M.G.L. c. 74, § 1 Definitions

c. 74, § 1. Definitions Section 1. The following words, as used in this chapter, shall have the following meanings unless the context otherwise requires: ''Commissioner'', the commissioner of education. ''Approved'', the approval of specific vocational-technical programs by the commissioner of education, acting through the division of occupational education, following investigation and determining the appropriateness of programs as to organization, control, location, equipment, courses of study, qualifications of teachers, methods of instruction, conditions of admissions of student, employment of students and expenditures. ''State board'', the board of education. ''Forms of vocational-technical education'', the classification of vocational-technical educational programs which lead employment or continuing preparation for employment associated with agriculture, allied health, automotive, construction, marketing, service occupations, industrial-manufacturing programs and technical programs. ''Agricultural programs'', the preparation of students for occupations connected with agriculture, the care of domestic animals, forestry and other wage earning or productive work on farm land. The term agricultural supplies, horticulture and agricultural and natural resources. ''Allied health programs'', the preparation of students for occupations connected with health, to include direct and indirect care of patients and other wage earning or productive work within the health care area and related services. ''Automotive programs'', the preparation of mechanics and technicians for any type of engine-powered vehicle. ''Construction programs'', the preparation of students for occupations in the areas of carpentry, plumbing, painting, electricity, heating, ventilation and air conditioning and other areas of construction. ''Marketing education programs'', the development of competent workers engaged in marketing, sales and such administrative supporting functions as buying, receiving, storing, shipping, promoting, financing, market research, and management. These activities are found in such areas as retail and wholesale trade, banking, and finance, insurance, real estate, service trades, manufacturing, utilities and communications. Such phrase shall not include the following occupations: stenographer, secretary, typist nor industrial workers in transportation activities. ''Industrial-manufacturing programs'', the development of workers for occupations involving the manufacturing or fabrication of products in either heavy or light industry. ''Technology programs'', the preparation of students for occupations or further education in such areas as: electronics, drafting, computers, electromechanical. ''Service programs'', the preparation of students in occupational areas such as hotel and lodging, cosmetology, child care or any service occupation that by its nature is characterized as being a service, professional or non-professional; provided, however, that such programs shall be in compliance with the program approval criteria regulations published by the state board. ''Part time class'', towns, cities, regional and county school districts and independent schools may operate part-time and evening vocational-technical classes approved by the commissioner under the state board. ''Cooperative education'', a program of vocational-technical education for persons who, through a cooperative arrangement between the school and employers, receive instruction, including required academic courses and related vocational-technical instruction, by the alternation of study in school with a job in any occupational field. Such instruction shall be planned and supervised by the school and the employer so that each contributes to the student's education and employability. Work periods and school attendance may be on alternate half-days, full days, weeks or other coordinated periods of time. ''Articulation'', is the educational process whereby curricular interaction occurs across grade levels and links programs between educational levels. Horizontal articulation provides the curricular process which serves to strengthen a student's mastery of interacting concepts and skills across all academic and educational levels. Vertical articulation provides the curricular vehicle which allows a student to progress by competencies from a vocational-technical program at one educational level to the same program area at a higher educational level, for example, between secondary and postsecondary education. ''Vocational-technical education'', organized education programs offering sequences of courses designed to educate and prepare students for both employment and continuing academic and occupational preparation. Such programs shall integrate academic and vocational education and shall include competency based applied learning which contributes to an individual's academic knowledge, higher order reasoning, and problem solving skills, work attitudes, general employability skills and the occupational-specific skills necessary for economic independence as a productive and contributing member of society. Vocational-technical education shall also include applied technology education to be taught by personnel certified in technology education.

The commissioner, under the direction of the state board, shall investigate and promote vocational-technical schools, and initiate and superintend the establishment of schools for the aforesaid form of education and shall supervise and approve such schools as provided in sections one to thirty-seven, inclusive. The commissioner, under the direction of the state board, shall approve or disapprove vocational-technical programs in accordance with regulations published by the board; provided, however, that said regulations shall more heavily favor an outcome-oriented approach for approval of such programs over a quantitative approach which solely measures time spent on lab instruction; provided, further, that said regulations shall consider a program's intention to integrate vocational and academic instruction and to train students in all aspects of a chosen industry.

The commissioner shall establish rules and regulations to promote the employment of vocational-technical students during their studies by the city or town in which said students attend school, or in the case of a regional or county agricultural school district, the cities and towns comprising said district. Students shall not be permitted to perform work on projects which are outside such city or town unless said projects have exceptional value as determined by the commissioner.

c. 74, § 2B. Construction program students; low income housing Section 2B. Notwithstanding any general or special law to the contrary, a city or town may provide for the construction of one and two family dwellings for persons of low income, by students in vocational-technical schools enrolled in construction programs. No such construction shall be undertaken without the prior approval of the division of occupational education and in a city with the prior approval of the mayor and council or in a town with the prior approval of the town council, or if there is no town council, with the approval of the town meeting and board of selectmen.

c. 74, § 3. Establishment in towns; management Section 3. Towns may, through school committees or boards of trustees elected for not more than five years, and known as local trustees for vocational-technical education, establish and maintain independent or vocational-technical schools.

M.G.L. c. 74, § 4 Establishment by districts

c. 74, § 4. Establishment by districts Section 4. Independent vocational-technical schools may be established and maintained by districts composed of two or more towns, through boards to be known as district trustees for vocational-technical education, consisting either of the chairman and two other members of the school committees of each town, to be appointed by such committees, or of three residents of each, to be elected by the town. Pursuant to section 21 of chapter 15A, 1 member of said board shall be designated by the district trustees to serve as a non-voting member of the board of trustees for any community college that shares the same geographic region as the independent vocational-technical school. The designated member shall serve as a liaison between the 2 boards for the purposes of sharing information and developing policies that will promote greater interaction between the vocational-technical school and the community college while maximizing the educational resources available to individuals seeking to learn a trade or develop targeted employment skills.

