10.80.040 - Variances—Application.

(A) The City Council may grant a variance from the prohibitions contained in Section 10.80.020 if it finds that the granting of such variance will not be materially detrimental to the public safety and welfare or injurious to other property or improvements in the vicinity. The Council may impose such conditions upon the granting of a variance as it deems appropriate. (B) To the extent possible, the variance procedures set forth in Title 19A shall apply to variance applications heard by the City Council pursuant to this Section, with the following exceptions: (1) The fee chargeable in connection with a variance application shall be fifty dollars. (2) The area for notification of property owners shall be within one hundred fifty feet of the exterior boundary lines of the lot or parcel described in the application.
