Oklahoma City Municipal Code § 51-61 Permit required.

§ 51-61. - Permit required. No person shall operate or maintain a public bathing place unless he has obtained a permit to operate a public bathing place from the Director. Only persons who comply with the provisions of this Code shall be entitled to receive and retain such a permit. Such permit shall be posted in a conspicuous place within the confines of the public bathing place. (Code 1980, § 51-31.1; Ord. No. 19756, § 4, 5-19-92)

Oklahoma City Municipal Code § 51-62 Procedure for obtaining permit.

§ 51-62. - Procedure for obtaining permit. (a) Any person desiring to operate a public bathing place shall make written application on forms provided by the Director for a permit and shall pay a fee as established in Chapter 60, the General Schedule of Fees. (b) Upon receipt of such an application and fee, the Director shall make an inspection of the facility to determine compliance with the provisions of this Code. (c) When the inspection reveals that the criteria set forth in Section 51-63 have been met, a permit shall be issued to the applicant by the Director. (d) The Director, for good cause shown, may waive the permit fee required herein for any governmental agency supported in whole or in part by public funds, but such agencies are not exempt from qualifying for and obtaining a permit as required by this Code. (e) Renewal applications shall be made on or before July 1 each year. (Code 1980, § 51-32.1; Ord. No. 19756, § 4, 5-19-92)

Oklahoma City Municipal Code § 51-63 Criteria for issuance of permit.

§ 51-63. - Criteria for issuance of permit. (a) No permit shall be issued pursuant to this chapter unless the following criteria have been met: (1) a score of 90 or greater on the inspection. (2) no critical violations present. (3) no imminent health hazards present. (b) Critical violations shall include: (1) improper fence. (2) no lifeguard present, no CPR/first aid certification, no lifeguard sign. (3) absence of lifesaving equipment. (4) absence of depth markers/stair stripes; improper size of depth markers/stair stripes. (5) improper outlet (main drain). (6) improper diving board. (7) improper pump and filter. (8) improper flow rate or flow meter. (9) improper disinfectant/pH controls. (10) no cross connections, approved backwash discharge. (11) temperature of spa not over 105 degrees Fahrenheit. (12) any condition, act or omission endangering health or safety. (c) Imminent health hazards shall include: (1) turbidity: Main drain must be clearly visible. (2) free available chlorine less than 1.0 ppm, bromine less than 2.0 ppm. (3) pH less than 7.2 or greater than 7.8. (Code 1980, § 51-33.1; Ord. No. 19756, § 4, 5-19-92)

Oklahoma City Municipal Code § 51-64 Duration and nontransferability of permits.

§ 51-64. - Duration and nontransferability of permits. The permit to operate a public bathing place shall not be transferable to other persons or other locations. All permits, unless otherwise suspended or revoked as provided herein, shall be valid for a period of time not to exceed 12 months. Each permit shall expire on June 30. (Code 1980, § 51-34.1; Ord. Oklahoma City Municipal Code § 51-65 Suspension or revocation of permits.

§ 51-65. - Suspension or revocation of permits. The permit to operate a public bathing place may be temporarily suspended without prior warning, notice or hearing, by the Director, if the Director has cause to believe that, in his opinion, an imminent public health hazard exists. Any person whose permit to operate has been suspended may make written request to the Director for a hearing before the Director within 24 hours of suspension to determine if the imminent health hazard has been corrected. The Director may permanently revoke the permit for serious or repeated violations of this chapter after the opportunity for a hearing has been provided pursuant to this chapter. Oklahoma City Municipal Code § 51-66 Permit revocation hearing procedure.

§ 51-66. - Permit revocation hearing procedure. (a) The permit revocation hearing procedure for a permit issued under this article shall be as provided in this section. The permit holder, designated operator, or person in charge of the premises shall be served notice in writing by the Director either by registered mail or personal service. Said notice shall state the reasons for which the permit shall be permanently revoked. The permit holder may file a written request for a hearing before the Public Bathing Code Review Board within ten days of receipt of said notice for the purpose of defending against the permanent revocation of the permit. The Public Bathing Code Review Board shall be comprised of three members, the Chief of the Laboratory Service of the Department or his designee, the Chief of Environmental Service of the Department or his designee, and a member of the Planning Division of the Department. The Board shall be within the Division of Public Affairs. (b) The hearing shall be held within ten days after the filing of the request and the permit holder shall be advised in writing of the time and place of said hearing. At any such hearing the Director and the permit holder may introduce such witnesses and evidence as either party deems necessary. Every ruling shall be accompanied by a written findings of fact based on the evidence received at the hearing. (Code 1980, § 51-36.1; Ord. No. 19756, § 4, 5-19-92)

Oklahoma City Municipal Code § 51-67 Appeal from revocation.

§ 51-67. - Appeal from revocation. Any permit holder whose permit has been revoked under this article may appeal to the Oklahoma City Council by filing with the City Clerk, within ten days from the date of the revocation, a written notice of appeal. Upon filing of the notice of appeal, the Director and the Review Board shall forthwith transmit to the Clerk all their records and orders pertaining thereto. The Clerk shall thereupon set the matter for a hearing before the Council and shall notify the appellant and the Director by registered mail of the time and date when the matter will be heard. The Council, after hearing the matter, may sustain, reverse, or modify the Board's decision. (Code 1980, § 51-37.1; Ord. No. 19756, § 4, 5-19-92)
