2-32-010 Department established - Composition. There is hereby established an executive department of the municipal government of the city which shall be known as the department of finance, and shall embrace the offices of city comptroller and city treasurer. (Prior code § 7-1)

Municipal Code of Chicago § 2-32-020 Comptroller - Office created - Appointment.

2-32-020 Comptroller - Office created - Appointment. There is hereby created the office of city comptroller who shall be the head of the department of finance and shall have the management and control of all matters and things pertaining thereto. Municipal Code of Chicago § 2-32-030 Comptroller - Powers and duties as fiscal agent.

2-32-030 Comptroller - Powers and duties as fiscal agent. The Comptroller shall be the fiscal agent of the City and as such shall be charged with and shall exercise general supervision over all officers of the City charged in any manner with the receipt, collection or disbursement of the City revenues and all funds required to be in the custody of the City Treasurer. The Comptroller shall have charge of all contracts, judgment-orders, notes, bonds, and evidences of indebtedness belonging to the City except such as are directed by law or ordinance to be deposited elsewhere. He shall have supervision of the issuance and sale of all bonds, warrants, and obligations. The Comptroller shall have the power to enter into agreements, including data-sharing agreements, with agencies of the county, state, and federal governments, and their respective designees, as may be necessary or useful to aid in the collection and allocation of revenues. Any such agreement may provide for indemnification, and any City expenditure pursuant to such an agreement shall be subject to the availability of duly appropriated funds. It shall be the duty of the City of Chicago’s Chief Financial Officer to post City Asset Lease Agreements and accounting information detailing the utilization of City asset lease proceeds as required by Section 2-32-035 on the City of Chicago, Department of Finance website. Municipal Code of Chicago § 2-32-031 Debt management policies; retention of rebate calculation agents, financial advisors, consultants, dissemination agents and qualified independent representatives.

