Denver Revised Municipal Code § 55-420 Definitions.

Sec. 55-420. - Definitions. The following terms shall have the following definitions for purposes of this article: (a) Business: means any business or commercial operation or establishment, whether operated for profit or not for profit, including but not limited to hotels, motels, restaurants, taverns, retail stores, funeral homes, office buildings, schools, colleges, wedding and reception halls, theatres, concert halls, and hospitals. The term does not include private residences. (b) Manager: means the manager of licensing and consumer protection. (c) Entity: means a corporation, limited liability company, limited partnership or partnership. (c.1) Face block: means a zone lot or lots fronting on one (1) side of the block. The "same" face block indicates only those lots fronting on the same side of the block as the subject property. The "facing face block" includes those zone lots located on a different block than the subject property, but located directly across the street from and fronting the same street as the subject property, and bounded by the same intersecting streets as the subject property's block. (d) Hire: means to employ, contract with, or utilize. (e) Person: means a natural person; not an entity. (f) Premises: means private real property owned, leased, or licensed to the valet client business. (g) Temporary valet parking sign: means a movable sign placed on the public right-of-way stating or advertising that valet parking is available at the valet client business. (h) Valet attendant: means any person hired by a valet operator to perform valet services for the valet operator, a valet client business, or the valet client business's valet customers. (i) Valet client business: means a business that hires a valet operator to perform valet services for valet customers of the business. (j) Valet customer: means the customer, employee, visitor, or other person who owns, leases, or has the lawful right to possess the motor vehicle that receives parking valet services while visiting, working at, occupying, or patronizing the valet client business and all drivers and passengers of such motor vehicle. (k) Valet drop-off location: means a place at or near the valet client business's location where valet customers and their passengers embark and disembark from their vehicles and load or unload their motor vehicles when utilizing valet services at the valet client business. (l) Valet operator: means any person or entity hired as an independent contractor by a valet client business to perform valet services for the valet client business or the valet client business' valet customers. The term includes the valet client business itself where the valet client business elects not to hire a parking valet operator as an independent contractor, but instead performs parking valet services for its valet customers through its own employees. (m) Valet parking lot: means a parking lot or lots or other place or places where the valet operator or valet attendants park one (1) or more valet customers' vehicles until the vehicle is retrieved by a valet operator, valet attendant, or the valet customer. There shall be no on-street valet parking. (n) Valet parking receipt: means a piece of paper or token with a unique number, letter, or symbol which identifies and connects the valet customer with his or her motor vehicle, which is issued in triplicate, one (1) copy of which is given to the valet customer, one (1) copy of which is attached to the key to the valet customer's motor vehicle and kept at the valet station, and one copy of which is left in the interior of the valet customer's motor vehicle on the dash or at some other place where the receipt is visible from the exterior of the vehicle when looking at or through the windshield of the motor vehicle. (o) Valet parking services: means the act of driving a motor vehicle to park or retrieve the motor vehicle for a valet customer while the valet customer visits, works at, or patronizes a valet client business. The term does not include merely loading or unloading people, animals or cargo from a motor vehicle, opening or closing doors of motor vehicles, greeting customers and patrons in motor vehicles, giving directions for parking, or providing parking spaces. (p) Valet parking station: means a table, podium, desk, or similar place at or near the valet client business where one (1) copy of the valet parking receipts and keys to the valet customers' vehicles are kept and where valet customers may go to drop off or retrieve their motor vehicles or the keys to their motor vehicles. Denver Revised Municipal Code § 55-421 Valet parking services for businesses prohibited without license.

Sec. 55-421. - Valet parking services for businesses prohibited without license. (a) No business shall perform valet parking services for any valet customer of the business unless: (1) The business itself holds a valet operator license and a valet location license for that location; (2) The business hires a valet operator who holds a valet operator license and a valet location license for the specific valet client business and location; or (3) The business has a valet location license and hires a valet operator with a valet operator's license. (b) No valet client business shall hire any valet operator to perform valet parking services unless the valet client business first obtains a copy of the valet operator's license. (c) No person shall perform valet parking services unless he or she holds a valet operator license or is employed by a person who holds such a license. (d) Valet parking services may only be performed at a location for which there is a valet location license. The person or entity performing valet services at any location must hold the location license or have permission from the location license holder. Denver Revised Municipal Code § 55-422 Valet operator license.

