No. 995 By Council Member Recchia (by request of the Mayor) A Local Law in relation to the date of submission by the mayor of a preliminary management report and the date prior to which the council shall conduct public hearings and the date by which the council shall submit a report or reports pertaining thereto, the date of submission by the director of management and budget and the director of city planning of a draft ten-year capital strategy, the date of submission by the city planning commission of a report on the draft ten-year capital strategy, the date of submission by the mayor of the preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects, the date of submission by the mayor of the preliminary budget, the date of publication by the director of the independent budget office of a report on revenues and expenditures, the date of submission by the community boards of statements in regard to the preliminary budget, the date of submission by the commissioner of finance of an estimate of the assessed valuation of real property and statement of real property taxes due, expected to be received, and uncollected, the date of submission by the mayor of a tax benefit report, the date of submission by the borough boards of statements on budget priorities, the date of submission by the council of estimates of the financial needs of the council, the date of submission by the borough presidents of proposed modifications of the preliminary budget, the date of publication by the director of the independent budget office of a report analyzing the preliminary budget, the date by which the council shall hold hearings and submit recommendations in regard to the preliminary budget, and the date of submission by the campaign finance board of estimates of the financial needs of the campaign finance board, relating to the fiscal year two thousand fourteen. Be it enacted by the Council as follows: Section 1. During the calendar year 2013 and in relation to the 2014 fiscal year: 1. Notwithstanding any inconsistent provisions of section 12 of the New York city charter, as amended by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a preliminary management report as therein described not later than February 22, 2013, and the council shall conduct public hearings on such report prior to April 12, 2013 and submit to the mayor and make public not later than April 12, 2013, a report or reports of findings and recommendations. 2. Notwithstanding any inconsistent provisions of section 228 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of management and budget and the director of city planning shall pursuant to such section jointly submit a draft ten-year capital strategy as therein described not later than February 7, 2013. 3. Notwithstanding any inconsistent provisions of section 234 of the New York city charter, as added by vote of the electors on November 7, 1989, the city planning commission shall pursuant to such section submit a report on the draft ten-year capital strategy as therein described not later than March 6, 2013. 4. Notwithstanding any inconsistent provisions of section 235 of the New York city charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit and publish a preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects as therein described not later than February 7, 2013. 5. Notwithstanding any inconsistent provisions of section 236 of the New York city charter, as amended by local law number 25 for the year 1998, the mayor shall pursuant to such section submit a preliminary budget as therein described not later than February 7, 2013. 6. Notwithstanding any inconsistent provisions of section 237 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall publish a report on revenues and expenditures as therein described on or before February 14, 2013. 7. Notwithstanding any inconsistent provisions of section 238 of the New York city charter, as added by vote of the electors on November 7, 1989, each community board shall pursuant to such section submit a statement and recommendations in regard to the preliminary budget as therein described not later than February 28, 2013. 8. Notwithstanding any inconsistent provisions of section 239 of the New York city charter, as added by vote of the electors on November 7, 1989, the commissioner of finance shall pursuant to such section submit an estimate of the assessed valuation of real property and a certified statement of all real property taxes due as therein described not later than February 28, 2013. 9. Notwithstanding any inconsistent provisions of section 240 of the New York city charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a tax benefit report as therein described not later than February 28, 2013. 10. Notwithstanding any inconsistent provisions of section 241 of the New York city charter, as added by vote of the electors on November 7, 1989, each borough board shall pursuant to such section submit a statement of budget priorities as therein described not later than March 20, 2013. 11. Notwithstanding any inconsistent provisions of section 243 of the New York city charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section approve and submit estimates of the financial needs of the council as therein described not later than March 21, 2013. 12. Notwithstanding any inconsistent provisions of section 245 of the New York city charter, as added by vote of the electors on November 7, 1989, each borough president shall pursuant to such section submit any proposed modifications of the preliminary budget as therein described not later than March 20, 2013. 13. Notwithstanding any inconsistent provisions of section 246 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall pursuant to such section publish a report analyzing the preliminary budget as therein described on or before March 29, 2013. 14. Notwithstanding any inconsistent provisions of section 247 of the New York city charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section hold hearings and submit recommendations as therein described not later than April 12, 2013. 15. Notwithstanding any inconsistent provisions of subdivision c of section 1052 of the New York city charter, as added by vote of the electors on November 3, 1998, the campaign finance board shall pursuant to such subdivision submit estimates of the financial needs of the campaign finance board as therein described not later than March 20, 2013. § 2. This local law shall take effect immediately and shall be retroactive to and deemed to have been in full force and effect as of November 1, 2012.

A Local Law to amend the administrative code of the city of New York, in relation to requiring city plantings to be stormwater tolerant so as to facilitate stormwater retention and filtration. Be it enacted by the Council as follows: Section 1. Legislative findings and intent. The Council finds that the PlaNYC Sustainable Stormwater Management Plan of 2008 recommends the use of green infrastructure as a desirable means to control and detain stormwater. Such control and detention is important because combined sewer overflows (CSOs) discharge over 27 billion gallons of sewage and polluted rainwater into the New York harbor every year. The Council also finds that initiatives undertaken by the City of New York, including the Green Infrastructure Plan, contemplate planting thousands of trees and many thousands of plants annually. Therefore the Council finds that it is in the best interests of the City to use stormwater-tolerant plantings to maximize the capacity for stormwater retention and infiltration. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect immediately.

Be it enacted by the Council as follows: Section 1. Legislative findings and intent. The Council finds that native plants are the building blocks of our biological diversity and the cornerstone of our natural ecosystems. The Council also finds that invasive plant species are a detriment to the environment, out-competing native plant species and the animals that depend on them, and leaving them vulnerable to depletion or extinction. Further, native plantings may also result in reduced maintenance costs. Therefore the Council finds that it is in the best interests of the City to require greater native biodiversity and limit the use of invasive species in public landscapes. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect immediately.

Be it enacted by the Council as follows: Section 1. Study of underground power lines. a. The office of long-term planning and sustainability shall conduct a study of the utilization of underground power lines in the city and submit the findings of such study to the mayor and council within six months of the effective date of this local law. b. To the extent that the data required below has been made available by local electric corporations that provide electric service in the city, such study shall include, but not be limited to: 1. General information. Disaggregated by borough, and by community district or other areas as defined by the office of long-term planning and sustainability, the names of local electric corporations that provide electric service in the city, and for each such electric corporation the number of residential and commercial customers, respectively, and the estimated number of persons serviced by underground power lines and above ground power lines, respectively, and the average cost per mile for maintenance and repair of underground power lines and above ground power lines, respectively, for the most recent calendar year that such data is available. 2. Weather related outages. Disaggregated by borough, and by community district or other areas as defined by the office of long-term planning and sustainability, the total number of power outages resulting from a failure of all infrastructure servicing a customer that were directly caused by damage resulting from weather events for the past five years, including, but not limited to, damage resulting from: trees and wires downed by wind, snow or ice; heat; cold; rain; and flooding. The study shall provide a summary and statistical analysis of the data collected on each outage, including (i) the number of customers affected, (ii) the estimated number of persons affected, (iii) critical infrastructure affected, (iv) whether the power lines were underground or above ground, (v) the cause and length of time of each such outage, and (vi) the costs of restoring service. 3. General network reliability. Disaggregated by borough, and by community district or other areas as defined by the office of long-term planning and sustainability, the total number of power outages resulting from a failure of all infrastructure servicing a customer other than those directly caused by damage resulting from weather events for the most recent calendar year that such data is available, disaggregated by the cause of such outages. The study shall provide a summary and statistical analysis of the data collected on each outage, including (i) the number of customers affected, (ii) the estimated number of persons affected, (iii) critical infrastructure affected, (iv) whether the power lines were underground or above ground, (v) the cause and length of time of each such outage, and (vi) the costs of restoring service. 4. Costs of undergrounding power lines. The estimated per mile cost of undergrounding power lines within the city of New York, including a breakdown of the costs for labor and materials, and the variables, including population density, that would affect the final cost of undergrounding. 5. Recommendations. A list of neighborhoods or service areas where relocating above ground power lines to underground locations would not be practical or would result in more severe power outages and the considerations that went into such determination; and a list of neighborhoods or service areas where relocating above ground power lines to underground locations would be most advantageous and the considerations that went into such determination. § 2. This local law shall take effect immediately.