District trustees under the preceding section shall adopt, for one year or more, plans or organization, administration and support of such schools, which shall be binding on the towns made parties thereto, and shall not be altered or annulled except by two-thirds votes of such trustees, with the consent of the commissioner under the direction of the state board.

Independent vocational-technical schools may be established under sections fourteen and fifteen of chapter seventy-one, if the agreement for the establishment of the regional school district, either as originally adopted or as subsequently amended, so provides, and for that purpose the regional district school committee shall have the powers and perform the duties conferred or imposed by law upon local trustees for vocational-technical education, and may be known as a board of regional school district trustees for vocational-technical education.

Regional school districts or cities and towns which are not members of vocational-technical regional school districts, may through educational collaboratives formed under the provisions of section four E of chapter forty, conduct vocational-technical education programs approved under the provision of this chapter.

M.G.L. c. 74, § 6 Advisory committees

c. 74, § 6. Advisory committees Section 6. Each school district, county agricultural school, collaborative or municipality operating an approved vocational-technical program shall, under a plan approved by the commissioner under the direction of the state board, appoint advisory committees composed of representatives of local business and industry related to the program, organized labor, parents and students, which shall consult with and advise the trustees and other school officials managing and supervising such schools.

c. 74, § 7. Admission of non-resident pupils Section 7. Residents of towns in the commonwealth not maintaining approved independent distributive occupations, industrial, agricultural, vocational home economics and allied health occupations training schools offering the type of education desired, or children placed in such a town by the commissioner of children and families or by the trustees of the Massachusetts training schools, may, upon the approval of the commissioner under the direction of the state board, be admitted to a school in another town. In making his decision, the commissioner under the direction of the state board shall take into consideration the opportunities for free vocational training where the applicant resides, the financial status of such place, the age, preparation, aptitude and previous record of the applicant, and other relevant circumstances.

For the tuition in an approved vocational-technical program of any regional or county agricultural school district, city, town, independent school or collaborative of any pupil placed in such school by the department of children and families, the commonwealth or the city of Boston, as the case may be, shall pay to said school the tuition fee established by the commissioner under the direction of the state board.

c. 74, § 7B. Apprenticeship program Section 7B. An apprentice, as defined in section eleven H of chapter twenty-three shall, upon the concurrence of the commissioner of labor and industries, be approved by the commissioner under the direction of the state board for related vocational-technical training in any city, town, regional district or independent school, regardless of residential qualification. Related classes for an approved apprenticeship program shall be conducted in a single school system, unless the commissioner, in agreement with the commissioner of labor and industries, determines that it would be in the best interest of said program to conduct such classes in more than one such school system.

Notwithstanding the provisions of section twenty-seven C of chapter twenty-nine, or of any other general or special law to the contrary, a town where a person resides who is admitted to the school of another town under section seven shall pay a tuition fee to be fixed by the commissioner under the direction of the state board, and in default of payment shall be liable therefor in contract to such other town. If an approved vocational school established by a regional school district or a public independent vocational school accepts a student who resides in a town, other than a member town of said district, which does not maintain such a vocational school, the town in which such student resides shall pay a tuition fee to be fixed by the regional district school committee or by the board of trustees of a public independent vocational school and approved by the commissioner under the direction of the state board; provided, however, that a town shall not be required to pay any portion of the tuition of any student residing therein who is enrolled in a post-secondary vocational program. Tuition shall be paid in two equal installments in each school year of attendance, one in January and one in June, or on a pro-rated monthly basis if a nonresident student fails to apply for his first year of admission on or before April first of the preceding school year. The commissioner may direct that the resident community's tuition payment for said first year be paid in full in July of the fiscal year after the student completes his first year of nonresident attendance including the penalties that the commissioner may determine. No tuition shall be payable under this section with respect to a student who has satisfactorily complete the twelfth grade or courses equivalent thereto and whose personal income exceeds eighteen thousand dollars, said amount to be adjusted periodically as recommended by the commissioner of education.

M.G.L. c. 74, § 8A Transportation of students

c. 74, § 8A. Transportation of students Section 8A. A municipality, wherein a person resides who is admitted to a day school in another municipality under section 7, shall, through its school committee, when necessary, provide for the transportation of such person, and shall, subject to appropriation, be entitled to state reimbursement to the full extent of the amount so expended; provided, that such a municipality wherein a person is placed by the department of children and families or the trustees of the Massachusetts training schools who is admitted as aforesaid to a day school in another municipality shall similarly provide for the transportation of such pupil to such school and shall, subject to appropriation, be entitled to state reimbursement to the full extent of the amounts so expended; provided further, that no transportation shall be provided for, or reimbursement made on account of, any pupil who resides less than 1 1/2 miles from the school which he attends. A municipality shall not be required under the provisions of this section to provide for the transportation of a person who has completed the twelfth grade of school or the equivalent thereto.

