Oklahoma City Municipal Code § 40-74
in effect§ 40-74. - Death or Retirement Benefits prior to March 1, 1967.
(a) In the event of the death of an Employee who died or retired prior to March 1, 1967, the spouse of such deceased Employee shall be paid an amount not to exceed 100 percent of said retirement pay if the spouse can qualify under any one of the following events or provisions:
(1) in the event of the death of any Employee who has been awarded retirement pay prior to March 1, 1967.
(2) if the Employee was killed in the line of duty regardless of the time of service with the City, prior to March 1, 1967.
(3) if the Employee had not been awarded retirement pay but was eligible therefor on March 1, 1967.
(4) if the Employee was not eligible for retirement pay but had served 15 years or more in the service of the City and died from causes not arising in the line of duty, prior to March 1, 1967.
(b) Retirement pay for a spouse is defined as the amount of retirement income to which the Employee was or would have been entitled, had he/she been eligible for retirement, at the time of his/her death; provided, however, that in the event the Employee suffered death from injuries arising out of and incurred in the course of his/her employment with the City prior to March 1, 1967, his/her spouse shall receive Retirement Benefits, regardless of period of service by an Employee, of 40 percent of the Average Final Compensation for a period of 60 months and thereafter 75 percent of 40 percent or 30 percent of the Average Final Compensation for an additional 48 months, and 50 percent of 40 percent or 20 percent of the Average Final Compensation thereafter.
(c) In the event of the death of the spouse, Retirement Benefits shall cease and the monthly payments, not to exceed 100 percent of said Retirement Benefits, shall be divided equally among the minor children, if any there be, of the deceased Employee. Said payments shall continue until the children shall have married or attained 18 years of age. The benefits of an unmarried child who is either physically or mentally disabled shall not cease when the child attains 18 years of age, but shall continue so long as the Disability remains. Children adopted by an Employee after his/her retirement are not entitled to Retirement Benefits.
(d) In order to qualify for the benefits provided herein, the spouse of an Employee must have been married to the Employee on the date he/she retired and have been married to and continuously lived with the Employee for the five years immediately preceding the Employee's death.
(e) This section shall not be construed to limit the Employee's benefits during his/her lifetime.
