El Paso City Code § 12.16.010 Required—Driver of vehicles involved.

12.16.010 - Required—Driver of vehicles involved. The drivers of vehicles involved in an accident resulting in injury or death to any person, or damage to property to an apparent extent of one thousand dollars or more shall immediately report such accident to the police department and shall remain on the scene of such accident until the arrival of police. (Ord. 14931 § 1, 2001: Ord. 10197 § 1, 1990: prior code § 20-19)

El Paso City Code § 12.16.020 Required—Defense to prosecution.

12.16.020 - Required—Defense to prosecution. It shall be a defense to prosecution under this chapter that the person: A. Was physically incapable of making a required accident report; B. Complied with all applicable requirements of Chapter 550, Texas Transportation Code, but left the scene of the accident prior to the arrival of a police officer in order to obtain medical care for himself or herself or an occupant of his or her vehicle; or C. Made the required accident report and complied with all applicable requirements of Chapter 550, Texas Transportation Code, but left the scene of the accident prior to the arrival of a police officer after waiting thirty minutes at the scene after reporting the accident and no officer arrived at the scene within that time. El Paso City Code § 12.16.030 Confidentiality.

12.16.030 - Confidentiality. All required accident reports and supplementary reports shall be without prejudice to the individual so reporting and shall be for the confidential use of the police department or other governmental agencies having use for the records for accident prevention purposes, except that the police department may disclose the identity of a person involved in an accident when such identity is not otherwise known or when such person denies his presence at such accident.