Independent industrial, agricultural, vocational home economics and allied health occupations schools may offer instruction in day, part time and evening classes. Independent distributive occupations schools may offer instruction in part time and evening classes only. Attendance upon such day or part time classes shall be restricted to those over fourteen years of age; and upon such evening classes, to those over sixteen years of age.

c. 74, § 14. Practical arts classes; required age of students Section 14. Towns may, through school committees or trustees for vocational education, establish and maintain practical art classes. Such classes shall be open to persons over sixteen years of age, and may be established and maintained as approved state aided practical art classes under sections one to twenty-two, inclusive, so far as not inconsistent therewith. Regional school districts established under sections fourteen and fifteen of chapter seventy-one, if the agreement for the establishment of the district, either as originally adopted or as subsequently amended, so provides, may through the regional district school committee establish and maintain such practical art classes. School committees or trustees for vocational education may in addition to the courses approved by the department of education establish and maintain such evening practical art courses as in their opinion they deem expedient and necessary, and may, upon request to the state board and with its approval, hire provisionally in the absence of certified evening practical arts teachers such teachers who may not be certified but are qualified through experience to teach such practical arts courses until such time as such teachers are certified or certified evening practical arts teachers are available.

The commissioner under the direction of the state board, in the name and on behalf of the commonwealth, may apply for and receive, and thereafter expend for any or all of the purposes of section fourteen any funds received for any of such purposes from the federal government or any of its agencies.

c. 74, § 14B. Culinary arts; revolving fund Section 14B. In any city or town that accepts this section in the manner provided in section 4 of chapter 4 or in a regional school district that accepts it as provided in this section, any income received from the purchase and sale of products produced in the culinary arts subject area of the home economics program, or any other vocational-technical program conducted in any public vocational-technical high school shall be deposited in a special fund by the school committee in any banking institution in the commonwealth. Expenditures may be made from said fund by the school committee for purposes needed for the culinary arts subject area or in the case of a fund established for any other program, such funds may be expended for the purposes of such program area without further appropriation, notwithstanding section 53 of chapter 44; provided, however, that said special funds shall not be used to pay the salary of any employee. Three years from the year a city or town accepts the provisions of this section, and every third year thereafter, said city or town may act to rescind its original acceptance. The superintendent of a school district with such a fund shall submit annually a report of said fund to the mayor, city council, city manager, board of selectmen or town manager of each city and town in said district and a copy of said report shall be submitted to the director of the bureau of accounts. The provisions of this section shall be effective in any regional school district upon its acceptance by the school committee of said district and a majority of the towns and cities and said district by vote of the board of selectmen or city council of said cities and towns.

Cities may establish and maintain schools for instructing families and individuals in day, part time or evening classes in gardening, fruit growing, floriculture, poultry raising, animal husbandry, and other branches of agriculture and horticulture. The location and organization thereof and the instruction given therein shall be subject to the approval of the commissioner.

Before action taken under the preceding section, school committees shall circulate a description of the purposes and scope of the instruction to be given thereunder, and request applications for such instruction.

M.G.L. c. 74, § 17 Acquisition of land for use of agricultural classes

c. 74, § 17. Acquisition of land for use of agricultural classes Section 17. Boards or officers having power to take land for school purposes in cities may take, by eminent domain under chapter seventy-nine, land therein not already appropriated to public use, or lease or purchase land either within or without the city limits, for the purpose of section fifteen. A school committee may erect suitable building on land so acquired, and provide, on terms not involving loss to the city, for the use of plots of ground and for the temporary housing of pupils complying with its regulations and not having access to other land suitable for proper instruction.

M.G.L. c. 74, § 18 Competency-based vocational-technical teacher training standards

c. 74, § 18. Competency-based vocational-technical teacher training standards Section 18. The department of elementary and secondary education shall establish basic competency-based vocational-technical teacher training standards which shall serve as the fundamental, pedagogical requirements for beginning vocational-technical instructors. The department shall further require that all persons seeking to meet the department's requirements shall have successfully passed performance and written tests in areas as determined by the board or shall have satisfied alternative measures of proficiency established by the board and shall have successfully completed an approved seminar on teaching skills and methods. The commissioner under the direction of the state board shall encourage the establishment of a two year certificate program and a four year preservice program for the preparation of vocational-technical teachers. Said board shall promulgate regulations governing the administration of the vocational-technical education program and the establishment of criteria for the inclusion of the basic and two year programs.

M.G.L. c. 74, § 20 Custodian of federal funds

c. 74, § 20. Custodian of federal funds Section 20. The state treasurer shall be the custodian of federal funds allocated to the commonwealth for vocational-technical education. The funds so allocated from the federal government shall be expended with specific appropriation under the direction of the state board.

M.G.L. c. 74, § 21 Expenditure of federal funds

c. 74, § 21. Expenditure of federal funds Section 21. Subject to section twenty, the funds received under the act of Congress may be paid out, on requisition of the state board, as reimbursement for expenses already incurred, to approved schools.

M.G.L. c. 74, § 22 Use of federal funds

c. 74, § 22. Use of federal funds Section 22. The state board may use the funds received under the act of Congress mentioned in section twenty as supplementary to state aid for salaries of teachers of vocational-technical subjects in schools complying therewith. It may also use such funds (1), for salaries of teachers giving types of training selected by it as especially needing stimulus; or (2), for competency-base programs for the pedagogical preparation of teachers of vocations selected by it; or (3), to arrange with schools and colleges to give the training to teachers of vocations under its supervision; or (4), to enable local school authorities to conduct, under its supervision, inservice training of vocational technical teachers; or (5), for travel as provided for under said act of Congress. Such payments shall be subject to conditions prescribed by said board.

