Sec. 50-63. - Appeals.

Within thirty (30) days of the calculation of the impact fees, an applicant for a building permit or a property owner may appeal the applicability of the impact fees, or amount of the impact fees imposed, including the denial of a credit, to the department of transportation and infrastructure pursuant to section 56-106(b). The provisions of this article III shall govern in the event of any inconsistency between this article and section 56-106(b). If the notice of appeal is accompanied by a bond or other sufficient surety satisfactory to the city attorney's office in an amount equal to the impact fees due, as calculated herein, a building permit may be issued pending the appeal. The filing of an appeal shall not stay the collection of the impact fees due unless a bond or other sufficient surety has been filed.
