Columbus City Codes § 517.01 Definition.

517.01 - Definition. Unless a different meaning is clearly indicated by the context in which the word is used, when used in this Chapter: "Itinerant vendor" shall mean all persons, both principal or agents, who engage in a temporary or transient business in the city, selling goods, wares, or merchandise, and who for the purpose of carrying out such business hire, lease or occupy any room, building or structure for the exhibition or sale of such goods, wares and merchandise. The person so engaged shall not be relieved from the provisions of this chapter by reason of association temporarily with any local dealer, trader, merchant or auctioneer, or by conducting such temporary or transient business in connection with or as a part of the business of or in the name of any local dealer, trader, merchant or auctioneer. Columbus City Codes § 517.02 License required.

517.02 - License required. No person shall engage in the business or trade of itinerant vendor, either as principal or agent, without first having secured a license for the same from the License Section. (Ord. 225-77; Ord. No. 0768-2024, § 3, 3-18-2024)

Columbus City Codes § 517.03 Exemptions.

517.03 - Exemptions. The provisions of this chapter shall not apply to sales made to dealers by commercial travelers or selling agents in the usual course of business, nor to bona fide sales of goods, wares and merchandise by sample for future delivery, nor to hawkers on the streets, nor peddlers from vehicles, nor to judicial sales directed by law or under order of court, nor to the sales of the common necessities of life in open market. (Sec. 23.2.)

Columbus City Codes § 517.04 Fee; bond.

517.04 - Fee; bond. The License Section is authorized to grant a license to any person upon submission of a properly executed application and the payment of the applicable fee and executing a bond to the city in the sum of one thousand dollars ($1,000.00), and with sufficient sureties, conditioned for a faithful observance of the ordinances of the city. Columbus City Codes § 517.05 Term of license; renewal.

517.05 - Term of license; renewal. Permission to conduct the business of an itinerant vendor under a city license shall terminate twenty-four hours after the issuance of such license, unless the person securing the same shall pay the applicable fee for each additional day the person desires to continue in the business of an itinerant vendor. Columbus City Codes § 517.06 Severability clause.

517.06 - Severability clause. If any portion of this chapter, or any section or part of a section is declared to be invalid by a court of competent jurisdiction, such declaration of invalidity shall be limited to that portion, section, or part of a section declared invalid. Any such declaration or invalidity shall not affect or impair the remainder of the chapter, and to this end the objectionable provisions are severable. (Ord. No. 0768-2024, § 3, 3-18-2024)
