2-45-010 Establishment - Composition. There is hereby established an executive department of the municipal government of the City, which shall be known as the Department of Planning and Development. The Department shall include the Commissioner of Planning and Development, and such deputies, assistants and other employees as may be provided by annual appropriation ordinance. (Added Coun. 2-45-040 Commissioner of Planning and Development - Powers and duties. (a) The Commissioner has the authority to: (1) develop and administer programs and policies to encourage and promote the retention and expansion of existing commercial and industrial businesses within the City, and the attraction of new businesses to the City, and to encourage and promote workforce development. (2) administer workforce development programs that will: (A) include a citywide service delivery system which responds to employer needs; and (B) cultivate public and private relationships that increase employment opportunities for Chicagoans and prepare Chicagoans for the global workplace. (3) expend legally available funds for the purpose of assisting the Chicago Housing Authority in maintaining and improving its property, including but not limited to, property repairs and rehabilitation, purchase and installation of fencing and other security measures and devices, nuisance abatement, playground construction and other site improvements. The Commissioner may enter into cooperative agreements with the Chicago Housing Authority when performing the Commissioner's powers under this section. Such agreements shall not authorize the use of City funds for purposes of demolition or major capital projects. (4) subject to the appropriation of funds, enter into land banking agreements with the Cook County Land Bank Authority (CCLBA), or its successor agency, and enter into and execute all such other instruments and perform any and all acts as shall be necessary or advisable in connection with the implementation of such agreements, including any extensions thereof. The agreements may authorize the Commissioner to pay or reimburse the CCLBA, or its successor agency, for acquisition-related costs, holding costs, and land banking fees for use of CCLBA, or such agency's staff and resources, and may include such other terms as the Commissioner deems appropriate, including provisions providing indemnification. (5) subject to the appropriation of funds, to enter into and execute any and all agreements or instruments and to perform any and all acts as shall be necessary or advisable to purchase delinquent or forfeited property taxes from the County of Cook in order to assemble property for development. (6) in connection with negotiations to sell, lease, license or develop real property, subject to the approval of the Corporation Counsel as to form and legality, and upon providing notification to the Commissioner of Fleet and Facility Management, to negotiate and execute, on behalf of the City, right-of-entry agreements, releases of liability, or other similar agreements, authorizing access to City-owned property for up to 60 days for purposes of conducting inspections and other non-invasive due diligence activities. Notwithstanding any law or any mayoral executive order to the contrary, a party that enters into a right-of-entry agreement, release of liability or other similar agreement with the City pursuant to this subsection (a)(6) shall: (A) not be required to provide economic disclosure statements to the City in connection with such agreement. For purposes of this subsection, “economic disclosure statements” means economic disclosure statements, affidavits and pledges filed with the City by parties that seek a City action, as defined in Section 2-154-015, using the form document commonly referred to as “Economic Disclosure Statement and Affidavit” (or any successor to such form document), as amended, pursuant to, among other applicable laws and executive orders, Chapter 2-154, Section 2-92-325, Section 2-92-415, Section 2-92-585 and Section 5-24-020 of the Code. (B) be required to provide to the City the following information in a form prescribed by the Commissioner: (i) a list of: (a) the party’s family members or relatives who are currently employed by the City; and (b) elected City officials to whom the party, or any person hired by the party to perform work on the due diligence activities, have provided income, compensation or donations during the 12-month period preceding the date of the party’s application to enter into the agreement, and the amount of the income, compensation or donations given to each City official; (ii) a statement certifying that: (a) no City official or City employee has a financial interest, as defined in Section 2-156-010, in the party or any person hired by the party for the due diligence activities; and (b) neither the party nor any person working on the due diligence activities are delinquent in the payment of any fine, fee, tax or other source of indebtedness owed to the City. (C) Nothing provided in this subsection (a)(6) shall be construed to limit the authority granted to the Commissioner of Fleet and Facility Management under Chapter 2-51 of this Code. Editor's note – Coun. J. 10-27-21, p. 39525, § 2, amended