Las Vegas Municipal Code § 6.12.010 Privileged business finding.

6.12.010 - Privileged business finding. The City Council hereby finds that the businesses set forth in this Chapter seriously affect the well-being of the City and its residents, and that it is necessary to regulate such activities carefully in order to ensure that persons of honesty and integrity are operating such businesses and that they are operated in a responsible manner to the public. Such businesses must therefore comply with Chapter 6.06. (Ord. 2246 § 1 (part), 1981: prior code § 5-10-1)

Las Vegas Municipal Code § 6.12.020 Required.

6.12.020 - Required. No person shall carry on, practice, teach, or profess to practice the business of psychic arts and demand or receive a fee for the exercise or exhibition of his art therein, directly or indirectly or incidental to the conduct of any other business, either as a gift, donation or otherwise, or give an exhibition thereof at any place where an admission fee is charged, without first obtaining and thereafter maintaining a valid unexpired license pursuant to this Code. Las Vegas Municipal Code § 6.12.030 Psychic arts—Defined.

6.12.030 - Psychic arts—Defined. For purposes of this Chapter, the term psychic arts includes the following: Astrology, numerology, hypnosis, psychic science, palmistry, phrenology, life reading, fortune telling, cartomancy, clairvoyance, clairaudience, crystal gazing, mediumship, prophecy, augury, divination or necromancy. Las Vegas Municipal Code § 6.12.040 Age of applicant.

6.12.040 - Age of applicant. The applicant for a psychic arts license must be eighteen years of age or older. (Ord. No. 6213, § 8, 9-5-12; Ord. 2246 § 1 (part), 1981: prior code § 5-10-2(C))

Las Vegas Municipal Code § 6.12.050 Publications exempted.

6.12.050 - Publications exempted. The publication or placement of astrology information in a book, newspaper, magazine or other periodical is exempt from this Chapter. (Ord. No. 6213, § 9, 9-5-12; Ord. 2246 § 1 (part), 1981: prior code § 5-10-2(D))

Las Vegas Municipal Code § 6.12.060 Charges—Donations.

6.12.060 - Charges—Donations. (A) Any fee, gift, donation or otherwise, charged to the patron for providing psychic arts must be posted in a conspicuous place within the place of business to be visible to patrons upon entry to the place of business on a sign of no less than eight inches by ten inches in size with lettering no smaller than three-quarters of an inch. (B) If the licensee accepts donations, or any other method of indirect remuneration at the discretion of a patron, such signage shall indicate that information to such patron. (C) The licensee shall not charge a patron a different fee than is posted upon such sign. (Ord. No. 6213, § 11, 9-5-12)

Las Vegas Municipal Code § 6.12.070 Exceptions.

6.12.070 - Exceptions. Except as otherwise provided in LVMC 6.12.090 as it relates to the payment of business license fees, this Chapter shall not apply to the following: (A) Doctors, dentists and other medical practitioners licensed by the appropriate board under the Nevada Revised Statutes; (B) Hypnotherapy practitioners who do not qualify under Subsection (A) but who have a current certification from a qualified professional hypnotherapy organization. For purposes of the preceding sentence, "qualified professional hypnotherapy organization" means a nationally recognized organization that is dedicated to providing training, continuing education, and performance testing in hypnotherapy and that: (1) Has a current membership of at least one thousand members; or (2) Requires for certification purposes a minimum of three hundred hours of training initially and thirty hours of continuing education training every two years. (C) Persons employed by such practitioners and acting under their direction and control, who use hypnotism as an aid in treatment or as a supplementary form of treatment in the course of their profession. Las Vegas Municipal Code § 6.12.080 License fee.

6.12.080 - License fee. The following shall pay in advance an annual license fee of two hundred dollars: (A) Each person required to be licensed by this Chapter; and (B) Each practitioner who is otherwise exempt from this Chapter pursuant to LVMC 6.12.070(B). (Ord. No. 6213, § 11, 9-5-12)
