Traffic control by off-duty officers.
Charlotte City Code § 14-9
in effectSec. 14-9. - Traffic control by off-duty officers.
(a) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
Off-duty police officer means a police officer who is not currently engaged in duty assignment.
Traffic control officer means a law enforcement officer appointed pursuant to G.S. 20-114.1.
(b) Permit required. It shall be unlawful for any person or other public or private entity (referred to as "entity") to engage or employ an off-duty police officer or traffic control officer to regulate or control traffic in or along any public street within the corporate limits without a valid unexpired private traffic control permit issued by the director pursuant to this section. Each day that an entity violates this subsection shall constitute a separate offense.
(c) Application for permit and requirements. A private traffic control permit application and a private traffic control permit shall be subject to the following:
(1) An application shall be submitted to the department and shall include, at a minimum, the following:
a. The name and address of the entity;
b. The name and address of the site location;
c. The type of traffic control sought; and
d. The hours and days that the traffic control would be utilized.
(2) In deciding whether to issue a permit, the department shall consider, among other things, whether the requested traffic control services fairly serve the interests of all motorists and promote the preservation of public safety.
(3) A permit shall require the entity to indemnify and hold the city harmless from and against any liability of the off-duty officer or traffic control officer, including, but not limited to, wrongful death, bodily injury or property damage that is proximately caused by the negligence of the off-duty police officer or traffic control officer while directing or controlling traffic for compensation for the entity at the designated site location.
(4) A permit shall require the entity to provide proof of insurance with coverage and limits prescribed by the department.
(5) A permit shall be kept on the premises of the approved site location.
(6) The director may revoke any permit issued under this section based upon a determination that the continued control or regulation of traffic at the site location unnecessarily interferes with the public safety or convenience.
(7) An entity shall be required to pay application and permit fees, the amount of which shall be established pursuant to section 2-1 of this Code.
(d) Exceptions. This section shall not apply to the use of off duty-police officers or traffic control officers when such use is required or approved through a separate city permitting process.
(e) Duties and responsibilities maintained. Nothing contained in this section shall prevent or prohibit any on-duty or off-duty police officer, law enforcement officer or traffic control officer from exercising and fulfilling all duties and responsibilities of his position.
