4-156-285 Covered business activities - License - Required. (a) Except as otherwise provided in this chapter, no person shall engage in any of the following business activities ("covered business activity") without first having obtained a public place of amusement license under this Chapter 4-156 authorizing such person to engage in such covered business activity: (1) producing, presenting or conducting any amusement within the meaning of Section 4-156-300 in Article III of this chapter, or (2) producing, presenting or conducting any amusement within a performing arts venue within the meaning of Article V of this chapter, or (3) producing, presenting, conducting or hosting an industrial venue event within the meaning of Article VI of this chapter. The covered business activity authorized under a public place of amusement license shall be stated on the face of the license. Such covered business activity shall be governed by the Article(s) applicable to such covered business activity. (b) No person shall engage in the business of indoor special event without first having obtained an indoor special event license under Article IV of this chapter. (Added Coun. Municipal Code of Chicago § 4-156-290 Definition.

4-156-290 Definition. As used in this Article III, a public place of amusement means any building or part of a building, park or other grounds used or intended to be used for any amusement as defined in Article I of this chapter; provided that any entity which is licensed as a children's services facility pursuant to Chapter 4-75 of this Code shall not be considered a public place of amusement. 4-156-300 License - Required - Special requirements for establishments catering to minors. (a) Unless specifically exempted in Section 4-156-305 or subsection (f) of this section, it shall be unlawful for the owner, lessee or manager of any property, or for any other person, to produce, present or conduct thereon, any amusement unless the owner, lessee or manager of such property has first obtained a public place of amusement license to engage in the business of public place of amusement. If an amusement is produced, presented or conducted on any property without such a valid public place of amusement license first having been obtained, and unless Section 4-156-305 or subsection (f) of this section applies, all of the following persons shall be in violation of this subsection: (1) the owner of the property, (2) the lessee of the property, (3) the manager of the property, (4) the producer of the amusement, (5) the presenter of the amusement and (6) the person conducting the amusement. Each person found in violation of this subsection (a) shall be subject to a fine of up to $10,000.00. (b) If any part of the property is used or intended for use for any amusement, a public place of amusement license under this Article III shall be required, regardless of whether the use is incidental to the property's principal use. (c) If more than one amusement is produced, presented or conducted at any single place or premises as part of a single business, only one public place of amusement license under this Article III shall be required. (d) A public place of amusement license under this Article III shall be required for any public resort for underage persons which is designed, used or intended to be used primarily for participation by minors in entertainment or amusement primarily involving music, music videos and dancing. Examples of such resorts shall include but are not limited to a dry dance hall, nonalcohol bar, "dry cabaret", "juice bar" or "teenage cabaret". No public resort for underage persons, as defined herein, may operate between the hours of 2:00 a.m. and 11:00 a.m. or be eligible for a retail liquor license under Chapter 4-60 of this Code. (e) In addition to any other penalty provided by law, any violation of any requirement set forth in subsection (d) of this section or any rule promulgated thereunder may result in revocation of all city licenses pertaining to that establishment. (f) No public place of amusement license under this Article III shall be required if: (1) the property is a church, temple, synagogue or other place of worship, or school which has been inspected pursuant to Section 14A-6-602 within the 12-month period preceding the production, presentation or conduct of any amusement; and (2) the sponsor of the event is affiliated with the church, temple, synagogue or other place of worship, or school; and (3) all necessary food, liquor and other licenses and permits required by this Code have been obtained. Municipal Code of Chicago § 4-156-305 License - Exceptions.

4-156-305 License - Exceptions. No public place of amusement license under this Article III shall be required, if the only amusement to be produced, presented, or conducted is one or more of the following: (a) two or fewer pool or billiard tables regardless of whether players must pay to use the pool or billiard table; (b) less than five automatic amusement devices; provided, however, that when calculating the number of automatic amusement devices, jukeboxes shall not be counted. A pool or billiard table shall be included when calculating the number of automatic amusement devices for purposes of this subsection if players must pay to use the pool or billiard table; provided that, in no case shall this subsection create an exemption for establishments which contain more than two pool or billiard tables regardless of whether any payment is required; (c) music, dancing or other amusement, if: (i) it is offered in a venue with a capacity of less than 100 persons; and (ii) no admission fee, minimum purchase requirement, membership fee or other fee or charge is imposed for the privilege of entering the premises or the portion of premises where the music, dancing or other amusement is provided or permitted; (d) live or recorded music and dancing in a banquet hall, restaurant or similar establishment if: (i) the owner of the establishment possesses the necessary retail food establishment license; and (ii) the music and dancing is being presented in connection with an event which is not open or advertised to the general public, including a wedding, graduation, or religious celebration; and (iii) no admission fee, minimum purchase requirement, membership fee or other fee or charge is imposed for the privilege of entering the premises or the portion of premises where the music and dancing is provided or permitted; (e) live or recorded readings from books or other publications available for sale within the premises of a retail seller of books or other publications, and the presentation of live or recorded music within the premises of a retail seller of printed or recorded music, if: (i) the owner of the establishment possesses the necessary retail establishment license; (ii) the retail activity conducted on the premises is not the sale of alcoholic liquor; and (iii) no admission fee, minimum purchase requirement, or other fee or charge is imposed for the privilege of entering the premises or the portion of premises where the reading or musical presentation takes place; (f) instrumental music by an orchestra of not more than eight