Memphis Code of Ordinances § 2-86-1 Establishment, designation and membership.

Sec. 2-86-1. - Establishment, designation and membership. There is established a commission designated and known as the commission on alcohol and drug abuse, such commission to consist of 11 members. The members of the commission shall be appointed: two members by the mayor of the city and two members by the mayor of the county; four jointly by the city and county mayors as representatives of and on recommendation by the president of the United Way, the state commission of human services, the commission of education and the state commissioner of mental health; and three citizen members jointly by the mayors of the city and county, all subject to approval of the city council and the county board of commissioners. Memphis Code of Ordinances § 2-86-2 Members' terms of office.

Sec. 2-86-2. - Members' terms of office. The members, after the initial members, shall serve for a period of three years. All members shall be eligible for reappointment. Sec. 2-86-3. - Compensation of members; organization, election of officers, and adoption of rules and procedures. All members of the commission shall serve without pay and shall organize, elect officers, and adopt such rules and procedures, consistent with the laws of the city and county, and the provisions of this chapter, as are necessary for the conduct of its affairs and performance of its functions and responsibility. Memphis Code of Ordinances § 2-86-4 Purpose; legislative intent.

Sec. 2-86-4. - Purpose; legislative intent. The purposes of the commission shall be: A. To determine and prioritize needs and make recommendations based thereon for the support of such services addressing the problem of alcohol and drug abuse within the city and county; B. To present, yearly, recommendations to the mayors of the city and the county, the president of the United Way, the state department of human services, the state department of mental health and mental retardation, the state commissioner of education, and the health systems agency for a comprehensive plan of services to address the problem of alcohol and drug abuse; C. To serve as the coordinating body for the delivery of services among all programs offering alcohol and drug abuse remedial and preventative services and to encourage formal evaluation of all such programs; D. To increase the awareness of schools, government, industry, and union organizations regarding the effects of alcohol and drug abuse on job performance and work with aforesaid groups to develop policies to promote early detection, understanding, and recognition in order to deal effectively with alcohol and drug abuse problems; E. To advocate, through its funding sources in the legislative process, action and programs to address the problems associated with alcohol and drug abuse. It is the intention of this chapter to encourage the commitment of all local funding sources within the community to recognize the commission as an official source for federal, state and local planning and as an official planning, review and comment body for alcohol and drug abuse service program proposals and the funding for each of them. Memphis Code of Ordinances § 2-86-5 Authority to make application for receipt of funds.

Sec. 2-86-5. - Authority to make application for receipt of funds. It is not the intent of this chapter to establish a commission to operate an alcohol and drug abuse program but rather to serve as a planning, coordinating, review and recommending body to funding sources. However, insofar as such functions and duties may require funds for administration, it shall be authorized, subject to approval by the city council and the county board commissioners, to apply for and accept from federal, state, other governmental units or other sources, funds which may be offered or tendered to the commission for use in carrying out its various functions and programs. Memphis Code of Ordinances § 2-86-6 Authority to appoint committees, subcommittees and advisory board.

Sec. 2-86-6. - Authority to appoint committees, subcommittees and advisory board. The commission is authorized to establish such committees and subcommittees as it may consider necessary to its operation in conducting inquiries, studies and research into all areas relating to the problem of alcohol and drug abuse. Such committees may include persons who are not members of such commission. The commission is further authorized in its discretion to establish an advisory board of not more than 21 members, to include representatives of the health systems agency, educational and training agencies and institutions, community-based organizations, participant community, business, organized labor and others who have an interest in and concern regarding the use of alcohol and drugs. Memphis Code of Ordinances § 2-86-7 Assistance by other agencies.

Sec. 2-86-7. - Assistance by other agencies. The commission shall have access to the services of other agencies in the city and county for any reasonable assistance in the operation and function of the commission. Memphis Code of Ordinances § 2-86-8 Administration; funding.

Sec. 2-86-8. - Administration; funding. The activities of the commission shall be administered by the county, and it shall be the duty of the commission to prepare and submit to the mayor of the city and the mayor of the county, for their approval, a proposed budget for the commission for the ensuing fiscal year. Memphis Code of Ordinances § 2-86-9 Conflicts of interest.

Sec. 2-86-9. - Conflicts of interest. In no case shall voting citizen members have an interest, directly or indirectly, in any program receiving funds from those agencies who are participating in the administration of this chapter.
