Reemployment of a Retired Participant.
Oklahoma City Municipal Code § 40-83
in effect§ 40-83. - Reemployment of a Retired Participant.
(a) Rehired within 90 Days of Termination of Employment. If a retired Participant is rehired as an employee in any capacity of the City within 90 days of his/her Termination of Employment, he/she shall repay any benefit payments (including any partial lump sum) he/she received upon Termination of Employment, plus interest, computed at the interest rate set forth in Section 40-51(1). The Retirement Benefit payable from the System to any retired Participant shall cease as of the first date of reemployment, if such Retired Participant is rehired as an employee of the City in any capacity. Such Participant shall not be treated as having incurred a Termination of Employment for purposes of consecutive years of service or Consecutive Years of Vesting Service, but no service or compensation should be earned for such period of absence.
(b) Rehired After 90 Days of Termination of Employment. If a retired Participant is rehired as an Employee of the City after 90 days of his/her Termination of Employment, the Retirement Benefits payable from the System to such retired Participant shall be suspended as of the first date of reemployment, Such rehired retired Participant shall be entitled to a prorata portion of the monthly benefit for the month of re-employment which shall reflect the portion of such month that the Participant was retired. The suspended Retirement Benefit shall be subject to the cost of living adjustments under Section 40-79 during the period of reemployment and the suspended Retirement Benefit shall resume as of the first day following the Participant's subsequent Termination of Employment subject to the provisions of Subsection (e) hereof.
(c) Contributions Resume. Upon the reemployment of a retired Participant as an Employee, he/she shall be required to make Employee Contributions.
(d) Benefit Accrued During Reemployment. If the rehired retired Participant is either (1) employed by the City beyond his/her Normal Retirement Age or (2) earns five (5) or more Consecutive Years of Vesting Service during the period of reemployment, the Participant shall accrue an additional Retirement Benefit to be paid on the Participant's subsequent Termination of Employment, subject to the provisions of Subsection (e) hereof. The additional Retirement Benefit shall be determined on the Credited Service and Compensation earned during the period of reemployment and the System's formula for computing the Retirement Benefit in effect at the time of the Participant's subsequent Termination of Employment. If the rehired retired Participant does not meet the requirements for benefit accrual described above, upon the Participant's subsequent Termination of Employment, such Participant shall only be entitled to receive a refund of his/her Employee Contribution Account attributable to the period of re-employment.
(e) Application. A retired Participant who is reemployed as an Employee must file a completed application to retire in accordance with Section 40-51(29), before payment of Retirement Benefits may recommence. The retired Participant's first application shall govern the payment of his/her suspended Retirement Benefit and the second application shall govern payment of his/her additional Retirement Benefit accrued during reemployment or for a refund of his/her Employee Contribution Account attributable to the period of reemployment.
(f) Death. In the event a reemployed retired Participant dies while reemployed:
(1) the portion of the Participant's Retirement Benefits attributable to the Participant's preceding Termination of Employment shall be payable in accordance with any form of benefit in effect at such time, or if none, in accordance with Section 40-71; and
(2) the portion of the Participant's Retirement Benefits attributable to the Participant's subsequent period of employment shall be payable in accordance with Section 40-73.