pieces in a hotel, restaurant or retail establishment if: (i) no dancing or other entertainment is permitted; and (ii) no admission fee, minimum purchase requirement, membership fee or other fee or charge is imposed for the privilege of entering the premises or the portion of premises where the music is provided or permitted; (g) any amusement produced, presented or conducted on the premises owned or leased, for a minimum lease term of two years, by a private club or lodge that is produced, presented or conducted either (1) solely for its members and their guests, or (2) as part of a program to augment the support of the fine or performing arts by a club that has been in continuous existence for more than 50 years. For purposes of this subsection (g) "private club or lodge" means any not- for-profit association that: (i) has been in active and continuous existence for at least three years; and (ii) has a membership role of more than 50 bona fide members who pay membership dues on an annual or other periodic basis. For purposes of this subsection (g) "bona fide members" do not include members who pay membership dues at the time of an amusement produced, presented or conducted by the club or lodge or in conjunction with contracting for production, presentation or conduct of an amusement by the club, as a condition to entering the premises where the amusement is produced, presented or conducted. For purposes of clause (2) of this subsection (g), a private club's program of supporting the fine or performing arts must include offering residential facilities to performers or artists; offering a venue for practice and performances; and availability of facilities for the discussion, promotion and development of skills and interests in the fine or performing arts. A private club or lodge, at the request of the department of business affairs and consumer protection or the department of police, shall make available for inspection records and documents that provide evidence of its not-for-profit status and membership roles; (h) paid television programming; (i) a health club, racquetball club, tennis club or similar club or organization when such club or organization is organized and operated on a membership basis and for the recreational purposes of its members and its members' guests; (j) an indoor special event licensed under Article IV; or (k) an industrial venue event conducted at an establishment licensed as an industrial private event venue under Article VI. For purposes of this section, when determining whether a venue has an occupancy of more than 100 persons, the total occupancy of all rooms or other occupancy areas of the premises of the business operating the amusement shall be calculated. Municipal Code of Chicago § 4-156-310 License - Application - Contents.

4-156-310 License - Application - Contents. An application for said license shall be made in conformity with the general requirements of this Code relating to applications for licenses. Said application shall be signed under oath by the owner of the business for which a license is sought. If the owner is a corporation, the application shall be signed by an authorized officer of the corporation. If the owner is a partnership, the application shall be signed by a partner. If the owner is a limited liability company that is managed by managers, the application shall be signed by a manager. If the owner is a limited liability company managed by members, the application shall be signed by a member. The application shall set forth the location and a description of the property used or intended for use as a public place of amusement, indicating the seating capacity and the floor area or ground area of the place, the types of amusements which the applicant intends to conduct on the property, and shall include the following: (a) The name, residence address, current telephone number, and social security number of the applicant in the case of an individual; in the case of a partnership, the names, residence addresses, social security numbers, and percentage of interest therein of the three members who own the highest percentage interest in such partnership and of any other member who holds a 25 percent or more interest therein; in the case of a limited partnership, the names, residence addresses, social security numbers, and percentage interest therein of each general partner thereof; in the case of a corporation, the date of incorporation, the objects for which it was organized, a summary of its activities during the past year, and the names, residence addresses, and social security numbers of its principal officers, those stockholders who own 25 percent or more of its voting shares; in the case of a limited liability company, the date of its formation, the objects for which it was organized, a summary of its activities during the past year and the names, residence addresses, social security numbers and percentage of interest of the three members who own the highest percentage interests in such limited liability company, of any other member who holds a 25 percent or more interest therein and, if the limited liability company is manager-managed, the names, residence addresses and social security numbers of all managers; and in case of a club, the date of its incorporation, the objects for which it was organized, a summary of its activities during the past year, and the names, residence addresses, and social security numbers of the officers and directors. If the applicant is a partnership, limited partnership, corporation, limited liability company or club, the applicant shall also provide the current telephone number of its authorized agent; (b) The name and address of the owner of the premises. If the premises are leased: (1) a copy of the lease, unless the applicant already has a lease for premises on file with the department of business affairs and consumer protection and no changes have been made to the lease since it was filed; (2) the name, address and telephone number of the owner of the premises, including the name and address of the beneficiary if title to the premises is held by a person as trustee and if known to the applicant; (3) the name, address, social security number and telephone number of the manager of the premises; (c) A copy of each agreement for management of the licensed business; (d) A statement as to whether the applicant has made application for a similar license on premises other than that described in the application and the disposition of such application; If a change in any information required in this section occurs at any time during a license period, the licensee shall file a statement, executed in the same manner as an application, indicating the nature and effective date of the change. The supplemental statement shall be filed within ten days after the change takes effect. The department of business affairs and consumer protection shall take measures to prevent disclosure of confidential information required under this section and not subject to disclosure under the Illinois Freedom of Information Act to persons outside the government. Municipal Code of Chicago § 4-156-311 Notice requirements; objections.

