Jacksonville Ordinance Code § 106.401 Employee authorizations.

Sec. 106.401. - Employee authorizations. The authorized number of employees set forth in the budget ordinance for each subfund, in the general government, and for each independent agency is a maximum authorization, and employees may not be employed within any subfund or independent agency, as appropriate, at any one time in excess of the maximum authorization for that subfund or independent agency, as appropriate. Increases in the authorized number of employees shall require the approval of the Council. The Mayor, for the general government, or the governing body or other designated official, for an independent agency, may allocate and reallocate the authorized number of employees as may be necessary for the efficient administration of the agency or agencies involved; provided, that the Mayor may not allocate any authorized position in one subfund to any other subfund. Nothing in this Section shall prevent the Council from further regulating employee authorizations in the budget ordinance. (Ord. 77-691-638, § 2; Ord. 83-591-400, § 1; Ord. 2017-2-E, § 2)

Jacksonville Ordinance Code § 106.402 Elimination of employee positions.

Sec. 106.402. - Elimination of employee positions. Whenever, for better budgetary control, the Council determines in the budget ordinance that certain positions should be eliminated from the total number of authorized employees, the positions so enumerated or described in the budget ordinance shall become vacant when the persons then employed in those positions cease to be employed by the City, and shall be eliminated as authorized positions. The maximum number of authorized positions for the major fund in which a vacant and eliminated position was located shall be reduced by one, and the Mayor may not allocate or allot any other position to take the place of the eliminated position. Jacksonville Ordinance Code § 106.403 Overtime.

Sec. 106.403. - Overtime. (a) Because of the potential abuse that may be made of overtime salaries and wages, the Council hereby declares it to be the policy of the City that overtime shall be closely controlled and monitored and shall not be permitted unless it is necessary to perform the functions of the government that cannot be accomplished during the usual working day. Except for emergencies, all overtime shall be scheduled in advance of the time it is to be performed, and the approval of the department head or his designee shall be obtained before any employee is authorized to work scheduled overtime. In the case of an emergency, advance approval by the department head or his designee is not required, but the department head or his designee shall be notified as quickly as possible after the emergency begins of the reason for and the amount of overtime involved. Upon notification, the department head or his designee shall schedule and approve necessary overtime for handling the remainder of the emergency. (b) Employees of agencies covered by the Fair Labor Standards Act must have their right to overtime reviewed by their respective agency in accordance with the provisions of that act. Employees exempted from coverage under the Fair Labor Standards Act shall be subject to the provisions of this Section. (c) Civil Service managerial employees, as defined by the Personnel Manager pursuant to F.S. § 447.203(4), shall not receive a cash payment for overtime. Compensation for overtime for these employees shall be in the form of compensatory time at the rate of one hour of compensatory time for each hour of overtime worked. (d) Confidential employees, as defined by the Director of Employee Services Department pursuant to F.S. § 447.203(5), shall be entitled to earn compensation for overtime at the rate of one and one-half hours for each hour of overtime worked. Compensation shall be paid in the form of a cash payment unless compensatory time is mutually agreeable between the employee and the department head. (e) Employees in the classification of Fire Chief shall be entitled to receive a cash payment for overtime at the rate of one hour of pay for each hour of overtime worked, but not compensatory time. (f) Whenever a collective bargaining agreement approved by the Council and in force and effect provides for overtime compensation to employees in the bargaining unit covered by the agreement, the terms of the agreement relative to such compensation shall prevail over the provisions of this Section with respect to those employees. (g) The terms of the Grant Employee Salary and Employment Plan relative to overtime compensation shall prevail over the provisions of this Section with respect to grant employees. (h) Temporary employees or part-time employees may be paid overtime at the regular straight time rate or at the rate of one and one-half hours for each hour of overtime worked at the discretion of the department head. These employees shall not be entitled to receive compensatory time for payment of overtime. (i) The provisions of this Section shall not apply to special purpose contract employees, whose rights to overtime compensation, if any, shall be contained in a Special Purpose Employee Administration Plan or in the special purpose employee contracts; provided, however, such rights shall not exceed those granted to other employees of the City in this Section. (j) Any employee of the City other than those listed in subsections (c) through (i) of this Section may receive compensation for overtime in the form of compensatory time at the rate of one hour of compensatory time for each hour of overtime worked. Jacksonville Ordinance Code § 106.404 Temporary employees.

Sec. 106.404. - Temporary employees. Temporary employees shall be hired by the City and by the independent agencies on the basis of temporary employee hours and not by employee positions. No temporary employee may be hired into a permanent employee position, although this prohibition shall not prevent the Council from authorizing the conversion of a permanent employee position into temporary employee hours. For the general government, the maximum number of temporary employee hours that will be available for use within each subfund during a fiscal year shall be established in the budget ordinance, as it may from time to time be amended, and may be allocated and reallocated by the Mayor within each subfund as necessary. For the independent agencies, the maximum number of temporary employee hours that will be available for use during a fiscal year shall be established in the budget ordinance, as it may from time to time be amended. Nothing in this Section shall prevent the Council from further regulating temporary employees in the budget ordinance. (Ord. 77-691-638, § 2; Ord. 83-591-400, § 1; Ord. 2017-2-E, § 2)

Jacksonville Ordinance Code § 106.405 Limitation of full-time positions.

Sec. 106.405. - Limitation of full-time positions. No person employed by the City or by an independent agency may fill more than a total of one full-time position, nor receive compensation simultaneously from more than one appropriation or from more than one City or independent agency unless approved by the Director of Employee Services Department. No person may receive compensation in excess of the amount fixed by law, collective bargaining agreement or pay plan for the position or class of positions to which the position filled by that person is classified. No more than one full-time officer or employee may be employed in each authorized position, except that, with respect to officials appointed by the Mayor or by the Sheriff and confirmed by the Council, if the incumbent of the position is leaving the employ of the City and remains on the payroll solely in order to use available leave (including the retirement leave account) accrued under a plan previously adopted by the Council or contained in an effective collective bargaining agreement: (a) The position shall be considered to have been vacated on the day on which the appointed official who is leaving the employ of the City begins using his available leave and the appointing authority may appoint a successor on that day or at any time thereafter, in accordance with Section 20.103 or Section 37.114, as the case may be. (b) When a successor is confirmed by the Council, his predecessor being still employed by the City under this provision, he shall be exclusively entitled to assume and exercise all the powers and duties of the office prescribed by law, unless otherwise directed by the Mayor. (c) For as long as an appointed official is carried on the payroll under the terms of this provision, both the incumbent appointed official and his successor may each be employed in the position as full-time employees. (d) Payment of persons appointed to positions as provided in this provision shall be from funds available to the department concerned or the Office of the Sheriff, as the case may be. Jacksonville Ordinance Code § 106.406 Preservation of status quo upon pay grade changing.

Sec. 106.406. - Preservation of status quo upon pay grade changing. Anything in this Part to the contrary notwithstanding, when a pay grade range for a job classification is changed as a result of a collective bargaining agreement approved by City Council, or an approved change to the City-wide compensation and classification plan which affects employees not covered by collective bargaining agreements, the base salaries of affected employees whose base salaries are above the maximum of the new pay grade range shall not be reduced to the new pay grade range maximums.
