Jacksonville Ordinance Code § 106.441 Acceptance of gifts, donations, etc.

Sec. 106.441. - Acceptance of gifts, donations, etc. Unless otherwise provided in the Code, the Mayor is authorized to accept on behalf of the City, gifts, bequests, and other donations, whether testamentary, charitable or otherwise, for any purpose which the City has power under the Charter to perform, and the Mayor and Corporation Secretary are empowered to execute appropriate instruments of acceptance or receipt in connection therewith. Notwithstanding the general authority granted by the first sentence of this Section, the Mayor may not, without the approval of the Council, accept any such gift, bequest, or other donation if the same contains any condition, limitation, or restriction which: (a) Would limit the general government in the exercise of its governmental functions or would have that effect. (b) Requires any public building or facility, whether existing, under construction or proposed, to be named after any individual, whether living or deceased. (c) Obligates the City to provide specific governmental services to specific individuals or to a specific class of individuals when such services are already available generally to the public. (d) Involves the purchase or lease of real property not already under public ownership or the disposition of public property contrary to the provisions contained in Chapter 122. (e) Requires an appropriation by the Council. (f) Involves the alteration, relocation, demolition, or removal of any portion of a statue, obelisk, or monument. (g) Involves services for capital improvements as defined in Chapter 126 of the Code, including, but not limited to, projects identified on the Capital Improvement Plan. The provisions of this Section are not to be construed as conflicting with the provisions of Section 122.401. Nothing in this Section shall be construed as an appropriation of any funds received pursuant to a gift, bequest, or donation. Jacksonville Ordinance Code § 106.442 Expenditure of funds when no budget ordinance adopted.

Sec. 106.442. - Expenditure of funds when no budget ordinance adopted. If, by the first day of the fiscal year, there has been no budget ordinance enacted for that fiscal year, then the Mayor is authorized to expend any funds that may be available in the City Treasury and not otherwise encumbered, impounded or previously restricted as to manner or purpose of disbursement on a monthly basis in an amount equal to one-twelfth of the previous fiscal year annual appropriations so long as funds are available. The funds so expended shall not be utilized to fund new positions that may be established within the government; nor shall these funds be expended for salary increases or raises except as may be required by statute or pursuant to contractual obligation for salary increases or other benefits resulting from promotion of employees; nor for any new capital outlay expenditures. Jacksonville Ordinance Code § 106.443 Agreements to act as fiscal agent.

Sec. 106.443. - Agreements to act as fiscal agent. Upon recommendation of the Director of Finance and Administration that it will be cost-effective for the City to do so, the Mayor and Corporation Secretary may execute an agreement with: (a) An independent agency, or (b) A governmental agency outside the Consolidated Government to whose budget the City makes a contribution, For the City to act as fiscal agent for the independent agency or other governmental agency and to perform the accounting for such agency. This agreement shall provide that: (a) The City will be reimbursed for its costs incurred in performing its duties under the agreement, including personal services, supplies, equipment, technical and professional assistance and storage of records. (b) The City will establish the accounts and records necessary to show receipts, disbursements and balances in accordance with good accounting principles and practices, plus any other accounts and records required because of special circumstances or requirements of the agency, and make such accounts and records available to the agency at its request. (c) The funds of the agency will be held by the City in an agency capacity only, and the agency alone will be liable for loss or misapplication of the funds, except loss or misapplication occasioned by the City or its employees. (d) The City will disburse agency funds in accordance with the approved agency budget, as it may from time to time be changed, using City checks indicating the agency relationship. Jacksonville Ordinance Code § 106.444 Sale of firearms; City funding.

Sec. 106.444. - Sale of firearms; City funding. (a) No person who receives funds from the City through Public Services Grants or who receives any operational funding form the City shall allow firearms to be sold on any property owned, leased, or controlled by such person unless the sale is made by a licensed firearms dealer or the sale is to be made to a licensed gun dealer. (b) Firearms has the same meaning as set forth in F.S. Ch. 790. (c) Licensed gun dealer means a person licensed by the State or federal government to sell firearms. (Ord. 94-189-697, § 2)

Jacksonville Ordinance Code § 106.445 Vote required to fund initiatives through certain economic development agreement incentives.

Sec. 106.445. - Vote required to fund initiatives through certain economic development agreement incentives. Section 180.104, Ordinance Code, provides that the City shall set aside funds equal to one percent of the economic development agreement incentives approved during each calendar year for projects located outside an established Community Redevelopment Area to fund the Jacksonville Upward Mobility Program ("JUMP"). In addition, Section 111.920, Ordinance Code, provides that the City shall set aside funds equal to four percent of the economic development agreement incentives approved during each calendar year for projects located outside an established Community Redevelopment Area for deposit in the Homelessness Initiatives Special Revenue Fund. It is the Council's intent to limit the funding of City initiatives in this manner to a total of five percent (one percent for JUMP and four percent for the Homelessness Initiatives Special Revenue Fund) as outlined above. Any additional requests to set aside funds equal to any portion of the economic development agreement incentives approved during a calendar year for projects located outside established Community Redevelopment Areas shall require an affirmative vote of 14 Council Members to approve. A waiver of this provision shall also require an affirmative vote of 14 Council Members. (Ord. 2024-112-E, § 1)