NYC L.L. 2013/030 In relation to prohibited acts committed during a local state of emergency and to certain technical revisions to chapter 1 of title 10 of such code

L.L. 2013/030 Enactment date: 4/2/2013 Preconsidered Int. No. 1016 By Council Members Oddo, the Speaker (Council Member Quinn), Vallone, Recchia, Mendez, Ignizio, Ulrich, Rose, Arroyo, Chin, Comrie, Gentile, Greenfield, King, Nelson, Palma and Halloran A Local Law to amend the administrative code of the City of New York, in relation to prohibited acts committed during a local state of emergency and to certain technical revisions to chapter 1 of title 10 of such code. Be it enacted by the Council as follows: Section 1. Declaration of legislative findings and intent. The Council hereby finds and declares that in the aftermath of Tropical Storm Irene and Super Storm Sandy there were instances where criminals took an emergency situation as an opportunity to target vulnerable New York City residents and areas of the City for their own personal gain. Crimes of opportunity, including those causing physical injury, or those that involve damaging, taking, or entering property, or fraudulently impersonating public servants, when committed during a local state of emergency and in areas of the City made vulnerable by such emergency, are distinguishable from and more egregious than crimes that occur outside of a crisis. Such acts cause harm and disruption to defenseless residents of the City of New York above and beyond what has already been caused by the circumstances surrounding the emergency, as well as harm and disruption to the City as a whole, both during the emergency and during recovery efforts thereafter. Additionally, the actions of these opportunistic criminals can reverberate throughout the entire City because they lead to the diversion of critical City resources, which could have harmful effects on any of this City's eight million residents. When criminals target mandatory evacuation areas during mandatory evacuation periods, the problems posed by such criminal conduct are worsened. Mandatory evacuations are declared by the Mayor to secure the safety of the most at-risk New Yorkers, however, many of these residents do not evacuate for fear of their homes being looted. In fact, during Super Storm Sandy reports show that some people, particularly those in Staten Island, lost their lives for this very reason. Moreover, residents of evacuation zones are likely to suffer the most physical or financial damage and are therefore much more susceptible to criminals who prey on the misfortunes of others. For all of these reasons, it is the intent of the Council to provide all law-abiding New Yorkers with a safe and secure environment during times of emergency. To do so the Council finds that it is necessary to deter crimes of opportunity committed during local states of emergency in mandatory evacuation zones and in areas where access to essential goods and services has been reduced or lost by making such actions punishable criminally and civilly, with heightened penalties for such activity when it takes place in mandatory evacuation zones and during mandatory evacuation periods. * * * [Consolidated provisions are not included in this Appendix A] * * * § 4. This local law shall take effect 60 days after its enactment into law.

NYC L.L. 2013/031 In relation to waiver of fees for businesses recovering from damage caused by Hurricane Sandy

No. 1017 By Council Members Reyna, Chin, the Speaker (Council Member Quinn), Recchia, Lappin, Arroyo, Mealy, Koo, Eugene, Vallone, Barron, Cabrera, Comrie, Greenfield, James, King, Koslowitz, Lander, Mark-Viverito, Mendez, Nelson, Palma, Richards, Rose, Vacca, Vann, Halloran and Ulrich (in conjunction with the Mayor) A Local Law in relation to waiver of fees for businesses recovering from damage caused by Hurricane Sandy. Be it enacted by the Council as follows: Section 1. Statement of intent. A severe storm, known as Hurricane Sandy, recently hit New York City causing heavy flooding, power outages, and widespread damage and disrupting the operation of businesses offering services that are essential to the economic vitality of the city and to the health and well-being of its residents. The expeditious resumption of business in storm damaged areas will be encouraged and incentivized by waiving certain fees that would otherwise be payable to agencies of the city for permits, licenses and inspections required by law in order for such businesses to rebuild and to operate. § 2. The fees listed in section 5 of this local law payable to city agencies in connection with the recovery from the effects of Hurricane Sandy by businesses that were in operation as of October 26, 2012, and that meet the eligibility criteria of this section, as determined by the Mayor or his or her designee, may be waived as set forth in this local law. The waiver of fees shall apply to fees otherwise payable to agencies on or prior to December 31, 2013 in connection with the repair or reconstruction of space occupied or to be occupied by eligible businesses, the alteration or repair of systems owned by eligible businesses and serving only space occupied by such eligible businesses, or the replacement of a vehicle required to do business. For the purposes of this section a building shall not be considered an eligible business. Businesses eligible for waiver of fees pursuant to this local law must meet the following criteria: a. As of October 26, 2012, the business must (i) have been located in space that is in a building within the boundaries of a Disaster Recovery Area, as defined in section 4 of this local law; or (ii) have been located in a building that, after Hurricane Sandy, was assigned a red, yellow or green placard by the Department of Buildings; or (iii) have been a vehicle. b. On or prior to October 31, 2013 the owner of the business must apply to the mayor or his or her designee for a determination of eligibility for waiver of applicable fees pursuant to this local law on forms and in a manner to be prescribed by the mayor or his or her designee. The owner must submit written certification signed by such owner or such other documentation as may be required by the mayor or his or her designee, confirming that: (i) the space occupied by such business or the vehicle required for the operation of such business suffered substantial damage as a result of Hurricane Sandy that has interfered significantly with and that continues to interfere significantly with the operation of such business in the manner in which it operated prior to Hurricane Sandy; and (ii) the business currently occupies or intends to re-occupy space in the same building that it occupied prior to Hurricane Sandy or in a new building within the same Business Recovery Zone, or intends to replace a vehicle required for the operation of the business that was rendered inoperable as a result of Hurricane Sandy. § 3. The owner of the business shall present the approved eligibility application to the applicable agency to obtain the fee waiver. The fee waiver may be granted only for eligible fees that would otherwise be payable by such business on or prior to December 31, 2013. An agency may refund fees paid by an eligible business after October 26, 2012 and prior to the effective date of this local law provided that an application for such refund is made to the agency on or prior to May 31, 2013. § 4. For the purposes of this local law the term Disaster Recovery Area means: a. The area within Hurricane Evacuation Zones A and B, as designated by the New York City Office of Emergency Management on the New York City Hurricane Zone Maps in effect as of October 26, 2012; or b. The area within any Business Recovery Zone created by the Department of Small Business Services and delineated on maps published on such department's web site. § 5. The following fees are eligible for waiver pursuant to this local law: a. Department of Consumer Affairs. Fees required by Administrative Code § 20-314, and inspection fees required by Administrative Code § 20-250(c), Administrative Code § 20-501(b) and 6 RCNY § 2-362(m)(1). b. Department of Environmental Protection. Fees required by Administrative Code §§ 24-136, 24-137, 24-138, 24-139 and 24-140. c. Department of Buildings. Application, permit and inspection fees required by Administrative Code § 28-112 for the following work: plumbing, scaffolds, sidewalk sheds, fences, signs, boilers, demolition, elevators, construction, limited alterations and after hours variances as well as fees required by Administrative Code § 27-3018 with respect to electrical work. d. Fire Department. (1) Fees required by New York City Fire Code Sections A03.1(3) and A03.1(37) with respect to the inspection and testing of liquid motor fuel dispensing system installations. (2) Fees required by New York City Fire Code Section A03.1(20) with respect to acceptance testing of fire protection systems, including fire alarm systems, fire extinguishing systems and fire pumps. (3) Fees required by New York City Fire Code Section A03.1(45) and fire department rule 3 RCNY § 4601-01(e) with respect to plan examinations applicable to review of design and installation documents for liquid motor fuel dispensing systems and fire protection systems. e. Department of Small Business Services. Fees required by 66 RCNY § 4-01 with respect to waterfront construction work, equipment use permits, mooring permits, fill work permits and certificates of completion. f. Department of Transportation. Fees required by 34 RCNY § 2-03 with respect to street opening permits, building operations and construction activity permits, debris containers, sidewalk construction permits, vault permits and canopy permits. g. Landmarks Preservation Commission. Fees required by 63 RCNY § 13-04 with respect to certificates of appropriateness and certificates of no effect h. Taxi and Limousine Commission. Fees required by 35 RCNY § 58-07(b)(2), § 58-07(h)(1-3),§ 59A-04(e)(7) and § 59A-07(f)(2-4) with respect to fees for replacement vehicle license plates, replacement medallions, transfer of vehicle licenses and for-hire vehicle inspections. § 6. Within 90 days after the repeal of sections 1 through 5 of this local law pursuant to section 7 of this local law, the mayor or the mayor's designee shall compile information, so as to submit a report to the mayor and the speaker regarding the number of businesses that submitted applications for a waiver of applicable fees pursuant to this local law, including the number that were determined to be eligible and the number that were determined not to be eligible. The report shall specify the geographic distribution of such businesses. § 7. This local law shall take effect immediately except that sections 1 through 5 of this local law shall remain in effect up to and including December 31, 2013 after which such sections 1 through 5 shall be deemed repealed.

