Sec. 2-82-1. - Created; composition.
There is created an alcohol commission consisting of five members.

Sec. 2-82-2. - Appointment, terms and compensation of members.
A. The mayor shall appoint nine members to the alcohol commission, which appointments shall be subject to the approval of the city council. After the initial members, the nine members shall be appointed for terms beginning January 1, for a three-year period, or until their successors are appointed and qualified.
B. In the event of a vacancy, whether by reason of resignation, death or other cause, the mayor, with the approval of the council, may elect a successor only for such unexpired term. The members shall serve without compensation.
C. In the event of an absence of a quorum at the scheduled meeting of the alcohol commission, the secretary may notify the mayor or chief administrative officer who then may designate in writing a temporary appointee for that meeting. The appointee shall be administered the oath, and shall have all the rights and responsibilities of a member at the meeting for which the temporary appointed has been designated to serve.

The members of the alcohol commission shall be residents of the city and shall have been for at least five years preceding their appointment.

Sec. 2-82-4. - Members' oath.
Each member of the alcohol commission shall take an oath to faithfully perform the duties imposed upon him or her without fear or favor, and in full accordance with the constitution and laws of the state and the ordinances of the city.

The mayor shall designate one member of the commission to serve as chairperson of the commission.

The alcohol commission shall employ a secretary and it may employ other necessary clerical help, with the approval of the director of public service.

Sec. 2-82-8. - Rules and regulations.
The alcohol commission is empowered to make such rules and regulations, not inconsistent with the state law and the provisions of this chapter, as may be necessary or proper in the performance of its duties.

Sec. 2-82-9. - Police power of members and secretary; assistance from police and health departments.
The members of the alcohol commission and the secretary employed by the commission shall have full police power and authority to enter, inspect, and investigate any business operated pursuant to any license issued under this chapter, and shall have full authority to call upon any member of the police force or the department of health for assistance in the enforcement of the provisions of this chapter or any other ordinance of the city.

Sec. 2-82-10. - Purchases.
The alcohol commission is authorized to purchase all necessary stationery, printing and supplies through the purchasing agent of the city.

Sec. 2-82-11. - Payment of expenses; annual financial statement.
All expenses of the alcohol commission shall be paid out of the general funds of the city, pursuant to an annual appropriation by ordinance, and it shall be the duty of the commission to prepare and submit to the director of finance and administration a statement of its expenditures for the previous year and an estimate of its current year's operating cost.
