Jacksonville Ordinance Code § 122.801 Definitions.

Sec. 122.801. - Definitions. As used in this Part 8: (a) Accountable officer means the person who is responsible for an item of tangible personal property within his jurisdiction, notwithstanding that a custodian has been appointed for the property. (b) Awards Committee means the Awards Committee created in Section 126.202. (c) Custodian means the person to whom the custody of City property has been delegated by the City under this Part. (d) Owned means and includes ownership by the City acquired by purchase, gift, donation, escheat or other transfer of the right to use, possess and dispose of tangible personal property. Property purchased with State or federal funds, which must be returned to the State or the United States (unless otherwise provided by the respective government), is considered to be owned for the period during which it is in the control and possession of the City, and until custody thereof is accepted by the appropriate State or federal agency or officer. (e) Property or tangible personal property means those items of a nonconsumable nature, the value of which is $5,000 or more and the normal expected life of which is more than one year. Jacksonville Ordinance Code § 122.802 Record and inventory required.

Sec. 122.802. - Record and inventory required. Each item of tangible personal property owned by the City which it is practicable to identify by marking shall be marked in the manner required by the State Auditor General and entered on a property record containing the information required by the Auditor General. A complete physical inventory of all tangible personal property shall be taken annually, and the date of the inventory shall be entered on the property. The inventory shall be compared with the property record and discrepancies shall be traced and reconciled. An inventory shall also be taken whenever there is a change in accountable officers, for the property under the control and in the custody of the accountable officer; and the accountable officer shall not be relieved of his responsibility and accountability for this property until the inventory is completed, any discrepancies are reconciled and his successor has accepted the inventory, which shall be the basis for the successor accountable officer's initial accountability under this Part. Jacksonville Ordinance Code § 122.803 Deletion of unaccountable items of tangible personal property from property records; Council action.

Sec. 122.803. - Deletion of unaccountable items of tangible personal property from property records; Council action. Annually, the Director of Finance and Administration shall, pursuant to authority granted by resolution of the Council, delete from the tangible personal property records of the City items of property: (a) For which there is an entry in the property records, but which have been verified as not being owned by the City. (b) Which have been reported as missing or stolen. The Director of Finance and Administration shall provide to the Council, in his request for authority to delete items, a listing of the items sought to be deleted, which shall state for each item: (a) Its last known location, as indicated on the property records. (b) Its description. (c) The property number assigned to it. (d) The unit of government to which it was last assigned. (e) Its original cost. (f) Accumulated depreciation, if any. Jacksonville Ordinance Code § 122.804 Property supervision and control.

Sec. 122.804. - Property supervision and control. The Accounting Division shall have the responsibility of maintaining a perpetual inventory system for the City and for keeping the inventory and property records of tangible personal property. The Division shall note the acquisition, transfer of custody of and disposal of tangible personal property on the property records. The Division shall maintain the custody receipts for tangible personal property which is held under the receipts and shall note transfers of custody and withdrawals from custody on the receipts and property records. Jacksonville Ordinance Code § 122.805 Accountable officers: personal responsibility and liability.

Sec. 122.805. - Accountable officers: personal responsibility and liability. Each executive officer is the accountable officer for tangible personal property assigned to or used by his respective department, division or office; provided, that: (a) A department director appointed by the Mayor may, by departmental rule, provide that he will be the sole accountable officer for his department and that no division chief will be an accountable officer. (b) The Sheriff will be sole accountable officer and custodian of the property in the Office of the Sheriff, pursuant to F.S. § 274.03. An accountable officer will be officially and personally accountable and liable for: (a) The value of all tangible personal property within his jurisdiction and assigned to or used by his unit of government and not withdrawn from his accountability. (b) The value of tangible personal property lost or damaged when the loss or damage is determined to be due to negligent use or lack of due care on his part. The fact that a subordinate employee or custodian in the unit of government was the direct cause of the loss or damage may be used in mitigation of liability but not as a defense to the accountability of the accountable officer. Jacksonville Ordinance Code § 122.806 _______: relief from responsibility and accountability.

