No. 890 By Council Member Sadowsky (by request of the Mayor) (Passed under a message of necessity from the Mayor) A Local Law to amend the administrative code of the city of New York, In relation to the date of submission of the mayor's preliminary management report, the date of submission of the preliminary expense budget statements, the date for hearings, comment and of submission by the comptroller of statements pertaining thereto, the date of issuance by the mayor of the preliminary statement as to maximum debt incurred for capital projects, the date of submission of the preliminary capital projects budget statements and for hearings and comment pertaining thereto, relating to the fiscal year for nineteen hundred eighty-six Be it enacted by the Council as follows: Section 1. During the calendar year nineteen hundred eighty-five and in relation to the nineteen hundred eighty-six fiscal year: 1. Notwithstanding any inconsistent provisions of section twelve of the New York city charter the mayor shall pursuant to such section submit a preliminary management report as therein described not later than the fourteenth day of February, nineteen hundred eighty-five. 2. Notwithstanding any inconsistent provisions of subdivision a of section one hundred twelve-a of such charter, the mayor shall pursuant to such subdivision submit preliminary expense budget statements as therein described not later than the thirty-first day of January, nineteen hundred eighty-five. 3. Notwithstanding any inconsistent provisions of subdivision b of section one hundred twelve-a of such charter, each community board shall pursuant to such subdivision hold a public hearing pertaining to such statement and submit a statement of budget priorities as therein described not later than the fourth day of March, nineteen hundred eighty-five. 4. Notwithstanding any inconsistent provisions of subdivision c of section one hundred twelve-a of such charter, each borough board shall pursuant to such subdivision submit a statement of budget priorities and recommendations as therein described not later than the twelfth day of March, nineteen hundred eighty-five. 5. Notwithstanding any inconsistent provisions of subdivision a of section one hundred thirteen of such charter, the comptroller shall pursuant to such subdivision submit a certified statement as therein described not later than the fourth day of March, nineteen hundred eighty-five. 6. Notwithstanding any inconsistent provisions of section one hundred fifteen of such charter, the board of estimate and the council shall pursuant to such section hold hearings and submit recommendations as therein described not later than the ninth day of April, nineteen hundred eighty-five. 7. Notwithstanding any inconsistent provisions of section two hundred thirteen of such charter, the mayor shall pursuant to such section issue and publish a preliminary statement as to the maximum amount of debt and reserves as therein described not later than the thirty-first day of January, nineteen hundred eighty-five. 8. Notwithstanding any inconsistent provisions of subdivision a of section two hundred fourteen-a of such charter, the mayor shall pursuant to such subdivision submit preliminary capital project statements as therein described not later than the thirty-first day of January, nineteen hundred eighty-five. 9. Notwithstanding any inconsistent provisions of subdivision b of section two hundred fourteen-a of such charter, each community board shall pursuant to such subdivision hold a public hearing pertaining to the capital project statements and submit a statement of budget priorities as therein described not later than the fourth day of March, nineteen hundred eighty-five. 10. Notwithstanding any inconsistent provisions of subdivision c of section two hundred fourteen-a of such charter, each borough board shall pursuant to such subdivision submit a statement of budget priorities and needs of the borough as therein described not later than the twelfth day of March, nineteen hundred eighty-five. 11. Notwithstanding any inconsistent provisions of subdivision d of section two hundred fourteen-a of such charter, the city planning commission shall submit a statement of the capital needs and priorities of the city as therein described not later than the first day of April, nineteen hundred eighty-five. 12. Notwithstanding any inconsistent provisions of subdivision a of section two hundred sixteen of such charter, the board of estimate and city council shall pursuant to such subdivision hold joint hearings as therein described not later than the ninth day of April, nineteen hundred eighty-five. 13. Notwithstanding any inconsistent provisions of subdivision b of section two hundred sixteen of such charter, the board of estimate and the council, or its committees, shall pursuant to such subdivision submit findings and recommendations as therein described not later than the ninth day of April, nineteen hundred eighty-five. § 2. This local law shall take effect immediately.

This local law shall take effect immediately and shall be applicable to final state determinations made and to amended returns or reports filed with the state tax commission on and after June thirtieth, nineteen hundred eighty, but only to such final state determinations or such amended returns or reports which relate, in whole or in part, to sales and use tax credits claimed under titles QQ, R or S of chapter forty-six of the administrative code of the city of New York. Notwithstanding any provision to the contrary contained in the amendments made by this local law, any final state determination or amended return or report which, under any such provision, would have been required to be reported or filed prior to the effective date of this local law, shall be deemed to have been timely filed if filed within ninety days of the effective date hereof.

