Post-retirement death benefit.
Oklahoma City Municipal Code § 40-78
in effect§ 40-78. - Post-retirement death benefit.
(a) Provided, prompt notice is provided to the Administrator of the Employee Retirement System concerning the death of a retired participant, and in addition to any benefits provided in this division, a $5,000.00 lump-sum payment shall be paid to the beneficiary designated by a retired participant on a form provided by the system. Prompt notice under this Section 40-78 shall be considered 20 days or less from the date of death of the retired participant. Said retired participant may change his/her beneficiary from time to time in the same manner. The retired participant may designate his/her estate as beneficiary.
(b) If the retired participant's estate, family, or designated death-benefit beneficiary fails to provide prompt notice of the retired participant's death to the system and an overpayment of retirement benefits is therefore made to the retired participant, then the system shall have the right to withhold payment of the lump-sum death benefit until such time as the overpayment is returned to the system, or an agreement is made with the retired participant's estate or designated death benefit beneficiary to reduce the lump-sum death benefit by the amount of overpayment made to the retired participant.
(c) If there is no designated beneficiary surviving at the death of the retired participant, payment of any death benefit shall be made to the estate of the deceased retired participant.