Sec. 122.806. - _______: relief from responsibility and accountability. (a) An accountable officer may be relieved from responsibility and accountability for an item of tangible personal property when the property is: (1) Obsolete and no longer used or needed by his unit of government. (2) In excess of the present and expected needs of the unit of government. (3) Worn out, inefficient or uneconomical to continue in use. (4) Unsafe for further use or storage because of age or condition. (5) Unusable, but capable of being disassembled for component parts. (6) To be used for a trade-in or replacement item for a new item of property. (7) Lost, destroyed or missing under circumstances beyond the control of the accountable officer. (8) To be transferred to the custody of another accountable officer. The City Comptroller and Chief of Procurement will jointly prescribe the manner in which relief from accountability will be requested, documented and recorded, including a method of review to determine the ultimate disposition to be made of the property if it is not transferred to another accountable officer. (b) No accountable officer will be relieved of responsibility until the Chief of Procurement has authorized such relief and the transfer of the property to the custody of the Procurement Division for disposition. If the Chief of Procurement authorizes relief from accountability, the responsibility and accountability, for the property will be transferred from the accountable officer to the Procurement Division when and as directed by the Chief of Procurement, whether or not the property is physically transferred to the possession of the Procurement Division. The Procurement Division will notify the Accounting Division of the action taken on requests for relief from accountability. (Ord. 83-591-400, § 1; Ord. 85-1327-691, § 1; Ord. 86-900-561, § 1)

Jacksonville Ordinance Code § 122.807 Property officers.

Sec. 122.807. - Property officers. Each accountable officer will appoint a property officer for his unit of government. The property officer shall: (a) Maintain the tangible personal property records and associated files for the unit of government in accordance with the rules promulgated by the City Comptroller. (b) Assist the Accounting Division in the taking of physical inventories and in the reconciliation of the inventory with the property records in the case of discrepancies. (c) Maintain the records of service contracts and warranties and see that they are faithfully executed or honored according to their terms. (d) Receive new property items and assist the Accounting Division in properly identifying and marking them. (e) Be responsible for disposing of property which has been authorized for disposition by the Procurement Division, as directed by the Chief of Procurement. (f) Maintain the custody receipt files for property which is delegated to custodians by the accountable officer, and note changes in custody and withdrawals from custody in appropriate instances. Where the size of the unit of government or the diverse locations of the tangible personal property makes it advisable, the accountable officer may appoint more than one property officer and designate, for each one, the property and associated files and records for which he is responsible under this Section. Jacksonville Ordinance Code § 122.808 Custodians.

Sec. 122.808. - Custodians. An accountable officer may designate a custodian to have direct responsibility for specific items of tangible personal property for which the accountable officer is accountable under this Part. The City Comptroller shall prescribe a method and system for recording custody and changes in custody, using custody receipts and other records as necessary. A custodian shall have the same responsibility as the accountable officer with respect to the property assigned to his custody and the accountable officer shall be responsible on his official bond for the acts of custodians designated by him. An inventory shall be taken whenever: (a) There is a change in custodians. The custodian shall not be relieved of his responsibility for this property until the inventory is completed, any discrepancies are reconciled and his successor has accepted the inventory, which shall be the basis for the successor custodian's initial responsibility under this Section. (b) A custodian is completely relieved of his responsibility under this Section; but the custodian shall not be relieved of his responsibility for this property until the inventory is completed, any discrepancies are reconciled and the accountable officer has accepted the inventory. An accountable officer may withdraw all or a portion of the tangible personal property assigned to a custodian from his custody at any time, in his absolute discretion, and may assign custody to another custodian or retain custody in himself personally. Where the size of the unit of government or the diverse locations of the tangible personal property makes it advisable, the accountable officer may appoint more than one custodian and designate, for each one, the tangible personal property for which he is responsible under this Section. Jacksonville Ordinance Code § 122.809 Custody and use of tangible personal property.

