Sec. 7-71. - Revocation of a license.
(a) Grounds for revocation. A license issued under this article may be revoked pursuant to the procedures set forth in section 7-7 of this Code if the director determines that:
(1) The licensee or the licensee's place of business has not been in compliance with the requirements of any provision of Chapter 1956 of the Texas Occupations Code, this article or any applicable rules or regulations since the license was issued;
(2) The licensee obtained a license by means of fraud, misrepresentation, or concealment of a fact or that the licensee falsified his original application for a license;
(3) Any fact or circumstance exists that would be a basis for denial of an application for issuance or renewal of a license, or the license was otherwise obtained or issued in error; or
(4) Any person listed on the licensee's original application has since the license was issued been convicted of any applicable offenses specified in section 1-10 of this Code.
(b) Suspension or revocation of state-issued certificate of registration. When a metal recycler's state-issued certificate of registration is suspended or revoked, the metal recycler shall immediately limit its operations by excluding all public transactions involving the purchase of regulated material for the duration of the suspension or revocation. Notwithstanding the provisions of section 7-62 of this article, a metal recycler shall notify the director within three days of a suspension or revocation of his state-issued certificate of registration. A metal recycler may resume engaging in public transactions involving the purchase of regulated material once its state-issued certificate of registration has been reinstated.