Sec. 55-422. - Valet operator license. Any person or entity, including the valet client business itself, who meets all of the following requirements may obtain or renew a valet operator license: (a) If the applicant is a person, he or she is at least eighteen (18) years of age; (b) If the applicant is a person, he or she holds a valid Colorado driver's license; (c) The applicant provides a copy of an insurance policy specifically naming the applicant, the valet client business, and the city as insured parties, providing liability coverage for property damage in an amount not less than two hundred fifty thousand dollars ($250,000.00) and personal injury coverage in an amount not less than one million dollars ($1,000,000.00) covering injuries and damages caused by the valet client business, valet operator, or any of his or her valet attendants in the course of conducting valet services for the valet client business, with a term of at least the twelve (12) month term of the license; (d) If the applicant is a person, the applicant has no convictions for felony offenses or for misdemeanors or ordinance offenses involving theft or violence within the ten-year period preceding the application, or if the applicant is an entity, no officer, director or person owning a ten-percent or greater interest in the applicant has a conviction for a felony, misdemeanor or ordinance violation involving theft or violence within ten (10) years preceding the application; (e) If the applicant is a person, there are no outstanding warrants or citations for any crime, ordinance violation, or traffic offense. If the applicant is an entity, no officer, director or person holding a ten-percent or greater interest in the entity has an outstanding warrant or citation for any crime, ordinance violation, or traffic offense; (f) The applicant and its employees, agents, and valet attendants have not committed any act or omission that is cause for denial, suspension or revocation of the license as provided in this article within one year preceding the application; (g) The applicant completes and signs an application on forms prescribed by the manager; (h) The applicant does not have any unpaid fines, taxes, or fees due to the city; and (i) The application and license fees are paid. Denver Revised Municipal Code § 55-423 Valet location license.

Sec. 55-423. - Valet location license. Any person or entity, including the valet client business itself, who meets all of the following requirements may obtain or renew a valet location license: (a) The applicant completes and signs an application on forms prescribed by the manager; (b) The application and license fees are paid; (c) The applicant holds a valid valet operator license or is a business operating on the same face block as the location for which the license is being sought; (d) If the applicant is not the valet client business itself, the applicant submits written proof that the applicant has been hired by the valet client business to perform services as a valet operator at the specific location; and (e) The applicant obtains approval from the city traffic engineer of a valet parking plan for the valet client business as provided in this article. Denver Revised Municipal Code § 55-424 Valet parking plan; modification of valet parking plan.

