Construction of chapter regarding donation of food Nothing in this chapter shall be construed to prohibit or regulate the donation of safe and apparently wholesome food by a retail food establishment, a nonprofit or religious organization that is recognized as tax exempt under Section 501(c)(3) of the Internal Revenue Code, or a home-based processor in accordance with KRS 217.127.