subsection (a) and added subsection designations (a)(1) through (a)(3). Coun. J. 3-23-22, p. 45596, § 2, amended subsection (a) by adding two unnumbered paragraphs but did not take into account the that prior amendment. The unnumbered paragraphs added by Coun. J. 3-23-22, p. 45596, § 2, have been added as subsections (a)(4) and (a)(5) at the discretion of the editor. (b) The Department may act as agent for the City in the management, demolition, site preparation and disposition of any property acquired pursuant to Chapter 2-124 or otherwise and may, subject to such approval of the City Council as the Code requires, sell surplus land pursuant to Chapters 2-158 and 2-159 of this Code. (c) The Commissioner shall have the duty to: (1) supervise and coordinate the formulation and execution of projects and programs affecting the present and future physical and social environment of the City to the extent they relate to zoning and land use planning, including industrial development and growth, development of the City's central and outlying business areas, development of culture and art, redevelopment, employment opportunities, public transportation, streets and expressways, parks and recreation, airports and harbors, water and sewers, libraries, education, the environment, health, and the preservation of historical areas and landmarks; (2) keep and permanently maintain on file for public inspection a bound copy of the Chicago Historic Resources Survey published in 1996; (3) upon receipt by the landmarks division, post any application for a demolition permit submitted pursuant to Section 14A-4-407.6 on the City of Chicago website for a period of at least 120 days after the application is approved or denied by the Department of Buildings; (4) conduct research and demographic studies; (5) create, maintain, and expand plans for the City of Chicago; (6) review and recommend necessary amendments to the Chicago Zoning Ordinance; (7) exercise the powers and duties of the Commissioner as provided in the Chicago Zoning Ordinance; (8) render necessary services, as requested, to the Mayor and to the City Council and its committees; (9) post the Tax Increment Financing (T.I.F.) documents required by Section 2-45-155 on the Department's website; and (10) adopt such rules as the Commissioner may deem necessary or appropriate for the proper administration and enforcement of this Chapter 2-45 and the provisions of this Code pertaining to the rights, powers, duties, obligations, and responsibilities of the Department. (d) The powers and duties in this section that are also conferred upon the Commissioner and Department of Housing, including but not limited to the authority to promulgate rules governing the same subject matter, shall, to the extent feasible, be carried out in consultation and coordination with that Department in order to promote consistency, efficiency, and effectiveness. 2-45-045 Department - Composition - Zoning Administrator. The Department shall include such divisions as may be necessary or desirable to enable the performance of the duties of the Commissioner as set forth in this chapter. The Department shall furnish services necessary and proper to the functioning of the Chicago Plan Commission, the Capital Improvements Advisory Committee and such other offices and agencies as are appropriate. There is created within the Department the Office of Zoning Administrator who shall have the powers and duties prescribed for that Office in the Chicago Zoning Ordinance and other provisions of this Code. 2-45-047 Proposals affecting zoning or land use planning. Prior to approval or passage by the City Council, all proposals affecting the zoning or planning of the City shall be referred in writing by the departments, City Council committees or agencies originating or having charge or jurisdiction of such proposals, to the Commissioner and Plan Commission for study, recommendation and report. Municipal Code of Chicago § 2-45-050 Transfer of rights, powers and duties.

2-45-050 Transfer of rights, powers and duties. The Commissioner and the Department shall, respectively, assume all rights, powers, duties, obligations and responsibilities of the following: (1) the former Commissioner and Department of Community Development, and (2) the former Commissioner and Department of Zoning and Land Use Planning, including the rights, powers, duties and obligations of the former Commissioner serving ex officio as Zoning Administrator. All such personnel, books, records, property and funds relating to such powers transferred from such former departments are transferred to the Department. The Commissioner shall succeed such former commissioners in the administration of any federal, state, local or private grant or loan programs relating to such transferred powers. The Commissioner shall succeed to the rights and duties of such former commissioners under existing contracts, grant agreements, redevelopment agreements, leases, indentures or other agreements or ordinances. All rules issued by the former commissioners relating to such transferred powers in effect as of the effective date of this chapter shall remain in effect until amended or repealed by the Commissioner. Municipal Code of Chicago § 2-45-055 Planned developments.