2-32-031 Debt management policies; retention of rebate calculation agents, financial advisors, consultants, dissemination agents and qualified independent representatives. (a) The chief financial officer and the comptroller shall each have authority to retain, in connection with debt obligations issued by the City, such rebate calculation agents as either such officer may deem necessary or desirable in order for such debt obligations to comply with applicable requirements of the Internal Revenue Code. (b) The chief financial officer shall have authority to retain, in connection with financial products and debt obligations purchased, entered into and/or issued by the City, such advisors to provide structuring, timing and related advice for such financial products and debt obligations, as deemed necessary in compliance with the applicable requirements of the Dodd-Frank Wall Street Reform and Consumer Protection Act, Public Law 111-203, and the regulations in connection therewith. (c) The chief financial officer shall have authority to retain, in connection with debt obligations issued by the City, such qualified independent representatives for selecting, retaining and monitoring the performance of the City's interest rate exchange agreements, as deemed necessary or desirable in order for such interest rate exchange agreements to comply with applicable requirements of the Dodd-Frank Act and the regulations in connection therewith. As used in this section, "interest rate exchange agreements" shall mean those certain interest rate exchange agreements entered into pursuant to an ordinance of the city council authorizing the issuance of a series of bonds. (d) The chief financial officer shall have authority to adopt written policies which shall address the management of the city's bond, note and other debt issuances, including the entering into of interest rate exchange agreements and hiring of advisors in connection therewith. The chief financial officer may amend such written policies from time to time. Copies of each such written policy and any amendments thereto shall be kept on file with the comptroller. (e) The chief financial officer shall have authority to retain, in connection with debt obligations issued by the City, such dissemination agents to assist with continuing disclosure requirements under continuing disclosure agreements entered into by the City in connection with City debt obligations as deemed necessary or desirable in order to ensure ongoing compliance with Rule 15c2-12 of the Securities and Exchange Commission and any successor or similar disclosure requirements of the federal or state government. (f) In connection with proposed acquisition and/or disposition of existing or new sources of revenue, whether by the City or sister agencies or entities acting on behalf of or for the benefit of the City or sister agencies (including through the issuance of debt obligations or other means), the chief financial officer shall have authority to retain financial advisors and consultants to provide to the City structuring, timing and related advice for such proposed transactions. (g) In connection with the administration of workers' compensation and other insurance claims payable, per the annual appropriation ordinance, from the Chicago Midway Airport Fund and the Chicago O'Hare Airport Fund, and as needed to secure insurance agreements entered into by the Comptroller covering construction and operations at Chicago O'Hare International Airport and Chicago Midway International Airport, the Chief Financial Officer is authorized to obtain one or more letters of credit, lines of credit, or tri-party trust agreements (collectively, for purposes of this subsection, "security instruments"). Such security instruments may provide for indemnification. Each such security instrument, if applicable, shall bear interest at a rate or rates not to exceed seven percent (7%) per annum. The sum total of all such security instruments at any one time outstanding shall not exceed an aggregate of fifty million dollars ($50,000,000). Terms exceeding these limits shall be approved by the City Council. (h) (1) In connection with revenues from operation of any casino located within the City pursuant to a temporary operator permit or owners license issued by the Illinois Gaming Board, the Chief Financial Officer shall have authority to enter into agreements, instruments and other documents and provide consents, waivers or approvals as contemplated under the Host Community Agreement referenced in Section 13 of this ordinance (the "Host Community Agreement"), and perform any other ministerial acts necessary for the administration of the Host Community Agreement. (2) Notwithstanding subparagraph (h)(1), no material amendment or change to: (i) the Host Community Agreement; or (ii) any such agreement, instrument or other document referenced in subparagraph (h)(1), shall be made or be effective unless ratified or authorized by an ordinance duly adopted by the City Council. The term "material" for the purpose of this subsection (h) means any deviation in terms which operates to cancel or otherwise reduce any developmental, construction, sourcing or job-creating obligations of the casino developer by more than ten percent (10%) or materially changes the casino project sites or character of the casino project or the activities undertaken by the casino developer affecting the casino project sites, the casino project, or both, or increases any time agreed for performance by the casino developer by more than ninety (90) days. (3) The Chief Financial Officer shall have the authority to retain financial advisors, consultants and services firms to provide the City advice and services in connection with administering, or otherwise relating to any activities contemplated by or arising from, any such Host Community Agreement. (4) Any City revenues from operation of a casino within the City shall be subject to appropriation by the City Council. (Added Coun. J. 7-28-10, p. 96442, § 27; Amend Coun. Municipal Code of Chicago § 2-32-033 Comptroller as director of revenue.

2-32-033 Comptroller as director of revenue. For purposes of any law, statute or regulation that references the director of revenue or department of revenue of the City of Chicago, the comptroller and the department of finance shall occupy those roles, respectively. Municipal Code of Chicago § 2-32-035 City Asset Lease Agreements (C.A.L.A.) disclosure ordinance.

2-32-035 City Asset Lease Agreements (C.A.L.A.) disclosure ordinance. (a) The following City Asset Lease Agreement documents and any future lease agreements worth more than $10,000,000 shall be made publicly available as electronic, searchable files on the City of Chicago's Department of Finance website: 1. The ordinances establishing the leasing of or long-term concession concerning the Chicago Skyway Toll Bridge System, the Chicago Downtown Public Parking System, the Chicago Metered Parking System. 2. Any introduced legislation pertaining to proposed City asset lease agreements, worth more than $10,000,000, including all attachments and any amendments thereof, prior to its referral to the appropriate Chicago City Council Committee. 3. Any future City asset lease agreements approved by the Chicago City Council and worth more than $10,000,000, including all attachments, and any amendments thereof. 4. A separate accounting document detailing the allocation of lease proceeds including, but not necessarily limited to, appropriations, investments, interest income earned, and distributions to future budget years. This document should also detail the payment of all fees and expenses related to the lease transaction. Additionally, the document should list the names and fees paid to all financial consultants, auditors and/or financial institutions hired by the city to invest and manage City asset lease proceed funds. 5. A quarterly update of the accounting document for each city asset lease agreement. The Chief Financial Officer/Comptroller shall submit such update to the Chairman of the Committee on Finance and/or post such update on the Department of Finance's website, and shall appear before that Committee to present the status of each agreement where appropriate or necessary. (b) In addition to the requirements set forth in subsection (a) of this section, any future lease agreements worth $400,000,000 or more shall be subject to the requirements set out in Chapter 2-164 of this Code. Municipal Code of Chicago § 2-32-040 Comptroller - Supervision of bonds and sureties.