Sec. 55-424. - Valet parking plan; modification of valet parking plan. (a) The manager shall not issue a valet location license unless the city traffic engineer has first: (1) Approved a written valet parking plan for the valet client business, and (2) Issued a street occupancy permit. (b) The city traffic engineer shall, within a reasonable time, review the valet parking plan and either approve the valet parking plan, disapprove the plan, or approve the plan with terms, conditions, and restrictions that may be necessary to protect public health, safety, welfare or convenience. The city traffic engineer shall forward his or her approval, disapproval, or approval with conditions, terms, limitations, and restrictions to the manager of licensing and consumer protection. In the event that the city traffic engineer approves the valet parking plan with conditions, terms, limitations, or restrictions, the city traffic engineer shall attach the conditions, terms, limitations, and restrictions in writing to the approval along with a statement briefly describing why such conditions, terms, limitations, and restrictions are necessary to protect public health, safety, welfare or convenience. (c) The manager shall make any terms, conditions, restrictions or limitations imposed by the city traffic engineer written conditions of the valet location license. The applicant shall have the right to contest the validity of such conditions in an administrative hearing, as provided in subsection 55-426(d). (d) Any valet operator may apply to the city traffic engineer for a modification of the valet parking plan approved at the time the valet location license was issued. Any approved modification of the valet parking plan shall be in writing and shall become a condition of the valet location license. The city traffic engineer may issue a temporary approval of the proposed modified valet parking plan pending consideration of the application. The city traffic engineer shall forward any modification of the approved valet parking plan as well as any temporary approval of modifications to the valet parking plan to the manager. (e) In the event that the valet parking plan requests the use of existing parking meters in order to access the valet drop-off location, the identified parking meters will be designated as passenger loading zones only during the hours specified in the valet parking plan. (f) For valet parking operating anytime between 5:00 p.m. and 6:00 a.m. the valet operator shall not be required to pay a fee, in addition to the valet location license fee, for use of up to two (2) parking metered spaces or forty (40) feet of right-of-way during the time that such parking meters or right-of-way are utilized as a passenger loading zone. For use of additional meters, the valet operator shall pay an annual meter fee equal to one-third of the actual maximum revenue lost from the use of each additional meter, based on the meter charges for the area. (g) For valet parking operating anytime between 6:00 a.m. and 5:00 p.m., the valet operator shall pay an annual fee equal to one-third the actual maximum revenue lost from the use of each meter, up to two (2), based on the meter charges for the area. The operator shall pay an annual fee equal to the actual maximum revenue lost from the use of each additional meter over two (2), based on the meter charges for the area. (h) There shall be no more than one (1) valet location permitted per face block, provided, however, that more locations may be granted upon approval by the city traffic engineer. The applicant for any extra location must show a demonstrated need for such location that can not adequately be filled by existing valet locations and must show there will be no adverse impact on traffic or public safety. (i) Notwithstanding (h) above, hotels may have a valet location, regardless of the number of other valet locations on the face block. Hotels shall be allowed two (2) free spaces twenty-four (24) hours per day unless they have an off-street loading zone, driveway or porte-cochere. If a hotel demonstrates a need for extra spaces that can not adequately be filled by the off-street loading zone, driveway or porte-cochere or the two (2) free spaces, whichever is applicable, and demonstrates that there will be no adverse impact on traffic or public safety, the city traffic engineer may allow extra spaces. Extra spaces in excess of the two (2) free spaces and on-street spaces for locations with an off-street loading zone, driveway or porte-cochere shall be charged as specified in (f) and (g) above. Denver Revised Municipal Code § 55-425 Terms of valet operator license and valet location license.

Sec. 55-425. - Terms of valet operator license and valet location license. (a) Every valet operator license and every valet location license shall be issued in writing and shall be valid for a one (1) year term specified in the license. (b) A valet operator license does not give the licensee the right to conduct valet services at any location unless the licensee also obtains a valet location license for the location where the valet services are conducted or obtains written permission from the person or entity holding the location license. (c) A valet location license does not give the licensee the right to conduct valet services unless the licensee also holds a valet operator license. (d) Every valet location license shall be issued for a specific valet client business at a specific location, and shall not be valid for any other valet client business, except as provided in subsection 55-425(f). (e) A valet operator shall obtain a separate valet location license for each valet client business and each location of the same valet client business where the valet operator provides valet services, except as provided in subsections 55-424(c) and 55-425(f). (f) A valet operator may obtain a single valet location license for two or more valet businesses which choose to share valet services if: (1) The valet client businesses are all within one thousand (1,000) feet of each other; and (2) The valet operator submits a copy of a written agreement under which all of the client businesses agree to a share a single valet drop-off location, valet station, valet parking lot, and valet parking signs among them as part of the proposed parking plan; and (3) The city traffic engineer finds that the valet drop-off location, valet, station, and valet parking lot as provided in the valet parking plan and the sharing agreement meet the requirements of this article as to each valet client business. (g) Every valet location license includes the contents, terms, conditions, restrictions and limitations of the valet parking plan approved at the time the license is issued, or as modified in writing by the city traffic engineer after issuance, and the same shall be conditions of the license. The manager may impose any additional term, condition, requirement, or limitation on any valet operator license that the manager may determine is necessary to protect public health, safety, welfare or convenience. (h) The issuance of a valet operator license and valet location license under this article does not grant the licensee any right, license, franchise, or property right in any part of the public right-of-way under the license itself or under the terms of any revocable permit for use of the public right-of-way issued or utilized in connection with such license. The city and any of its police officers or officials may reasonably require, in the exercise of reasonable discretion, that the licensee or any valet client business to temporarily or permanently suspend its valet parking operation, the use of its valet drop-off location, or remove its valet parking station or valet parking sign from a part or all of the public right-of-way in order to protect public safety, to facilitate special transportation needs, to permit construction, for parades and other special events, or for other reasonable purposes. Denver Revised Municipal Code § 55-426 Denial of valet operator or valet location license; applicants denied ineligible for one year; hearings on denial or conditions imposed on license.