4-156-311 Notice requirements; objections. (a) Within five days after payment of the license fee for a public place of amusement license under this Article III, the department of business affairs and consumer protection shall cause a written notice to be sent to the alderman of the ward in which the premises described in the application is located, providing the information specified in Section 4-156-310 and the current telephone number of the applicant. (b) Within five days after payment of the license fee, the department of business affairs and consumer protection shall serve written notice by first class, registered or certified mail on all legal voters residing within 250 feet of the location for which the license is sought. The measurement of such area shall be made from the boundaries of the premises described in the application for which the license is sought, to a radius of 250 feet away. The notice shall: (1) identify the license being sought and state the name of the applicant; (2) identify the address of the premises for which the license is sought; (3) identify the date on which the license fee was paid; and (4) advise the recipient that any legal voter residing within 250 feet of the location for which the license is sought may file an objection with the commissioner no later than 35 days after the date the license fee was paid, requesting the commissioner to deny the application on the grounds that the license would have an adverse effect on: (i) the value of the property in the surrounding area; (ii) other commercial or industrial enterprises in the surrounding area; (iii) traffic-flow or parking within the surrounding area; (iv) the character of the surrounding area because of the hours of operation or use; or (v) the health, safety or welfare of the surrounding area. The objection shall be in writing signed by the objector and include the objector's name and address and set forth the grounds for the objection. (c) Within five days after payment of the license fee, the applicant shall cause to be posted at the location of the premises for which the license is sought, in a place clearly visible from the public way, a notice stating that an application has been made for a public place of amusement license, the date the license fee was paid, the name of the applicant and the street number and location of the premises covered by the application. The notice shall also include the language required by subsection (b)(1) – (4) of this section. (d) (1) Any objection filed pursuant to subsection (b) shall be delivered to the department no later than 35 days after the date on which the license was paid and shall set forth the grounds for the objection. (2) The commissioner shall review the application materials, including any objections. The review period for the application shall be no less than 35 days and no more than 90 days after the date the license fee was paid. (3) (A) The commissioner shall deny an application if the commissioner finds that the approval of the application would give rise to any of the adverse effects set forth in subsection (b). When an application is denied under this subsection (d)(3)(A), the commissioner shall send a written notice to the applicant of the findings which are the basis of the denial and advise the applicant that the applicant may submit a plan of operation within 20 days of the notice. If the applicant submits a plan of operation within the 20-day period, the time for a final ruling on the application shall be extended until 35 days after the date the plan of operation was submitted. A plan of operation may include conditions upon the applicant's operation of the premises that are useful or necessary to mitigate the adverse effects, including but not limited to providing security personnel, restricted hours of operation, providing outdoor lighting, the display of signs, providing trash pickup services, or any other reasonable restrictions on business practices. It shall be a violation if a licensee fails to comply with all requirements of the approved written plan of operation and subject the licensee to a fine pursuant to Section 4-156-700, or license suspension or revocation. (B) For any application for which the license fee is paid on or after March 13, 2013, in addition to any other grounds for denial of an application set forth in this section, the commissioner shall deny an application if the commissioner finds that within the two-year period prior to the date of the application, the premises identified in the application was identified in a prior application for a substantially similar business and the prior application was denied for a finding of an adverse effect on the surrounding area under this section or another similar provision; provided that the commissioner may approve an application if an applicant can prove by clear and convincing evidence that the issuance of the license will not have an adverse effect on the surrounding area. The commissioner shall send a written notice to the applicant of the findings which are the basis of the denial under this subsection and advise the applicant that the applicant may submit evidence that the issuance of the license will not have an adverse effect on the surrounding area within 20 days of the notice. The evidence may include, but is not limited to: (i) a petition with the written support of a majority of the legal voters registered within a radius of 250 feet from the boundaries of the premises for which a license is sought; (ii) a traffic study or traffic management plan which sets forth methods to mitigate any potential adverse effect on traffic flow or parking in the surrounding area; or (iii) a plan of operation to mitigate any of the adverse effects on the surrounding area which the commissioner found was a basis for a denial pursuant to this section. If the applicant submits the evidence that the issuance of the license will not have an adverse effect on the surrounding area within the 20-day period, the time for a final ruling on the application shall be extended until 35 days after the date the evidence was submitted. (4) This section shall not limit the authority of the city or a department or agency of the city to seek denial of an application on the basis of other applicable law. (Added Coun. Municipal Code of Chicago § 4-156-320 License - Application - Approval conditions.

