Franchise fees.
Las Vegas Municipal Code § 9.08.250
in effect9.08.250 - Franchise fees.
(A) Every franchisee shall pay a baseline quarterly franchise fee, in the amount specified in the franchise agreement or as adjusted pursuant to the franchise agreement, based on its cash receipts derived from the collection of solid waste and residential recyclables collection for the preceding calendar quarter. A franchisee shall also pay any franchise fee that has been augmented pursuant to Subsection (C) of this Section on the same basis. All baseline and augmented franchise fees shall be due no later than forty-five days after the end of each calendar quarter. If a franchise fee is received by the City after the due date, a late fee of two percent per month (or fraction thereof) of the delinquent amount will be assessed to the franchisee.
(B) Except with respect to augmented quarterly franchise fees described in Subsection (C) of this Section:
(1) All charges to customers for the collection of solid waste and residential recyclables pursuant to this Chapter and a franchise agreement shall be deemed to include the franchise fee which the franchisee pays to the City.
(2) The franchisee may pass such baseline franchise fees through to its customers only as part of the general service charges charged to its customers and not as a separate charge that is additional to the general service charges.
(C) As provided for in a franchise agreement, an augmented quarterly franchise fee may be charged by the City over and above the baseline quarterly franchise fee. The augmented quarterly franchise fee, if any, is subject to the provisions of Subsections (A) and (B) of Section 9.08.220 regarding the pass through and separate listing of charges.
(D) A franchisee shall remit the baseline and, if applicable, augmented franchise fees to the City. The franchisee shall not be responsible for covering any shortage caused by failure of a customer to pay franchise fees for solid waste collection. Franchise fees collected by the franchisee shall pass through directly to City and shall not be considered cash receipts as set forth in this Chapter and no franchise fees will be paid to the City on top of the franchise fees paid by customers.