No. 900 By Council President (Ms. Bellamy) the Vice Chairman (Council Member Cuite), and Council Members Vallone, Messinger, Foster, Pinkett, Samuel, Spigner, Williams, Wooten (by request of the Mayor); also Council Members Berman, Dryfoos, Friedlander, Gerges, Lisa, Maloney, Michels, Albanese, Alter, Eisland, Crispino, Ferrer, Greitzer, Horwitz, Robles, Fossella and O'Donovan A Local Law to amend the charter of the city of New York in relation to the depositing of city funds in banks that have dealings with the government of the Republic of South Africa, and to amend the administrative code of the city of New York in relation to the purchase by the city of goods originating in the Republic of South Africa or Namibia and city contracts with companies that export goods to the Republic of South Africa or Namibia in violation of the arms control act or the export administration act, and companies that make direct sales to certain agencies of the South African government Be it enacted by the Council as follows: Section 1. Declaration of legislative intent and findings. The legally enshrined policy of apartheid practiced by the government of the Republic of South Africa is morally repugnant to the people of the city of New York. Under apartheid, the South African government uses the processes of law to deprive the black majority of basic human freedom and dignity. Blacks are by law excluded from participation in politics and government. They are overwhelmingly compelled to live in designated homelands far from cities and employment, systematically excluded from education and training, and almost all relegated to menial, low paying jobs. Other non-whites have been allowed nominal participation in some aspects of government but suffer many of the same privations and indignities as do the blacks. Apartheid is maintained by the repressive tactics of a police state. Under South African law, blacks must carry passes in order to travel. The police detain and arrest persons indefinitely without charging them with the commission of a crime. Freedom of speech, press, and assembly are severely restricted. Non-whites seeking to exercise fundamental human freedoms individually or collectively are swiftly subjected to brutal repression. Apartheid, which has been official government policy at least since nineteen hundred forty-eight, as yet shows no signs of retreat in the face of condemnation by the world community of nations. The city of New York has a long tradition of regulating the use of public monies to ensure that purchases, deposits and investments are made consistently with moral standards and in a manner which promotes the public welfare. For example, as early as nineteen hundred forty-two the council enacted a local law prohibiting discrimination on the basis of race, color or religion by city contractors. The council has also required that city contractors agree not to violate provisions of the export administration act prohibiting participation in foreign-sponsored boycotts of nations friendly to the United States. The council recently enacted legislation providing for a "locally based enterprise" program to increase opportunities for disadvantaged persons to be employed in city construction contracts. The charter provides that city funds may be deposited only at banks which have a policy of hiring and promoting employees without regard to race, color, creed, religious affiliation, sex or national origin. The trustees of the New York City Employees' Retirement System have adopted a resolution calling for the divestiture of assets invested in those companies doing business in the Republic of South Africa which are not doing enough to oppose apartheid. In keeping with this tradition, the council seeks, through city policy on depositing public funds and public contracting, to send a message to the government of the Republic of South Africa and to encourage those who do business there to support change. This local law provides that the banking commission shall not designate a bank or trust company as eligible to receive city deposits if, after the effective date of this law, the bank or trust company provides certain services that benefit the South African government. A bank or trust company may not be so designated if it promotes the sale of krugerrands or other coins minted in the Republic of South Africa or Namibia outside of the Republic of South Africa or Namibia, but merely selling the krugerrands or other such coins to a customer upon request would not disqualify a bank for designation. Nor may a bank or trust company be designated if it underwrites securities for or makes a loan to the government of the Republic of South Africa. An exception is made for loans for educational, housing or health facilities, but only where these are available to ail persons on a totally nondiscriminatory basis and located in geographic areas accessible to all groups of the population. A further exception is made to allow for the designation of a bank if such designation is necessary to allow the city to obtain essential services which are not reasonably obtainable from another bank. This local law also applies to certain city contracts for goods and services. Recognizing the needs of city agencies to contract economically and in accordance with applicable competitive bidding requirements, this law provides for a determination to be made whether it is in the public interest to contract with persons who do not agree to certain conditions concerning their activities in the Republic of South Africa and Namibia if the city can obtain goods or services of comparable price and quality from a person who does agree to those conditions. This determination would occur when a person seeking a contract would sell the city goods originating in the Republic of South Africa or Namibia or sells goods or services other than food or medical supplies directly to the South African police, military, prisons, or the