2-45-055 Planned developments. The Commissioner is authorized to administer and review planned development ordinances, including any provisions of the Chicago Zoning Ordinance applicable to such ordinances and shall consult with the Commissioner of Housing with respect to any planned development that includes affordable units required under Sections 2-44-070, 2-44-080, 2-44-090, and 2-44-100 of the Municipal Code. In the performance of his duties, the Commissioner may consult with such units and agencies of local, state and federal government, and with such community organizations, labor and business organizations, professional and technical organizations and other groups and agencies as may provide assistance to the Department in the formulation and execution of the programs herein described. Municipal Code of Chicago § 2-45-080 Assistance from residents.

2-45-080 Assistance from residents. The Commissioner shall have the authority to designate any appropriate public participation process that will ensure the involvement of residents in the activities of the Department. Municipal Code of Chicago § 2-45-090 Workforce development - Purpose and intent.

2-45-090 Workforce development - Purpose and intent. The Department shall promote the idea that genuine neighborhood revitalization requires strong human capital development and job growth. The Department will align services for essential employer physical needs with services supporting employee human capital development, working with both simultaneously to grow and diversify the Chicago economy. The Department shall identify opportunities for a workforce development component, activities and initiatives within economic development projects and programs, such as within agreements between the City and Chicago businesses as part of redevelopment or planned development agreements. This component may include working with the Department of Family and Support Services for the leveraging of funds through the Workforce Investment Act or successor federal Acts to provide worker training and recruitment activities to the business community. Municipal Code of Chicago § 2-45-100 Program applications, administration and closing costs - Fees.

2-45-100 Program applications, administration and closing costs - Fees. The Commissioner shall have the authority to charge fees in the amount specified and as provided in this section for the processing of program applications and administration and closing costs: (1) of programs administered by the Department, and (2) relating to the sale of City-owned property. Such fees shall be made payable to the Department of Finance. The fees shall be nonrefundable and shall not guarantee approval of an application or adequacy of funding. The amount of such fees shall be as follows: Loans: Micro Loan Program – Application fee: $100.00 – Closing fee (due at closing): $250.00 Amendments/modifications to Urban Development Action Grants and Illinois Development Action Grants (including subordination and refinancing requests) – Administration fee (due at time of City’s approval of request): $1,000.00 or 2% of the outstanding principal balance (whichever is greater) – Administration fee (due at time of City’s approval of request): $500.00 or 2% of the outstanding principal balance (whichever is greater) Tax Increment Financing Bonds: – Up to $3,000,000.00: $60,000.00 – Over $3,000,000.00: $60,000.00 plus 1.5% of the principal amount over $3,000,000.00 Development Assistance Program: Commercial Facade Rebate Program – Application fee: $50.00 Industrial Facade Rebate Program – Application fee: $100.00 Business Infrastructure Assistance (small) – Application fee $ 100.00 Business Infrastructure Assistance (large) – Application fee: $200.00 Commercial Area Signage Program – Application fee: $25.00 Security Rebate Program – Application fee: $25.00 The processing of applications for the programs specified in this section shall be contingent on the payment of the fees specified. The Commissioner may also specify that certain project and land sale-related out-of-pocket expenses, such as recording and filing fees, title search fees, appraisal fees and credit report charges, shall be the responsibility of the applicant or purchaser, as applicable. Municipal Code of Chicago § 2-45-110 Debt and lien waiver, release or assignment.