Sec. 55-426. - Denial of valet operator or valet location license; applicants denied ineligible for one year; hearings on denial or conditions imposed on license. (a) The manager may deny the issuance or renewal of any valet operator license or valet location license of any applicant who: (1) Fails to meet any of the requirements for issuance or renewal of the license as provided in this article; (2) Has committed or permitted any act or omission which is cause for suspension or revocation of that license as provided in this article within one year of the application; or (3) Makes any false or misleading statement of material fact in his or her application. (b) Any applicant whose application for a valet operator license or valet location license is denied shall be ineligible to re-apply for such license for one (1) year from the date of the denial unless the manager enters an order making the applicant eligible to re-apply in some shorter period. (c) Any applicant whose application for issuance or renewal of a valet operator license or valet location license is denied may, within fifteen (15) days of such denial, apply in writing to the manager for an administrative hearing to determine whether legal and factual cause exists to deny the issuance or renewal of the license under the terms of this article. If such application is made, the manager or the manager's hearing officers shall conduct an administrative hearing to determine whether legal and factual cause exist for the denial. (d) Any person or entity who is issued a valet operator license or valet location license containing terms, conditions, requirements, or limitations may, within fifteen (15) days of the issuance of such license, apply in writing to the manager for a hearing to determine whether a legal and factual cause exists for the imposition of such terms, requirements, conditions or limitations. If such application is made, the manager or the manager's hearing officers shall conduct a hearing to determine whether such legal and factual cause exist. (Ord. No. 493-01, § 1, 6-18-01; Ord. Denver Revised Municipal Code § 55-427 Suspension or revocation of valet operator license or valet location license; administrative fines against licensees.