4-156-320 License - Application - Approval conditions. (a) Each application and all information required to be furnished in connection therewith or a copy thereof shall be referred for approval to the buildings commissioner, zoning administrator, and fire commissioner. The commissioner shall require the following individuals to submit to fingerprinting in order to determine whether the issuance of the license is prohibited pursuant to Section 4-156-355: the individual applicant; all officers of an applicant corporation; the three members who own the highest percentage interests of an applicant partnership; the general partners of an applicant limited partnership; the three members who own the highest percentage interests and, in the case of a member-managed limited liability company, the manager of an applicant limited liability company, unless the above listed individuals are already named on a valid liquor license or are named in a liquor license application that has been filed and is being processed for the same premises for which the public place of amusement license under this Article III is sought. (b) After receiving zoning approval, an applicant for a public place of amusement license under this Article III shall pay the license fee at the time of filing the application. No later than 30 days after payment of the license fee, the applicant shall submit to the department all required documentation, as prescribed in rules, necessary to complete the application. If the applicant submits all the required documentation within the 30-day period, the commissioner shall review the application and documentation and any written objections to granting the license and shall approve or deny the application within 60 days after all required documentation has been submitted. If the applicant fails to submit all the required documentation within the 30-day period, the application shall be deemed to be incomplete and the commissioner shall suspend all further action on the application unless the applicant reactivates the application within six months after the original application was filed by: (1) submitting all required documentation necessary to complete the application, and (2) payment of a reactivation fee of $500.00. If the applicant reactivates the license application in accordance with this subsection, the commissioner shall review the application and documentation and any written objections to granting the license and shall approve or deny the application within 60 days after all required documentation has been submitted and the license application reactivation fee is paid. If the commissioner determines the application to be incomplete and the applicant fails to reactivate the application in accordance with this subsection, or if the applicant withdraws the application, the application shall expire and the applicant shall forfeit the license fee and any license application reactivation fee paid by the applicant. If the license application expires or is withdrawn, a new application for a public place of amusement license under this Article III, accompanied by the appropriate license fee, and all required documentation shall be required to obtain a license. (c) The procedures for the denial of a license set forth in Chapter 4-4 shall apply to the denial under this Article III of an application for a public place of amusement license. (Added Coun. Municipal Code of Chicago § 4-156-321 Contingent approval.

4-156-321 Contingent approval. The commissioner is authorized to approve on a contingent basis a public place of amusement license under this Article III for any application that requires the approval of additional city departments. Upon receipt of a license application, the department shall forward the information to the commissioner and to appropriate departments for review. Upon completion of the commissioner's review, which shall be concluded within 90 days of the date the license fee was paid, the commissioner shall notify the applicant whether the applicant is approved to receive the described license for the subject premises contingent upon the applicant receiving the approval of other necessary departments, such as, but not limited to, the fire department, the department of health and the department of buildings. The contingent approval shall be valid for twelve months from the date of issuance, but the license shall not issue until all necessary approvals have been received. Nothing in this section shall be construed as authorizing the applicant to produce, present or conduct any amusement until a public place of amusement license under this Article III is issued. Municipal Code of Chicago § 4-156-330 Location restrictions.

4-156-330 Location restrictions. (a) No public place of amusement license under this Article III shall be issued for any establishment within 200 feet of any church, temple, synagogue or other place of worship, hospital, or building used exclusively for educational purposes (for purposes of this section, collectively "affected institution"), unless the place to be licensed has been established as a public place of amusement under this Article III before the establishment of the affected institution. Said distance shall be measured from the nearest point of the premises for which application for a license has been made and the nearest point of the affected institution. This prohibition shall not apply to: (1) a performing arts venue, as defined in Article V of this chapter, or (2) the Chicago History Museum, or (3) the Bronzeville Children's Museum. (b) The commissioner may grant a reduction of the distance requirement in subsection (a) if, based on a review of relevant factors, the commissioner concludes that such a reduction would not detrimentally impact the affected institution. The grant of a distance reduction shall not exempt the applicant from any application requirement associated with issuance of a public place of amusement license under this Article III. (c) Factors which the commissioner may consider with regard to an application for a distance reduction include, by way of example and not limitation: (i) the type of amusement to be conducted and the days and times during which such activity will take place, (ii) the capacity of the venue, (iii) the availability of adequate parking for potential patrons, (iv) whether the sale or consumption of liquor will be associated with the amusement, (v) a report from the police regarding the location, as well as the history of activity conducted at or in conjunction with the venue and any associated infractions or violations of the municipal code, (vi) the relevant geography, (vii) the legal nature and history of the applicant, (viii) the measures the applicant proposes to implement to maintain quiet and security in conjunction with the amusement, and (ix) whether the affected institution supports or objects to the amusement. (d) A person seeking a distance requirement reduction shall make a written submission to the commissioner, presenting all factors which the applicant believes to be relevant to whether a reduction is appropriate. The applicant shall provide a copy of the written submission to the affected institution. The commissioner shall review the materials and make a written determination within 60 days, which shall set forth the factors used in arriving at the determination. During the 60-day review period, the commissioner shall notify the affected alderman and solicit a recommendation based on the alderman's analysis of relevant factors, and may seek additional information or supplementary proof from the applicant, and may also solicit information from the community, including the affected institution. If the commissioner denies the application for a reduction, the applicant, within fourteen days of receiving the denial, may request a hearing from the commissioner. Upon receiving such a request, the commissioner shall schedule and conduct a hearing expeditiously, and shall provide the affected institution with notice of and an opportunity to appear at the hearing. At the hearing the commissioner may receive written submissions, witness testimony, argument and documents regarding the application. The commissioner shall, within thirty days of the conclusion of the hearing, render a decision, which shall constitute a final determination for purposes of judicial review. (e) If the commissioner grants the application for a reduction, those factors that were deemed by her to be relevant to the determination shall be included in a plan of conduct. If the public place of amusement license under this Article III is granted, the plan of conduct shall be deemed a part of the license, and compliance with the plan of conduct shall be a necessary condition to the continued validity of the license. Failure to comply with one or more elements of the plan of conduct shall subject the licensee to suspension or revocation of such public place of amusement license. (Added Coun. No public place of amusement license under this Article III shall be issued unless the applicant certifies that, since the issuance of the most recent license and the most recent occupancy sign required to be posted on the licensed premises pursuant to Section 14A-8-802 of this Code, neither the applicant nor any other person has made any modifications or alterations affecting the layout, floor plan, doorways, stairways, interior separations, or other features of the subject premises that may affect occupancy limits. Municipal Code of Chicago § 4-156-355 License - Issuance prohibited.