Sec. 122.809. - Custody and use of tangible personal property. (a) The accountable officer will personally, or through his designated custodian or custodians, take all reasonable precautions to assure that tangible personal property owned by the City is used solely for the convenience of the City and is safeguarded in such manner as to best insure against misuse, loss or damage. In any instance where compliance with this subsection is impaired by causes not within his control, an accountable officer will describe the causes in a written report to the Accounting Division and, in appropriate instances, may request relief from accountability. (b) An item of tangible personal property shall not be taken from its assigned location except as authorized by the accountable officer and only when a written receipt is given for the property. After the authorized use, the property will be returned to its proper location and the receipt cancelled, but retained in the property records. Property that is physically moved within the custody of the same accountable officer will be noted on the property records. A notation shall also be made in the property records with respect to property which is on loan or being repaired off the premises where it is usually kept, and a note made when the property is returned. Jacksonville Ordinance Code § 122.810 Stolen, missing or lost tangible personal property.

Sec. 122.810. - Stolen, missing or lost tangible personal property. In the event that tangible personal property is stolen, discovered missing or lost, the Office of the Sheriff shall be notified and a copy of the report transmitted to the Accounting Division. If an item of property that was reported as stolen, missing or lost is subsequently recovered, or if the report was erroneous and the property is discovered, the Accounting Division shall be notified. No accountable officer may request to be relieved of responsibility under Section 122.806(a)(6) unless a report has been made as required in this Section. (Ord. 83-591-400, § 1)

Jacksonville Ordinance Code § 122.811 Sales of tangible personal property; prohibition of sales to certain persons.

Sec. 122.811. - Sales of tangible personal property; prohibition of sales to certain persons. (a) The procedures in Section 126.202 may be used with respect to sales of tangible personal property where the estimated sales price exceeds $5,000, except that awards shall be made to the highest, rather than the lowest, responsible bidder meeting or exceeding published specifications. In the alternative, the Chief of Procurement may sell the property at a public auction, be it in-person or online, to the highest responsible bidder, payable by a method accepted by the applicable auctioneer. Notice of the date, time and place of an in-person auction, as well as a general description of the items to be offered for sale, shall be published in a newspaper of general circulation in the City, or via such other advertisement or notice method as permitted by law (e.g., a publicly accessible website), and on the Procurement Division's public website, at least ten days prior to the in-person auction date. Online auctions shall take place at a time and duration as determined by the Chief of Procurement without such notification requirement, provided that a description of the online auction process and a link to the online auctioneer's website is published on the Procurement Division's public website. (b) No sale of tangible personal property shall be made to a person who is an officer or employee subject to F.S. Ch. 112, Pt. III, or in which the officer or employee has a private financial interest, direct or indirect, within the meaning of Part III. However, in cases where the Chief of Procurement shall have obtained more than one written sealed bid, whether or not he shall have been required by law to advertise for bids, this prohibition shall not apply. Jacksonville Ordinance Code § 122.812 Surplus, obsolete and waste supplies and other tangible personal property.

