Memphis Code of Ordinances § 2-44-1 Established; composition; appointment and terms of office of members.

Sec. 2-44-1. - Established; composition; appointment and terms of office of members. There is established a broadband telecommunications regulatory board, composed of five persons, appointed by the mayor and approved by the city council for terms of three years; provided that, one of the members shall be the director of public service of the city or his or her designee and four members shall be citizen members, of which two must be subscribers to a broadband telecommunications system. Memphis Code of Ordinances § 2-44-2 Duties; appeal of board findings.

Sec. 2-44-2. - Duties; appeal of board findings. A. The duties of the regulatory board shall be the following: 1. Resolving disputes or disagreements between subscribers and the grantee after investigation should the subscriber and the grantee not first be able to resolve their dispute or disagreement; 2. Reviewing and auditing reports submitted to the city as required by Ordinance No. 496, as amended, and such other correspondence as submitted to the city concerning the operation of the broadband telecommunications network so as to ensure that the necessary reports are completed and fulfilled pursuant to the terms of the ordinance; 3. Coordinate and publicize the implementing and usage of the governmental, educational and public access channels provided hereunder; 4. Work with the public and the media to assure that all records pertinent to the broadband telecommunications network in the city are made available for inspection at reasonable hours; 5. Confer and coordinate with the grantee on the interconnection of the city's cable system with other cable and communication systems; 6. Such other duties as the city council may assign to the broadband telecommunications regulatory board. B. The findings of the board shall be final subject to appeal as now provided by law for decisions of boards and commissions. (Code 1967, § 12½-51; Code 1985, § 10-17; Ord. No. 1710, § 2, 5-1-1973)

Memphis Code of Ordinances § 2-44-3 Notice of hearings.

Sec. 2-44-3. - Notice of hearings. The board shall adopt such rules and regulations as are necessary to insure that due notice is given to all parties concerning any hearing on any complaints to the board and the hearings are held promptly in accordance with reasonable notice to all parties. Memphis Code of Ordinances § 2-44-4 Persons ineligible to serve on board.

Sec. 2-44-4. - Persons ineligible to serve on board. No officer, director or employee of a franchisee may serve on the board created in section 2-44-1. (Code 1967, § 12½-53; Code 1985, § 10-19; Ord. No. 1710, § 4, 5-1-1973)

Memphis Code of Ordinances § 2-44-5 Time of meetings; quorum; secretary.

Sec. 2-44-5. - Time of meetings; quorum; secretary. The regulatory board shall meet regularly on the first Wednesday of each quarter, at a time specified by the board, in the office of the public service director; provided that, if and when additional franchise agreements may be granted, then, and in that event, meetings shall be held regularly on the first Wednesday of each month in the office of the public service director, at a time specified. Special meetings may be held at such other times as may be called by the chairperson or a majority of the members thereof. Three members of the board shall constitute a quorum to transact any business, and it will require not less than three affirmative votes to carry out any matter before the board. The board shall appoint a secretary who may, but need not necessarily, be a member of the board. (Code 1967, § 12½-54; Code 1985, § 10-20; Ord. No. 2599, § 2, 5-31-1977; Ord.
