§ 40-28. - Operation of plan on year-to-year basis. Nothing in this division shall be construed as contracting to pay extra benefits or any sum whatever beyond the present fiscal year without the plan being readopted in subsequent fiscal years, nor shall this division bind or obligate funds not appropriated nor give any Employee a right of action for Compensation until such Employee has actually rendered the service; and provided, further, that the inclusion of funds in the City's annual budget, and appropriations sufficient to implement the provisions hereof, shall be construed as a re-adoption of this division for the year for which such appropriation is made.
