Denver Revised Municipal Code § 49-531 Eligibility.

Sec. 49-531. - Eligibility. The manager of transportation and infrastructure may issue to any person a permit to occupy the public right-of-way outside of the roadway for the purpose of placing miscellaneous street furniture, insofar as the manager of transportation and infrastructure determines that such street furniture is in the public interest. Miscellaneous street furniture shall include, but shall not be limited to, privately-owned guide signs to nonprofit places of public interest, telephone booths, flagpoles, bicycle or motorcycle storage racks, private ornamental lighting, etc.; but shall not include street furniture or utility poles otherwise permitted by law. Denver Revised Municipal Code § 49-532 Prohibitions.

Sec. 49-532. - Prohibitions. Placing miscellaneous street furniture on the public right-of-way is prohibited on any street or portion of a street where such miscellaneous street furniture would interfere with the safe and efficient movement of vehicles or pedestrians. (Code 1950, § 331A.9-2)

Denver Revised Municipal Code § 49-533 Limitations.

Sec. 49-533. - Limitations. Placing miscellaneous street furniture on the public right-of-way is subject to the following limitations: (1) The size, design and color of miscellaneous street furniture shall be subject to the approval of the manager of transportation and infrastructure. (2) No miscellaneous street furniture may be mounted on or attached to any privately owned piece of street furniture or utility pole without written permission of the owner. Denver Revised Municipal Code § 49-534 Physical requirements.

Sec. 49-534. - Physical requirements. Placing miscellaneous street furniture may be permitted where the following conditions are met: (1) Miscellaneous street furniture may be placed no closer than two (2) feet to the roadway edge. (2) Miscellaneous street furniture may not interfere with the safe and efficient passage of pedestrians, and specifically may not impede pedestrian access to or use of traffic control devices or other street furniture. (Code 1950, § 331A.9-4)

Denver Revised Municipal Code § 49-535 Maintenance and repair.

Sec. 49-535. - Maintenance and repair. The permittee shall maintain all miscellaneous street furniture in a safe and clean condition at all times. Damaged or disfigured miscellaneous street furniture shall be repaired or replaced immediately upon notification or discovery of such damage or disfigurement. (Code 1950, § 331A.9-5)

Denver Revised Municipal Code § 49-536 Permits.

Sec. 49-536. - Permits. (a) Permits will be issued annually under this division and may be revoked without cause or written notification to the permittee. (b) The manager of transportation and infrastructure is authorized to propose to the council, from time to time, rules and regulations relating to the fees for permits for street furniture, issued under this division; provided, that no such rules and regulations shall be adopted by the manager of transportation and infrastructure or take effect, nor shall the fees proposed thereunder be established, unless the same are approved by ordinance.