2-45-110 Debt and lien waiver, release or assignment. (a) Definitions. In this section: (1) The term “debt” means a sum of money owed to the City, including any water or sewer assessment, any obligation or payment of a sum of money owed to the City pursuant to a court order or an order of the Department of Administrative Hearings, and any demolition lien. The term “debt” does not include property tax debt. (b) Waiver, release or assignment. Notwithstanding any other inconsistent or contrary provision of this Code, the Commissioner is authorized to waive or assign any City debt and release or assign any associated City liens encumbering any residential or mixed-use building, or vacant lot regardless of zoning classification, where the encumbered property: (1) Is in a low-moderate income area as that term is defined in Section 2-44-085; (2) Has been vacant, abandoned, or not in productive use for not less than a continuous period of six months; (3) Will be transferred to a new owner unrelated or unaffiliated with the current owner; and (4) Will be developed, redeveloped, or maintained in a manner that promotes the redevelopment and re-occupancy of a specific vacant or abandoned property, supports neighborhood development and stabilization efforts, improves the health, safety, and welfare of the surrounding community, and encourages City revitalization. (c) Consultation. The Commissioner shall consult with the Budget Director, the Commissioner of Buildings, the Commissioner of Planning and Development, the Comptroller, the Corporation Counsel, and the alderman of the ward in which the encumbered property is located before waiving, releasing, or assigning any debt or lien under this section. (d) Agreement conditions. No debt or lien may be waived, released, or assigned under this section unless the party taking or developing the property executes an agreement with the Department providing that: (1) Such party will develop, redevelop, or maintain the property pursuant to plans approved by the Department; (2) Such party will not resell the property for at least two years; (3) Such party will comply with the requirements of this section; (4) The debt is fully guaranteed by at least one natural person; and (5) If the property will be developed or redeveloped: (A) The project will be completed within three years of taking ownership of the property, unless the Commissioner authorizes an extension; (B) Such party has obtained or applied for all applicable permits and licenses; (C) Such party has financing or funds available to complete the development or redevelopment; and (D) All City liens remain on the property and are fully enforceable, or a replacement lien of the same value be placed on the property, until the development or redevelopment is complete. (e) Enforcement of agreements. Failure to comply with the terms of any agreement executed under this section shall be unlawful. There shall be imposed a fine of $500 on each party to any agreement, including any guarantor, under this section for each day that the agreement is out of compliance. If the party that executed the agreement is not a natural person, the fine under this section shall be jointly and severally imposed on all natural persons with control over the entity that executed the agreement, including the officers of any corporation, the members and managers of any limited liability company, the partners of any partnership, and the trustees and beneficiaries of any trust. Any agreement executed under this section shall include a provision essentially similar to this subsection (e). (f) Prohibited transactions. Any party that transfers encumbered property to a new owner as part of a transaction involving a waiver, release, or assignment of City debt or liens under this section shall be ineligible for a period of three years following the date of the transfer to acquire any real property from the City or to receive any financial assistance, including grants, loans, or subsidies, from the City. (g) Foreclosure rights. Notwithstanding any other inconsistent or contrary provision of this Code, during a foreclosure, supplementary proceeding, bankruptcy proceeding, or similar proceeding involving property encumbered by City debt, the Corporation Counsel is authorized to bid City debt to acquire the property or assign the bid or bid right to a third party for the purpose of allowing that third party to acquire the property. (h) Reporting. Each quarter, the Commissioner shall submit to the Chair of the Committee on Finance a report regarding all debts or liens waived, released, or assigned pursuant to this section during the applicable quarter, including the amount of debt waived, released, or assigned. (i) Rules. The Commissioner is authorized to promulgate rules for the proper administration and enforcement of this section. (Added Coun. I, § 15, repealed in its entirety Section 2-45-100 (which was amended in § 14). The text of Art. Municipal Code of Chicago § 2-45-130 Participation by eligible persons in eligible programs.

2-45-130 Participation by eligible persons in eligible programs. (a) With respect to each Eligible Program (as defined in paragraph (b) below), Eligible Persons (as defined in paragraph (b) below) shall not be subject to the restrictions of Section 2-156-110, but only as that section pertains to the participation of said Eligible Persons under such Eligible Program. (b) As used in this section: (i) "Eligible Programs" shall mean (1) programs administered by the Department (or by delegate agencies or other entities with funds provided, in whole or in part, by the Department) which provide various forms of economic assistance (including, but not limited to, land write-downs and financial assistance in the form of grants, loans, fee waivers and tax credits) directly to individuals who are tenants in residential buildings in the City or are owner-occupants of one- to four-unit residential buildings in the City (including individuals who are owner-occupants of a condominium unit in the City), or which provide for the rehabilitation of one- to four-unit residential buildings in the City (including one to four condominium units, without regard to the total number of condominium units in the building); and (2) rental subsidy assistance for very low-income households (as "very low-income" may be defined by United States Department of Housing and Urban Development), provided by the Department through The Chicago Low-Income Housing Trust Fund, an Illinois not-for-profit corporation, or through another entity selected by the Commissioner, and which is paid directly to owners of residential buildings in the City. (ii) With respect to each Eligible Program, "Eligible Persons" shall mean employees and appointed officials of the City (other than those persons described in the next succeeding sentence) who meet the eligibility requirements to participate under such Eligible Program. With respect to each Eligible Program, the following employees and appointed officials of the City shall not constitute "Eligible Persons" for such Eligible Program: any employee or appointed official who, during his/her tenure of employment or appointment, respectively, by the City (1) exercises or has exercised any contract management authority with respect to such Eligible Program, (2) is or was in a position to participate in a decision-making process with respect to such Eligible Program, or with respect to a specific project entered into pursuant to such Eligible Program, or (3) gains or has gained confidential information with regard to such Eligible Program. (iii) If an employee or appointed official of the City qualifies as an "Eligible Person" pursuant to paragraph (ii) above, the following shall also qualify as "Eligible Persons": (1) such employee’s or official’s spouse or domestic partner, and (2) any entity in which such employee or official has a "financial interest" (as defined in Section 2-156-010). (c) The Commissioner is authorized to promulgate rules and prepare forms to effectuate the purposes of this section in conformity, to the extent applicable, with subsection (b) of Section 2-45-040. Municipal Code of Chicago § 2-45-140 Fee waivers for Class 8 MICRO projects.

