§ 22-111 USE OF TRUCK ROUTES REQUIRED FOR THROUGH TRAFFIC; EXCEPTIONS. No person shall operate or cause to be operated any commercial motor vehicle, truck-tractor, trailer, semi-trailer or any combination thereof through the city in inter-city travel, without a local destination or point of origin, except upon such streets as are designated as truck routes by this article. § 22-112 USE OF TRUCK ROUTES OR COMMERCIAL DELIVERY ROUTES REQUIRED - GENERALLY. Except as otherwise provided herein, no person shall operate or cause to be operated upon any public street within the city any commercial motor vehicle, motorbus, truck-tractor, trailer, semi-trailer or any combination thereof except on such streets as are designated as either truck routes or commercial delivery routes by this article; such vehicles shall be operated on a truck route wherever capable of being used; they shall be operated on a commercial delivery route only when it is not possible to use a truck route to fulfill the purpose for which such vehicle is then being operated. Fort Worth City Code § 22-113 SAME - DEFENSES.

§ 22-113 SAME - DEFENSES. The following shall be defenses to prosecutions under the provisions of § 22-112: (a) To operate a vehicle to or from a truck terminal, garage, place of repair, place of performing a service, or a place of loading or unloading, over the shortest route to a point on a truck route or commercial delivery route; any such vehicle shall be permitted to proceed from one such point not on a truck route or commercial delivery route to another such point without returning to a truck route or commercial delivery route if to so return would increase the distance to be traveled on nondesignated streets; the operators of any such vehicles shall carry evidence of the location of its last stop and of its immediate destination in order for this defense to apply; (b) To operate emergency vehicles in response to any emergency call; (c) To operate vehicles of a public utility while cruising in an assigned area for the purpose of inspecting the facilities of such public utility or providing maintenance service to the facilities; and (d) To operate motorbuses for the purpose of transporting people for hire upon a regular schedule over a defined route. Fort Worth City Code § 22-116 TRANSPORTATION OF HAZARDOUS MATERIALS.

§ 22-116 TRANSPORTATION OF HAZARDOUS MATERIALS. (a) For the purposes of this section the following terms are defined: HAZARDOUS MATERIAL. Any quantity, group, form or class of material designated as hazardous material in any official publication of the Secretary of Transportation of the United States under the authority of 27 U.S.C.A. § 1803 (1976), as amended, including any such publication issued after the effective date of this section. REQUIRING PLACARDS. That the material to be transported is hazardous and is in sufficient quantity to require placarding in accordance with the Department of Transportation Hazardous Materials Regulations (49 U.S.C.A. §§ 1801 et seq. (1976)) or in accordance with the Tex. Revised Civil Statutes Article 6701d, § 139, as amended, or regulations promulgated under the authority of such § 139, as amended. TRANSPORT. To move any motor vehicle requiring placards upon any public street or highway. (b) No person shall knowingly transport hazardous materials or knowingly cause hazardous materials to be transported upon any public street within the corporate limits of the city, except upon the following: (1) That portion of Interstate Highway 820 and Interstate Highway 20 lying within the corporate limits of the city; (2) That portion of any state or federal highway running outward from Interstate Highway 820 or Interstate Highway 20 to the corporate limits of the City of Fort Worth, Texas; and (3) Any other street or thoroughfare posted by the traffic engineer of the city with signs stating. “HAZARDOUS MATERIAL ROUTE.” (c) It shall be a defense to prosecutions under subsection (b) of this section that the transporting vehicle was empty. (d) It shall be a defense to prosecutions under subsection (b) of this section that such transportation was to a point of destination within the corporate limits of the city or was from a point of origin within the corporate limits of the city, or both, and that no portion of such transportation was in violation of §§ 22-112 and 22-113, as amended, of this code. (e) The operator of a vehicle that is used for transport of hazardous materials requiring placards shall before operations, inspect such vehicle and determine that: (1) Brakes are in good working condition; (2) Steering mechanism is in good working condition; (3) All electrician wiring is well insulated and firmly secured; (4) The vehicle is in a safe condition to transport hazardous materials; and (5) All emergency features on bulk transport carriers are installed and operative as outlined in U. S. Department of Transportation specifications and requirements. (f) It shall be presumed for purposes of prosecution under this section that a transporting vehicle contains hazardous materials if it bears a placard. (g) Both the bureau of fire prevention of the city and the city’s police department are expressly authorized to enforce the provisions of this section. Fort Worth City Code § 22-117 VEHICLE RESTRICTIONS.

