Indianapolis-Marion County Revised Code § 103-1 Copies of Code kept by clerk; amendments and supplements.

Sec. 103-1. - Copies of Code kept by clerk; amendments and supplements. The clerk shall keep at all times two (2) permanent copies of this printed Code, either bound or unbound, besides the original ordinance adopting the same. The clerk shall cause all amendments or additions to this Code to be noted in said permanent copies by ordinance number in the section amended, and he shall publish supplements in binder or book form whenever funds therefor are appropriated and available or at the end of each year. Indianapolis-Marion County Revised Code § 103-2 Altering Code.

Sec. 103-2. - Altering Code. It shall be unlawful for any person in the city to change or amend, by additions or deletions, any part or portion of this Code, or to insert or delete pages, or portions thereof, or to alter or tamper with such Code in any manner whatsoever which will cause the law of the city to be misrepresented thereby. Indianapolis-Marion County Revised Code § 103-3 General penalties for violations of Code.

Sec. 103-3. - General penalties for violations of Code. (a) Whenever in any chapter, article, division or section of this Code, or of any ordinances amendatory thereof or supplemental thereto: (1) The doing of any act, or the omission to do any act or to perform any duty, is declared to be a violation of this Code, or of any such amendatory or supplemental ordinance, or of any provision thereof, or is declared to be unlawful; and (2) If there shall be no fine or penalty otherwise specifically prescribed or declared for any such violation, or for doing or for omitting to do any such act or to perform any such duty; any person found to have committed any such violation shall be fined, by way of a penalty therefor, an amount not exceeding any limitation under IC 36-1-3-8 for each such violation, act or omission. (b) In addition to the foregoing penalty, the city may enjoin or abate any violation of this Code by appropriate action. (G.O. 68, 1988, § 6; G.O. 92, 2008, § 1)

Indianapolis-Marion County Revised Code § 103-4 Amendment of sections subject to penalty.

Sec. 103-4. - Amendment of sections subject to penalty. In case of the amendment or supplementing of any section of this Code which had therein prescribed a penalty for a violation of its provisions, or for which violation a penalty is prescribed in another section of the same chapter of any title, the penalty so provided in such other section of this chapter shall be held to apply also to the section as so amended or supplemented, whether or not such penalty is reenacted or referred to in such later ordinance, unless in any instance such penalty is specifically repealed or altered therein in respect to any such amendment or addition. Indianapolis-Marion County Revised Code § 103-5 Prosecution; election by corporation counsel.

Sec. 103-5. - Prosecution; election by corporation counsel. In all cases where the same offense is made punishable or is created by different clauses or sections of this Code, or of any additions thereto, the corporation counsel may elect under which to proceed; but not more than one (1) prosecution and recovery shall be had against the same person for the same violation of any provision of the Code actually constituting the same offense; provided, however, the corporation counsel may delegate to the city prosecutor the general power so to decide and proceed in all instances, and the latter shall be conclusively presumed to act by such authority.