Sec. 122.812. - Surplus, obsolete and waste supplies and other tangible personal property. (a) It is the policy of the City to sell or otherwise dispose of the City's tangible personal property for fair market value, unless the public interests support disposing such property for some other public purpose. (b) The Director of Procurement shall periodically prepare reports declaring stocks of supplies and other tangible personal property which are no longer used or which have become obsolete, wornout or scrapped, (surplus property) and using agencies shall be required to furnish such information for this purpose as the Director of Procurement may require. The Director of Procurement shall have authority to sell, under the authority of Section 122.811, supplies and other tangible personal property which have been declared surplus by the using agencies, except that the Duval County School Board may sell or otherwise dispose of tangible personal property which is surplus, obsolete or waste supplies with a resale value estimated to be under $100 without utilizing the Procurement Department. Surplus property shall not be disposed of unless certified by the Director of Procurement to be obsolete, wornout or scrapped. (c) The disposition of tangible personal property for other than fair market value, or not in accordance with the procedures of the Director of Procurement shall require a public purpose, Council approval and the certification by the Director of Procurement that the property is obsolete, wornout or scrapped. All ordinances disposing of surplus tangible personal property shall include, at a minimum: (1) A clear statement of the use to which the property will be put and the public purpose to be achieved by the directed disposition of the property; (2) Designation of an appropriate City department or agency to monitor the actual use of the property and achievement of the stated public purpose after the transfer of the property; and (3) A reverter clause requiring the property to be returned to the City should the surplus property be put to a use other than the stated public purpose for which it was conveyed. (d) The Mayor and Corporation Secretary are hereby authorized to execute a revocable permit between the City and Jacksonville Kennel Club, Inc. for temporary use by the City of the Club's paved parking area in order to allow persons attending City surplus property auctions to park therein, which permit shall include a provision for the City to defend and hold harmless the Jacksonville Kennel Club, Inc. from and against injury or damage to persons or property occasioned by the City's use of the paved parking area. (e) The Chief of Procurement is authorized to negotiate contracts with the State or any of its agencies and with local governmental bodies in Duval County and the contiguous counties so as to allow them to participate in surplus property auctions of the City; provided, that a contract shall incorporate the following minimum requirements: (1) A term not to exceed one year in duration. (2) Prompt payment to the City of an amount of money not less than the total of all costs, direct and indirect, of the City arising from or in connection with participation by the State or State agency or the local governmental body. (3) A provision that the State or State agency or the local governmental body shall indemnify, defend and hold the City harmless from and against all costs, damages and liabilities arising from or in connection with its participation. (4) Approval as to form by the Office of General Counsel and execution by the Mayor and Corporation Secretary. (f) The JEA is authorized, with the prior approval of the Chief of Procurement, to negotiate the sale of tangible personal property valued in excess of $5,000 under one of the following conditions: (1) Competitive bidding has resulted in no responsive bids or a high responsive bid less than 75 percent of the fair market value of the property. (2) The JEA has determined by resolution that the nature of the market is not conducive to competitive sale. (g) Notwithstanding the provisions of Section 122.812(d), the JEA is authorized to sell, at a cost of replacement value, any equipment, supplies, material or other personal property of the JEA, unique to the electric utility industry, where, in the determination of the managing director or an associate managing director, all of the following conditions exist: (1) A request has been made by a customer or another electric utility for the sale of such personal property, and (2) There exists an emergency need for such property, and (3) Failure to receive the requisite part will result in disruption or curtailment of electrical service effecting an economic hardship on the requesting party, and (4) No reasonable alternative exists for the requesting party to acquire such property other than to purchase it from the JEA, and (5) Selling the property will not disrupt JEA operations or otherwise jeopardize the provision of electricity to its customers. (h) The Board of Library Trustees is authorized, with the prior approval of the Chief of Procurement, to: (1) Exchange with other established educational library systems those reading materials that are surplus for other reading materials which the Board deems necessary to enhance the free library services provided to the citizens of the City. (2) Donate withdrawn, duplicate or damaged reading materials to recognized worthy nonprofit charitable entities. (3) Establish written procedures to accomplish the purposes of this Section. (i) The Sheriff, with the approval of the Chief of Procurement, is authorized to donate to the Humane Society those horses and police dogs which are deemed no longer suitable for police work and are of no further use to the City; provided that such determination is based on: (1) Medical evaluations by at least two veterinarians, or (2) Training evaluations which indicate that the animal in question may pose a serious threat to an officer or the public. However, those dogs trained as police patrol dogs, because of their training, shall not be donated to the Humane Society but instead the Sheriff may donate the dog to a canine trainer/handler, or another appropriate governmental agency or have the dog put to sleep. (j) Notwithstanding any other provision of this Section, the City's Chief of Fleet Management is authorized to sell surplus automotive parts on behalf of the City to other fleets, retailers, or distributors upon: (1) Written certification by the Chief of Fleet Management that such sale is necessary and prudent for the City to achieve the highest value for the part(s); and (2) Written approval from the Director of Procurement. (k) The provisions of this Section shall apply to the independent agencies as well as to the City agencies, except where otherwise provided in this Section. Jacksonville Ordinance Code § 122.813 Disposal of surplus fire and rescue vehicles and equipment; mutual aid and assistance agreement.