2-32-040 Comptroller - Supervision of bonds and sureties. Except where otherwise provided, all indemnifying bonds required to be given by any person to the city to insure the performance or carrying out of any contract entered into with the city, or the observance and performance of any ordinance of the city, or of any other obligation, promise, or undertaking shall be subject to the approval of the city comptroller. It shall be the duty of the comptroller, if at any time it comes to his knowledge that any or all of the sureties on any such bond or any indemnifying bond required to be filed with the city clerk are insolvent or will be unable to respond in damages in case any liability shall arise upon any such bond, to notify forthwith the principal or principals upon such bond of such fact, and direct that different and satisfactory sureties be at once procured. It shall be the duty of the comptroller to make, from time to time, such examination as is necessary to keep informed as to the responsibility and sufficiency of any and all sureties upon any such bond or bonds, filed either with him or with the city clerk, or kept on file in his office or the office of the city clerk. In the event of a refusal or neglect on the part of any principal or principals so notified by the comptroller to procure a satisfactory surety or sureties, when directed so to do as herein provided, the comptroller shall forthwith report to the city council, setting forth in such report, the name of the principal and sureties upon the bond and the nature of the contract, undertaking or obligation which such bond was given to secure, with such recommendations and further information as he may deem necessary and proper. Except where otherwise provided, all such bonds shall be filed in the office of the comptroller. (Prior code § 7-4)

Municipal Code of Chicago § 2-32-050 Deputy comptroller.

2-32-050 Deputy comptroller. There is hereby created the office of deputy city comptroller. The comptroller may appoint such number of deputies as may be provided for in the annual appropriation ordinance. The deputy comptroller shall, during the disability or absence of the comptroller, have and exercise the powers and duties of the comptroller and shall at all times have and exercise such powers and duties as may be assigned to him by the comptroller. The comptroller shall designate which deputy shall act during the disability or absence of the comptroller. (Prior code § 7-5)

Municipal Code of Chicago § 2-32-055 Municipal marketing authority.

2-32-055 Municipal marketing authority. (a) The chief financial officer is authorized to: 1. Identify specific City assets available for marketing and desirable to potential commercial partners; 2. Prioritize these assets in terms of ease of marketing and short- and/or long-term commercial value; 3. Develop a marketing plan for these assets; 4. Seek out commercial partners for asset- based transactions; 5. Structure marketing programs; and 6. Negotiate the terms of, and execute, asset-based marketing agreements with public and private entities. (b) The chief financial officer may carry out the duties set forth in subsection (a) of this section either directly, or through a designee, agent or contractor, and is authorized to enter into one or more agreements to secure the services of such designee, agent or contractor. (c) The chief financial officer shall not enter into any agreement pursuant to subsection (a) of this section that effectuates the sale of a city asset. (d) Section 10-8-320 shall not apply to any assets used pursuant to this section. (e) The chief financial officer is authorized to promulgate reasonable rules relating to the administration of this section. (f) As used in this Section, the following definitions apply: "Assets" means all assets available to the City, including without limitation tangible physical assets, such as buildings, vehicles and other equipment, and intangible intellectual property, such as patents, copyrights, and trademarks owned by the City, and other intangible opportunities, such as event sponsorship. "Chief financial officer" means the chief financial officer of the City appointed by the mayor or, if there is no such officer then holding that office, the city comptroller. (Added Coun. Municipal Code of Chicago § 2-32-060 Treasurer - Accounting and reports on city funds.