NYC L.L. 2013/032 In relation to studying the feasibility of developing geothermal energy

No. 694-A By Council Members Gennaro, Garodnick, Brewer, Fidler, Gentile, James, Koppell, Lander, Mark-Viverito, Palma, Williams, Arroyo, Levin, Dromm, Van Bramer, Barron, Eugene, Greenfield, Jackson, Richards, Halloran and Ulrich A Local Law in relation to studying the feasibility of developing geothermal energy. Be it enacted by the Council as follows: Section 1. Definitions. For the purposes of this local law, the following terms shall mean: a. "Energy" shall mean work or heat that is, or may be, produced from any fuel or source, including, but not limited to, electrical, fossil, geothermal, wind, hydro, solid waste, tidal, solar and nuclear. b. "Geothermal energy" shall mean the stored thermal energy of the Earth that is recovered to heat or cool buildings, or generate electricity. c. "Geothermal ground coupling" shall mean the arrangement of piping and fluid handling equipment designed to exchange the stored thermal energy of the Earth with a building. d. "Geothermal system" shall mean a type of heating, ventilating and air conditioning (HVAC) system used to exchange the stored thermal energy of the Earth with a building, to provide space heating and cooling, and hot water through the use of geothermal ground coupling and mechanical heat exchange devices such as heat pumps, modular reversible chillers, or other heat exchangers. § 2. Geothermal energy study and recommendations. As provided in section three of this local law, the office of long-term planning and sustainability shall submit a study to the mayor and the speaker of the council to explore the feasibility of developing geothermal energy resources in the city, which shall include, but need not be limited to: a. a map that visually identifies or estimates areas of the city that may be appropriate for geothermal energy exchange with the Earth based on subsurface geologic conditions and the type or types of geothermal system that would be appropriate for each such area, and that can be used to determine whether a building may be within any such area; b. a summary of building characteristics that would be suitable for a retrofit installation of a geothermal system; c. an analysis of the viability of developing large district or campus-scale geothermal ground couplings to serve clusters of buildings; d. a summary of the applicable federal, state, and city laws, rules, regulations, filing requirements, and fees for the installation and operation of geothermal systems; e. a summary of the specific practical and legal impediments, if any, to the installation and operation of geothermal systems; f. a summary of existing technical standards and/or guidelines for geothermal system installations in the city of New York; and g. recommendations to promote the installation and use of geothermal systems in new construction, alterations, and retrofits of buildings. § 3. The study required by section two of this local law shall be submitted to the mayor and the speaker of the council on or before June 1, 2014. The statistical or factual information compiled by the city and utilized in such study shall be made available to the public on the city's open data web portal at the time the study is submitted. § 4. This local law shall take effect immediately.

Be it enacted by the Council as follows: Section 1. Retrospective review of existing violations. Within 120 days of the enactment of this section, the department of buildings, the department of consumer affairs, the department of health and mental hygiene, the department of environmental protection, the department of sanitation, the department of transportation, and the fire department shall conduct a retrospective review of those provisions of the administrative code, the rules of the city of New York, and the New York city health code which establish violations and which are enforced by such agency, and shall submit a report to the mayor and the speaker regarding those existing violations for which a penalty or fine may be assessed for which there is no cure period or other opportunity for ameliorative action by the party or parties subject to enforcement prior to the imposition of a penalty or fine. This report shall include: (1) a description of each violation for which the agency recommends that a cure period or other opportunity for ameliorative action be provided prior to the imposition of a penalty or fine, and the basis for such conclusion; and (2) a list of all other existing violations established by the agency's rules for which a penalty or fine may be assessed for which there is no cure period or other opportunity for ameliorative action by the party or parties subject to enforcement prior to the imposition of a penalty or fine. This list shall identify, either on individual item or aggregate basis, the rationale for the absence of a cure period or other opportunity for ameliorative action. § 2. This local law shall take effect immediately.

