Memphis Code of Ordinances § 2-26-1 Created and established.

Sec. 2-26-1. - Created and established. A. There is created and established a division of park services, which shall henceforth have complete and full control and management over all parks, playgrounds, recreational areas or centers, park or recreational facilities, parkways, boulevards, devices, concessions or any properties, projects, budgets or operations now or at any time devoted to or designated for use or used for park purposes or as part of the park system within the city. B. The Memphis Park Commission's jurisdiction and control over all parks, playgrounds, recreational areas or centers, park or recreational facilities, parkways, boulevards, devices, concessions or any properties, projects, budgets or operations now devoted to or designated for use or used for park purposes or as part of the park system is rescinded and such jurisdiction, control and authority shall be transferred to and shall be vested in the division of park services. All existing properties, budgets, personnel and operations are transferred from the former Memphis Park Commission to the division of park services as of the effective date of Ordinance No. 4763. C. The management and operations of the division of park services shall be under the supervision of a director of such division, who shall be appointed and removed in the same manner as other division directors of the city. The director of the division of park services shall report to, take direction from, and be responsible to the mayor for the efficient, economical and professional administration of the division of park services. D. Notwithstanding anything in this chapter to the contrary; however, no land, building, or facility under the jurisdiction of the mayor and/or division of park services shall be demolished, sold, given to, dropped from funding, closed to services or leased to any non-municipal entity (excluding routine short-term rentals of two years or less) without prior authorization of the city council, nor shall the mayor enter into a use of facility agreement, partnership agreement or operating agreement regarding any such land, building or facility under the jurisdiction of the mayor without prior authorization of the city council. Memphis Code of Ordinances § 2-26-2 Improvement of parks and other facilities.

Sec. 2-26-2. - Improvement of parks and other facilities. It shall be the duty of the division of parks to improve, maintain, operate and beautify all parks, properties and facilities. (Code 1985, § 23-2; Ord. No. 4763, 4-25-2000)

Memphis Code of Ordinances § 2-26-3 Acquisition of park lands.

Sec. 2-26-3. - Acquisition of park lands. A. It shall be the duty of the mayor of Memphis to acquire, in the name of the city, such suitable tracts of land within the city as are best adapted for public parks or recreational areas where the people may go for recreation and pleasure. Such land may be acquired by negotiation or condemnation. B. The city council shall take all necessary actions required for the issuance of bonds to acquire such suitable tracts of land pursuant to subsection A of this section. The city council shall also annually adopt all resolutions and ordinances required to fund the interest on such bonds and to provide sufficient and reasonable funding to improve, maintain and operate all such parks, properties and facilities. C. In the event any parks, properties or facilities under the control and jurisdiction of the division of park services are sold, taken through proceedings in eminent domain or otherwise diverted from the use as park land, the city shall be paid a fair market value for the properties or facilities, together with such incidental damages as are allowed by law, and such funds shall be used for the purchase of additional park lands and for no other purpose. Memphis Code of Ordinances § 2-26-4 Establishment of control of parkways and boulevards.

Sec. 2-26-4. - Establishment of control of parkways and boulevards. A. The division of parks is authorized to obtain, establish and construct a system of parkways or boulevards within the city and to have full and complete control over such parkways and boulevards. B. The mayor of Memphis shall have the power to purchase, by private negotiation or acquire by condemnation, the necessary lands and property for the establishment and construction of such parkways and boulevards.
