Memphis Code of Ordinances § 6-80-2 Approval of terminals.
Sec. 6-80-2. - Approval of terminals.
A. No terminal shall be located within the corporate limits of the city without making application for such location to and receiving the express approval of the building official. If the applicant for the terminal has applied for a certificate of public convenience and necessity under this chapter, the director of police services shall forward the application to the building official.
B. Before the granting of any permit of use and occupancy or any permits for building, remodeling or repairing any property as a terminal, plans showing the location of the terminal, the construction, remodeling or repairing of buildings, if any, the number of schedules to be operated, the location of the repair shop, and the routing of passenger vehicles for hire into and out of such terminal and the general plan of operation shall be submitted to the building official for investigation and approval. If a special zoning permit is required, the building official shall make the necessary referrals.
C. Before granting approval for the location and structure of any terminal, the building official shall refer to all data, together with any comment, suggestion or report made, to the city engineer and the directors of police services and fire services. Upon receipt of any such data or report from the building official, the city engineer and the directors of police services and fire services shall investigate the routing of the passenger vehicles for hire over the streets of the city and into and out of the terminal and make their report to the building official and director of police services.
D. Upon receipt of the report of the city engineer and the directors of police services and fire services, if such report approves the routing, as submitted or as modified, and if the plan, as submitted or as modified, meets with the approval of the building official and does not require a special zoning permit, such official shall approve the issuance of permit or permits authorizing the location, operation or construction of such terminal. A copy of such approval shall be forwarded to the director of police services. If a special permit is approved, such approval shall be forwarded to the director of police services. No provision in this section shall limit or override any present or future provisions of the zoning or building code ordinances, including the need for special permits.
E. If the terminal location and plan, as originally submitted or as modified by the reports of the city engineers and the directors of police services and fire services, does not meet the approval of the building official or if the plan as submitted is not approved by the city engineer, the directors of police and/or fire services and the city engineer or director so reports to the building official, the building official shall then refuse his or her approval of the location and plan of the terminal. A copy of the disapproval and the reasons therefor shall be forwarded to the director of police services. If a special permit is denied, a copy of this denial shall be forwarded to the director of police services.