No. 1032 By Council Members Recchia, Comrie and Koo (by request of the Mayor) A Local Law in relation to the date of issuance and publication by the Mayor of a ten-year capital strategy, the date of submission by the Mayor of the proposed executive budget and budget message, the date of submission by the Borough Presidents of recommendations in response to the Mayor's executive budget, the date of publication of a report by the director of the independent budget office analyzing the executive budget, the date by which the Council hearings pertaining to the executive budget shall conclude, the date by which if the expense budget has not been adopted, the expense budget and tax rate adopted as modified for the current fiscal year shall be deemed to have been extended for the new fiscal year until such time as a new expense budget has been adopted, the date by which if a capital budget and a capital program have not been adopted, the unutilized portion of all prior capital appropriations shall be deemed reappropriated, the date of submission by the Mayor of an estimate of the probable amount of receipts, the date by which any person or organization may submit an official alternative estimate of revenues, the date by which if the Council has not fixed the tax rates for the ensuing fiscal year, the commissioner of finance shall be authorized to complete the assessment rolls using estimated rates, and related matters, relating to the fiscal year two thousand fourteen. Be it enacted by the Council as follows: Section 1. During the calendar year 2013 and in relation to the 2014 fiscal year: 1. Notwithstanding any inconsistent provisions of section 248 of the New York city charter, as added by vote of the electors on November 7, 1989, the Mayor shall pursuant to such section issue and publish a ten-year capital strategy as therein described not later than May 2, 2013. 2. Notwithstanding any inconsistent provisions of section 249 of the New York city charter, as added by vote of the electors on November 7, 1989, subdivision a of section 249 as amended by local law number 25 for the year 1998, the Mayor shall pursuant to such section submit a proposed executive budget and budget message as therein described not later than May 2, 2013. 3. Notwithstanding any inconsistent provisions of section 251 of the New York city charter, as added by vote of the electors on November 7, 1989, each borough president shall pursuant to such section submit recommendations in response to the Mayor's executive budget as therein described not later than May 13, 2013. 4. Notwithstanding any inconsistent provisions of section 252 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall pursuant to such section publish a report analyzing the executive budget as therein described not later than May 21, 2013. 5. Notwithstanding any inconsistent provisions of section 253 of the New York city charter, as added by vote of the electors on November 7, 1989, the Council shall pursuant to such section hold hearings on the executive budget as therein described, which shall conclude by June 6, 2013. 6. Notwithstanding any inconsistent provisions of subdivision d of section 254 of the New York city charter, as added by vote of the electors on November 7, 1989, and subdivision b of section 1516 of the New York city charter, as amended by vote of the electors on November 7, 1989, if an expense budget has not been adopted by June 12, 2013 pursuant to subdivisions a and b of section 254 of the New York city charter, the expense budget and tax rate adopted as modified for the current fiscal year shall be deemed to have been extended for the new fiscal year until such time as a new expense budget has been adopted. 7. Notwithstanding any inconsistent provisions of subdivision e of section 254 of the New York city charter, as added by vote of the electors on November 7, 1989, if a capital budget and a capital program have not been adopted by June 12, 2013 pursuant to subdivisions a and b of such section, the unutilized portion of all prior capital appropriations shall be deemed reappropriated. 8. Notwithstanding any inconsistent provisions of subdivision a of section 1515 of the New York city charter, as amended by vote of the electors on November 7, 1989, the Mayor shall pursuant to such subdivision prepare and submit to the Council an estimate of the probable amount of receipts as therein described not later than June 12, 2013. 9. Notwithstanding any inconsistent provisions of subdivision d of section 1515 of the New York city charter, as added by vote of the electors on November 7, 1989, any person or organization may pursuant to such subdivision submit an official alternative estimate of revenues as described therein at any time prior to May 21, 2013. 10. Notwithstanding any inconsistent provisions of subdivision a of section 1516-a of the New York city charter, as amended by vote of the electors on November 7, 1989, if the Council has not fixed the tax rates for the ensuing fiscal year on or before June 12, 2013, the commissioner of finance shall pursuant to such subdivision be authorized to complete the assessment rolls using estimated rates and to collect the sums therein mentioned according to law. The estimated rates shall equal the tax rates for the current fiscal year. 11. Notwithstanding any inconsistent provisions of subdivision b of section 1516-a of the New York city charter, as amended by vote of the electors on November 7, 1989, if, subsequent to June 12, 2013, the Council shall, pursuant to section 1516 of the New York city charter, fix the tax rates for the ensuing fiscal year at percentages differing from the estimated rates, real estate tax payments shall nevertheless be payable in accordance with subdivision a of section 1516-a of such charter at the estimated rates, where the commissioner of finance has exercised the authority granted by subdivision a of section 1516-a of such charter to complete the assessment rolls using estimated rates and to collect the sums therein mentioned according to law. However, in such event, prior to the first day of January in such fiscal year, the commissioner of finance shall cause the completed assessment rolls to be revised to reflect the tax rates fixed by the Council pursuant to section 1516 of such charter, and an amended bill for the installment or installments for such fiscal year due and payable on or after the first day of January shall be submitted to each taxpayer in which whatever adjustment may be required as a result of the estimated bill previously submitted to the taxpayer shall be reflected. § 2. This local law shall take effect immediately.

This local law shall take effect immediately, provided that: a. the requirement to report on admissions data regarding limited secure placement facilities described in subparagraph ii of paragraph one of subdivision c of section 21-905, as added by section four of this local law, shall take effect in the report due by September 30, 2015; b. the requirement to report on the average daily population in non-secure placement facilities, as described in subparagraph i of paragraph one of subdivision d of section 21-905, as added by section four of this local law, shall take effect in the report due by September 30, 2014; c. the requirement to report on the average daily population in limited-secure placement facilities, as described in subparagraph ii of paragraph one of subdivision d of section 21-905, as added by section four of this local law, shall take effect in the report due by September 30, 2015; d. the requirement to report on the number of youth admitted who spent time either in non-secure placement only, limited secure placement only, or both non-secure and limited secure placement, as described in paragraph two of subdivision d of section 21-905, as added by section four of this local law, shall take effect in the report due by September 30, 2015; e. the requirement to report on transfers, as described in subdivision e of section 21-905, as added by section four of this local law, shall take effect in the report due by September 30, 2014; f. the requirement to disaggregate incident data by limited secure placement facilities, as described in subparagraph iv of paragraph two of subdivisions a and b of section 21-906, as added by section five of this local law, shall take effect in the report due by September 30, 2014; g. the requirement to publish data regarding bias-based incidents that occur in detention and placement facilities, pursuant to subparagraph viii of paragraph one of subdivision a of section 21-906, as added by section five of this local law, shall take effect in the report due by September 30, 2014; and h. the requirement to disaggregate data by youth transferred to an ACS placement facility, as described in subparagraph vii of paragraph two of subdivision c of section 21-905, as added by section four of this local law, shall expire three years after it shall have become a law. Notwithstanding the preceding sentence, the requirement to report on limited-secure placement facilities shall not take effect until such facilities have been operational for a period of three months.