M.G.L. c. 74, § 22D Cooperation with federal authorities for rehabilitation of veterans

c. 74, § 22D. Cooperation with federal authorities for rehabilitation of veterans Section 22D. Said state board is hereby directed to cooperate with the veterans administration in carrying out the provisions of federal laws and regulations relating to the rehabilitation of disabled veterans; to establish and maintain classes or courses for training as it is deemed advisable and necessary for the education, training and rehabilitation of disabled veterans and other veterans; to establish and maintain, or to assist in establishing or maintaining, with the consent of the commissioner of administration and finance, and with the approval of the governor, training facilities within the various institutions and departments of the federal government and of the commonwealth or any political subdivision thereof, located within the commonwealth; to cooperate with the veterans administration in the selection of the number of trainees to be placed in training, or otherwise to carry out the provisions of said federal laws and regulations.

M.G.L. c. 74, § 22E Employment of teachers; conditions

c. 74, § 22E. Employment of teachers; conditions Section 22E. Any school committee or board of trustees for vocational education may elect a teacher who has served in its schools for not less than one school year to serve with professional teacher status under the same conditions and subject to the same limitations as is provided in sections forty-one, forty-two, forty-two A, forty-two D, forty-three, forty-three A and forty-three B of chapter seventy-one, which sections shall also apply to teachers for educational programs under this chapter. The provisions of this section shall apply to school librarians, school psychologists, school adjustment counselors, and school social workers entitled to tenure pursuant to the provisions of chapter seventy-one. The provisions of chapter thirty-two B, section one hundred C of chapter forty-one, sections thirty-seven B, thirty-eight I, forty, forty-one A and forty-eight of chapter seventy-one, and of sections seventeen B, seventeen C and seventeen D of chapter one hundred and eighty shall also apply to school personnel granted certificates in accordance with section thirty-eight G of chapter seventy-one and employed for vocational educational programs.

M.G.L. c. 74, § 23 Independent industrial shoemaking school of the city of Lynn

c. 74, § 23. Independent industrial shoemaking school of the city of Lynn Section 23. The independent industrial shoemaking school of the city of Lynn, established under chapter one hundred and seventy-four of the Special Acts of nineteen hundred and sixteen, shall be maintained by the city of Lynn as a state aided approved vocational school under and subject to sections one to twenty-two, inclusive; provided, that the trustees of said school shall consist of the mayor of Lynn, ex officio, and eight appointive members who shall be residents of Lynn and of whom two shall represent the laboring class. Two appointive members shall annually be appointed by the governor, with the advice and consent of the council, for terms of four years and until their successors are qualified. The trustees shall serve without compensation, but shall be reimbursed for their necessary expenses, to be charged and paid as maintenance. The trustees may determine the situation of said school, subject to the approval of the commissioner, and may expend annually for rent of suitable floor space for the school a sum not exceeding six thousand dollars until such time as it is deemed expedient to purchase, construct or alter a building for the use of the school. After the said school is established and equipped the city of Lynn shall annually raise by taxation such sums as may be needed for its maintenance and operation.

M.G.L. c. 74, § 24 Smith Agricultural School; maintenance; superintendents

c. 74, § 24. Smith Agricultural School; maintenance; superintendents Section 24. Smith Agricultural School, established under chapter one hundred and fifty-one of the Special Acts of nineteen hundred and eighteen, shall be maintained by the city of Northampton as a state-aided approved vocational-technical school under and subject to sections one to twenty-two, inclusive; provided, however, that the superintendents of said school shall consist of the mayor and superintendent of schools of said city, ex officiis, and three other superintendents to be elected at its city election by ballot, as provided in the will of Oliver Smith, and that said superintendents shall have the powers of local trustees elected under section three. Upon the death or resignation of an elected superintendent of said school his successor shall be chosen by the city council and the remaining superintendents in joint convention, who shall serve until the next city election.

c. 74, § 24B. Public secondary vocational-technical school districts and public institutions of higher education; coordination of programs Section 24B. The state board and the board of regents shall encourage the coordination of programs between public secondary vocational-technical school districts and public institutions of higher education. Said boards shall establish policies and procedures for the standardization of articulation agreements between the aforementioned institutions and that said boards shall meet annually to review the implementation of such policies and procedures.

The Bristol county agricultural school and the Norfolk county agricultural school shall be maintained as state-aided, approved, independent vocational schools under sections one to twenty-two, inclusive, subject to sections twenty-six to thirty-seven, inclusive.

c. 74, § 26. Management; appointment of trustees Section 26. There shall be a board of trustees for each of the schools enumerated in section twenty-five. The boards of trustees for the Bristol county agricultural school and the Norfolk county agricultural school shall each consist of the county commissioners, ex officiis, and four residents of the county, appointed by the governor, with the advice and consent of the council, for four years. The term of one appointive trustee in each county shall expire each year.

c. 74, § 27. Compensation of trustees Section 27. The trustees provided for in the preceding section shall serve without compensation, but shall be reimbursed for their necessary expenses, to be charged and paid as maintenance.

c. 74, § 28. Duties of trustees; preparation of budget Section 28. On or before December fifteenth the trustees of the schools mentioned in section twenty-five shall, in consultation with and with the approval of the commissioner, prepare estimates of the amounts necessary to equip and maintain their respective schools for the ensuing fiscal year as defined in section sixteen of chapter thirty-five. The amounts of such estimates shall be included by the respective county commissioners in the estimates required by section twenty-eight of chapter thirty-five.

c. 74, § 29. Funds raised by taxation Section 29. If any part of the amount estimated under the preceding section shall be authorized as part of the county taxes, the respective counties shall raise the said amounts by taxation.

M.G.L. c. 74, § 30 Disposition of income

c. 74, § 30. Disposition of income Section 30. Miscellaneous income of the Bristol county agricultural school and the Norfolk county agricultural school, including the tuition of non-resident pupils and receipts from the sale of products and work of pupils, shall be paid to the county treasurer; provided, however, that all such income shall be appropriated and expended for the operation and purposes of the school or institute that paid the same to the county treasurer.