2-45-140 Fee waivers for Class 8 MICRO projects. (a) The following fees shall be waived in connection with any permit or review application for any project receiving a Class 8 MICRO Classification pursuant to the State of Illinois MICRO Act (35 ILCS 45/110-1, et seq.), Section 74-65 of the County ordinance and a City ordinance designating such project area: 1. All fees for permits issued by the City’s Department of Water Management; 2. All fees for permits issued by the City’s Department of Buildings under Chapter 11-12, Chapter 11-16, Chapter 11-18, and Article XIII of Chapter 13-20 of this Code; 3. All fees for permits issued by the City’s Department of Public Health under Chapter 11-4 of this Code; 4. All fees for permits issued by the City’s Fire Department under Chapter 15-16 of this Code; 5. All fees issued by the Chicago Department of Transportation for permits related to construction in the public way under Chapter 10-20, or public way use under Chapters 10-28 and 10-29 of this Code; 6. All fees required under Section 17-13-0103 of the Chicago Zoning Ordinance; 7. The Part II review fee required for planned developments under Section 17-13-0610 of the Chicago Zoning Ordinance; and 8. The fee to review and process a request for minor change approval required under Section 17-13-0611-D of the Chicago Zoning Ordinance. (b) In addition to the fee waivers specified in subsection (a) of this section, any generally applicable fee waiver authorized under this Code may be granted in connection with any permit or review application for any qualifying project receiving a Class 8 MICRO Classification pursuant to the State of Illinois MICRO Act (35 ILCS 45/110-1, et seq.), Section 74-65 of the County ordinance and a City ordinance designating such project area. Municipal Code of Chicago § 2-45-150 Utilization database.

2-45-150 Utilization database. (a) For the purposes of this section, the following definitions shall apply: The term “City resident hiring utilization goal” means an aspirational goal for Chicago residents to perform a minimum number of work hours on the applicable project. The term “commercially useful function” has the meaning ascribed in Section 2-92-670 of this Code. The term “covered project” means any project that: (1) receives financial assistance, planned development approval, or other discretionary City approval; and (2) includes a commitment to meet or exceed M.B.E. and W.B.E. utilization goals or City resident hiring utilization goals. The term “financial assistance” has the meaning ascribed in Section 2-44-085 of this Code. The term “M.B.E.” has the meaning ascribed in Section 2-92-670 of this Code. The term “M.B.E. and W.B.E. utilization goal” means an aspirational goal to utilize or award subcontracts to M.B.E.s and W.B.E.s, including but not limited to in connection with financial assistance, planned development approval, or other discretionary City approval. The term “W.B.E.” has the meaning ascribed in Section 2-92-670 of this Code. (b) The Department shall create an online database to track outcomes associated with M.B.E. and W.B.E. utilization goals, and City resident hiring utilization goals that contains, at a minimum, the following information for each covered project: (1) the name and business address of the owner and developer of the covered project; (2) the address, ward, and a brief description of the covered project; (3) any applicable M.B.E. and W.B.E. utilization goals and City resident hiring utilization goals; (4) the date any financial assistance, planned development approval, or discretionary City approval was granted; (5) the outcomes associated with the applicable M.B.E. and W.B.E. utilization goals and City resident hiring utilization goals, including a description of any good faith efforts, waivers, liquidated damages, or mitigating factors related to failure to meet such goals; (6) the name and business address of any M.B.E. or W.B.E. subcontractor or supplier performing a commercially useful function on the covered project, including a brief description of the work performed, or product or service supplied, by each subcontractor or supplier; (7) the number of work hours completed by City residents compared to the total number of work hours; and (8) any other information deemed necessary or useful by the Commissioner related to adherence to applicable M.B.E. and W.B.E. utilization goals and City resident hiring utilization goals. (c) The owner and developer of a covered project shall submit to the Department, in a form approved by the Commissioner, all of the information required under subsection (b) of this section, as available: (1) prior to Chicago Plan Commission approval; (2) concurrently with an application for permit review; and (3) concurrently with an application for a Certificate of Occupancy. Upon receipt, and subject to applicable law, the Department shall make all such information available to the public via an online dashboard. (d) Each contract, planned development approval, or other document containing a M.B.E. and W.B.E. utilization goal or City resident hiring utilization goal shall incorporate terms necessary to implement and enforce this section. Municipal Code of Chicago § 2-45-155 Tax increment financing (T.I.F.) Sunshine ordinance.