Be it enacted by the Council as follows: Section 1. Legislative intent. The City Council finds that nearly every worker at some time during each year will need time off from work to take care of his or her health needs or the health needs of family members. Providing the right to earned sick time will therefore have a positive effect on the public health of the City and lessen the spread of and exposure to diseases. The Council further finds that supporting a healthy workforce will foster greater employee retention and productivity, and recognizes that responsible businesses that already have policies that allow time off that amounts to at least the minimum requirements under this law, and that can be taken for the same reasons and under the same conditions as enumerated in this legislation, will not be required to provide additional sick time. Providing sick time to workers at a time when the economy is improving, and ensuring that workers' jobs are protected when they need to take a sick day, strikes the right balance and will result in a more prosperous, safe and healthy City. * * * [Consolidated provisions are not included in this Appendix A] * * * § 4. Effect of invalidity; severability. If any section, subdivision, paragraph, sentence, clause, phrase or other portion of this local law is, for any reason, declared unconstitutional or invalid, in whole or in part, by any court of competent jurisdiction, such portion shall be deemed severable, and such unconstitutionality or invalidity shall not affect the validity of the remaining portions of this local law, which remaining portions shall continue in full force and effect. § 5. Independent Budget Office report. Pursuant to section 260 of the New York City Charter, no later than thirty months after employers with twenty or more employees are required to provide sick time to employees pursuant to section 3 of this local law, the Independent Budget office ("IBO") shall report to the Mayor and the Council and post on its website a report presenting data related to the costs and benefits of the Earned Sick Time Act. Such report shall include to the extent practicable given available data and methodologies, but not be limited to, data regarding wage and employment rates; businesses, including small business start-up and failure rates, expenses and revenues; and infectious disease rates; and shall include to the extent practicable a comparison of New York City with surrounding counties and large cities comparable to New York City that do not provide sick time. When reporting this data, the IBO director shall ensure that IBO uses appropriate and professionally accepted methodologies for comparing similar data and identify such methodologies in the report, and shall clearly specify the extent to which the earned sick time act can properly be determined to have had an impact on any of the data analyzed. The report shall be contingent on the availability to IBO of data the IBO director determines to be necessary to complete such report. The IBO director shall be authorized to secure such information, data, estimates and statistics from the agencies of the City as the director determines to be necessary in the preparation of such report, and such agencies shall provide such information to the extent that it is available in a timely fashion. § 6. Independent Budget Office review and determination. On December 16, 2013, the Independent Budget Office shall submit to the Council and the Mayor and post on its website a determination stating whether the most recent New York City Coincident Economic Index or similar successor index as published by the Federal Reserve Bank of New York (the "Index") is at or above its January 2012 level. If such determination states that the Index is below its January 2012 level, the IBO shall make and submit a determination every June 16 and December 16 of each year thereafter, until it determines that the Index is at or above its January 2012 level. § 7. This local law shall take effect pursuant to the following schedule: (1) If the December 16, 2013 Independent Budget Office ("IBO") determination shows that the most recent New York City Coincident Economic Index or similar successor index as published by the Federal Reserve Bank of New York (the "Index") is at or above its January 2012 level, then: (a) all employers that employ twenty or more employees must comply with the provisions of this local law on April 1, 2014; (b) all employers that employ fifteen to nineteen employees or a domestic worker must comply with the provisions of this local law regarding paid sick time on October 1, 2015; and (c) all employers with employees not entitled to paid sick time pursuant to chapter 8 of title 20 of the administrative code as added by section 3 of this local law, including those employers covered by paragraph 3 of subdivision a of section 20-913 of such code as added by section 3 of this local law during the period specified therein, must comply with the provisions of this local law on April 1, 2014. (2) If on December 16, 2013, the Index is not at or above its January 2012 level, but on June 16, 2014, the Index is at or above its January 2012 level as determined by the IBO, then: (a) all employers that employ twenty or more employees must comply with the provisions of this local law on October 1, 2014; (b) all employers that employ fifteen to nineteen employees or a domestic worker must comply with the provisions of this local law regarding paid sick time on April 1, 2016; and (c) all employers with employees not entitled to paid sick time pursuant to chapter 8 of title 20 of the administrative code as added by section 3 of this local law, including those employers covered by paragraph 3 of subdivision a of section 20-913 of such code as added by section 3 of this local law during the period specified therein, must comply with the provisions of this local law on October 1, 2014. (3) If on June 16, 2014, the Index is not at or above its January 2012 level, but on December 16, 2014, the Index is at or above its January 2012 level as determined by the IBO, then: (a) all employers that employ twenty or more employees must comply with the provisions of this local law on April 1, 2015; (b) all employers that employ fifteen to nineteen employees or a domestic worker must comply with the provisions of this local law regarding paid sick time on October 1, 2016; and (c) all employers with employees not entitled to paid sick time pursuant to chapter 8 of title 20 of the administrative code as added by section 3 of this local law, including those employers covered by paragraph 3 of subdivision a of section 20-913 of such code as added by section 3 of this local law during the period specified therein, must comply with the provisions of this local law on April 1, 2015. (4) If on December 16, 2014 the Index is not at or above its January 2012 level, then the IBO shall make a determination every June 16th and December 16th of each year thereafter until such Index is at or above its January 2012 level, and the effective date of this local law for all employers shall be on the succeeding October 1 or April 1, respectively, after the first such determination that the Index is at or above its January 2012 level. (5) Notwithstanding the preceding paragraphs (1) through (4), in the case of employees covered by a valid collective bargaining agreement in effect on the effective date prescribed by such preceding paragraphs, this local law shall take effect on the date of the termination of such agreement. (6) This local law shall take effect pursuant to the preceding paragraphs, and the commissioner of consumer affairs shall take such measures as are necessary for its implementation, including the promulgation of rules, prior to such effective date.