The trustees of the Essex agricultural and technical institute, the Bristol county agricultural school and the Norfolk county agricultural school may, if in their judgment the circumstances warrant, and it is not otherwise provided for, pay, in whole or in part, the costs of transporting any pupil who resides in a town in the county of Essex, the county of Bristol, or the county of Norfolk, as the case may be, between the town and the school, and such expenditure shall be deemed to be a proper maintenance item.

The boards of trustees of the Bristol county agricultural school, the Essex agricultural and technical institute, and the Norfolk county agricultural school may supervise and control all athletic and other organizations composed of vocational agricultural school pupils and bearing the name of said school or organized in connection therewith. The trustees of each of said county agricultural schools may, directly or through authorized representatives, determine under what conditions the same may compete with similar organizations in other schools. Expenditures by said trustees for the organization and conduct of physical training and exercises, athletics, sports, practice sessions of athletic teams, games and play, for providing proper apparatus, equipment, supplies, athletic wearing apparel, including appropriate souvenir garments and trophies, and facilities for the same in the buildings, yards and playgrounds under the control of said trustees, or upon any other land which they may have the right or privilege to use for this purpose, and for exercises, athletics, sports, practice sessions of athletic teams, games and play, shall be deemed to be for school purposes and shall be considered to be a proper maintenance item for reimbursement purposes. Said trustees shall include in their annual budgets, with the approval of the commissioner, amounts sufficient for the employment of coaches, an athletic director, a faculty manager, and a physician to supervise in said county agricultural schools physical training and exercises, athletics, sports, games and play, and for the transportation of the school athletic teams, coaches, cheerleaders, bands and other groups composed of pupils of the said schools, within the commonwealth to places where athletic contests or physical exercises, sports, games, play, musical festivals, competitions or other events are held, and for the purchase of uniforms and musical instruments for the members of bands composed of pupils of said schools.

M.G.L. c. 74, § 32 Admission of non-residents

c. 74, § 32. Admission of non-residents Section 32. Any resident of the commonwealth over 14 years of age who resides in any town outside of a county in which a county agricultural school is located may be admitted to such school on the conditions prescribed in section 7.

The Bristol county agricultural school and the Norfolk county agricultural school shall be free to residents of Bristol and Norfolk counties, respectively, over 14 years of age, except that free attendance shall be limited by the capacity of the courses provided for such schools. The trustees of the Bristol county agricultural school and Norfolk county agricultural school may require the payment of tuition and related fees from each person enrolled in adult evening courses offered by said schools. The amount of tuition and related fees shall be determined by said trustees. All receipts of such tuition and related fees shall be deposited with the treasurer of the county.

Members of the staffs of the Bristol county agricultural school, the Essex agricultural and technical institute and the Norfolk county agricultural school shall investigate farm and market conditions for the purpose of advising individuals and organizations as to business methods among farmers, and satisfactory methods of marketing farm products, shall instruct in the formation of co-operative enterprises, and shall perform other work calculated to promote the agricultural or rural development of the respective counties. Members of such staffs shall keep in touch with, and avail themselves of, agencies in the commonwealth or elsewhere that will enable them to utilize the latest and best knowledge and practice in the furtherance of their work.

M.G.L. c. 74, § 37A Technical institutes

If a school committee or the board of trustees of any industrial, technical, agricultural or vocational school subject to this chapter determines that sufficient need exists in such school for a course or courses beyond secondary school level and designed to prepare students for greater opportunities for employment in industrial, agricultural and technical occupations, it may submit in writing its plans for such course or courses to the board of higher education. Upon the written approval of said plans by said board, such school committee or board of trustees may establish and maintain such extended courses of instruction on a technical institute level, and public funds may be appropriated for said purpose; provided, that such courses of instruction conform to such standards as said board may establish, and are maintained by said school committee or said trustees under the general regulations of the board. Any such school may use the designation ''technical institute'' with respect to the maintenance of such courses at such school, and the school committee or trustees of such school may, subject to the approval of the state board and the board of higher education, grant the degree of Associate in Applied Science to persons who complete such course or courses of instruction. Tuition fees in an amount approved by the commissioner of education may be charged to students enrolled in a program leading to the degree of Associate in Applied Science offered by any such school. This section shall not be applicable to the board of regional community colleges, or any action of said board under section twenty-seven of chapter fifteen, or to any regional community college.

The commissioner under the direction of the state board may approve nondegree granting vocational education programs at the post-secondary level. In making his decision, the commissioner shall take into consideration the availability of similar training opportunities at the secondary and public regional community college levels. Upon the vote of the school committee or board of trustees of any industrial, technical, or vocational school, tuition and other related fees may be charged to students residing in its city, town or regional school district admitted to approved post-secondary vocational education programs for the full amount of the average per pupil cost of such program.

In making his determination the commissioner shall take into consideration the opportunities for free vocational training where the applicant resides, the preparation, age, aptitude and previous record of the applicant, and other relevant circumstances, including the level of state assistance to such program. A student admitted under this provision shall be charged tuition and fees for the full amount of the average per pupil cost of such program, as approved by the commissioner under the direction of the state board. Such students shall be eligible to apply for state scholarship aid pursuant to section seven of chapter fifteen A.