4-156-355 License - Issuance prohibited. No public place of amusement license under this Article III shall be issued to: (1) A person who has been convicted of a felony under any federal or state law (other than a minor cannabis offense) unless the commissioner determines, after investigation and in accordance with duly promulgated rules, that such person has been sufficiently rehabilitated to warrant the public trust. The burden of proof of rehabilitation shall be on the person seeking such rehabilitation; (2) A person who knowingly files false or incomplete information on an application for a public place of amusement license under this Article III or any other document required by this Chapter 4-156; (3) A person whose license, issued by the City of Chicago under any chapter of the Municipal Code of Chicago, has been revoked for cause within the past five years; (4) A person who at the time of application for renewal of a public place of amusement license under this Article III would not be eligible for such license upon a first application; (5) A corporation, partnership, limited partnership, or limited liability company, if any of the officers, substantial owners, members or other individuals required to be identified in the initial license application by Section 4-156-310(a) would not be eligible to receive a license hereunder; (6) A corporation unless it is incorporated in Illinois, or unless it is a foreign corporation which is qualified under the "Business Corporation Act of 1983" to transact business in Illinois; provided that the corporation is not dissolved and is in good standing under the laws of the State of Illinois; (7) A person who is not a beneficial owner of the business for which a license is sought; (8) A person whose place of business is conducted by a manager or agent unless the person demonstrates that the manager or agent possesses the qualifications required to obtain a license hereunder; or (9) A person whose public place of amusement license under this Article III has not undergone and passed a building inspection as required by Section 14A-6-602 of this Code within the 90 days preceding the date of submission, every two years, of a renewal license application. 4-156-380 Public place of amusement - Exit diagram. The licensee of every public place of amusement issued under this Article III shall post diagrams, drawn to scale, showing the locations of the exits. If such public place of amusement is located in a building or in a part of a building, the diagrams shall be posted in the same locations as the occupancy signs required under Section 14A-8-802. If such public place of amusement is a park or other outdoor venue enclosed by a fence or other enclosure, the diagrams shall be conspicuously posted in the entrance to the park or outdoor venue. 4-156-410 Motion picture theaters - Billboard contents. It shall be the duty of the licensee of any motion picture theater to exhibit on a billboard, placed in front of the building or other structure in which such show is given and such motion pictures are exhibited, the title to the pictures, which title shall either be full enough to describe in general terms the nature and character of the picture or pictures to be shown, or shall be accompanied by other explanatory wording, pictures or other advertising matter so as to describe the said picture or pictures. No such licensee shall place, maintain, or allow to be placed or maintained, in front of or in connection with any such place, any sign, picture or other announcement which in any manner misstates or misrepresents the picture or other amusements which are being shown in said place, or which announces a picture or other form of amusement or entertainment which is not, at the time such announcement is displayed, being shown and exhibited in said place. Municipal Code of Chicago § 4-156-420 Billiard rooms and poolrooms.

4-156-420 Billiard rooms and poolrooms. It is unlawful for any person who has not reached the age of 18 years, unless accompanied by a parent or guardian, to play billiards or to be permitted to remain in a billiard room for any purpose, or to play any coin- operated pool table; and it is unlawful for any person to represent himself to have reached the age of 18 years in order to obtain admission to such billiard room or to be permitted to remain therein, or to play any coin- operated pool table, when such person is in fact under 18 years of age. No person shall operate any billiard or poolroom between the hours of 2:00 a.m. and 7:00 a.m. or harbor or permit any person to be or remain in any such room between such hours. This section, however, shall not be construed to prevent regular employees from performing necessary work within the premises during such prohibited hours of operation. Nor shall this section prohibit a licensed billiard or poolroom which is also a duly licensed liquor establishment from operating during the hours established by the liquor license; provided, however, that no game of billiards or pool shall be allowed to commence later than 30 minutes before the end of liquor service as allowed by the license. The licensee of the billiard or poolroom shall post a sign, visible in the area of the billiard or pool table, indicating the latest time for commencing a game of pool or billiards. No person conducting or operating any billiard or poolroom shall allow or permit any screens, curtains, blinds, partitions or other obstructions to be placed between the front windows and back or rear wall of such room, but an unobstructed view of the entire interior must be maintained at all times. This provision, however, shall not be construed to preclude the maintenance of washrooms or toilet rooms, or the maintenance of closets for storing purposes exclusively. (Added Coun. Municipal Code of Chicago § 4-156-424 Outdoor patio.