Additionally, the City does not receive recyclables from certain large residential and institutional buildings. Such activity has a negative economic impact on the City, jeopardizes the stability and integrity of the City's residential and commercial recycling program and makes it more difficult to achieve the City's recycling goals. Furthermore, there has been a dramatic increase in the theft of recyclable material containing refrigerants placed curbside by residents for DSNY removal. Theft of this material likely means that the chlorofluorocarbons (CFCs) and other refrigerants present in this material are not being properly removed pursuant to the Clean Air Act. The City Council finds that bias-based policing endangers New York City's long tradition of serving as a welcoming place for people of all backgrounds. The name and reputation of these officers should not be tarnished by the actions of those who would commit discriminatory practices. By passing this legislation, it is the intent of the City Council to create a safer city for all New Yorkers. The City Council expresses deep concern about the impact of NYPD practices on various communities in New York City. In particular, the Council expresses concern about the NYPD's growing reliance on stop-and-frisk tactics and the impact of this practice on communities of color. In 2002, the NYPD made approximately 97,000 stops. By 2010, the number of stops had increased to more than 601,000. Black and Latino New Yorkers face the brunt of this practice and consistently represent more than 80 percent of people stopped despite representing just over 50 percent of the city's population. Moreover, stop-and-frisk practices have not increased public safety, as year-after-year nearly 90 percent of individuals stopped are neither arrested nor issued a summons. Bias-based profiling by the police alienates communities from law enforcement, violates New Yorkers' rights and freedoms, and is a danger to public safety. It is the intent of the Council to combat this form of discrimination by requiring employers to provide reasonable accommodations to pregnant women and those who suffer medical conditions related to pregnancy and childbirth. Such a reasonable accommodation may include bathroom breaks, leave for a period of disability arising from childbirth, breaks to facilitate increased water intake, periodic rest for those who stand for long periods of time, and assistance with manual labor, among other things. Be it enacted by the Council as follows: Section 1. Legislative intent. Tobacco use remains a leading cause of preventable premature death in New York City, killing thousands of New Yorkers every year and increasing the risks of lung cancer, heart disease, stroke, asthma, emphysema, pre-term delivery, low birth weight, and many other types of cancer. Furthermore, cigarettes are the only consumer products that, when used exactly as intended, kill up to one-third of regular users. In 2002, the City launched a comprehensive program to reduce and prevent tobacco use. By implementing multiple strategies-including legislation restricting the use and sale of cigarettes and tobacco products, public education media campaigns, and the promotion of smoking cessation-and rigorously evaluating those efforts, the City has succeeded in reducing the prevalence of adult smoking by 28 percent, from 21.5 percent in 2002 to 15.5 percent in 2012. The prevalence of youth smoking has also declined substantially, from 17.6 percent in 2001 to 8.5 percent in 2007. Youth smoking rates, however, have plateaued since 2007, and remain at 8.5 percent as of 2011. Almost 100,000 persons between eighteen and twenty-four years of age, as well as 19,000 New York City public high school students, currently smoke. Most smokers start using tobacco as youth or young adults. In New York City, 80 percent of smokers started smoking before they turned twenty-one years old. Furthermore, there is strong evidence that people who begin smoking at an early age are more likely to develop a severe addiction to nicotine than those who start at a later age. The transition from experimental to regular smoking typically occurs around twenty years old. Most people who are not smokers by twenty-one years of age do not start smoking later in their lives. Raising the legal sales age for cigarettes and tobacco products will reduce access to both products in stores among young adults, between eighteen and twenty years old, and among youth who are younger than eighteen. According to one study, raising the minimum sales age to twenty-one could reduce the smoking rate over time among eighteen to twenty year olds by 55 percent and among fourteen to seventeen year olds by two-thirds. Raising the sales age will reduce access to cigarettes and tobacco products by youth because youth often acquire such products from older friends: 90 percent of people purchasing cigarettes for minors are between eighteen and twenty years old. Other jurisdictions that have increased the minimum sales age for cigarettes and tobacco products have seen decreases in tobacco use among youth. In 2005, Needham, Massachusetts increased the legal sales age from eighteen to twenty-one years. Between 2006 and 2012, the percentage of high school students in Needham who reported smoking declined from 12.9 percent to 5.5 percent, a decrease of over 50 percent. In 2007, England increased the minimum sales age from sixteen to eighteen years. By 2009, there was a 30 percent decline in smoking among youth between the ages of sixteen and seventeen, and younger students between the ages of eleven and fifteen were one-third less likely to be regular smokers than they had been previously. Electronic cigarettes have emerged as an alternative to cigarettes. Sales of electronic cigarettes doubled from nearly $300 million in 2011 to $600 million in 2012. According to data released by the Centers for Disease Control and Prevention, the percentage of middle and high school students in the United States who have used electronic cigarettes more than doubled from 2011 to 2012. Among high school students, the percentage who reported ever using an electronic cigarette increased from 4.7 percent in 2011 to 10.0 percent in 2012. More than 1.78 million middle and high school students nationwide tried electronic cigarettes in 2012. Electronic cigarettes are not regulated by the Food and Drug Administration (FDA) and contain nicotine, a potent and highly addictive substance, as well as potentially harmful chemicals. Although the long-term effects of electronic cigarette use require further study, the FDA has expressed concerns about their safety. Adolescents are more susceptible to the addictive properties of nicotine. Compared with adults, adolescents appear to display evidence of nicotine dependence at much lower levels of consumption. Thus, exposure to nicotine during adolescence may lead to a lifetime of nicotine addiction. Establishing a legal sales age of twenty-one years for electronic cigarettes will reduce electronic cigarette use among youth and prevent the emergence of a new generation that is addicted to nicotine. The Council therefore finds that establishing a minimum sales age of twenty-one for cigarettes, tobacco products, and electronic cigarettes will reduce smoking, tobacco, and electronic cigarette use among youth and young adults, and decrease the likelihood that members of this cohort will become smokers or electronic cigarette users later in life. This increase in the minimum sales age will also reduce high school students' opportunities to access tobacco or electronic cigarettes from legal buyers. Moreover, this proposal will simplify enforcement for retailers selling cigarettes, tobacco products, or electronic cigarettes because New York State driver's licenses conspicuously indicate when a licensee is under twenty-one years of age. Be it enacted by the Council as follows: Section 1. Legislative findings. The Council hereby finds that tobacco use is a leading cause of preventable premature death in the United States and the City of New York, and cigarette trafficking costs New York City and State hundreds of millions of dollars annually in foregone tax revenue. Cigarettes are the only consumer products that, when used exactly as intended, kill up to one-third of regular users. Currently, 981,000 adults smoke in New York City. In 2011, 28,000 New York City public high school students under the age of eighteen experimented with smoking for the first time; of those, more than one-third (35%) currently smoke. In total, approximately 19,000 New York City public high school students under the age of eighteen smoke. Smoking-related illnesses cost New Yorkers billions of dollars annually in health care costs and lost productivity. Given the substantial human and economic costs associated with tobacco use, New York City has taken numerous steps to reduce tobacco use among adults and to stop youth (persons under the age of eighteen) from starting to use cigarettes and tobacco products. In 2002, New York City employed a comprehensive, multifaceted tobacco control program incorporating the following components: (1) high cigarette excise taxes; (2) educational media campaigns on the risks of tobacco use; (3) a cessation program that helps people to quit; and (4) laws imposing restrictions and regulations on the sale and use of cigarettes and tobacco products. The City has succeeded in reducing the prevalence of adult tobacco use from 21.5% in 2002 to 15.5% in 2012, a 28% reduction. Prevalence among youth also declined substantially from 17.6% in 2001 to 8.5% in 2007. Youth smoking rates, however, have plateaued since, and remain at 8.5% as of 2011. Because tobacco use persists among youth and adults, the City must take further action. Preventing youth and young adults from taking up smoking is critical because, in New York City, 80% of adults who become daily smokers start smoking before reaching the age of twenty-one, and nationwide, 99% of smokers start by age twenty-six. The City employs a strong retail inspection program to prevent illegal sales to youth, conducting more than 9,000 retail inspections annually, only 10% of which result in violations. Nevertheless, more than a quarter of underage New York City public high school students who smoke buy their cigarettes from retail stores. The Council further finds, based on numerous studies, that high tobacco prices reduce tobacco consumption among both youth, who are especially price-sensitive, and adults. A 10% increase in cigarette prices reduces demand among adult smokers by 3-5% and among youth by 7%. High prices reduce the prevalence of tobacco use, the probability of trying tobacco for the first time, the average number of cigarettes consumed per smoker, initiation of daily smoking, and initiation of daily heavy smoking. In addition, reductions in smoking prevalence indirectly lead to even greater reductions by minimizing peer and parental influences and by helping addicted smokers to succeed in quitting. Just as high tobacco prices decrease demand, the availability of low-priced cigarettes and tobacco products increases demand and contributes to continued tobacco use. Low-priced cigarettes and tobacco products are widely available in New York City through a number of sources. First, contraband cigarettes are widely available at low effective prices that are only possible through tax evasion, thereby undermining the public health purpose of New York City's high cigarette taxes. Criminal actors take advantage of the disparities in state cigarette excise taxes along the East Coast by trafficking cigarettes from low-tax jurisdictions to high-tax jurisdictions, violating numerous laws in the process. For example, Virginia's excise tax on cigarettes is $0.30 per pack; in New York City, the combined excise tax is $5.85 per pack, including the $4.35 State tax and the $1.50 City tax. A trafficker purchasing 10,000 packs of cigarettes in Virginia could profit tens of thousands of dollars reselling them in New York City. Several studies show the widespread availability of trafficked cigarettes. In a 2011 study of littered cigarette packs in New York City, only 39% of littered packs bore the proper New York City tax stamp; and among packs with out-of-state stamps, 71.4% were from Virginia. Out of 1,071 targeted investigations of licensed retailers in 2012 by the New York City Department of Finance's Sheriff's Office, 55% of the retailers possessed cigarettes without the required New York City tax stamp. Cigarette tax evasion puts law-abiding retailers at a competitive disadvantage relative to retailers and street sellers selling untaxed cigarettes. Cigarette tax evasion also hurts the government and taxpayers. New York State's Department of Health estimated that cigarette excise tax evasion deprived the State of $500 million in 2009. New York City's cigarette tax revenue losses amount to a substantial fraction of New York State's losses. Available evidence suggests the extent of cigarette tax revenue losses has likely increased since 2009. Second, the use of coupons, multipackage discounts and other price reduction instruments, all of which are widely available in New York City, reduce retail prices for tobacco products. In a 2011 study of New York City smokers attempting to quit, 25% reported using a coupon or other discount on their last purchase, saving an average $1.25 per package of cigarettes. Discounts entice consumers, including price-sensitive youth, to purchase deadly and highly addictive products. Third, as cigarette prices have increased, smokers, particularly youth and young adults, have migrated to cheaper tobacco products. Little cigars, for example, appear virtually identical to cigarettes and cost substantially less. Manufactured cigarillos, cigars and smokeless tobacco are also less expensive alternatives. These products are not subject to New York City excise taxes or other fees specific to cigarettes and are often sold individually for one to two dollars. Despite well-documented risks, smokers of all ages - especially youth and young adults in low-income urban areas - erroneously perceive cigars as less harmful than cigarettes. The Council hereby declares that enactment of this law is necessary to address the persistent availability of low-priced cigarettes and tobacco products in New York City. This law will (1) reduce the illegal evasion of cigarette excise taxes; (2) ban the redemption of coupons and other price reduction instruments in the sale of cigarettes and tobacco products to consumers; (3) create a price floor for a package of cigarettes and little cigars; and (4) require inexpensive cigars to be sold in packages of no fewer than four. Such actions are necessary to maximize the public health impact of high tobacco prices, prevent traffickers from profiting from illegal cigarette sales and New York City and State from losing billions of dollars in tax revenue, and protect law-abiding retailers who are at a competitive disadvantage relative to retailers who illegally evade excise taxes. * * * [Consolidated provisions are not included in this Appendix A] * * * § 27. This local law shall take effect immediately, provided that: (i) sections two, seven, eight, nine, eleven, seventeen, eighteen, nineteen, twenty, twenty-one, twenty-four and twenty-six shall take effect sixty days after its enactment; (ii) sections five, six, ten, twelve and thirteen shall take effect one hundred twenty days after its enactment; (iii) section twenty-five shall take effect one hundred eighty days after its enactment; and (iv) the commissioners of finance, consumer affairs and health and mental hygiene may take such actions as are necessary for its implementation, including the promulgation of rules, prior to such effective dates.