department of cooperation and development (the agency that administers the pass laws). In addition, contracts by city agencies will be required to provide that the contractor shall not violate provisions of the export administration act or the arms control act concerning shipment of military supplies and equipment and other goods to the Republic of South Africa and Namibia. These provisions not only express the moral concerns of the city of New York, but also seek to protect the financial interests of the city by limiting the number of city contracts which may depend for their satisfaction on the internal security of the Republic of South Africa, where relentless oppression has led to increasing civil disturbances, making sabotage of business interests and even revolution possible. Like the provisions concerning deposits, these provisions operate prospectively, and contracting decisions shall not be based on a contractor's dealings with the South African government prior to the effective date of this law. * * * [Consolidated provisions are not included in this Appendix A] * * * § 4. No bank shall be denied designation pursuant to section two of this local law because of any action taken prior to the effective date of this local law. § 5. The provisions of section 343-11.0 of the administrative code as added by this local law shall not apply to actions taken or contracted to be taken by any person prior to the effective date of this local law. § 6. Nothing in this local law shall be deemed to restrict or diminish the powers conferred on the board of estimate by law. § 7. If any provision of this local law or the application thereof is held invalid, the remainder of this local law and the application thereof to other persons or circumstances shall not be affected by such holding and shall remain in full force and effect. § 8. This local law shall take effect one hundred twenty days from the date it shall have become law, but all actions necessary to prepare for the implementation of this local law may be taken prior to its effective date.

Notwithstanding the provisions of subdivision b of section one hundred sixty-four-b or section fifteen hundred ten of the New York city charter, or any other provision of law, rule or regulation to the contrary, during the year nineteen hundred eighty-five: a. Employees of the tax commission or the real property assessment bureau of the department of finance, authorized by the president to accept applications for correction of the assessment of property classified as class one pursuant to the provisions of article eighteen of the real property tax law, shall accept such applications between the fifteenth day of January and the first day of April. b. The books of the annual record of assessed valuation shall, in respect to property designated as class one property, remain open for public inspection until the first day of April. § 2. This local law shall take effect immediately.

Legislative intent. The council finds that there is undue confusion on the part of the public regarding consumers' rights pursuant to title ten of article twenty-seven of the environmental conservation law of the state of New York, titled the New York state returnable container act, popularly known as the "Bottle Bill" or "Bottle Law". Accordingly, the council finds that there is a need to publicize the rights of consumers under the returnable container act at the place of container return by the consumer. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect ninety days after it shall have become a law, except that section D64-35.0, as added by section two of this local law, shall take effect immediately.

No. 935 By Council Member Sadowsky (by request of the Mayor) (Passed under a message of necessity from the Mayor) A Local Law in relation to dates for submission of the expense budget, expense budget hearings, approval of the expense budget by the board of estimate and council, disapproval by the mayor of certain portions of the expense budget and override thereof, certification of the expense budget, certification of debt and reserves for capital projects, submission of the capital budget and program, recommendations by the comptroller and city planning commission on the capital budget and program, capital budget and program hearings, adoption of the capital budget and program by the board of estimate and council, disapproval by the mayor of certain portions of the capital budget and program and override thereof, certification of the assessment roll, the estimate by the mayor of receipts and submission of a statement setting forth the amount of the capital budget, and fixing of the tax rate, relating to the fiscal year nineteen hundred eighty-six Be it enacted by the Council as follows: Section 1. During the calendar year nineteen hundred eighty-five and in relation to the nineteen hundred eighty-six fiscal year: 1. Notwithstanding any inconsistent provisions of section one hundred sixteen of the New York city charter, the mayor shall pursuant to such section submit a proposed expense budget and budget message as therein described not later than the third day of May, nineteen hundred eighty-five. 2. Notwithstanding any inconsistent provisions of section one hundred nineteen of such charter, the board of estimate and the council shall pursuant to such section hold public hearings on the expense budget as therein described between the thirteenth day of May and the third day of June, nineteen hundred eighty-five. 3. Notwithstanding any inconsistent provisions of subdivision b of section one hundred twenty of such charter, the single expense budget adopted pursuant to such subdivision shall be returned to the mayor not later than the twelfth day of June, nineteen hundred eighty-five. 4. Notwithstanding any inconsistent provisions of subdivision c of section one hundred twenty of such charter, if a single expense budget has not been adopted as therein described by the twelfth day of June, nineteen hundred eighty-five, the expense budget and tax rate adopted as modified for the nineteen hundred eighty-five fiscal year shall be deemed to have been extended for the nineteen hundred eighty-six fiscal year until such time as a new budget is adopted. 