Sec. 55-427. - Suspension or revocation of valet operator license or valet location license; administrative fines against licensees. (a) After notice and an administrative hearing at which the city submits proof by a preponderance of the evidence, or upon stipulation of the parties, or upon failure of the licensee to appear at such a hearing after notice has been given, the manager may suspend or revoke the valet location license of any person or entity who: (1) Makes any false or misleading statement of material fact on his or her application for a license or to any city employee enforcing this article or investigating whether a violation has occurred under this article; (2) Commits any act or omission prohibited under this article, fails to perform any act required under this article, or permits any valet attendant or other person in his employment to do the same; (3) Commits any act or omission is cause for denial of a license under section 55-428; (4) Violates any term, condition or limitation on his or her license; (5) Commits any act prohibited under any rule or regulation or fails to perform any act required under any rule or regulation promulgated under this article by the manager or permits any valet attendant or other person hired by him to do the same; (6) Commits any crime involving violence or theft; or (7) Commits any act or omission or meets any condition which is cause for suspension or revocation under chapter 32. (b) After notice and an administrative hearing at which the city submits proof by a preponderance of the evidence, or upon stipulation of the parties, or upon failure of the licensee to appear at such a hearing after notice has been given, the manager may suspend or revoke the valet operator license of any person or entity who: (1) Makes any false or misleading statement of material fact on his or her application for a license or to any city employee enforcing this article or investigating whether a violation has occurred under this article; (2) Commits any crime involving violence or theft; (3) Commits any act which is cause for denial of a license under section 55-428; (4) Commits any act or omission which is cause for suspension or revocation of the license under chapter 32; or (5) Commits three or more acts or omissions prohibited under section 55-432 within any ninety (90) day period. (c) In lieu of any suspension, the manager may assess an administrative fine against the license not to exceed one thousand dollars ($1,000.00) per violation. Whether a fine should be assessed in lieu of suspension or revocation, and the amount of such fine shall be determined by the manager in his or her discretion, based upon the nature of the offense, the licensee's record, whether the violation presents a threat to public health, safety or welfare, the duration of the violation, and any other mitigating or aggravating circumstances present. In the event that the manager imposes an administrative fine under this section, the manager's order shall state a deadline for payment of the fine, not to exceed thirty (30) days. In the event that the fine is not paid by that date, the manager shall suspend the license until the fine is paid. (d) In addition to or in the alternative to any suspension, revocation, or administrative fine provided in this section, the manager may impose new or additional terms, requirements, conditions, or limitations on any license issued under this article. (e) In addition to or in the alternative to any suspension, revocation, or administrative fine provided in this article, and in addition to or in the alternative to any new or additional terms, requirements, conditions, or limitations imposed on any license issued under this article, the manager may impose administrative citations pursuant to article XII of chapter 2 of the Denver Revised Municipal Code. No license shall be renewed if any outstanding fine is unpaid at the time of renewal, and the manager shall suspend any license if any fine is unpaid within thirty (30) days of imposition or, in the event the fine was appealed, within thirty (30) days of resolution of the appeal. (f) If a valet location license is revoked there shall be a fee of two thousand dollars ($2,000.00) for reinstatement. Applications for reinstatement may not be made for one (1) year from the date of revocation and reinstatement shall only be granted upon a showing that all violations have been corrected and the applicant presents a plan to prevent repeat violations. (g) For purpose of this section and the suspension, revocation or denial of any valet operator license or valet location license, any act or omission of a valet attendant that occurs in the course of his or her employment as a valet attendant for the valet operator shall be imputed to the valet operator and his or her valet operator and valet location license. Denver Revised Municipal Code § 55-428 Waiver of licensing requirements for certain events.

Sec. 55-428. - Waiver of licensing requirements for certain events. (a) The manager may waive the valet location licensing requirements of this article for certain events where: (1) The event occurs only once in any 12-month period within the city; (2) The event does not exceed sixty (60) days in duration; and (3) The event does not have a permanent location within the city. Denver Revised Municipal Code § 55-429 Rules and regulations.

Sec. 55-429. - Rules and regulations. The manager may make and promulgate rules and regulations for the administration of this article and further regulating the conduct of valet operators and valet attendants while providing valet parking services consistent with the provisions of this article. Denver Revised Municipal Code § 55-430 Unlawful acts in connection with valet parking.

