Violations and cure provisions.
Memphis Code of Ordinances § 6-28-26
in effectSec. 6-28-26. - Violations and cure provisions.
A. If the city has reason to believe that grantee is in violation of this chapter, the city shall notify grantee in writing of the violation, setting forth the nature of such violation. Within ten days of receipt of such notice, grantee shall respond in writing to provide explanation or documentation to support that the violation did not occur. Grantee shall be allowed 30 days to cure violations after written notice is received from the city, unless prevented from doing so for reasons beyond control of grantee.
B. Upon evidence being received by the city that any violation of this chapter, any city Charter provisions or any ordinances willfully regulating grantee in the construction and operation of the system is occurring, or has occurred, the city shall cause an investigation to be made. If the city finds that such a violation exists or has occurred, the grantee shall take appropriate steps to comply with the terms of this chapter and any lawful regulation. Should grantee fail to comply, after the above-stated notice and opportunity to cure, then the city may take any action authorized by law, including revocation or repeal of the franchise or a suit in court to compel compliance. If, in any such proceeding, default is finally established, grantee shall be required to pay to the city the reasonable expenses incurred in the prosecution of such suit and all the city's damages and costs (including attorney fees); provided, however, the preceding sentence shall be inapplicable unless its provisions may be lawfully enforced against other telecommunication franchisees of the city.