2-45-155 Tax increment financing (T.I.F.) Sunshine ordinance. (a) The following T.I.F.-related documents for each active T.I.F. district shall be made publicly available on the Department’s website: 1. The ordinances establishing each T.I.F. district, including all attachments, and any amendments thereto; 2. The ordinances authorizing each T.I.F. redevelopment agreement, including any attachments, any amendments thereto and accompanying Economic Disclosure Statements; 3. Written staff reports presented to the Community Development Commission related to T.I.F.-funded projects; 4. T.I.F. overviews prepared by the Department and annual reports prepared pursuant to 65 ILCS 5/11-74.4-5(d); 5. City-issued Certificates of Completion and any required annual employment certifications prepared pursuant to T.I.F. redevelopment agreements. All such ordinances as described in (1) and (2) above shall be made available on the City of Chicago website within seven business days of their publication in the Journal of the Proceedings of the City Council of the City of Chicago. All such documents as described in (3), (4) and (5) above shall be made available on the Department’s website within fourteen business days of their completion in final form. The T.I.F. documents described above for T.I.F. districts established from and after July 30, 2004 will similarly be made available by July 30, 2009. (b) The Department of Housing and Economic Development shall create and maintain an online and searchable database for public consumption on the City of Chicago Data Portal for every private project funded by any active TIF district starting with fiscal year 2009 in the City of Chicago within one year of the issuance of a final certificate of completion. The database shall be made available by July 1, 2014. The database shall include the following information: 1. Project location by address and ward; 2. Total budget of project approved by City Council; 3. Total TIF subsidy; 4. Total TIF subsidy as a percentage of project budget approved by City Council; 5. Date of approval by the Community Development Commission; 6. Date of issuance of the final certificate of completion; 7. Jobs covenant, if applicable; 8. Compliance with jobs covenant during the first year after the issuance of a final certificate of completion; 9. Compliance with MBE/WBE and City residency commitments, if applicable; 10. Pre-development property tax due for the PINs listed in the redevelopment agreement, in the year prior to the date of approval by the Community Development Commission; 11. Post-development property tax generated due for the PINs listed in the redevelopment agreement, in the third year after the issuance of a final certificate of completion; 12. Affordable housing units completed, if applicable; 13. For projects approved by the Community Development Commission after the date of enactment, green matrix (sustainable) requirements, if applicable. (c) Notwithstanding anything in this Code or any rules promulgated hereunder, no T.I.F. funds may be declared “surplus”, as described in 65 ILCS 5/11-74.4-7, unless authorized by ordinance. 2-45-160 Redevelopment agreement and reporting requirements for Cook County tax incentive classifications. (a) For the purposes of this section, “tax incentive classification” means the following Cook County tax incentive classifications requiring City approval: Class 6b; Class 6b (special circumstances); Class 6b TEERM; Class 6b SER; Class 6b CEERM; Class 7a; Class 7b; Class 7c; Class 7d; Class 8; Class 8 TEERM; and Class 8 CEERM. (b) For each application seeking City approval of a tax incentive classification filed on or after November 1, 2020, each applicant shall enter into a redevelopment agreement with the City as a condition of the City supporting such tax incentive classification. A substantially final version of each such redevelopment agreement shall be attached to the ordinance or resolution seeking approval of a tax incentive classification. (c) In the event that the applicant breaches such redevelopment agreement required under this section, the City may pursue a revocation of the tax incentive classification in accordance with applicable law. (d) Beginning August 1, 2021, each applicant who has received City approval of a tax incentive classification subject to subsection (b) of this section shall submit to the Department an annual report no later than August 1 of each year, which shall include: (1) An affidavit from the applicant detailing the current