Sec. 55-430. - Unlawful acts in connection with valet parking. If there are three (3) violations of any of the following provisions at any valet location within any one-year period that valet location license shall be revoked. It shall be unlawful for any person or entity: (a) To violate any provision of this article or any rule or regulation promulgated under this article; (b) To fail to perform any act required under this article or under any rule or regulation promulgated under this article; (c) To utilize any valet parking station unless it is located either: (1) On the premises of the valet client business or on the premises of another valet client business which is sharing the valet parking station with the valet client business under the valet parking plan; or (2) On the public right-of-way at a place where the valet client business holds a current revocable permit from the city for such use of the public right-of-way, or on the public right-of-way at a place where another valet client business which is sharing the valet parking station with the valet client business holds a current revocable permit from the city for such use of the public right-of-way; (d) To fail to utilize a valet parking station consisting of a table, podium, desk, or lectern prominently posted with the valet operator's license and a sign stating: "Valet Station," the name and logo of the valet operator, and the cost of the valet services offered, all located and situated as shown in the valet parking plan approved as part of the valet operator license for that valet client business; (e) To utilize a valet drop-off location when performing parking valet services for any valet client business unless the valet drop-off location is located: (1) On the premises of the valet client business or on the premises of another valet client business which is sharing the valet drop-off location with the valet client business under the approved valet parking plan; or (2) On the public right-of-way at a place where the valet operator or a client business holds a current valet location license for such use from the city; (f) To utilize a drop-off location when performing valet services for any valet client business unless the drop-off location is shown and described in the valet parking plan approved as part of the valet operator's license for the valet client business; (g) To utilize any location as a valet parking lot unless: (1) The location is off the public right-of-way; (2) The location is within two (2) miles of the entrance to the valet client business; (3) The location is on the property of the valet client business or on some other property on which the valet operator has secured a written lease or contract with the owner of the property giving the valet operator the right to use the property as a valet parking lot on the day of the week and the time of the day that the property is utilized as a valet parking lot; (4) A valid parking lot license has been issued for the location or it is exempt from such requirement; and (h) To stop any valet customer's vehicle in the public right-of-way for the purpose of embarking or disembarking persons, loading or unloading material from the motor vehicle, or for any other purpose, or to permit any valet customer to do any of the same, except in a valet drop-off location approved in the valet parking plan as part of the valet operator license for the valet client business; (i) To fail, neglect, or refuse to: (1) Utilize valet parking receipts; (2) Provide each valet customer with one (1) copy of the valet parking receipt; (3) Keep one (1) copy of the valet parking receipt at the valet parking station with the key to the valet customer's motor vehicle; or (4) Leave one (1) copy of the valet parking receipt in the interior of the valet customer's motor vehicle on the dash or at some other place where the receipt is visible from the exterior of the vehicle when looking at or through the windshield of the motor vehicle; (j) To leave a valet customer's vehicle unlocked or to leave the key to the vehicle in the vehicle while the same is parked and unattended; (k) To place any temporary valet parking sign on any part of the public right-of-way at or near any valet client business, unless: (1) There is a valid valet operator license issued for the valet client business; (2) The valet parking plan approved as a part of the valet operator's license includes the temporary valet parking sign; (3) The temporary valet parking sign is used, displayed, constructed, and attached at the place and in the manner approved by the manager of transportation and infrastructure and as shown in the valet parking plan approved as part of the valet operator's license; (4) There is a revocable permit in full force and effect for such sign and the manager of transportation and infrastructure has approved use of the temporary valet parking sign; and (5) The temporary valet parking sign meets the requirements of and is used as required in section 49-437; (l) To consume any alcohol beverage or to be in possession of any unsealed or open container holding an alcohol beverage while performing any valet services; (m) To park any valet customer's motor vehicle in a valet parking lot more than two (2) miles from the valet client business, measured by the shortest route that can be legally traveled by motor vehicle from the valet client business to the valet parking lot; (n) To drive, occupy, or utilize any valet customer's motor vehicle to conduct any personal or business task other than parking and retrieving the motor vehicle; (o) To transport another person in or allow any person to enter a valet customer's motor vehicle except other valet attendants, the licensed valet operator, and the valet customer; (p) To fail, neglect or refuse to immediately exhibit copies of his or her valet operator license to any police officer or city employee enforcing the terms of this article who requests the same; (q) To perform any valet services unless he or she is wearing on the outside front of his or her shirt, jacket or other upper body garment, in a place that is plainly visible to the public, the word "valet," and the name and logo of the valet operator; (r) To make any false or misleading statement of a material fact to any city official or employee in connection with any application for any license or any license issued under this article; (s) To fail to follow procedures regarding hiring valet attendants, record maintenance, and reporting; (t) To hire any valet attendant who does not possess a valid driver's license; (u) To hire any valet attendant unless the valet operator has first obtained a current written copy of the prospective valet attendant's motor vehicle driving record from the state that issued the driver's license, has reviewed the same; and has submitted the same to the valet operator's liability insurance carrier; (v) To hire any valet attendant unless the valet operator has first submitted the prospective valet attendant's motor vehicle record to his or her liability insurance carrier and the insurance carrier has approved hiring the valet attendant; or (w) To hire any valet attendant unless the valet operator has first performed a criminal background check on the prospective valet attendant, including a review of his or her motor vehicle record and references.