Sec. 122.813. - Disposal of surplus fire and rescue vehicles and equipment; mutual aid and assistance agreement. (a) Disposal procedures. The Chief of Procurement is authorized to dispose of surplus fire and rescue vehicles and equipment that are in operable or repairable condition but that are no longer needed by the City for fire protection or emergency medical services. The Chief of Procurement may dispose of such surplus vehicles and equipment without the necessity of a public sale, in accordance with the following procedures: (1) The Chief of Procurement shall establish a minimum price for the sale of each surplus vehicle, with the advice of the Chief of Fleet Management, and a minimum price for the sale of any other surplus item, with the advice of the Director of Fire and Rescue. The minimum price shall be based on the national industry standard and recent sales of similar vehicles in comparable condition and/or manufacturer repurchase prices. (2) The Chief of Procurement shall notify the Second, Third, Fourth and Fifth Urban Services Districts and Baker, Bradford, Clay, Columbia, Flagler, Nassau, St. Johns and Union Counties and the various fire protection and emergency medical services agencies therein owned or operated by any of these counties or any municipality therein that a surplus vehicle or equipment is for sale, and he may negotiate with such of them that indicate an interest in purchasing the surplus vehicle or equipment, for the sale thereof at the best price he can obtain, but not less than the minimum price. In offering the surplus vehicle or equipment for sale, the Chief of Procurement shall negotiate first with the Urban Services Districts and the counties contiguous to Duval County and the agencies and municipalities in those counties and, if he is unable to arrive at an agreement with any of them that express an interest in the surplus vehicle or equipment, then he shall negotiate with the remaining counties and the agencies and municipalities in those counties. In addition, sales may be made to volunteer fire protection and emergency medical services units with prior approval of the chief fire protection official or other similar applicable official of the governmental jurisdiction in which the applicable unit is located. (3) When the Chief of Procurement has completed negotiations, he shall present the results thereof to the Awards Committee, which shall proceed as provided in Section 126.202(f) for the awarding of the contract. If the Awards Committee recommends any of the negotiated agreements to the Mayor, who subsequently authorizes the award, the purchaser shall execute the agreement required by subsection (b) of this Section, which agreement shall recite, in addition to the provisions required by subsection (b) of this Section, the sale price and other consideration for the purchase and transfer of the surplus vehicle or equipment being sold. Otherwise, the Chief of Procurement shall continue negotiations until an award is made or until he certifies that no sale can be negotiated, as provided in subsection (c) of this Section. (b) Mutual aid and assistance agreement. If the Mayor authorizes the award of a negotiated agreement, the purchaser of the surplus vehicle or equipment being sold shall, if it is a public agency as defined by F.S. § 163.01, execute an interlocal agreement, as provided for in F.S. Ch. 163, Pt. I, and, if it is not a public agency as defined by F.S. § 163.01, execute an agreement similar in form and contents to an interlocal agreement, for mutual firefighting or emergency medical services aid and assistance between the City and the purchaser. The agreement shall contain such provisions for the mutual firefighting or emergency medical services aid and assistance as may be agreed upon by the City and the purchaser; for this purpose, the Director of Fire and Rescue is authorized to join and assist the Chief of Procurement in that portion of the negotiations relating to the aid and assistance provisions of the agreement. The agreement may provide for any or all of the things enumerated in F.S. § 163.01, except that the City shall not agree to include in the agreement any of the following provisions authorized by F.S. § 163.01(5): (1) The creation of a separate legal or administrative entity to administer the agreement or to render the mutual firefighting or emergency medical services aid and assistance; but this shall not prevent the City and the purchaser from agreeing to use or authorize the use of a central dispatch center and other centrally located or jointly manned facilities owned or operated by either party or from agreeing to provide each other with mutual information through a centralized information center. (2) The contribution to the purchaser of any capital outlay funds or capital equipment, other than the fire or rescue vehicle or equipment which is the subject of the agreement, unless the contribution is approved by the Council. (3) Any provisions dealing with the employing, engaging, compensating, transferring or discharging of personnel; but this shall not prevent the City and the purchaser from agreeing to joint command and control of firefighting or emergency medical forces and equipment when in actual service under the agreement and to joint manning of control points and dispatch centers when necessary to fulfill the mutual aid and assistance provisions of the agreement. (4) The fixing of any rates, fees or other charges for the rendering of any mutual firefighting or emergency medical services aid and assistance, to be paid by the City to the purchaser, unless approved by the Council. The agreement may be executed by the Mayor and Corporation Secretary without the necessity of specific Council approval, except in those cases when the approval of the Council is necessary for the inclusion of an otherwise prohibited provision. (c) Failure to sell to eligible purchaser. In the event that the Chief of Procurement is unable to negotiate a successful agreement with an eligible purchaser for the sale of a surplus fire or rescue vehicle or equipment, he shall so certify and the surplus vehicle or equipment shall be disposed of at public auction. Jacksonville Ordinance Code § 122.814 Disposal of surplus timber.