A professor or teacher in the Bradford Durfee College of Technology or the New Bedford Institute of Technology, who is not employed in a position classified under chapter thirty-one, and who has served as such for three consecutive years, shall not be dismissed from such employment except for just cause, and for reasons specifically given him in writing by the trustees of the college or institute in which he is employed. Before any such removal is effected, the professor or teacher, upon his written request made within ten days of receipt by him of the required written notice, shall be given a full hearing before the trustees of the college or institute in which he is employed, of which hearing he shall have at least thirty days' written notice from the trustees, and he shall be allowed to answer the charges preferred against him either personally or by counsel.

In addition to the authority, responsibility, powers and duties specifically conferred by sections forty-two to forty-two C, inclusive, and by sections forty-two E to forty-six B, inclusive, the said boards of trustees shall have the authority, responsibility, rights, privileges, powers and duties customarily and traditionally exercised by governing boards of institutions of higher learning. In exercising such authority, responsibility, powers and duties said board shall not in the management of the affairs of said institutions be subject to, or superseded in any such authority by, any other state board, bureau, department or commission, except as herein provided.

The trustees shall publish such rules and regulations and shall file copies thereof with the governor, the commission on administration and finance, and the joint committee on ways and means. The trustees shall determine the time and place of their meetings and the manner of giving notice thereof. Nine members shall constitute a quorum.

The trustees of the college and the trustees of the institute shall administer property held in accordance with special trusts, and shall also administer grants or devises of land and gifts or bequests of personal property made to the commonwealth for the use of said college or institute, and execute said trusts, investing the proceeds thereof in notes or bonds secured by sufficient mortgages or other securities. The trustees shall have the authority to assent to federal laws designed to benefit said college or institute and to enter into agreements or contracts with the federal government or agencies thereof, as well as into agreements or contracts with agencies of other governments, other colleges and universities, foundations, corporations, interstate compact agencies and individuals where such agreements or contracts, in the judgment of the trustees, will promote the objectives of the college and the institute.

The trustees shall, on behalf of the commonwealth, manage and administer the college and the institute, and all property, real and personal, belonging to the commonwealth and occupied or used by said college or institute, and shall keep in repair houses, buildings and equipment so used or occupied.

Notwithstanding any other provision of law to the contrary, the trustees of the college or an officer of the college designated by them and the trustees of the institute or an officer of the institute designated by them shall have the authority to make any purchase or purchases in the amount of five hundred dollars or less, and to purchase without limitation of amount library books and periodicals, educational and scientific supplies and equipment, printing and binding, emergency repairs and replacement parts, and perishable items, without recourse to any other state board, bureau, department or commission; provided, that in so doing the college or institute shall follow modern methods of purchasing and shall, wherever practicable, invite competitive bids. Except as herein provided, the state purchasing agent shall on the certification of availability of funds purchase all items specified on requisitions submitted to him by the college and by the institute; provided, that the college and the institute shall have the right to review all bids received on college or institute requisitions and to make binding recommendation on the award of the contract based on the judgment of the college or institute as to which of the bids best meet the specification of the college or institute on which the bids were received.

M.G.L. c. 74, § 42O Election of officers; salaries of officers and professional staff; employment, status and benefits of personnel

As used in this section the following words shall have the following meanings, unless the context otherwise requires: ''Professional staff'', all officers of the college and of the institute and all persons, except those whose duties are clerical, custodial, security, labor, maintenance and the like, employed for teaching, research, administration, extension, enforcement, control laws and regulatory services, technical and specialized academic support staff, and such related activities as shall be determined by the trustees thereof. ''Non-professional staff'', all employees who are not classified as professional personnel, such as clerical, custodial, security, labor, maintenance and the like. ''General salary schedule'', the pay plan of the commonwealth as contained in paragraph (1) of section forty-six of chapter thirty. The trustees shall elect the president and such other officers and members of the professional staff of the college and of the institute as they may determine necessary and shall fix their classification, title and salary within the general salary schedule, except that any such salary may be fixed at any amount not less than the minimum salary nor more than the maximum salary shown in the said schedule, and shall define their duties and tenure of office without limitation of any other provision of law. The trustees shall have complete authority with respect to the election or appointment of the professional staff including terms, conditions and periods of employment, compensation, promotion, classification and reclassification, transfer, demotion and dismissal within funds available by appropriation of the general court or from other sources. The classification, title, salary range within the general salary schedule, and descriptive job specifications for each position shall be determined by the trustees for each member of the professional staff and copies thereof shall be placed on file with the governor, budget commissioner, personnel administrator, and the joint committee on ways and means, except that any such salary may be fixed at any amount not less than the minimum salary nor more than the maximum salary shown in the said schedule. A notification of each personnel action taken shall be filed by the president or other officer of the college or institute designated by him with the personnel administrator and with the comptroller. In establishing the classification, title and salary plan for the professional staff of the college and the institute, the trustees shall give recognition to the need to establish and maintain appropriate academic ranks and titles as may be appropriate for higher education in order to provide for outstanding scholars, scientists and teachers. The president of the college or an officer designated by him and the president of the institute or an officer designated by him, shall file annually with the governor, the budget commissioner and the joint committee on ways and means a list of all positions at said college or institute, including the name of the incumbent, the classification and title, and the rate of pay. The trustees may, without prior approval and within limits of appropriations, engage designers, lecturers, students, other professional personnel, and non-employee services, at such rates and for such periods of time as they may determine necessary for the operation of the college and the institute. The non-professional personnel of the college and of the institute shall continue as state employees under the provisions of chapter thirty and except as otherwise provided in this paragraph, shall be employed in authorized permanent positions in accordance with the provisions of section forty-five of said chapter; provided, however, that the trustees of the college and the institute shall have the authority without prior approval and within the limits of appropriations to establish and fill temporary, part time and seasonal positions within existing titles and rates within available appropriations for the fiscal year. A notice of action taken in filling all such positions shall be filed with the personnel administrator and with the comptroller. All officers and employees, professional and non-professional, of the college and of the institute shall continue to be employees of the commonwealth irrespective of the source of funds from which their salaries or wages are paid. They shall have the same privileges and benefits of other employees of the commonwealth such as retirement benefits, group insurance, industrial accident coverage, and other coverage enjoyed by all employees of the commonwealth.