5. Notwithstanding any inconsistent provisions of subdivision a of section one hundred twenty-one of such charter, the mayor may pursuant to such subdivision disapprove certain parts of the expense budget as therein described not later than the seventeenth day of June, nineteen hundred eighty-five, and shall return the expense budget to the board of estimate and the council setting forth his objections in writing by that date. 6. Notwithstanding any inconsistent provisions of subdivision b of section one hundred twenty-one of such charter, the board of estimate and the council shall pursuant to such subdivision shall act and the expense budget shall be adopted not later than the twenty-seventh day of June, nineteen hundred eighty-five. 7. Notwithstanding any inconsistent provisions of section one hundred twenty-two of such charter, the mayor, the comptroller and the city clerk shall pursuant to such section certify the expense budget as therein described not later than the twenty-eighth day of June, nineteen hundred eighty-five. 8. Notwithstanding any inconsistent provisions of section two hundred thirteen of such charter, the mayor shall pursuant to such section issue and publish a certificate as to the maximum amount of debt and reserves which may be incurred for capital projects and projects financed by capital debt as therein described not later than the third day of May, nineteen hundred eighty-five. 9. Notwithstanding any inconsistent provisions of subdivision a of section two hundred nineteen of such charter, the mayor shall pursuant to such subdivision submit a proposed capital budget, capital program and explanatory message, as therein described, not later than the third day of May, nineteen hundred eighty-five. 10. Notwithstanding any inconsistent provisions of section two hundred twenty of such charter, the comptroller and city planning commission shall pursuant to such section submit reports containing comments and recommendations as therein described not later than the thirteenth day of May, nineteen hundred eighty-five. 11. Notwithstanding any inconsistent provisions of section two hundred twenty-one of such charter, the board of estimate and council shall hold public hearings as therein described between the thirteenth day of May and the third day of June, nineteen hundred eighty-five. 12. Notwithstanding any inconsistent provisions of subdivision a of section two hundred twenty-two of such charter, the single capital budget and single capital program adopted pursuant to such subdivision shall be returned to the mayor not later than the twelfth day of June, nineteen hundred eighty-five. 13. Notwithstanding any inconsistent provisions of subdivision b of section two hundred twenty-two of such charter, if a single capital budget and single capital program have not been adopted as therein described by the twelfth day of June, nineteen hundred eighty-five, they shall be deemed adopted so far as acted on by both bodies with the lower amount of any item in dispute between the two bodies in effect. 14. Notwithstanding any inconsistent provisions of subdivision b of section two hundred twenty-three of such charter, the mayor may pursuant to such subdivision disapprove certain parts of the capital budget or capital program as therein described not later than the seventeenth day of June, nineteen hundred eighty-five, and shall return the capital budget and capital program to the board of estimate and the council setting forth his objections in writing by that date. 15. Notwithstanding any inconsistent provisions of subdivision c of section two hundred twenty-three of such charter, the board of estimate and the council shall pursuant to such subdivision act and the capital budget and capital program shall be adopted not later than the twenty-seventh day of June, nineteen hundred eighty-five, and in the event the board of estimate and the council fail to act by that date, the capital budget and capital program as modified by the mayor are adopted. 16. Notwithstanding any inconsistent provisions of subdivision d of section two hundred twenty-three of such charter, the capital budget as finally adopted shall pursuant to such subdivision be certified by the mayor and the city clerk as therein described not later than the twenty-eighth day of June, nineteen hundred eighty-five. 17. Notwithstanding any inconsistent provisions of subdivision two of section fifteen hundred fourteen of such charter, the commissioner of finance shall pursuant to such subdivision deliver to the council certified assessment rolls as therein described on or before the twenty-seventh day of June, nineteen hundred eighty-five. 18. Notwithstanding any inconsistent provisions of subdivision a of section fifteen hundred fifteen of such charter, the mayor shall pursuant to such subdivision prepare and submit to the council an estimate of the probable amount of receipts as therein described not later than the twelfth day of June, nineteen hundred eighty-five. 19. Notwithstanding any inconsistent provisions of subdivision b of section fifteen hundred fifteen of such charter, if necessary, the mayor shall pursuant to such subdivision submit to the council a statement setting forth the amount of the budget as therein described not later than the twenty-ninth day of June, nineteen hundred eighty-five. 20. Notwithstanding any inconsistent provisions of subdivision c of section fifteen hundred sixteen of such charter, if necessary, the council shall pursuant to such subdivision fix a new annual tax rate as therein described not later than the thirtieth day of June, nineteen hundred eighty-five. 21. This local law shall take effect immediately.