Sec. 122.814. - Disposal of surplus timber. The disposal of cut or uncut timber, after being declared surplus by the using agency and the permit required by Chapter 304 having been obtained, may be made by the Chief of Procurement according to the following: (a) If the estimated value is $5,000 or more, to the highest bidder meeting or exceeding specifications after publication in a local newspaper of general circulation or via such other advertisement or notice method as permitted by law (e.g., a publicly accessible website). (b) If there are no acceptable bids received pursuant to subsection (a) or if the estimated value is less than $5,000, to the highest bidder after solicitation of written quotations by informal procedures. (c) If there are no acceptable bids received pursuant to subsection (b), to the contractor who agrees by negotiation with the Chief of Procurement to the best possible price or prices. A contract awarded or negotiated by the Chief of Procurement, as the case may be, shall be limited to one year in duration, shall contain adequate protection against waste, damage or destruction of public property and shall provide only such license for right of entry to the property and prosecution of the work on the property as may be absolutely necessary to accomplish the disposal. Jacksonville Ordinance Code § 122.815 Surplus food products.

Sec. 122.815. - Surplus food products. When, in the opinion of the Sheriff, meat and vegetable products produced at the Jacksonville Correctional Institution are in excess of the amount necessary to meet the needs of the City, he may declare the excess food products to be surplus property of the City. The Sheriff may establish such procedures and requirements as he deems necessary and proper for the distribution of food surplus products produced by the Jacksonville Correctional Institution; provided, that distribution shall be limited to those organizations which receive cash contributions from the City. Jacksonville Ordinance Code § 122.816 Donation, destruction or abandonment of valueless tangible personal property.

