Denver Revised Municipal Code § 39-130 Definitions.

Sec. 39-130. - Definitions. The following words and phrases, when used in this article, shall have the meanings respectively ascribed to them: (1) Adjoining. Touching or contiguous. (2) Board. The board of parks and recreation as established in Section A4.3 of the Charter of the City and County of Denver. (3) Compatible nonpark use. A use capable of integration and operation within a designated park. (4) Department. The department of parks and recreation of the City and County of Denver. (5) Manager. The manager of the department. (6) Neighborhood organizations. An organization registered with the planning office under section 41-19. (7) Park. Property designated as a park by Charter or ordinance. (8) Notice. Signs at least three (3) feet by five (5) feet with lettering at least two (2) inches in height placed at entrances to the park, at major facilities in the park, and on the qualifying structure. The signs shall identify the qualifying structure and the purpose, date, time and location of the meeting for public comment. (9) Qualifying structure. A structure located in a park which has been designated pursuant to chapter 30 as a structure for preservation or which is located in a district for preservation. (Ord. No. 381-94, § 1, 5-31-94)

Denver Revised Municipal Code § 39-131 Determination of availability of a qualifying structure.

Sec. 39-131. - Determination of availability of a qualifying structure. Upon the determination by the manager that a qualifying structure is not suitable for a park use, the issue of compatible nonpark use may, in the manager's discretion, be referred to the board. (Ord. No. 381-94, § 1, 5-31-94)

Denver Revised Municipal Code § 39-132 Recommendation of compatible nonpark use by the board.

Sec. 39-132. - Recommendation of compatible nonpark use by the board. The board, upon receipt of a referral from the manager for a recommendation of a compatible nonpark use or uses for a qualifying structure, shall: (1) Request the manager to notify all registered neighborhood organizations that will be affected or which are within the area served by the park in which the qualifying structure is located at least forty-five (45) days prior to the time set by the board for a meeting for public comment that: a. The described qualifying structure has been referred to the board; b. The board will study and recommend to the manager a compatible nonpark use or uses for the structure; c. A meeting for public comment will be held in accordance with the rules of the park and recreation advisory board to discuss possible compatible nonpark uses; d. The time, date and location of the public meeting; and e. Request statements of suggested uses for a qualifying structure and that such statements may be submitted to the board not later than ten (10) days before the meeting. Statements of suggested uses must contain: 1. A description of the suggested use for the qualifying structure and its impact on the park; 2. A preliminary analysis of the necessary remodeling and repairs required to make the qualifying structure useable for the proposed use; 3. A preliminary analysis of the traffic that will be generated by the proposed use and the parking that will be required for the proposed use; 4. A preliminary economic analysis showing the financial viability of any use suggested; and 5. Such other information that the board determines may be useful. (2) In determining the neighborhood organizations to be notified, the manager shall consider whether the park is in or near a neighborhood; the size of the park; and the type of facilities located at the park and recommendations from the board. All neighborhood organizations adjoining or including the park shall be notified. (3) After posting notice for not less than fifteen (15) consecutive days, hold a meeting for comment to discuss possible compatible nonpark uses. (4) Consider all suggestions submitted either in writing or at the meeting for public comment and make a recommendation to the manager concerning a compatible nonpark use or uses for the qualifying structure. The recommendation shall include methods for limiting the impacts on park uses and copies of all written suggestions for use of the qualifying structure. (Ord. No. 381-94, § 1, 5-31-94)

Denver Revised Municipal Code § 39-133 Preparation of an ordinance.

Sec. 39-133. - Preparation of an ordinance. Either after reviewing the recommendation of the board, or on their own initiative, the manager or a member of council may, at any time, prepare a bill for an ordinance allowing a compatible nonpark use in a qualifying structure for submission to the city council. Such bill for an ordinance may contain conditions or limitations which will limit the impacts of a use on the park. (Ord. No. 381-94, § 1, 5-31-94)

Denver Revised Municipal Code § 39-134 Requests for proposals.

Sec. 39-134. - Requests for proposals. Upon approval by ordinance of a compatible nonpark use or uses for a qualifying structure, the manager may: (1) Prepare a request for proposals seeking a party to make use of the qualifying structure which request requires that all proposals contain: a. Details of the use proposed and its impact on the park; b. Plans, costs and proposed financing of any remodeling or repairs proposed for the qualifying structure; c. A traffic and parking plan for the park minimizing the negative impacts of the proposed use; d. An economic analysis showing the financial viability of any use proposed and a financial statement of the party proposing the use which establishes an ability to meet the obligations of the proposal; and e. Such other information as the manager may consider useful. (2) Distribute to all interested parties, including neighborhood organizations, the request for proposals; and (3) Receive and review all proposals. (Ord. No. 381-94, § 1, 5-31-94)

Sec. 39-135. - Establishing compatible nonpark use. Upon receipt of the proposals, the manager shall determine whether or not to accept a proposal. (Ord. No. 381-94, § 1, 5-31-94)