M.G.L. c. 74, § 42P Travel policy

c. 74, § 42P. Travel policy Section 42P. The trustees shall have complete authority in determining the travel policy of the college and the institute. They shall determine which of the college personnel and which of the institute personnel may travel within and without the commonwealth at state expense and where such personnel may travel.

The trustees shall make rules and regulations for the control, movement and parking of vehicles on the campus of the college and the institute, and may provide reasonable penalties for the violation of said rules and regulations. The trustees may appoint as police officers persons in the employ of the college and the institute who in the enforcement of said rules and regulations and throughout the college and the institute property shall have the powers of police officers, except as to service of civil process. Notwithstanding any other provision of law, all fines and penalties recovered for violation of rules and regulations made under authority of this section shall be accounted for by the clerk of the court and forwarded to the trustees of the college or to the trustees of the institute, as the case may be, to be deposited in the scholarship trust fund of said college or institute for scholarship purposes.

M.G.L. c. 74, § 43 Acceptance of gifts

The commissioner shall make an annual report as to said college, and said institute, containing a concise statement as to its buildings, equipment, and resources, its courses and methods of instruction, the number of teachers and students during the preceding school year and the number of graduates.

c. 74, § 45. Insurance Section 45. The board of trustees of said college and of said institute may insure the buildings of said institutes and their contents in such amount as it deems sufficient.

M.G.L. c. 74, § 46 Tuition

c. 74, § 46. Tuition Section 46. The yearly tuition at said college and at said institute for day students who are non-residents of the commonwealth shall not be less than one hundred and fifty dollars.

Said college and said institute may make, under such regulations as their respective boards of trustees may from time to time prescribe, tests, comparative or otherwise, of new and useful improvements in textile machinery or of apparatus, dyes, compounds, processes, methods or means, directly or indirectly relating to the manufacture of textiles or to the machinery, tools, appliances and materials used in connection therewith. The person for whom any such test is made shall pay therefor on account of the commonwealth a sum not less than the actual cost thereof, including a reasonable amount for overhead expense. No such test shall be undertaken by said college or said institute which in the opinion of the trustees will be likely to interfere with the regular, efficient and proper exercise of school functions. In the making of such tests preference shall be given to citizens of, and to corporations organized under the laws of, the commonwealth.

M.G.L. c. 74, § 46B Research foundations; patents

The Bradford Durfee College of Technology and the New Bedford Institute of Technology may establish and manage, under such regulations as the board of trustees of said college and of said institute, respectively may from time to time prescribe, the Research Foundation of Bradford Durfee College of Technology and the Research Foundation of New Bedford Institute of Technology, for the purpose of promoting research at said college and institute by obtaining, administering or disposing of patents of inventions resulting from such research or otherwise and devoting the income therefrom to further research, beneficial to the college or institution and to the commonwealth. Said research foundation may (1) receive and hold in separate custody gifts, bequests and devises of real or personal property; (2) receive and hold in separate custody compensation or reimbursement resulting from inventions, patents, contractual or other research, the conducting of tests for outside agencies or other funds that may be acceptable to the research foundation; (3) disburse funds so acquired for purposes of instruction, research, tests, invention, discovery, development or engineering consistent herewith; (4) obtain, administer and dispose of patents, assignments, grants, licenses, or other rights and hold the same in separate custody; (5) make assignments, grants, licenses, or other disposal, equitably in the public interest, of any rights owned, acquired or controlled by the research foundation in or to inventions, discoveries, patent applications or patents, and to charge therefor and collect and to incorporate in funds in the custody of the research foundation reasonable compensation in such form as the board of trustees may determine; and (6) execute contracts with employees or others for the purpose of carrying out the provisions hereof and permitting such employees or others to share in the net proceeds of such contracts as the board of trustees shall determine. The funds of each research foundation shall be subject to audit by the state auditor, in accordance with generally accepted government auditing standards, as often as the state auditor determines is necessary. No activities, specified in the foregoing, shall be undertaken by said research foundation which in the opinion of the board of trustees will be likely to interfere with the regular, efficient and proper exercise of the functions of said college or institute. In conducting contractual or other research, tests or similar activities, such research foundation shall give preference to citizens of and to corporations organized under the laws of the commonwealth. The boards of trustees shall prescribe and enforce such regulations as it may deem necessary, with regard to the ownership of inventions developed with the use of facilities of the college and institute by students, research fellows, staff members, faculty or other persons, the transfer of such inventions, or patent applications or patents resulting therefrom, to the foundation, the amount of the respective shares of the inventor, the college or institute, and the foundation in the proceeds therefrom, and the arbitrating of any and all disagreements involving the same.

