Sec. 12-12-4. - Worker's bond—Breach of conditions. Upon the failure to abide by the terms and conditions of the bond required by section 12-12-2, the person engaged in such business shall pay to the city such sum as is necessary to repay any injuries done by the nonobservance of the bond and shall immediately place the work in such condition as shall be directed and approved by the city engineer. The city attorney shall, in case of a failure to comply with this section, at once institute proceedings against the principal and surety upon the bond. (Code 1967, § 36-23; Code 1985, § 34-34)