2-32-060 Treasurer - Accounting and reports on city funds. The city treasurer shall receive all monies belonging to the city, and shall render at the end of each month, and oftener if required by the comptroller, a statement, under oath, to the comptroller, showing the state of the treasury at the date of such account and the balance of the money in the treasury. Such statement shall set forth all the monies received by him, and from whom, and on what account such monies shall have been received. It shall also show all monies paid out by him, and on what account the same shall have been paid. The city treasurer shall cause books of account to be kept in such manner as to show with entire accuracy all monies received by him, and from whom, and on what account they shall have been received; and all monies paid out by him, and on what account they shall have been paid; and the same shall be shown in such manner that such books may be readily understood and investigated. Such books, and all papers and files of his office, shall at all times be open to the examination of the comptroller, the committee on finance, or any member of the city council. There shall be no ineligibility of, nor disqualification or limitation upon, any person being elected to successive terms as city treasurer. Any prior law, statute or ordinance to the contrary notwithstanding, no restriction on succession in the office of city treasurer shall be applicable. (Prior code § 7-6)

Municipal Code of Chicago § 2-32-065 Treasurer's authority for financial education and outreach programs.

2-32-065 Treasurer's authority for financial education and outreach programs. The city treasurer shall have the authority to research, conduct educational programs, provide counseling and disseminate information regarding financial education, small business support and access to banking (for purposes of this section, collectively "financial programs") for residents of the city. The city treasurer is authorized to organize, administer and deliver financial programs either directly or through agents. In furtherance of organizing, administering and delivering financial programs, the city treasurer shall have the authority to: (1) award and apply for, and accept on behalf of the city, grants; and (2) enter into service agreements with public and private entities; and perform any and all acts, including the expenditure of funds subject to appropriation therefor, as shall be necessary or advisable in connection with such service agreements, including any renewals thereto. The city treasurer is authorized to enter into and execute sponsorship agreements, containing terms and conditions that she deems appropriate, in conjunction with the treasurer's Small Business Entrepreneur Expo Program (for purposes of this paragraph, "Expo"). For purposes of this paragraph, the term "sponsor(s)" means those persons providing money or other in-kind goods or services to the city in exchange for advertising or promotional rights at Expo. Sponsors may, in the discretion of the city treasurer, and upon such terms as the city treasurer determines, sell goods and services to the public at Expo. (Added Coun. J. 11-19-08, p. 47220, Art. Municipal Code of Chicago § 2-32-070 Payments to the city - Records - Bad check fees.

2-32-070 Payments to the city - Records - Bad check fees. License fees, inspection fees, compensation for franchises and all other payments of money to the city not otherwise specifically provided for shall be paid directly to the city comptroller and such payments shall be transmitted daily by the city comptroller to the city treasurer. The city comptroller shall establish, maintain and preserve statistical records of revenue, taxes, license or permit measures and shall report to the mayor from time to time, or as often as the mayor deems necessary. A fee of $34.00 shall be imposed on any person, corporation, trustee, court-appointed representative, association or partnership who tenders a check or draft as payment of any tax, license fee, inspection fee, franchise fee or other payment to the city if the check or draft is returned unpaid for any reason. This fee shall be paid within 30 days after notice of return of the check or draft, and shall be in addition to any other fee or penalty imposed for late payment of the tax or fee involved. Municipal Code of Chicago § 2-32-075 Contracts for payment technology services.