status of the project and certification that it meets any obligations or compliance requirements specified in the ordinance or resolution adopted by the City approving such tax incentive classification or any redevelopment agreement entered into by the City and applicant, as applicable; (2) A jobs report providing anonymized information on each employee, including their status as full-time or part-time; the ZIP code of the employee's primary residency; and the employee's total employment tenure in months; (3) Any reports, affidavits, or other statements required to be filed with Cook County or the Cook County Assessor for the applicable annual period; and (4) Such other reports as may be specified in the ordinance or resolution adopted by the City approving the tax incentive classification, any redevelopment agreement entered into by the City and the applicant, or as may be otherwise agreed to in writing by the applicant in connection therewith. (e) Upon receipt of the annual reports and sworn statements required under this section, the Department shall forward such reports and sworn statements, no later than October 1 of each year to the Committee on Economic, Capital and Technology Development and the alderman of each ward in which the applicable property receiving the tax incentive classification is located. Municipal Code of Chicago § 2-45-165 Revocation of property tax incentives.

2-45-165 Revocation of property tax incentives. (a) Purpose and definitions. (1) This section establishes the process and procedure for the City to exercise its authority under Section 74-73 of the Cook County Tax Incentive Ordinance, Classification System for Assessment, to request revocation of certain Cook County tax incentive classifications, including Class 6b; Class 6b (special circumstances); Class 6b TEERM; Class 6b SER; Class 6b CEERM; Class 7a; Class 7b; Class 7c; Class 7d; Class 8; Class 8 TEERM and Class 8 CEERM. (2) For purposes of this section, "Committee" means the Committee on Economic, Capital and Technology Development. (b) Notice. Following the referral to the Committee of a resolution calling for revocation of a property tax incentive, the Committee shall provide written notice to the applicable taxpayer. Such notice must: (i) include a copy of the filed resolution and the date of the hearing conducted pursuant to subsection (d) of this section, and (ii) be given to the applicable taxpayer no less than 15 days prior to any hearing conducted pursuant to subsection (d) of this section. (c) Recommendation. The Commissioner shall review each proposed resolution calling for revocation of a property tax incentive and forward a recommendation on the proposal to the Committee before the Committee's public hearing. (d) Hearing and final action. The Committee must hold a public hearing on all resolutions calling for revocation of property tax incentives in accordance with this section to afford the taxpayer or their representative an opportunity to be heard. (e) Review and decision-making criteria. The act of revoking a property tax incentive is a legislative action that must be made in the best interests of the public health, safety, and general welfare, while also recognizing the rights of individual taxpayers. In reviewing and making decisions on proposed resolutions to revoke a property tax incentive, factors that the Committee may consider include, but are not limited to, the following: (i) The circumstances outlined in Section 74-73 of the Cook County Code, and failure to comply with the requirements of Sections 74-71 or 74-72 of the Cook County Code; (ii) Failure to adequately maintain or invest in the project in order to meet, or cause to be met, the stated redevelopment objectives or as otherwise required under any applicable redevelopment agreement between the City and the taxpayer; (iii) Failure to submit any reports required to be submitted to the county or the City under applicable law or any redevelopment agreement between the City and the taxpayer; (iv) An event of default under any applicable redevelopment agreement between the City and the taxpayer; or (v) Failure to comply with any applicable environmental laws or regulations if such environmental laws or regulations are considered in issuing the applicable tax incentive. (f) Notice to County Board. Following the effective date of a resolution calling for revocation of a property tax incentive, the City Clerk shall forward a copy of such resolution to the Board of Commissioners of Cook County.
