Unless the context requires otherwise, the following definitions apply to this Chapter: "Charitable" means and includes the words patriotic, philanthropic, religious, social service, welfare, benevolent, educational, civic or fraternal, either actual or purported. "Charitable organization" has the same meaning as provided at LVMC 11.62.020(A). "Contributions" means and includes the words alms, food, clothing, money, subscription, property, the loan of money or property, financial assistance or items of personal property. "Exhibitor" means any person who exhibits or advertise goods or services, but does not sell, offer to sell or take orders for such goods or services. "Professional promoter" includes a professional promoter of charitable events and a professional promoter of non-charitable events. For purposes of accessing the multi-vendor permit provisions of LVMC 6.78.037, the term may also include the organizer of an event who receives no compensation for organizing the event and therefore does not otherwise qualify as a professional promoter. "Professional promoter of charitable events" means a person who, for compensation, plans, promotes, conducts, manages or carries on or attempts to plan, promote, conduct, manage or carry on any drive or campaign for the purpose of soliciting contributions for or on behalf of any charitable person, or engages in the business of soliciting contributions for charitable purpose and who directly or indirectly receives: (1) Admission or entrance fees paid by participants or spectators; or (2) Compensation, consideration or revenue from sponsors or private donors. "Professional promoter of non-charitable events" means a person who, for compensation, plans, promotes, conducts, manages, carries on or attempts to plan, promote, conduct, manage or carry on any drive or campaign for the purpose of organizing a special event or any other type of event where more than three hundred persons are expected to attend, and who directly or indirectly receives: (1) Admission or entrance fees paid by participants or spectators; or (2) Compensation, consideration or revenue from sponsors, owners or beneficial owners of an establishment. "Qualifying multi-vendor event" means a temporary commercial event of less than thirty days, whether open to the public or not, that is proposed to take place within a government facility, convention center, event center or plaza, resort hotel, cultural establishment (as defined in LVMC 6.50.010), or permanent trade show facility (as defined in LVMC 6.50.010), and at which two or more vendors or exhibitors will be selling or offering to sell goods or services, or will be displaying or exhibiting products or services for commercial purposes. The term does not include a parade or an event that has been approved pursuant to a special event permit under LVMC Chapter 12.02. "Solicit" and "solicitations" means the request, either directly or indirectly, for contributions on the plea or representation that such contributions or any proceeds to be derived therefrom will be used for a charitable purpose. Without limiting the generality of the above, such words shall include the following methods of securing contributions on the plea or representation that it will be used for a charitable purpose: (1) Any oral or written request; (2) The distribution, circulation, mailing, posting or publishing of any handbills, written advertisement or publication; (3) The making of any announcement through the press, radio, television, or by telephone or telegraph concerning an appeal, assembly, athletic or sporting event, bazaar, benefit, campaign, contest, dance, dinner, entertainment, exhibition, exposition, party, performance, picnic, sale, social gathering, or similar events, which the general public is requested to patronize or to which the general public is requested to contribute; or (4) The sale of or the offer or attempt to sell any advertisement, advertising space, book, coupon, magazine, merchandise, subscription, ticket or other thing. A "solicitation," as defined herein, shall be deemed completed when made, whether or not the person making the same receives any contribution or makes any sale. "Special event" means any event: (1) Described as a special event in LVMC 12.02.010; and (2) At which at least three hundred persons are expected to attend. "Vendor" means any person who sells, offers to sell, or takes orders for goods or services.