§ 22-117 VEHICLE RESTRICTIONS. (a) Except as otherwise provided in this article, it shall be unlawful for any person to drive, operate or move, or to cause or permit to be driven, operated or moved, on any public street within the city, any commercial motor vehicle with or without load, contrary to any of the regulations contained in this section. (b) Commercial motor vehicles shall be subject to the vehicle width, length and height limitations and restrictions which are delineated in V.T.C.S. Article 6701d-11, § 3. (c) No commercial motor vehicle, truck-tractor, trailer, semi-trailer nor combination of such vehicles shall be operated or caused or permitted to be operated upon any public street within the city having a weight in excess of any one or more of the following limitations: (1) In no event shall the total gross weight, with load, of any vehicle or combination of vehicles, exceed 80,000 pounds; (2) No axle shall carry a load in excess of 20,000 pounds. An AXLE LOAD shall be defined as the total load transmitted to the road by all wheels whose centers may be included between two parallel transverse vertical planes 40 inches apart, extending across the full width of the vehicle; (3) The total gross weight concentrated on the highway surface from any tandem axle group shall not exceed 34,000 pounds for each such tandem axle group. TANDEM AXLE GROUP is defined to be two or more axles spaced 40 inches or more apart from center to center having at least one common point of weight suspension; (4) Vehicles used exclusively to transport ready-mix concrete may be operated upon the public streets of the city with a tandem axle load not to exceed 44,000 pounds, a single axle load not to exceed 20,000 pounds and a gross load not to exceed 64,000 pounds. Before any vehicle used exclusively to transport ready-mixed concrete with a tandem axle load in excess of 34,000 pounds may be operated upon the public streets of the city, the owner thereof shall file with the office of consumer affairs a surety bond in the sum of $15,000. Such bond shall be conditioned that the owner of such vehicle will pay to the city all damages done to the public streets and highways by reason of the operation of such vehicle with a tandem axle load in excess of 34,000 pounds; and (5) A limit is placed on the amount of load which may be carried by vehicle tires, according to the width in inches of the tires, as follows: a. Six hundred and fifty pounds per inch for low pressure tires; and b. Six hundred pounds per inch for high pressure tires. (d) The provisions of this section shall not apply to: (1) Any person operating or causing to be operated a motor vehicle under a valid and subsisting permit for the operation of overweight or oversize equipment for the transportation of such commodities as cannot be reasonably dismantled issued by the state highway department under the provisions of Tex. Revised Civil Statutes Article 6701a as such Article now exists or might from time to time be amended; (2) Emergency vehicles operating in response to any emergency call; (3) Vehicles operated for the purpose of constructing or maintaining any public utility in the city. (4) Vehicles used exclusively to transport solid wastes, as defined in Vernon’s Texas Civil Statutes, may be operated in accordance with V.T.C.S. Article 6701d-19a of that statute; and (5) Vehicles used exclusively to transport milk may be operated in accordance with V.T.C.S. Article 6701d-12a of Vernon’s Texas Civil Statutes. (e) The permits referred to in subsection (d)(1) of this section shall be subject to the following. (1) Upon written application timely made by any person who desires to operate or cause to be operated on the public streets within the city, overweight or oversize equipment for the transportation of such commodities as cannot be reasonably dismantled, where the total gross weight or size of the vehicle and its load exceed the limits allowed by this section, the office of consumer affairs, after consulting with the public works department, shall issue a permit for the operation of such equipment or fleets of equipment for a specified period of time, over a route or routes to be designated by the public works department, if such routes can be determined at the time application for the permit is made. (2) The application for the permit provided for in this section shall be in writing and contain the following: a. The kind of