3333.37 - Ownership. A town house development shall be in common ownership or control during development as well as at the time approval is sought for the subdivision plat. Any transfer of land within the development resulting in ownership by two or more parties after an application has been filed shall not alter the applicability of the regulations of this chapter to the project or any lot within it. A homeowners' association shall be established and shall own all common areas. (Ord. 1506-86.)