Sec. 122.816. - Donation, destruction or abandonment of valueless tangible personal property. If tangible personal property no longer used or needed by the City is without commercial value, it may be donated, destroyed or abandoned pursuant to this Section. The Chief of Procurement shall certify that the property is valueless and: (a) With respect to property that may still have a use, shall offer the property for donation to public or private institutions that may request its donation and for which property the institutions can show a need. The Chief of Procurement shall transmit to the Awards Committee the names of not less than three institutions that have expressed a desire to have the property donated to them, and the Awards Committee shall select one of the institutions to which the property is to be donated. Upon approval by the Mayor, the property shall be transferred to the institution, and the Mayor and Corporation Secretary shall execute the necessary instruments to transfer the City's interest. If less than two institutions respond to the offer, the Chief of Procurement shall submit the names of responding institutions to the Awards Committee. The Awards Committee may decline to select an institution but authorize the Chief of Procurement to destroy or abandon the property. Action taken under this subsection shall be noted in the property records maintained by the Accounting Division. (b) If the property has no remaining use or if it is authorized for destruction or abandonment as provided in subsection (a) of this Section, the Chief of Procurement shall cause the property to be destroyed in a safe, lawful manner or shall abandon the property by disposal in a safe, lawful manner. The fact of destruction or abandonment shall be noted in the property records maintained by the Accounting Division. (Ord. 83-591-400, § 1; Ord. 85-1327-691, § 1)

Jacksonville Ordinance Code § 122.817 Weapons and firearms in custody of Sheriff.

Sec. 122.817. - Weapons and firearms in custody of Sheriff. (a) Weapons and firearms in the custody of the Sheriff as a result of arrests, abandonment or otherwise obtained shall, if not required as evidence in court and not reclaimed by the lawful owner thereof within six months from the date they came into the custody of the Sheriff's Office, become forfeited to the City. (b) A weapon suitable for use by the Sheriff may be used by him. A weapon or firearm which is not needed by his Office or which is useless or unfit for use shall be destroyed by him. A weapon which, in the opinion of the Sheriff, is considered to be designed principally for sporting purposes shall not be destroyed but shall be disposed of by public auction to the highest bidder. Proceeds from these sales shall be remitted to the General Fund-General Services District. (c) A report of firearms and weapons destroyed shall be made and kept by the Sheriff. The report shall contain the make, model, serial number and other complete description of each weapon, together with the date and method of destruction. (Ord. 83-591-400, § 1)

Jacksonville Ordinance Code § 122.818 Recovery of value of tangible personal property for which accountable officer is liable; custodians.

Sec. 122.818. - Recovery of value of tangible personal property for which accountable officer is liable; custodians. An accountable officer will be liable to the City for the value of tangible personal property for which he is responsible when: (a) The property is lost, stolen, missing, damaged or destroyed and the accountable officer, or a custodian designated by him, failed to use due care or exercise adequate supervision or was negligent in the safeguarding of the property, so that the property was put at unnecessary risk. (b) He, or a custodian designated by him, unlawfully converted, stole, embezzled or otherwise deprived the City of its rightful ownership and use of the property. (c) A comparison between an inventory of the property and the property records reveals a discrepancy in the amount or existence of the property and the accountable officer cannot satisfactorily reconcile the discrepancy. The City Comptroller shall certify the value for which the accountable officer is responsible. Upon approval of the amount by the Director of Finance and Administration, the Accounting Division shall charge the accountable officer for the approved amount. If the accountable officer fails or refuses to pay the certified amount to the City within the time set by the Director of Finance and Administration, it may be recovered in a civil action by the City. In proper instances, a custodian may be charged with the value of property under the same conditions as an accountable officer and, in these cases, the liability of the accountable officer and custodian shall be joint and several. Jacksonville Ordinance Code § 122.819 Alternative methods of recovery.