equipment to be operated, with a complete description of same and a statement as to its weight; b. The kind of commodity to be transported and a certificate as to its weight; c. The street or streets over which the equipment is to be operated, and the date or dates and the approximate time of the operation, and the number of trips to be made, except when the nature, route, time or frequency of operation cannot be determined at the time the permit is issued; and d. The application shall be dated and signed by the applicant. (3) Before a permit is issued under this section, the applicant for the same shall file with the office of consumer affairs a bond in an amount to be set and approved by the public works department. The amount of such bond shall not exceed the product of the number of vehicles for which a permit is sought multiplied by $15,000, which bond shall be payable to the city and conditioned that the applicant will pay to the city the sum of money necessary to repair any damage which might be occasioned to any public street or publicly owned fixture appurtenant to such street by virtue of operation of any commercial vehicle under such permit. Venue of any suit for recovery upon the bond shall be in the county and any bond issued hereunder shall contain an unambiguous contractual provision to that effect. (4) A fee shall be charged for each permit as follows: Oversize load | Single-trip | $20 Not to exceed 30 days | $45 Not to exceed 60 days | $60 Not to exceed 90 days | $75 Overweight load, single-trip permit only | $20 (5) Any permit issued hereunder shall include at least the following: a. The name of the applicant, the date, a description of the equipment is to be operated and a description of the commodity to be transported; b. The signature of an authorized member of the police department and the public works department; c. The time for which the permit is issued; and d. The specified street or streets over which the equipment is to be operated, insofar as it can be determined at the time the permit is issued. (f) Subsections (c), (d) and (e) shall not apply to a commercial motor vehicle, trucktractor, trailer, semi-trailer, or combination of such vehicles operating on City streets within the Alliance Logistic District if the total gross weight, with load, of the vehicle or combination of vehicles, does not exceed 1200,000 pounds. For purposes of this subsection, the term "Alliance Logistics District" shall mean the area described as follows: BEING a tract of land situated in the G. Overton Survey, Abstract Number 1185, City of Fort Worth, Tarrant County, Texas, and the W. Sample Survey, Abstract Number 1207, the W. Zeckular Survey, Abstract Number 1454, the L.A. Butler Survey, Abstract Number 64, A.W. Robertson Survey, Abstract Number 1553, and the G. Overton Survey, Abstract Number 972, City of Fort Worth, Denton County, Texas, being all or part of the following tracts of land located in Tarrant County, Texas: the remainder of that tract of land described by deed to AIL Investment, LP, recorded in Volume 13588, Page 187; Fort Worth City Code § 22-118 VIOLATIONS.

§ 22-118 VIOLATIONS. (a) It shall be unlawful for any person to operate or permit to be operated or aid in the operation of a vehicle on the public streets of the city in violation of this article. The appropriate officials of the office of consumer affairs of the city are empowered to enforce the provisions of this article. (b) It shall be unlawful for any person to load, or cause to be loaded, a vehicle for operation on the public streets of the city with the intent to violate the weight limitations established in this article. Intent to violate such limitations is presumed if the loaded vehicle exceeds the applicable gross vehicular weight limit by 15% or more. Fort Worth City Code § 22-119 ENFORCEMENT OF VIOLATIONS BY CITY; FINE.

§ 22-119 ENFORCEMENT OF VIOLATIONS BY CITY; FINE. Any official of the office of consumer affairs having reason to believe that the gross weight, vehicle tire load limit or axle load of a loaded motor vehicle is unlawful, is authorized to weigh the same by means of a portable or stationary scales, and to require that such vehicle be driven to the nearest available scales for the purpose of weighing. If a vehicle is found to be in violation of the weight limits set out in this article, the driver of the vehicle shall be issued a citation. (Ord. 9983, § 8, passed 10-13-1987)