2-32-075 Contracts for payment technology services. (a) Definitions. The following definitions shall apply for the purposes of this section: “Application” means any software installed or available for download on a computer, tablet, smart phone, kiosk, or other electronic device, or any website, mobile application or platform, internet-enabled application or platform or digital platform. “Payment technology” means any software, hardware, or other innovation owned, operated, or authorized for use by the City for its benefit or the benefit of the public that enables any person to engage in financial transactions. “Third party” means any provider of an application, including, but not limited to, a provider of any payment technology application. “Utility company” means any enterprise that provides utility services, including, but not limited to, gas, electricity, water, sewage, or telecommunications. (b) Authority. The Comptroller is authorized to enter into and execute one or more agreements with a third party, permitting the third party to install an application on payment technology in order to enable persons to pay utility company bills. Third parties may generate revenue from the application installed on the payment technology. However, third parties shall not collect payment, in any form, from the persons who use the application to pay utility company bills. (Added Coun. J. 11-15-23, p. 6700, Art. III, § 1)

Municipal Code of Chicago § 2-32-080 Comptroller - Tax and revenue powers.

2-32-080 Comptroller - Tax and revenue powers. In addition to the other powers conferred on him, the city comptroller shall have the powers enumerated in paragraphs A through F hereof: A. To administer and enforce all the responsibilities, powers and duties delegated to him in every tax ordinance presently contained in or to be included in the Municipal Code of Chicago; provided, however, that where said tax revenues are now and are continued to be collected by the State of Illinois for and in behalf of the City of Chicago and remitted to the City of Chicago, the department of finance shall act solely in an advisory capacity with respect to such collections; B. To correct errors of tax designation on department records and to notify the city treasurer so that necessary adjustments and corresponding changes may be made; C. To investigate, analyze and propose new revenue programs for the City of Chicago toward the end that revenue, tax, license and permit fee financial burdens may be equitably distributed among the citizens of the City of Chicago; D. To require the production and examination of books, papers, records and documents pertinent to any tax liability, or license and permit fee, or revenue question as well as to institute investigations, inquiries or hearings consistent with the requirements of due process of law and to take testimony and proof under oath at such hearings; E. To take such steps, actions, and to request prosecutions by the corporation counsel's office, for the purpose of enforcing ordinances relating to revenue, tax, license and permit fees receivable by the City of Chicago; F. To receive, hear and decide all protests and challenges to the determinations of tax liability of any taxpayer and to issue, tentative and final determinations of such claims; G. To accept payments, including by credit card, in categories of receivables designated by the comptroller, and to impose a surcharge on such payments. Such surcharges, if any, shall reasonably relate to the average cost incurred by the city to process such payments. The comptroller shall post a notice setting forth the amount of applicable surcharges at all places where payments are accepted, including electronically for payments made on-line. 2-32-082 Comptroller - Debt collection contracts employing ex-offenders. (a) The city comptroller is authorized, subject to the availability of duly appropriated funds, to negotiate and enter into contracts from time to time with one or more collection agencies which employ ex-offenders to perform debt collection services on the City's behalf (for purposes of this section, "Services"). (b) A collection agency shall not be eligible to contract with the City pursuant to this section unless all ex-offenders it employs to perform Services have been trained and screened for employment by one or more not-for-profit corporations that provide appropriate ex- offender training and screening services. (c) As a prerequisite to entering into contracts pursuant to this section, the comptroller shall establish and apply standards of conduct and performance that the applicable not-for-profit corporation and collection agency must meet. (d) The contracts authorized by this section may contain terms that the comptroller determines to be reasonable and appropriate, including terms governing reasonable compensation. Compensation for Services may, in the discretion of the comptroller, include payment based upon a percentage of debts collected that are attributable to Services performed. (Added Coun. Municipal Code of Chicago § 2-32-085 Voluntary charitable payroll deductions.

