Austin City Code § 14-2-31 LICENSE AND FEE REQUIREMENTS.

§ 14-2-31 - LICENSE AND FEE REQUIREMENTS. (A) A person may not display, offer for sale, or sell any merchandise in the People's Renaissance Market without a license. (B) Except as provided in Section 14-2-32 (Exception from License Fee), a licensee must pay the license fee established by ordinance before the licensee claims use of or occupies a vendor's space in a public market. Austin City Code § 14-2-32 EXEMPTION FROM LICENSE FEE.

§ 14-2-32 - EXEMPTION FROM LICENSE FEE. A person 60 years old or older, 17 years old or younger, or physically handicapped is exempt from the license fee established in Section 14-2-31 (License and Fee Requirements), if the person provides the director with proof of age or certification of disability. Austin City Code § 14-2-33 VENDOR LICENSE REQUIRED.

Austin City Code § 14-2-34 APPLICATION REQUIRED.

§ 14-2-34 - APPLICATION REQUIRED. (A) A person seeking a license to sell merchandise in the People's Renaissance Market must: (1) file an application with the director; and (2) except as provided in Section 14-2-32 (Exemption from License Fee), pay the fee established by ordinance. (B) An application submitted by a person 17 years old or younger must be signed by the person's parent or guardian. Austin City Code § 14-2-35 APPLICATION REQUIREMENTS.

§ 14-2-35 - APPLICATION REQUIREMENTS. (A) An application under this chapter shall included: (1) the applicant's name, including any business or assumed name, mailing address, phone number, and social security number; (2) a state sales tax permit number, if applicable, or exemption certificate; (3) a description of the merchandise the applicant intends to sell; (4) a statement that the applicant has created or produced all merchandise that the applicant intends to offer for sale at the People's Renaissance Market; and (5) a statement that, within seven days of receipt of a request from the director or director's designee, the applicant agrees to create an example of the applicant's art or craft before the director or his designee. (B) Two applicants may file a joint application if both applicants: (1) are engaged in a joint business venture; and (2) complete the application form and provide the information required by Subsection (A) for both applicants. Austin City Code § 14-2-36 LICENSE TERM AND RENEWAL.

§ 14-2-36 - LICENSE TERM AND RENEWAL. (A) A license issued under this chapter is valid for one year from the date of issuance. (B) A person must obtain a license annually. (C) The director or director's designee may automatically renew a person's license if the person has held a license for two consecutive years immediately preceding the renewal application, and has not been found to have violated the terms of the license. Austin City Code § 14-2-37 LICENSE FORM.

§ 14-2-37 - LICENSE FORM. Austin City Code § 14-2-38 DISPLAY AND INSPECTION.

§ 14-2-38 - DISPLAY AND INSPECTION. (A) A licensee shall display the license issued under this chapter at a vendor space during operation of the market. (B) An employee of the City or another governmental entity may inspect a license during operation of a public market. Austin City Code § 14-2-39 LICENSE ISSUANCE.

§ 14-2-39 - LICENSE ISSUANCE. (A) The director shall issue a license approved by the director or his designee under this article. (B) A license issued for the People's Renaissance Market shall include a list of the merchandise authorized to be sold under the license. § 14-2-40 - RESTRICTIONS ON ISSUANCE. The director shall not approve a license unless the director or his designee determines that the applicant's art or craft complies with this article. Austin City Code § 14-2-41 LICENSE REVOCATION.

§ 14-2-41 - LICENSE REVOCATION. (A) The director may revoke or suspend a license issued under this chapter for good cause, a violation of this chapter, or a public offense or violation by the licensee relating to the sale of merchandise at the People's Renaissance Market. (B) A person whose license has been revoked may not apply for a new license for one year from the date of revocation, unless the revocation is overturned on appeal.
