2.50.100 - Suspension of commissioners permitted when. Any member of the Board of Commissioners who is charged for any felony other than by indictment may be suspended from office by the Board, pending the outcome of such charges, after a hearing and a unanimous vote as set forth in this Article. 2.50.110 - Suspension of elected officials permitted when. Any elected official of the City who is charged for any felony other than by indictment may be suspended from office by the Board, pending the outcome of such charges, after a hearing and a unanimous vote as set forth in this Article. Las Vegas Municipal Code § 2.50.120 Hearing before board of commissioners.

2.50.120 - Hearing before board of commissioners. (A) Upon the filing of any felony charge against any member of the Board or other elected official of the City, other than by an indictment, the Board may hold an administrative hearing in regard to the official so charged concerning the nature of the conduct of the official which resulted in the felony charge. (B) The hearing shall not be held until after a preliminary hearing on the charge has been held. If a preliminary hearing is waived by the official so charged, the Board may hold the administrative hearing at any time after such waiver. Due consideration shall be given concerning whether or not the trial of the official so charged will be held within sixty days after the charge was originally filed. (C) The hearing shall be conducted in the same manner as provided in Article I of this Chapter, except that the words "complaint," "information" or "charge" shall be used in the place of the word "indictment." Las Vegas Municipal Code § 2.50.130 Determination by Board—Appeal—Temporary officeholder.

2.50.130 - Determination by Board—Appeal—Temporary officeholder. (A) After all of the evidence has been taken, by testimony or otherwise, and after all of the statements and arguments of the City Attorney, the Board and the official so charged have been considered, the Board shall make a determination, in the light of the evidence and in consideration of the interests of the public and the welfare of the government, whether or not such official should be suspended from office pending the outcome of the charge. (B) An appeal from a decision to suspend such official may be taken to an appropriate court, but, until such decision by the Board is reversed, the official shall remain suspended from his office. Upon such suspension and pending any appeal by the suspended official in connection therewith and the outcome of the charge, if such suspension is sustained on appeal, the office may be filled temporarily as in a case of a vacancy. Las Vegas Municipal Code § 2.50.140 Conviction—Acquittal.

2.50.140 - Conviction—Acquittal. (A) If the official so charged is ultimately found guilty of the charges against him, the Board shall declare the office to which the official was elected vacant, in the manner prescribed by NRS 283.040. (B) If such official is acquitted of the charges against him, his suspension shall be terminated and he may forthwith take office for the remainder of his term. If his position has been filled by a temporary appointment, as provided in Section 2.50.130, the person who holds the office by virtue of such temporary appointment shall relinquish the office upon the elected official's return to his original capacity. Las Vegas Municipal Code § 2.50.150 Salary—Official charged—Temporary replacement.

2.50.150 - Salary—Official charged—Temporary replacement. The salary paid to the said official shall be withheld from him during his suspension and shall be placed into a trust account pending the outcome of the charge. If such official is acquitted, the money shall be paid immediately to him. If he is found guilty, however, the money shall revert to the City. In the event his office during such suspension has been filled temporarily, as provided in Section 2.50.130, the person who fills such office shall receive the salary established for the office without regard to the salary which is concurrently being paid into the trust account.