2-32-085 Voluntary charitable payroll deductions. (a) The Chief Financial Officer shall administer a program (for purposes of this section, “the program”) under this section through which employees of the City may make contributions to charitable organizations by authorizing voluntary payroll deductions. (b) Pursuant to the program administered under this section, an employee may authorize the withholding of a portion of the employee’s salary or wages for contribution to a maximum number of 10 organizations designated as qualified to participate in the program administered under this section. (c) In addition to the organizations specified in subsection (i), the Chief Financial Officer may from time to time recommend that the City Council designate by ordinance other not-for-profit organizations as eligible for participation in the program established under this section, provided that the total number of organizations having such designation at any time may not exceed 30. The Chief Financial Officer may from time to time recommend that the City Council by ordinance remove the designation of an organization that no longer meets the requirements of this section. No organization shall be designated as qualified to participate in such program unless it is a voluntary, charitable, health, or welfare organization that provides or supports direct health or welfare services to individuals or their families, and is in compliance with the requirements in, and certifications made pursuant to, subsection (d). (d) An organization desiring to be designated as qualified to participate in the program established under this section shall: (1) Submit to the Chief Financial Officer an application in a form prescribed by the Chief Financial Officer; (2) Certify that the organization (or all agencies benefitting from such organization) is tax exempt under the Internal Revenue Code; and (3) Certify that the organization (or all agencies benefitting from such organization) conducts health or welfare programs and provides services to individuals directed at one or more of the following common human needs within a community: service, research, and education in the health fields; scholarships for attending institutions of higher learning; family and child care services; protective services for children and adults; services for children and adults in foster care; services related to the management and maintenance of the home; day care services for adults; transportation services; information, referral and counseling services; services to eliminate illiteracy; the preparation and delivery of meals; adoption services; emergency shelter care and relief services; disaster relief services; safety services; neighborhood and community organization services; recreation services; social adjustment and rehabilitation services; health support services; or a combination of such services designed to meet the special needs of specific groups, such as children and youth, the ill and infirm, and the physically or mentally handicapped; and that the organization and any such benefitting agencies provide the above-described services to individuals and their families in Chicago, or that the organization or benefitting agencies provide relief to victims of natural disasters and other emergencies on a where- and as-needed basis; (4) Certify that it will pay its share of the program costs; (5) Submit to the Chief Financial Officer a copy of the organization's annual report and, if the organization has an annual budget over $100,000, a copy of the most recently completed audit of the organization; and (6) Provide such other information to the Chief Financial Officer as the Chief Financial Officer may reasonably require. (e) Chief Financial Officer may require an organization designated as qualified to participate in the program administered under this section to provide, on a periodic or one-time basis, information reasonably necessary to determine whether the organization continues to be qualified to participate in the program. (f) The designation of any organization that receives fewer than 250 contributions in any calendar year shall be subject to removal under subsection (c) for the subsequent calendar year. If an organization is removed from the program, any employee contributions that were designated for the organization shall cease and not be withheld from the employee’s salary or wages. (g) The Chief Financial Officer is hereby authorized to perform any acts as shall be necessary to implement this section, including negotiating, executing and entering into any advisable agreements and instruments. (h) The Chief Financial Officer shall promulgate reasonable rules relating to the administration of the program. 2-32-093 Comptroller - Parking and parking administrator. (a) The Comptroller shall serve ex officio as the Traffic Compliance Administrator provided for in Section 9-100-010 of this Code, and in that capacity, the Comptroller has the power to appoint ticketing agents, who may include a person, or the person’s designee, acting pursuant to a concession agreement with the City governing the operation, maintenance, improvement, installation and removal of, and collection of fees from certain designated parking meters, for purposes of enforcing parking laws and regulations. (b) In addition to the powers authorized in subsection (a), the Comptroller has the following powers and duties: (1) Subject to subsection (b)(4), to operate off-street parking facilities owned by the City, and to collect all fees and charges for the use of such