(a) Definitions. Except as otherwise provided below, all terms used in this article shall have the meanings attributed to them by Reno Municipal Code Sec. 2.10.200(c), entitled "Definitions," which section is incorporated herein by reference.
(1) Operator means the person who is the proprietor of transient lodging that holds a nonrestricted gaming license within the district defined by section 2.10.410, whether in the capacity of owner, lessee, sub-lessee, mortgagee, licensee, realtor, real estate agency renting transient lodging, on-line discount booking agency, exchange company or any other capacity. Where the operator performs his or her functions through a managing agent of any type or character other than an employee, the managing agency shall also be deemed an operator for the purposes of this chapter and shall have the same duties and liabilities as his or her principal. Compliance with the provisions of this chapter by either the principal or the managing agent shall, however, be considered to be compliance by both.
(b) Amount of surcharge. There is fixed and imposed a surcharge on each operator of transient lodging in the amount of $2.00 on the per night charge derived by each operator from the renting of transient lodging within the district. The surcharge shall not be applied for any time during which the transient lodging is provided to an occupant free of charge.