4-156-424 Outdoor patio. At no time may any live or recorded music be played or performed on the outdoor premises of a public place of amusement licensed as an outdoor patio. This prohibition shall not apply to an outdoor patio operated in conjunction with a consumption on the premises – incidental activity license issued under Chapter 4-60, at a museum located at the Field Museum of Natural History, the Shedd Aquarium, the Adler Planetarium or the Art Institute of Chicago. Any person found in violation of this section shall be fined not less than $400.00 nor more than $1,000.00 for each offense. Every day a violation occurs shall be a separate and distinct offense. 4-156-430 Athletic contests at night and on weekday afternoons; restrictions. (A) (1) It shall be unlawful for any licensee or other person, firm, corporation or other legal entity to produce or present or permit any Event or Major League Baseball game that takes place between the hours of 8:00 p.m. and 8:00 a.m., or is scheduled to begin between the hours of 2:01 p.m. and 4:09 p.m. on weekdays (except for Memorial Day, Independence Day or Labor Day), and is presented in the open air portion of any stadium or playing field which is not totally enclosed and contains more than 15,000 seats where any such seats are located within 500 feet of 100 or more dwelling units. The 500 foot distance shall be measured from the seat to the nearest point of the buildings in which the dwelling units are contained. (2) For purposes of this section, the following definitions apply: "Dwelling unit" shall mean a room designed or used for sleeping accommodations, including hotel and dormitory rooms. "Event" means an amusement, as that term is defined in section 4-156-010, other than a Major League Baseball game. (B) The provisions of subsection (A) do not apply, in whole or in part, to a team whose regular home stadium, or a person using such stadium, is subject to this section for any of the following: (1) All-star, playoff, post-season or playoff determinative, regular season tie-breaker, divisional or conference championship series, league championship series, World Series, or similar baseball games, and directly related events to the baseball games listed in this paragraph (1); (2) Up to 43 regular season home baseball games of any team in each year, as designated by that team, when such games are scheduled to begin at or after 4:10 P.M. or at or prior to 7:05 p.m., or scheduled to begin no later than 8:00 p.m. if required by an asserted national television obligation; provided, however, (a) Up to 35 regular season home baseball games may be scheduled to start at the times set forth in subsection (B)(2); (b) The remaining eight games shall be used to satisfy any requirements of an asserted national television obligation that requires such team to reschedule a day game to a game starting during the times set forth in subsection (B)(2). Any games scheduled pursuant to this subparagraph shall be promptly reported to the Alderman of the affected ward and the Corporation Counsel. (3) Any baseball game scheduled to begin at or prior to 2:01 p.m. or in the case of a double-header where the second game is scheduled to begin reasonably promptly after the end of the first game; (4) Up to six non-double-header baseball games scheduled to start on a Friday afternoon between 2:01 p.m. and 4:10 p.m. per in calendar year. (5) During the duration of any contract between the city and any person, firm, corporation, legal entity, or professional sports team, that is authorized by the City Council, any games, contests, sports, amusements, or any other Events that may be held according to the terms of that contract or any other ordinance; (6) Any Event expected to have less than approximately 12,500 in attendance; (7) Reserved. (8) Up to four Events scheduled to take place between the hours of 8 p.m. and 8 a.m. expected to have more than 12,500 people in attendance, to be determined by the owner or operator of a stadium, or a promoter of the Event to be held at such stadium, subject to the following: (a) The owner, operator or promoter, whichever is applicable, shall notify the City, in writing, of the proposed date and time of such Event; (b) Such Event shall be allowed at the date and time specified in the notice; provided that the Event shall not be scheduled on any night Sunday through and including Thursday between Labor Day and June 15, nor the last Sunday in June; (c) Unless otherwise authorized by ordinance, an Event authorized under this paragraph (8) shall end no later than 11:00 P.M. Events may be held on any day of the week, including on a Friday or Saturday night; and (d) The owner, operator or promoter shall comply with the neighborhood protection provisions found in the ordinance adopted by the City Council on February 11, 2004, and appearing in the Journal of the Proceedings of the City Council of the City of Chicago of such date at pages 18722 – 18772 and as amended thereafter; and all provisions imposing obligations and protections enumerated in Sections 3, 4, 5(A) and (B), 6 and 7(A)(1) of the ordinance adopted by the City Council on March 13, 2013, and published at pages 48631 – 48638 of the Journal of the Proceedings of the City Council of the City of Chicago of such date. All such provisions are hereby incorporated as if fully set forth, except to the extent there are any inconsistencies, then the provisions of this section shall apply. (9) Except for Events with attendance under 12.500 people or those authorized by paragraph (B)(10), all other Events in excess of the four Events permitted in subsection(B)(8), which are scheduled to take place between the hours of 8 p.m. and 8 a.m. shall be counted as a night baseball game for the purposes of the limit of 43 night baseball games in a season, and if too late in the year to reduce the number of night games in that year, shall be counted toward the permissible number of night games in the following year. Such Events shall be subject to the provisions of paragraph (8)(a) – (d); (10) To any Event which takes place between October 1 and March 31, however, non-sporting Events must end no later than 11:00 P.M; provided that an Event may end no later than 2 a.m. when the Event is: (1) expected to have less than 500 people in attendance; and (2) conducted within a totally enclosed area during the duration of the Event. Such Event shall not be counted for purposes of the limit of 43 night baseball games in a season.. (C) Except as otherwise provided in this section, no regular season baseball game may be scheduled to begin after 4:10 p.m. on a Friday or a Saturday, except up to three regular season games per year may be scheduled on a Saturday after 4:10 p.m. if required by: (1) An asserted national television obligation, or (2) Other circumstance beyond the control of any person, firm, corporation, team, or legal entity whose stadium