No. 422-A By Council Members DeMarco, Horwitz, O'Donovan, Crispino, Katzman, Eisland, Albanese, Alter, Berman, Castaneira-Colon, Dear, Dryfoos, Ferrer, Foster, Leffler, Lisa, Maloney, Michels, Pinkett, Vallone, Ward, Williams, Wooten, Spigner, Friedlander, Fossella, Crowley, Samuel and Povman (by request of the Mayor) (Passed under a message of necessity from the Mayor) A Local Law to amend the administrative code of the city of New York, in relation to the defacement of property and the sale and possession of aerosol spray paint cans and broad tipped indelible markers, and to repeal section 435-13.2 thereof relating thereto Be it enacted by the Council as follows: Section 1. Legislative declaration. The council finds that for the health, safety and welfare of the residents of the city, the laws designed to deter the defacement of public and private property through the use of aerosol spray paint cans, broad tipped indelible markers and other marking devices should be strengthened. The council finds further that such defacement of property is most often committed by persons under eighteen years of age using aerosol spray paint cans and broad tipped indelible markers, that such aerosol cans and markers are frequently stolen from retail stores by such persons, that such persons rarely have a legitimate need for such aerosol cans or markers, that where such a need exists such aerosol cans or markers may be furnished by a parent or guardian, and therefore, that within the city, the sale of such aerosol cans and markers to such persons should be prohibited and that persons engaged in the retail sale of such aerosol cans and markers should be required to take reasonable steps to prevent the theft of such cans and markers. Further, it is the recommendation of the council that, where appropriate, the court require those who commit acts of defacement to restore the property so damaged. * * * [Consolidated provisions are not included in this Appendix A] * * * Section 3. The repeal of section 435-13.2 by section two of this local law shall not affect any offense committed or punishment incurred prior to the time such repeal takes effect and the same may be asserted, enforced, prosecuted or inflicted, as fully and to the same extent as if such repeal has not been effected. Section 4. If any clause, sentence, paragraph, section or part of this section shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy and in which such judgment shall have been rendered. Section 5. This local shall take effect immediately, except that subdivision c and d of section 435-13.2 of the administrative code of the city of New York contained in section two of this local law shall take effect ninety days after enactment of this local law.

No. 970-A By Council Member Vallone (by request of the Mayor); also Council Members Albanese, Crowley, Dear, Eisland, Ferrer, Foster, Katzman, Leffler, Maloney, Messinger, Michels, Pinkett, Povman, Robles, Williams, Friedlander, Berman and Dryfoos (Passed under a message of necessity from the Mayor) A Local Law to amend the administrative code of the city of New York, in relation to prohibiting the sale and possession of electronic stun guns Be it enacted by the Council as follows: Section 1. Legislative findings. It is hereby declared and found that the possession of electronic stun guns is a menace to the public health, peace, safety and welfare of the people of the city and that the possession of such electronic stun guns may result in the commission of many assaults and other crimes upon the people of the city. These devices may be used by criminals lo subdue and disable their victims while engaged in the commission of crimes against them. Therefore, the sale und possession of such electronic stun guns should be prohibited in the city of New York. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect sixty days after its enactment.

Illegal dumping of refuse, construction debris, and other wastes, including hazardous wastes, on public and private property in the city has reached epidemic proportions, endangering human life and safety and thereby creating a public emergency. The present penalties have not been sufficient to deter this illegal and dangerous activity. Certain persons have treated the fines and penalties imposed for illegal dumping as a cost of doing business. This is especially the case with respect to hazardous waste because of the high cost of lawful disposal. It is therefor necessary in order to deter such activity to provide for the forfeiture of vehicles unlawfully used to dump hazardous waste and of vehicles used for other unlawful dumping where the owner has demonstrated flagrant disregard of the illegal dumping law by committing three or more violations of such law within an eighteen month period. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. This local law shall take effect ninety days after it shall have been enacted into law and shall apply only to violations committed after such effected date.