facilities; (2) To administer Chapter 9-100 of this Code; (3) To negotiate and enter into intergovernmental agreements with the Illinois Secretary of State, and with other vehicle authorities and state agencies responsible for collecting and maintaining vehicle-related and driver-related information, for the purpose of sharing information relevant to motor vehicle registration and ownership and eligibility for parking- related privileges. Such agreements may include terms relating to indemnification by the City of Chicago and/or the payment of fees for such information, subject to the appropriation of funds; (4) To direct the operation, maintenance, improvement, installation and removal of, and collection of fees from, parking meters consistent with the provisions of the code, and to determine comparable meter revenue rates pursuant to Section 9-68-050; provided however that if the City Council authorizes a concession agreement for the operation, improvement, installation, removal and maintenance of, and collection of fees from, certain designated parking meters, all powers provided for in subsections (b)(1) and (4) of this section shall be performed consistent with the terms of such concession agreement; (5) To negotiate and enter into, subject to the approval of the City Council, licensing agreements or intergovernmental agreements for the use of the parking and compliance violation system, including any agreement for the marketing thereof. (6) Subject to any Illinois statutory requirements governing jurisdiction over the public way, to negotiate and enter into agreements with any Sister Agency, as that term is defined in Section 1-23-010, or the Metropolitan Pier and Exposition Authority ("Authority"), for enforcement of Chapter 9-64 on public ways, parking lots, and other property owned or controlled by the Sister Agency or Authority. 2-32-094 Indebtedness - Ineligibility for permits and acceptance of applications. (a) Definitions. As used in this section, unless the context indicates otherwise: "Debt" shall have the meaning ascribed to the term in subsection (a) of Section 4-4-150. "Otherwise resolved" or "otherwise resolves" means any debt that (1) has been discharged by the city council in accordance with terms and conditions fixed by the city council; or (2) is governed by an agreement for payment of the debt entered into by the person owing such debt with a court of competent jurisdiction or the department of finance or the department of law or the State of Illinois or any appropriate city department or local, state or federal government agency or third party for the payment of all debts owed, if each person owing the debt is in compliance with the terms of the agreement; or (3) enforcement of which has been judicially stayed by a court of competent jurisdiction; or (4) is the subject matter of a good faith negotiation with the department of finance, as determined by the comptroller, to resolve a dispute contesting liability for, or the amount of, such debt; or (5) is dischargeable in bankruptcy and the person owing such debt has filed a petition in bankruptcy. "Requested city action" means the issuance of the applicable license or permit or acceptance of the applicable application by the responsible department. "Responsible department" means the city department responsible for issuing the applicable license or permit or for accepting the applicable application. "Satisfied" or "satisfies" mean any outstanding debt that has been or is paid in full. (b) Investigation authorized. If the issuance of a license or permit or acceptance of an application is prohibited under this Code to any person who has outstanding debt, the department of finance may investigate whether such person has outstanding debt. (c) Notification required. If, as a result of an investigation under this section, the department of finance determines that any applicable person has outstanding debt, the department shall notify the person owing the debt of its determination and of the fact that such person is ineligible under the Code for the requested city action until such time that the outstanding debt is satisfied or otherwise resolved. The notification required under this subsection shall: (i) be in writing; (ii) notify the person owing the debt and, if required under the Code, such person's agent, that the Municipal Code of Chicago prohibits the responsible department from granting the requested city action to persons who have outstanding debt; (iii) state that the department of finance has determined that an outstanding debt exists; (iv) describe the debt that is outstanding or inform the person owing the debt that, upon request, a description of the outstanding debt is available from the department of finance; (v) inform the person owing the debt of his or her right to contest the department of finance's determination that an outstanding debt exists; and (vi) inform the person owing the debt of the circumstances under which an outstanding debt will be deemed to have been satisfied or otherwise resolved. If notice is provided by mail, it shall be sufficient to mail the notice to the last address that the person owing the debt provided to the responsible department. The date of the notice shall be the date such notice is deposited in the mail, if served by first class mail; the date of delivery, if served by personal service; or the date of service, if served in any other manner. (d) (1) Right to petition. Upon request of the person owing the debt, the department of finance shall provide such person with a written description