director of emergency management and communications and other officers of the city in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties imposed by the traffic code or other ordinances of this city. (b) Officers of the police department and traffic control aides are authorized to direct all traffic by voice, hand or signal in conformance with traffic laws or ordinances. In the event of fire or other emergency or in order to expedite traffic or safeguard pedestrians, officers of the police department, sworn members of the fire department and traffic control aides may direct traffic contrary to traffic control devices as conditions may require. (c) Any person who is found guilty of circumventing, ignoring or disobeying any direction or order authorized by subsection (b) of this section shall be subject to a fine of not less than $100.00 and not more than $300.00 for the first offense and not less than $300.00 and not more than $500.00 for each subsequent offense occurring within 12 consecutive months. Municipal Code of Chicago § 9-88-020 Traffic violation notices.

9-88-020 Traffic violation notices. (a) Traffic violation notice forms for notifying violators to appear and answer to charges of violating traffic laws and ordinances in the Circuit Court of Cook County and the corresponding complaint forms therefor, in serially numbered sets consisting of three copies of the notices and one copy of the corresponding complaint shall be provided in books and in the form prescribed and approved jointly by the corporation counsel and the superintendent of police. The superintendent of police shall be responsible for the issuance of such books, shall maintain a record of every such book and each set of notices and complaint therein issued to the individual members of the police department, shall require and retain a receipt for every book so issued, and shall require the return to him of a copy of every traffic violation notice issued by a member of the police department and of all copies of every traffic violation notice and the corresponding complaint which have been spoiled or upon which any entry has been made and not issued to an alleged violator. (b) Every police officer or traffic control aide, upon issuing a traffic violation notice to an alleged violator of any provision of the motor vehicle laws of the state or of any traffic ordinance of this city shall deposit the corresponding traffic violation complaint of the notice with his immediate superior officer who shall cause the complaint to be filed in the Circuit Court of Cook County. 9-88-030 Disposal of traffic or parking notices, complaints and records. It shall be unlawful and official misconduct for any police officer, traffic control aide or other officer or public employee to dispose of a traffic or parking or compliance violation notice or copies thereof, a traffic or parking or compliance violation complaint, or the record of the issuance of a traffic or parking or compliance violation notice in a manner other than as required in the traffic code. Municipal Code of Chicago § 9-88-040 Traffic reports.

9-88-040 Traffic reports. (a) The police department shall receive and properly file all crash reports made to it under state law or under any ordinance of this city, but all such crash reports made by drivers shall be for the confidential use of the police department, the corporation counsel, the commissioner of transportation, and other officers of the city for official use. All other crash reports made by police officers or others may be furnished to persons or organizations having an interest therein, and the police department shall charge a fee of $5.00 for each such report or, in the case of a crash which was investigated by a crash reconstruction officer or crash reconstruction team, $20.00 for each such report. The police department shall also maintain a suitable record of all traffic crashes reported for each driver. (b) The police department shall maintain records of all crashes in which the use of a mobile, cellular, analog, wireless or digital telephone while driving is a contributing factor. (c) The superintendent of police shall annually prepare a traffic report which shall be filed with the mayor and the city council. Such report shall contain information on: (1) the number of traffic crashes, the number of persons killed, the number of persons injured and the other pertinent traffic crash data; (2) the number of traffic crashes investigated and other pertinent data on the safety activities of the police; (3) the plans and recommendations of the superintendent of police for future traffic safety activities. (d) Whenever the crashes at any particular location become numerous, the superintendent of police shall cooperate with the commissioner of transportation in conducting studies of such crashes and determining remedial measures.