or playing field is subject to this section, such as by a collective bargaining agreement. (D) Games or Events scheduled to begin at or prior to 8:00 p.m. may begin on the same day upon the conclusion of weather delays or delays caused by other similar unexpected natural occurrences or by death or serious personal injury to a fan or a player or management employee of any person, firm, corporation, team, or legal entity whose stadium or playing field is subject to this section, all beyond the control any person, firm, corporation, team, or legal entity whose stadium or playing field is subject to this section, without restriction as to time except those dealing with public safety; provided that any Event authorized under subsection (B)(8) shall end no later than 11 p.m. regardless of the time it commenced. (E) Baseball games and other permissible events scheduled to begin at or prior to 8:00 p.m., as permitted by this section, once commenced, may be concluded without restriction as to time except those dealing with public safety. (F) Notwithstanding subsections (B)(2) and (B)(8), baseball games and other Events, regardless of the originally scheduled start time, which are postponed for the reasons listed in subsection (D), may be re-scheduled to a different date to begin during the times set forth in subsection (B)(2) or (B)(8), whichever is applicable, in the same or subsequent calendar year, provided that: (1) for any professional baseball game rescheduled under this subsection, the owners or operators of the stadium shall request that Major League Baseball not reschedule such game to the day of the Pride Parade if the City has provided notice to such owners or operators of the dates when the Pride Parade will be held no later than June 30 of the year preceding the Pride Parade, and if no notice was provided, then request the game not be rescheduled for the last Sunday in June. (2) if a professional baseball game or Event originally scheduled to take place during the day is rescheduled to take place during the times set forth in subsection (B)(2) or (B)(8), whichever is applicable, such game or Event shall count towards the number of night baseball games or Events authorized by those subsections; and (3) Any baseball game or Event rescheduled pursuant to this provision shall result in a reduction of permitted baseball games or Events under subsection (B)(2) or subsection (B)(8), whichever is applicable, in the following calendar year, if the games or Events allocated in subsection (B)(2) or (B)(8) have already been scheduled. (G) The owners, operators of any stadium, or any person promoting any Event, subject to this section, or the owners, operator of any stadium, or person promoting any Event, which is expected to have more than 12,500 people in attendance shall provide not less than 21 days notice to the Alderman of the affected ward, to the City Council and to a designated official of the City, or if 21 days notice is not possible, then notice to the Alderman of the affected ward, to the City Council and to a designated official of the City shall be provided reasonably promptly after such Event is scheduled. (H) Subsection(B)(2) of this section shall not be subject to amendment with regard to any game included in the schedule proposed by Major League Baseball for the following calendar year. (I) The owners or operators of any stadium where any baseball game is held that is subject to the provisions of the ordinance adopted by the City Council on February 11, 2004, and appearing in the Journal of the Proceedings of the City Council of the City of Chicago of such date at pages 18722 – 18772 shall comply with the neighborhood protection provisions found in the ordinance, or as thereafter amended. All such provisions are hereby incorporated as if fully set forth, except to the extent there is any inconsistency, then the provisions of this section shall apply. (J) The owner or operator of a stadium subject to this section, or promoter of an Event held at such stadium, whichever is applicable, shall be responsible for reasonable costs incurred by the City for City services supporting the Event, consistent with the costs paid by other similarly situated venues; provided that costs incurred for any additional city services above the city services normally provided as of the effective date of this 2013 amendatory ordinance, shall not be assessed, unless the additional services are required by federal or state law. The determination of the need and cost for the City services shall be based on such factors as the expected pedestrian and vehicular traffic and congestion, estimated attendance, density of area, number of street closures, street cleaning or refuse disposal, and other such similar factors. (K) The terms of this section may be enforced by the Corporation Counsel through injunction or any other suit, action or proceeding at law or in equity. (L) The sale of beer or alcohol in the open air public seating areas or related public concourses shall end: (1) at Events, no later than 11:00 p.m., and (2) at major league baseball games, no later than 10:30 p.m., or the end of the 7th inning, whichever occurs first. (M) (1) The owner or operator of a stadium, or promoter of an Event held at such stadium who violates subsection (B)(8)(c) shall be fined: (i) $5,000 for any Event that ends between 11:01 p.m. and 11:30 p.m.; (ii) $15,000 for any Event that ends between 11:31 p.m. and midnight; and (iii) $30,000 for each additional half-hour increment after midnight that an Event fails to end. Each period of violation shall be deemed a separate offense and the fine applied to each period of violation shall be separately assessed from the fine imposed for any preceding period of violation. The owner or operator of the stadium and the promoter of an Event found in violation of subsection (B)(8)(c) shall be jointly and severally liable for such violation. (2) Except where otherwise specifically provided, any person who violates this section shall be fined not less than $300.00 nor more than $5,000.00 for each offense. It shall be unlawful for any licensee to conduct or permit any person to conduct any exhibition where the intent or outcome of the exhibition or match is to injure or harm one of the contestants and the exhibition is unregulated by the State of Illinois. It is unlawful for any licensee to conduct or permit any person to conduct any raffle, lottery or chance distribution of money, or article of value, or any gift enterprise or any form of gambling upon the licensed premises; provided, however, that nothing in this Section shall be construed to prohibit any conduct authorized by: (1) Chapter 4-155; or (2) the Sports Wagering Act, 230 ILCS 45/25-1, et seq. or the Illinois Gambling Act, 230 ILCS 10/1, et seq., each as in effect on May 4, 2022. Municipal Code of Chicago § 4-156-480 Liability for certain additional city services.