of such debt. The person owing the debt shall have ten business days from the date of the notice issued under subsection (c) to petition the comptroller to reverse the department's determination under subsection (b), by submitting in person or by mail, a written response to the comptroller that includes the following materials and information: (i) the full name, address and telephone number of the person owing the debt; (ii) a written statement signed by the person owing the debt setting forth facts, law or other information relevant to establishing a defense to the department's determination under subsection (b); (iii) a copy of the notice provided by the department under subsection (c) to the person owing the debt; and (iv) any documentary evidence that supports the written statement of the person owing the debt, including receipts for the payment of an alleged debt or other tangible proof that the debt has been satisfied or otherwise resolved. (2) Final order. Within ten business days of receiving a petition under subsection (d)(1) from the person owing the debt, unless a longer period is mutually agreed upon, the comptroller shall enter an order granting or denying the petition. If the petition is denied, such order of the comptroller shall be accompanied by a written decision stating why the petition is being denied. Such order of the comptroller shall be final and may be appealed as provided by law. Upon issuance of such final order, the person seeking the requested city action shall not be eligible for such requested city action until such person satisfies or otherwise resolves the outstanding debt. (e) Failure to file timely petition. If the person owing the debt fails to file a timely and proper petition under subsection (d)(1), such person shall be deemed to have waived his or her right under this section to contest the department's determination under subsection (c), and the requested city action shall not be granted until the outstanding debt is satisfied or otherwise resolved. (f) Duration of validity of determination. If, in connection with any investigation conducted under subsection (b) of this section, the department of finance determines that a person does not have any outstanding debt or that an outstanding debt has been satisfied or otherwise resolved, the department may presume, for a period of 90 days from the date of such determination, that such determination is accurate and remains valid. (g) Refunds. Upon written application by any person determined under this section to owe debt, and subject to any applicable rules contained in this Code relating to refunds, the City or any third party collecting payments on behalf of the City shall refund any payment that was received from such person for any debt that the City or a court of competent jurisdiction determines was not owed by such person. The department of finance shall investigate and determine whether all persons required by the municipal code to pay any tax or secure any license, permit or franchise have complied with such provisions and, in cases of evasion of payment, the department shall serve notices of delinquency and upon advice, counsel and representation of the corporation counsel, shall request proceedings to be instituted to enforce such provisions and collections. 2-32-096 Comptroller - Rules. The Comptroller is authorized to make and enforce such reasonable rules as may be necessary to effectively administer any of the powers granted to the Comptroller in this Code. All such rules shall be adopted only after notice to the general public and publication of the rules proposed to be adopted on the Department of Finance’s public website, no fewer than ten and no more than 30 days prior to the effective date of such rules. Upon adoption, such rules shall be maintained on file in the Department of Finance and shall be made available for public inspection during regular business hours. (Added Coun. 2-32-097 Succession - Transfer of powers. The comptroller and the department of finance shall assume all rights, powers, duties, obligations and responsibilities of the former director and department of revenue. The comptroller shall succeed to the rights and duties of the former director of revenue under existing contracts, agreements or other programs. Any matter pending before the director or department of revenue as of January 1, 2012 shall be continued under the jurisdiction of the comptroller and the department of finance. All books, records, papers, documents, property, real and personal, unexpended appropriations and pending business in any way pertaining to the rights, powers, duties, obligations and responsibilities transferred to or vested in the director or department of revenue shall be delivered and transferred to the comptroller and the department of finance. All rules or regulations issued by the former director or department of revenue, in effect as of January 1, 2012, shall remain in effect until amended or repealed by the comptroller. (Added Coun. The transfer of the powers and functions from the director of revenue and the department of revenue to the comptroller and the department of finance shall not affect any act done, ratified or confirmed, or any right accrued or established, or any action or proceeding had or commenced in a civil, administrative or criminal cause before such transfer takes effect, but such actions or proceedings may be prosecuted and continued by the comptroller or applicable department having jurisdiction of the subject matter to which such litigation or proceeding pertains.