The council hereby finds and declares that a serious public emergency exists in the housing of a considerable number of persons which emergency has been created by the loss of single room occupancy dwelling units housing lower income persons; that the loss of such housing units has caused serious hardship for occupants who have been forced to relocate; that adequate housing resources to effectuate relocation of such occupants do not currently exist; that many of such occupants are elderly and infirm persons of low income who are incapable of finding alternative housing accommodations; that a considerable number of such persons have become part of a growing homeless population; that the intervention of the city government is necessary to protect such housing stock by imposing a moratorium on conversions, alterations and demolitions of single room occupancy multiple dwellings; that during such moratorium the department of housing preservation and development, after consultation with the mayor's office of SRO housing, shall arrange for the preparation of a study to determine the best means of making available single room occupancy dwelling units and other housing for low income persons; that the monies paid into the housing fund created under this legislation shall be separate from and not applicable to any mandate to create or substantially rehabilitate housing units as provided for in local law 78 of 1984; that the provisions of this local law are necessary and designed to protect the public health, safety and general welfare. * * * [Consolidated provisions are not included in this Appendix A] * * * § 5. If any provision of this local law or its application to any person or circumstance shall be held invalid, the remainder of this local law and the applicability of its provisions to other persons or circumstances shall not be affected thereby. § 6. The council further finds that a requirement that agencies maintain such guidelines would facilitate proper public scrutiny and legislative review of decisions reached by these agencies and would help to ensure that the decision to enter into such contracts takes into account existing agency personnel and resources, and the need of agencies to perform efficiently and in a cost-effective manner. Any provision in any law, rule, regulation, contract, grant or other document relating to the subject matter of such functions, powers or duties, and applicable to the agency or officer formerly exercising the same shall, so far as not inconsistent with the provisions of this local law, apply to the agency or officer to which such functions, powers and duties are assigned by this local law. § 28. No existing right to remedy of any character shall be lost or impaired or affected by reason of the adoption of this local law. b. The council finds that the continued operation of unlicensed tow cars and drivers defeats the intent of the council to regulate the tow car industry and poses a serious threat to the health, safety and welfare of the people of New York City and of the visitors thereto. The council further finds that the sanctions and penalties applied by the police commissioner must be sufficient to achieve the purposes of licensing and, to this end, the police commissioner should be authorized to impose further sanctions and penalties than those currently allowed by law. Such sanctions and penalties include additional penalties relating to the suspension or revocation of tow car and driver's licenses, additional fines, orders to cease activity for which a license is required but has not been obtained and orders to remove or make inoperable tow cars which operate without a license where one is required. These further sanctions and penalties are reasonable and necessary in order to protect the health and safety of the people of the city and to promote the general welfare. * * * [Consolidated provisions are not included in this Appendix A] * * * § 3. If any provision of this local law or the application thereof to any person or circumstances is held invalid, the remainder of this law and the application of such provisions to other persons and circumstances shall not be rendered invalid thereby. § 4. This local law shall take effect ninety days after its enactment into law and shall expire and be of no further effect two years after its effective date, except with respect to any rights, duties, liabilities, violations, penalties or other obligations arising or occurring thereunder during such period of effectiveness. The council hereby finds that exposure to airborne asbestos fibers and particles in the air has been linked by reputable medical and scientific authorities to a significant increase in the incidence of diseases such as asbestosis, bronchogenic carcinoma, mesothelioma, and other malignancies and that substantial amounts of materials containing asbestos have been used in buildings for fireproofing, insulation, soundproofing, decorative and other purposes. The council further finds that the predominant cause of asbestos becoming airborne is due to the performance of building renovation and demolition without adequate adherence to procedures for safeguarding workers and the general public, by persons who have not received adequate training in the handling of materials containing asbestos. Therefore, it is the purpose of this local law to safeguard the public health by requiring that renovation or demolition projects which disturb asbestos be conducted in accordance with procedures established pursuant to the provisions of this local law and that workers who handle materials containing asbestos receive appropriate training. * * * [Consolidated provisions are not included in this Appendix A] * * * § 9. Within eighteen months of the enactment of this local law, the commissioner of environmental protection shall submit to the council a report identifying and evaluating the potential risks, if any, which may be posed to workers and the general public from asbestos which is not disturbed by renovation, alteration or demolition work and recommending action deemed appropriate to ameliorate such risks as may be identified. § 10. This local law shall take effect sixty days after its enactment into law except that section C26-118.9 of article one of part two of the administrative code of the city of New York as added by section six of this local law and paragraphs one and two of subdivision b of section 1403.2-9.12 of part two of chapter fifty-seven of the administrative code of the city of New York as added by section seven of this local law shall take effect one year after its enactment.