Sec. 122.819. - Alternative methods of recovery. In lieu of a civil action against an accountable officer or custodian charged under Section 122.810 with the value of tangible personal property, the amount which he is charged shall, if agreed to by the accountable officer or custodian, constitute an offset by the City against future salary or wage payments to the accountable officer or custodian and the Director of Finance and Administration shall place a deduction against the future salary or wage payments to the accountable officer or custodian to recover the amount charged to him; provided, that: (a) Without the written consent of the accountable officer or custodian, the Director of Finance and Administration shall not deduct from any one salary or wage payment: (1) In the case of an accountable officer or custodian whose annual gross compensation is $10,000 or less, more than 20 percent of his net pay after all other authorized deductions and withholdings. (2) In the case of an accountable officer or custodian whose annual gross compensation is more than $10,000, more than 33⅓ percent of his net pay after all other authorized deductions and withholdings. (b) The Director of Finance and Administration is authorized, in lieu of a deduction against future salary or wage payments, to accept payment in full of the certified amount. (c) If the accountable officer or custodian resigns or is discharged from the City's employ, the Director of Finance and Administration shall offset the unpaid portion of the certified amount against moneys due to the accountable officer or custodian as a result of his resignation or discharge, except moneys due from any pension fund of the City, and if, after the offset: (1) Any portion of the certified amount remains unpaid, the Director of Finance and Administration shall render a bill to the accountable officer or custodian for the unpaid portion. (2) The amount of the certified amount has been repaid in full and moneys remain due to the accountable officer or custodian, the Director of Finance and Administration shall pay the person the moneys remaining due. Jacksonville Ordinance Code § 122.820 Disposition of goal post utilized during the Florida/Georgia football game and Gator Bowl football game.

Sec. 122.820. - Disposition of goal post utilized during the Florida/Georgia football game and Gator Bowl football game. Notwithstanding any provision to the contrary as may be contained in this Part or in the Ordinance Code, the school of the winning team at each annual Florida/Georgia football game and Gator Bowl football game played in the Gator Bowl shall be entitled to dispose of, at its discretion, the goal post located at the end of the field designated as that school's goal, and for the purpose of such disposition, that goal post is hereby declared surplus and of no value or need to the City. Such disposition shall be conducted in an orderly, lawful manner and the removal of the goal post shall be supervised by the City. (Ord. 86-83-276, § 2)

Jacksonville Ordinance Code § 122.821 Disposal of surplus vehicles and fleet equipment.

Sec. 122.821. - Disposal of surplus vehicles and fleet equipment. (a) Disposal procedures. In addition to the standard surplus disposal method provided in Section 122.811, Ordinance Code, the Chief of Procurement is authorized to dispose of surplus vehicles and fleet equipment that are in operable and repairable condition but are no longer needed by the City. The Chief of Procurement may dispose of such surplus vehicles and fleet equipment without the necessity of a public sale auction in accordance with the following procedures: (1) The Chief of Procurement shall establish a minimum price for the sale of each surplus vehicle, with the advice of the Chief of Fleet Management, based on the Kelly Blue Book wholesale trade-in price for the same or similar vehicles in the same or similar condition. (2) In the absence of Kelly Blue Book price for the vehicles or fleet equipment, the Chief of Fleet Management and the Chief Purchasing Officer shall set a price for the vehicles or fleet equipment based on industry standard and practice for the same or similar vehicles or fleet equipment. In no event shall the minimum price be less than the average wholesale trade-in price for comparable vehicles or fleet equipment in the same similar condition. (3) With the prior approval of the Chief of Procurement, the Chief of Fleet Management may decide not to offer, any surplus vehicle for sale to the general public or another governmental organization if the vehicle may be used as a trade-in toward the purchase of new City vehicles. (4) If the Chief of Procurement is unable to dispose of any surplus vehicle pursuant to this Section 122.821, the vehicle may be sold at public auction in accordance with the procedure set forth in Section 122.811, Ordinance Code. The motor pool may set a minimum price on any surplus vehicle offered for sale at public auction pursuant to Section 122.811. (Ord. 2002-1296-E, § 2)

Jacksonville Ordinance Code § 122.822 Penalty.

Sec. 122.822. - Penalty. An accountable officer or custodian who violates a provision of this Part shall be guilty of a class C offense. Upon conviction, the accountable officer shall be relieved of his accountability for tangible personal property in his unit of government (which accountability shall be assigned to another accountable officer).