The use of bioheating fuel would reduce emissions of air pollutants, reduce cleaning and maintenance costs, increase the viscosity and ease of handling of fuel oils, provide other operational benefits, strengthen the alternative fuels market, support regional farmers and local businesses, and increase energy independence and the diversity of our energy supply. Electric vehicles require chargers, or Electric Vehicle Supply Equipment (EVSEs). The vast majority of parking facilities are not currently being built to accommodate electric chargers. A Local Law to amend the New York city fire code, in relation to the enhancement of emergency preparedness in New York city and the adoption of current fire safety standards as incorporated in the 2009 edition of the international fire code, and to amend certain provisions of the New York city charter, the New York city mechanical code and the New York city plumbing code consistent with amendments to the New York city fire code. Be it enacted by the Council as follows: Section 1. Legislative intent. This local law arises from the mandate of section 29-104 of the administrative code, which requires the fire commissioner to review the latest edition of the international fire code and submit to the city council such proposed amendments to the New York city fire code as the fire commissioner determines should be made. Section 29-104 was enacted by local law 26 of 2008, which adopted a new fire code for New York city based on the international fire code, with amendments to reflect the unique New York City environment. This local law amends the New York city fire code to incorporate new fire safety standards and technologies adopted or reflected in the international fire code since the 2003 edition that was the basis for the 2008 New York city fire code. The fire code amendments enacted by this local law also reflect an evolution in thinking about the implementation of emergency preparedness requirements in a wide range of business, commercial and institutional occupancies. New emergency preparedness requirements address non-fire emergencies and coordinate plan, staffing and voice communication capabilities. These amendments will fulfill the goal of local law 26 of keeping the New York city fire code current and relevant to the fire safety challenges facing New York city. * * * [Consolidated provisions are not included in this Appendix A] * * * § 7. All actions and proceedings, civil or criminal, commenced prior to the effective date of this local law in accordance with any provision repealed by this local law and pending immediately prior to the taking effect of such repeal may be prosecuted and defended to final effect in the same manner as they might if those provisions had not been repealed. § 8. Rules promulgated by the fire commissioner in accordance with the law in effect prior to the effective date of this local law shall remain in effect for the matters covered to the extent that such rules are not inconsistent with the New York city fire code, as added by this local law, unless and until such rules are amended or repealed by the fire commissioner. § 9. This local law shall take effect 90 days after the date of enactment, except that the fire commissioner may take prior to such date any administrative actions necessary for the timely implementation of this local law, including but not limited to the promulgation of rules.

No. 1210-A By Council Members Gennaro, the Speaker (Council Member Quinn), Arroyo, Greenfield, Vacca, Koo, Koppell, Richards and Dromm A Local Law to amend the administrative code of the city of New York, in relation to the regulation of electronic cigarettes. Be it enacted by the Council as follows: Section 1. Legislative findings. Electronic cigarette devices have not been approved by the Food and Drug Administration (FDA) for smoking cessation and are currently unregulated by the FDA. Most devices contain nicotine, a highly addictive substance. Although the long-term effects of electronic cigarette devices require further study, the FDA has found that some devices contain toxins and carcinogens and has expressed concerns about their safety. Use of electronic cigarette devices, particularly in places where smoking is prohibited, may interfere with smokers' attempts to quit by making it easier for them to maintain their nicotine addiction. Children and youth who experiment with electronic cigarettes may become addicted to nicotine and ultimately switch to smoking cigarettes. The use of electronic cigarette devices may be visually similar to the smoking of cigarettes, and has already been observed in locations where smoking is prohibited, creating concern and confusion that threatens to interfere with enforcement of the Smoke-Free Air Act. The use of electronic cigarette devices in places where smoking is prohibited may increase the social acceptability and appeal of smoking, particularly for youth, potentially undermining the enormous progress that has been made over the years in discouraging smoking. The Council therefore finds that prohibiting the use of electronic cigarette devices in public places and places of employment will protect the health of the citizens of New York City, facilitate enforcement of the Smoke-Free Air Act, and protect youth from observing behaviors that could encourage them to smoke. * * * [Consolidated provisions are not included in this Appendix A] * * * § 14. Before the ninetieth day after this local law shall have become a law, every employer shall make any changes necessary in their written smoking policy to bring them into compliance with the requirements of chapter 5 of title 17 of the administrative code of the city of New York. § 15. This local law shall take effect one hundred twenty days after it shall have become a law, except that subdivisions (a) and (b) of section 17-506 of the administrative code of the city of New York, as amended by section six of this local law, shall take effect one hundred eighty days after this local law takes effect, provided however, that the commissioner shall take such actions, including the promulgation of rules, as are necessary for timely implementation of this local law.

