Jacksonville Ordinance Code § 360.801 Declaration and intent.

Sec. 360.801. - Declaration and intent. (a) The City finds and declares that the open burning of materials outdoors results in or contributes to air pollution. The City further finds that regulation of open burning will reduce air pollution significantly. (b) It is the intent of the City to require that open burning be conducted in a manner, under conditions and within certain periods that will reduce or eliminate the deleterious and noisome effect of air pollution caused by open burning. Jacksonville Ordinance Code § 360.802 Prohibition.

Sec. 360.802. - Prohibition. (a) It is unlawful and a violation of this Part for any person to engage or assist in open burning or to allow open burning on property owned or controlled by such person, unless such open burning is specifically allowed by State rules or by rules of the Board. (b) Any person violating any provision of this Part shall be liable for all damages caused by such violation, which damages shall be recoverable in any court of competent jurisdiction. The civil liability shall obtain whether there be criminal prosecution and conviction or not. Damages shall include but not be limited to the cost of the Fire and Rescue Department responding to any fire caused by such violation. (Ord. 97-539-E, § 4)

Jacksonville Ordinance Code § 360.803 Land clearing.

Sec. 360.803. - Land clearing. (a) Open burning of materials resulting from a land clearing operation (except for agricultural, silvicultural or forestry operations) or the demolition of a structure is allowed, if the burning complies with all requirements of State law including all applicable rules and regulations. (b) All open burning under this Section shall require a permit issued by the Director. Application for the permit shall be made on a form and in a manner prescribed by the Director. Permits shall be posted at the site of the burning for the entire time the burning takes place, and shall be clearly visible from adjacent roads. (Ord. 97-539-E, § 4)

Jacksonville Ordinance Code § 360.804 Industrial, commercial, municipal and research open burning.

Sec. 360.804. - Industrial, commercial, municipal and research open burning. Open burning in connection with industrial, commercial or municipal operations is prohibited except when the open burning is the only feasible method of operation and prior approval is obtained from the Environmental Protection Board or when the Director determines that an emergency exists. The application for approval under this Section shall be in accordance with all requirements of State rules and all rules of the Board. (Ord. 97-539-E, § 4)

Jacksonville Ordinance Code § 360.805 Agricultural and silvicultural fires.

Sec. 360.805. - Agricultural and silvicultural fires. Open burning in connection with agricultural and silvicultural or forestry operations is regulated by the State of Florida Department of Agriculture and Consumer Services, Division of Forestry. It is a violation of this Part to engage in agricultural or silvicultural burning without first having obtained permission from the County Forester. (Ord. 97-539-E, § 4)