4-156-480 Liability for certain additional city services. (A) The business entity benefiting from traffic management services provided by the city in connection with an event presented at a qualifying stadium, conference or exhibition facility shall pay to the city an amount equal to the sum of (1) 140 percent of the average non-overtime hourly rate for Chicago police officers, for each hour of time worked by a police officer in providing traffic management services related to the event; plus (2) 140 percent of the average non- overtime hourly rate for Chicago traffic aides, for each hour of time worked by a traffic control aide in providing traffic management services related to the event. (B) No later than 30 days before an event to be held in a major stadium, conference or exhibition facility, the business entity benefiting from traffic management services shall notify the superintendent of police and the executive director of emergency management and communications of the date, time and nature of the event, and the teams or other entities participating in the event. (C) For purposes of this section: (1) "Business entity benefiting" means: (a) The Chicago-based team participating in a professional baseball, football, basketball, hockey or soccer game, regardless of whether the game is considered pre-season, regular season or playoff. (b) With regard to any other event, the person who contracts for the use of the stadium, conference or exhibition facility for the presentation or conduct of the event. (2) "Qualifying stadium, conference or exhibition facility" means an enclosed, partially enclosed or open, facility having a capacity in excess of 7,000, but does not include a facility owned by an educational, charitable, religious, eleemosynary or veterans' organization that is organized on a not-for-profit basis. (D) The police department and the office of emergency management and communications shall maintain a record of the hours worked by police officers and by traffic control aides in providing traffic management services related to an event at a qualifying stadium facility. The records shall indicate the date, location and nature of each event; the number of police officers, if any, providing traffic management services related to the event; the total number of hours worked by those police officers; the number of traffic control aides, if any, providing traffic management services related to the event; and the total number of hours worked by those traffic control aides. At the end of each calendar month, the records shall be delivered to the department of finance, which shall issue separate bills to each business entity benefiting from traffic services. The business entity shall pay the amount billed no later than 30 days after the date of mailing indicated on the bill. Amounts due under this section shall constitute a debt due and owing the city. 4-156-500 Sports plaza - Additional requirements. (a) For purposes of this section, "Sports Plaza" has the same meaning ascribed to that term in Section 4-160-010. (b) If a Sports Plaza, or any portion thereof, is used or intended for use for any amusement, a public place of amusement license under this Article III shall be required, regardless of whether the use is incidental to the Sports Plaza's principal use. Application for such public place of amusement license shall be made pursuant to this Article III. (c) The licensee shall enter into a plan of operation with the commissioner for amusements to be held on the Sports Plaza. The plan shall include provisions that are useful or necessary to mitigate any adverse effects on the surrounding community and shall include specific provisions for amusements as to which the attendance is expected to be greater than 500 people. Such provisions shall include, but are not limited to, providing additional security personnel, restricting hours of operation, providing trash pickup services, or any other reasonable restrictions. It shall be a violation if a licensee fails to comply with all requirements of the approved written plan of operation and shall subject the licensee to a fine or license suspension or revocation. (d) All other applicable provisions of this chapter apply. (e) Except where otherwise specifically provided, any person who violates this section shall be fined not less than $300 nor more than $5,000 for each offense. A separate and distinct offense shall be held to have been committed each day any person continues to violate any of the provisions hereof. (Added Coun. J. 6-22-16, p. 26612, § 3; Amend Coun. Municipal Code of Chicago § 4-156-510 Violation - Penalty.

4-156-510 Violation - Penalty. Any person violating any provision of this chapter for which no other penalty is specified shall be fined not less than $200.00 nor more than $500.00 for each offense.