M.G.L. c. 74, § 52 Nautical schools

A town may establish and maintain, upon shore or upon vessels at the election of the school committee, one or more schools for training young persons in nautical duties. School committees may excuse persons attending such schools from attendance at other schools.

c. 74, § 54. Establishment and maintenance of schools for institutional on-farm training for World War II and Korean emergency veterans Section 54. The board of higher education may establish and maintain, in cooperation with local public or vocational school authorities, one or more schools for institutional on-farm training for veterans of World War II and for veterans of the Korean emergency. Said board may contract or agree with said local school authorities, in such centers as may be selected, for the establishment of such schools, for the use of quarters therefor, for the payment of the cost of operation thereof and equipment therefor, and for local supervision and administration of the training program. Said board shall appoint, and may remove, the teaching personnel of such schools, shall determine the rates of salary for said personnel, shall pay the costs of instructional and supervisory travel of such personnel, and shall purchase, or provide for the purchase of, approved texts for trainees at said schools. Said board shall employ such additional supervisory and clerical personnel as may be needed by it in the carrying out of the training programs under this section. Said board may contract with the Veterans' Administration for the purpose of procuring reimbursement to the commonwealth for approvable costs of conducting and administering said training courses for veterans of World War II. Said board may contract with and collect from veterans of the Korean emergency tuition for said training.

M.G.L. c. 74, § 56 Program for expansion of not-for-credit vocationally-oriented instruction

c. 74, § 56. Program for expansion of not-for-credit vocationally-oriented instruction Section 56. The district trustees shall establish a program, in collaboration with the advisory committee, the director of the department of career services and a representative of the local workforce investment board, to expand not-for-credit vocationally-oriented instruction provided through contracts with commonwealth employers. The program shall allow interested business partners to sponsor a prospective or current employee for training provided by the vocational school at the expense of the employer. Each vocational school shall report not later than December 31 annually to the commissioner of education on the level of not-for-credit vocationally-oriented instruction provided in the preceding fiscal year and the anticipated level of such instruction in the current fiscal year. The report shall detail enrollment levels, revenues received, sources of revenues, recruitment tools, the number of service contracts established with commonwealth employers and such other information as the commissioner may require. The commissioner shall prepare a comprehensive report of the information and present copies of the report to the board of higher education and the house and senate chairs of the joint committee on labor and workforce development not later than March 31 annually.

c. 74, § 57. Program to support training and education programs that address workforce shortages of advanced automotive and diesel technician industry Section 57. Subject to appropriation, the board of higher education shall establish and maintain, in cooperation with local public and vocational school authorities, postsecondary technical schools and the boards of trustees of community colleges, a program to support training and education programs that address the workforce shortages of the advanced automotive and diesel technician industry with the goal of training students, creating new jobs, retaining and upgrading existing jobs, and retraining existing workers to implement new technologies and to help meet the workforce and talent pipeline needs of employers including, but not limited to, a person who has obtained a Class 1 license pursuant to sections 58 and 59 of chapter 140. There shall be, subject to appropriation, a grant program to implement this section to which employers shall have access to: (i) identify, support or establish collaborative regional partnerships including, but not limited to, employers, workforce development and education organizations, regional economic development organizations established pursuant to sections 3J and 3K of chapter 23A and economic development officials in every region where Class 1 licensees and related industries demonstrate demand for automotive and diesel repair technicians; (ii) address critical workforce shortages in the automotive and diesel repair industry; (iii) improve and increase employment opportunities in the automotive and diesel repair industry for low-income individuals, women and minorities; (iv) provide training and educational or career ladder services for employed or unemployed automotive and diesel repair workers who are seeking new positions or responsibilities within the automotive and diesel repair industry; (v) increase support for internship and apprentice training at facilities associated with Class 1 licensees; (vi) boost industry-relevant instructor capacity for high school and postsecondary programs; and (vii) direct support for succession planning, worker retention and upskilling strategies for older and incumbent workers. For the purposes of the grant program, ''eligible applicants'' shall include, but not be limited to: (i) employers and employer associations; (ii) local workforce investment boards; (iii) institutions of higher education; (iv) kindergarten to grade 12, inclusive, and vocational education institutions; (v) private for-profit and nonprofit organizations providing education and workforce training; (vi) 1–stop career centers; (vii) local workforce development entities; and (viii) any partnership or collaboration between eligible applicants. Any funds allocated through the program shall complement and not replace existing local, state, private or federal funding for training and educational programs. A grant proposal submitted pursuant to this section shall include, but not be limited to: (i) a plan that defines specific goals for advanced automotive and diesel repair technology workforce training and educational improvements; (ii) the evidence-based programs the applicant shall use to meet the goals; (iii) a budget necessary to implement the plan, including a detailed description of any funding or in-kind contributions that an applicant will be providing in support of the proposal; (iv) any other private funding or private sector participation that the applicant anticipates in support of the proposal; and (v) the proposed number of individuals who would be enrolled, complete training and be placed into employment in the targeted industries. The board of higher education shall, in consultation with the executive office of economic development, executive office of labor and workforce development, the department of education and entities representing parties who are eligible to participate in the grant program, develop guidelines for an annual review of the progress being made by each grantee. A grantee shall participate in any evaluation or accountability process implemented by or authorized by the commonwealth corporation. The board shall file annual reports for the duration of the programs with the chairs of the house and senate committee on ways and means, the chairs of the joint committee on labor and workforce development and the chairs of the joint committee on economic development and emerging technologies not later than January 1; provided, however, that the report shall include an overview of the activities of the programs, the number of participants in the programs and the employment outcomes in the programs.

c. 74, § 58. Use of tobacco products within school buildings or facilities or on school grounds Section 58. No person shall use a tobacco product, as defined in section 6 of chapter 270, within the school buildings or facilities or on the grounds or school buses of a public or private vocational school or at a vocational school-sponsored event. Each school committee or board of trustees shall establish a policy regarding violations of this section. The policy may include, but shall not be limited to, mandatory education classes on the hazards of using tobacco products.