By June 30, 2014, the department of consumer affairs shall promulgate rules establishing opportunities to cure the first violation of the following signage mandates: 1) requiring the posting of refund policies; 2) requiring the posting of a sign stating that individuals may complain to the department of consumer affairs about a business licensed by such department; 3) prohibiting signs stating that a business is not liable for such business's negligence if such a statement is invalid under law; 4) requiring that parking lots and garages post a sign stating: a) the business hours of such lot or garage; b) the licensed capacity of such lot or garage; c) such lot or garage is at full capacity for car or bicycle parking; and d) minimum number of bicycle parking spaces; 5) requiring that parking lots and garages have separate entrances and exits, with the main entrance and exit clearly designated with illuminated signs marked "entrance" and "exit"; 6) requiring that all required signage is illuminated, clearly visible, and readable; 7) requiring that those lots and garages with waivers under section 20-327.1 of the administrative code post a sign with respect to bike parking; 8) requiring that auxiliary signs of parking lots and garages contain equally sized letters and numbers; 9) requiring that businesses that accept credit cards post a list of limitations that such business put on credit card usage at or near the entrance of each such business, and in all advertising indicating that credit cards are accepted; 10) requiring that electronic or home appliance service dealers include a notice in the department or area where electronic and home appliances are accepted for repair stating that customers are entitled to written estimates for repairs and other customer rights, and that the regulations of the department of consumer affairs relating to television, radio and audio servicing are available for review from the service dealer upon request; 11) requiring a tax preparer to display a sign: a) identifying him or herself, including his or her address, telephone number, and qualifications; b) stating that both the preparer and taxpayer must sign every tax return; c) stating how his or her fees are calculated; d) stating that he or she or his or her agency will not represent the taxpayer in an audit, if true; and e) stating that he or she is not licensed by the state board of public accounting or the New York state bar, or both, if true; 12) requiring dealers of products for the disabled to post a sign summarizing any provisions of the New York city products for the disabled law; 13) requiring any bus to include a posted sign on the windshield and near the entrance door of such bus that designates the departure time and destination of such bus; 14) requiring laundries: a) to distinguish in their advertising between services being offered at different prices; b) to post an out-of-order sign on non-functioning machines on such laundry's premises; c) to post a notice that complaints and claims for refunds may be made to a certain person or persons; and d) to post any sign in both english and spanish, if applicable; 15) requiring sidewalk cafes to post a sign stating the maximum number of tables and chairs licensed for such sidewalk café, and prohibiting other signage at a sidewalk café except for signage meeting certain specifications; 16) requiring motor vehicle rental businesses to post a notice of the department of consumer protection's consumer protection law; 17) requiring any labeling declaration to be written in the english language; 18) requiring that amusement arcades and gaming cafes post a sign describing age restrictions during certain hours of operation; and 19) requiring signage at businesses that sell beverages for off-premises consumption in beverage containers that are covered by title ten or article twenty-seven of the environmental conservation law of the state of New York to be placed within a certain distance of cash registers or to be visible to consumers from any specific vantage point; and 20) requiring stores with weighing and measuring devices for customer use to post a sign informing customers that they may reweigh products using such weighing or measuring device or devices. The rules promulgated pursuant to this section shall include language to the effect that a person shall not be subject to a civil penalty for the first-time violation of any signage mandate described in this section if such person proves to the satisfaction of the department, within thirty days of the issuance of the notice of violation and prior to the commencement of an adjudication of the violation, that the violation has been cured. The submission of proof of a cure shall be deemed an admission of liability for all purposes. The option of presenting proof that the violation has been cured shall be offered as part of any settlement offer made by the department to a person who has received, for the first time, a notice of violation of any signage mandate described in this section. The department shall permit such proof to be submitted electronically or in person. A person may seek review, in the department's administrative tribunal, of the determination that the person has not submitted proof of a cure within fifteen days of receiving written notification of such determination. § 17. This local law shall take effect one hundred eighty days following the date of its enactment.

No. 1228 By Council Members Recchia and Koo (by request of the Mayor) A Local Law in relation to the date of submission by the mayor of a preliminary management report and the date prior to which the council shall conduct public hearings and the date by which the council shall submit a report or reports pertaining thereto, the date of submission by the mayor of the preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects, the date of submission by the mayor of the preliminary budget, the date of publication by the director of the independent budget office of a report on revenues and expenditures, the date of submission by the community boards of statements in regard to the preliminary budget, the date of submission by the commissioner of finance of an estimate of the assessed valuation of real property and statement of real property taxes due, expected to be received, and uncollected, the date of submission by the mayor of a tax benefit report, the date of submission by the borough boards of statements on budget priorities, the date of submission by the council of estimates of the financial needs of the council, the date of submission by the borough presidents of proposed modifications of the preliminary budget, the date of publication by the director of the independent budget office of a report analyzing the preliminary budget, the date by which the council shall hold hearings and submit recommendations in regard to the preliminary budget, and the date of submission by the campaign finance board of estimates of the financial needs of the campaign finance board, relating to the fiscal year two thousand fifteen. Be it enacted by the Council as follows: Section 1. During the calendar year 2014 and in relation to the 2015 fiscal year: 1. Notwithstanding any inconsistent provisions of section 12 of the New York city charter, as amended by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a preliminary management report as therein described not later than February 26, 2014, and the council shall conduct public hearings on such report prior to May 5, 2014 and submit to the mayor and make public not later than May 5, 2014, a report or reports of findings and recommendations. 2. Notwithstanding any inconsistent provisions of section 235 of the New York city charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit and publish a preliminary certificate regarding debt and reserves and appropriations and expenditures for capital projects as therein described not later than February 12, 2014. 3. Notwithstanding any inconsistent provisions of section 236 of the New York city charter, as amended by local law number 25 for the year 1998, the mayor shall pursuant to such section submit a preliminary budget as therein described not later than February 12, 2014. 4. Notwithstanding any inconsistent provisions of section 237 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall publish a report on revenues and expenditures as therein described on or before February 28, 2014. 5. Notwithstanding any inconsistent provisions of section 238 of the New York city charter, as added by vote of the electors on November 7, 1989, each community board shall pursuant to such section submit a statement and recommendations in regard to the preliminary budget as therein described not later than March 14, 2014. 6. Notwithstanding any inconsistent provisions of section 239 of the New York city charter, as added by vote of the electors on November 7, 1989, the commissioner of finance shall pursuant to such section submit an estimate of the assessed valuation of real property and a certified statement of all real property taxes due as therein described not later than March 14, 2014. 7. Notwithstanding any inconsistent provisions of section 240 of the New York city charter, as added by vote of the electors on November 7, 1989, the mayor shall pursuant to such section submit a tax benefit report as therein described not later than March 14, 2014. 8. Notwithstanding any inconsistent provisions of section 241 of the New York city charter, as added by vote of the electors on November 7, 1989, each borough board shall pursuant to such section submit a statement of budget priorities as therein described not later than March 24, 2014. 9. Notwithstanding any inconsistent provisions of section 243 of the New York city charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section approve and submit estimates of the financial needs of the council as therein described not later than April 7, 2014. 10. Notwithstanding any inconsistent provisions of section 245 of the New York city charter, as added by vote of the electors on November 7, 1989, each borough president shall pursuant to such section submit any proposed modifications of the preliminary budget as therein described not later than April 7, 2014. 11. Notwithstanding any inconsistent provisions of section 246 of the New York city charter, as added by vote of the electors on November 7, 1989, the director of the independent budget office shall pursuant to such section publish a report analyzing the preliminary budget as therein described on or before April 11, 2014. 12. Notwithstanding any inconsistent provisions of section 247 of the New York city charter, as added by vote of the electors on November 7, 1989, the council shall pursuant to such section hold hearings and submit recommendations as therein described not later than April 21, 2014. 13. Notwithstanding any inconsistent provisions of subdivision c of section 1052 of the New York city charter, as added by vote of the electors on November 3, 1998, the campaign finance board shall pursuant to such subdivision submit estimates of the financial needs of the campaign finance board as therein described not later than April 7, 2014. § 2. This local law shall take effect immediately, except that if it shall have become a law after January 16, 2014, it shall be retroactive to and deemed to have been in full force and effect as of January 16, 2014.
